### 269 Recovery of performance costs > > (1) The cost of performing any work not performed by an owner as required under this Part is a debt due by the owner and recoverable in a court of competent jurisdiction. > > > (2) If a person fails to perform the work required by any order under this Part within a specified time, the council may enter land or a building and perform the required work and may recover its expenses as a charge on the land and recoverable as if it were rates or charges under the [Local Government Act 1993](/view/html/inforce/2026-04-12/act-1993-095) .
