### 88 Expenses of adjoining owner > > (1)  Any costs and expenses necessarily incurred by an adjoining owner in assessing proposed protection work, and in ensuring that the protection work is carried out as agreed, are payable by the owner of the relevant premises as agreed between the parties. > > > (2)  If there is no agreement between the parties in respect of the payment of costs and expenses, each party may apply to the appeal tribunal to hear and determine the matter. > > > (3)  The costs and expenses payable to an adjoining owner are recoverable in a court of competent jurisdiction as a debt due by the owner of the relevant premises to the adjoining owner.
