### 37 Change of building surveyor at building surveyor's request > > (1)  Subject to [section 38](#GS38@EN) , a person who has been engaged as a building surveyor by another person must not resign from that engagement without the consent of the Director of Building Control. > > > > Penalty:  In the case of – > > > > > > (a) a natural person, a fine not exceeding 100 penalty units; or > > > > > > > (b) a body corporate, a fine not exceeding 500 penalty units. > > > (2)  Despite [subsection (1)](#GS37@Gs1@EN) , a person who has been engaged as a building surveyor by another person may resign from that engagement, without the consent of the Director of Building Control, by notice in writing to the other person if it has been at least 3 years since his or her engagement as a building surveyor by that person. > > > (3)  Within 7 business days after resigning from an engagement under [subsection (2)](#GS37@Gs2@EN) , the building surveyor is to – > > > > > > (a) notify the Director of Building Control and the relevant permit authority of the resignation; and > > > > > > > (b) forward to the relevant permit authority copies of all documents, relevant to the building work, as specified by the Director of Building Control.
