### 90 Failure to perform adequate protection work > The owner of relevant premises must ensure that all protection work agreed under [section 79](#GS79@EN) , or determined under [section 81](#GS81@EN) , is – > > > > (a) performed in accordance with the National Construction Code; and > > > > > (b) performed and completed as agreed or determined. > > Penalty: In the case of – > > > > (a) a natural person, a fine not exceeding 100 penalty units; or > > > > > (b) a body corporate, a fine not exceeding 500 penalty units.
