247 Building order relating to illegal building work

(1)  [Section 247 Subsection (1) amended by No. 9 of 2023, s. 20, Applied:01 Oct 2024] In addition to a building order under section 246 , a permit authority is to serve a building order on an owner of premises where building work is performed, or on a builder performing building work, in contravention of this Act if the permit authority does not revoke a building notice in respect of that building work.

(2)  A building order in respect of building work performed in contravention of this Act is to require the owner at the owner's choice –

(a) to demolish the building work or building; or

(b) to complete any remaining building work in accordance with this Act.

(3)  A building order under this section may be –

(a) a separate building order; or

(b) combined with a building order under section 246 or section 248 .
