### 324 Infringement notices
> > (1) The following persons may issue and serve an infringement notice on a person if satisfied that the person has committed a prescribed offence against this Act or the regulations:
> >
> > > > (a) an authorised person other than a building surveyor;
> > >
> > > > (b) a person authorised in writing by the Director of Building Control to issue and serve infringement notices for the purposes of this Act.

> > (2) An infringement notice –
> >
> > > > (a) is not to relate to 4 or more offences; and
> > >
> > > > (b) is not to be served on a person under the age of 16 years.

> > (3) An infringement notice is to be in accordance with [section 14 of the](/view/html/inforce/2026-04-12/act-2005-057#GS14@EN) [Monetary Penalties Enforcement Act 2005](/view/html/inforce/2026-04-12/act-2005-057) .

> > (4) Any payments made in respect of an infringement notice –
> >
> > > > (a) [*\[Section 324 Subsection (4) amended by No. 9 of 2023, s. 32, Applied:01 Oct 2024\]*](/view/html/inforce/2024-10-01/act-2023-009#GS32@EN) are payable to a council if the notice was served by the relevant permit authority; or
> > >
> > > > (b) in any other case, are payable into the Fund.
