### 44 Minimum standards of design work > > (1)  A person undertaking design work under this Act is responsible for ensuring that the plans and specifications, or the advice, comprising the design work are sufficient to result in work that is likely to comply with the National Construction Code, if the work is properly completed in accordance with those plans and specifications or that advice. > > > (2)  [*\[Section 44 Subsection (2) substituted by No. 39 of 2018, s. 7, Applied:01 Jan 2017\]*](/view/html/inforce/2017-01-01/act-2018-039#GS7@EN) If design work under this Act requires a performance solution, a person undertaking the design work is to provide, as part of the design work, a method of assessment to ensure that the performance solution is likely to comply with the National Construction Code if it is properly completed in accordance with the design work.
