### 221 Refusing application for occupancy permit > > (1)  A building surveyor – > > > > > > (a) is to refuse an application for an occupancy permit in respect of a building if the building surveyor is not satisfied of any of the matters specified in [section 220(1)](#GS220@Gs1@EN) ; and > > > > > > > (b) may refuse to grant an application for an occupancy permit if he or she considers the refusal to be reasonable in the circumstances. > > > (2)  A building surveyor, by notice in writing within the prescribed period, is to notify an applicant of – > > > > > > (a) the refusal to grant the application; and > > > > > > > (b) the reasons for that refusal; and > > > > > > > (c) the right of appeal under this Act in respect of the refusal.
