5Responsible person

### 5 Responsible person > > (1)  For the purposes of this Act, the responsible person for building work is – > > > > > > (a) the licensed builder who is intending to perform, or who is performing or has performed, the building work; or > > > > > > > (b) if there is no such licensed builder, the owner of the premises where the building work is to be, is being or has been, performed. > > > (2)  For the purposes of this Act, the responsible person for plumbing work is – > > > > > > (a) the licensed plumber who is intending to perform, or who is performing or has performed, the plumbing work; or > > > > > > > (b) if there is no such licensed plumber, the owner of the premises where the plumbing work is to be, is being or has been, performed. > > > (3)  For the purposes of this Act, the responsible person for demolition work is – > > > > > > (a) the licensed builder who is intending to perform, or who is performing or has performed, the demolition work; or > > > > > > > (b) if there is no such licensed builder, the owner of the premises where the demolition work is to be, is being or has been, performed.
