42 Authorised nominating authorities S. 42(1) amended by No. 34/2013 s. 35(Sch. 2 item 1.9). (1) The Authority— (a) may, on application made by any person, authorise the applicant to nominate adjudicators for the purposes of this Act; and (b) may withdraw any authority so given. S. 42(2) amended by No. 34/2013 s. 35(Sch. 2 item 1.9). (2) Before giving an authority under this section, the Authority must have regard to any guidelines issued by the Minister under section 44. Note to s. 42 amended by No. 34/2013 s. 35(Sch. 2 item 1.9). An applicant can appeal to the Building Appeals Board under section 144A of the **Building Act 1993** against a decision of the Authority to refuse an application or withdraw an authority under section 42.
