### 140 Additional application requirements for alternative performance solutions > If an application under [section 139](#GS139@EN) relates to permit building work that involves a proposed performance solution under the National Construction Code, the applicant must include the following information, as part of the application, in addition to the requirements of that section: > > > > (a) a letter from the owner of the premises where the proposed permit building work is to be performed stating that the owner is aware that the proposed work includes a performance solution; > > > > > (b) [*\[Section 140 Amended by No. 39 of 2018, s. 21, Applied:01 Jan 2017\]*](/view/html/inforce/2017-01-01/act-2018-039#GS21@EN) evidence that the performance solution complies with the National Construction Code, which evidence is to include the assessment, of the performance solution, made by the building surveyor who granted the application for the relevant certificate of likely compliance (permit building work) in relation to the proposed work.
