36 Period for which approvals operate
(1) A building approval operates until the end of the earliest of the
(a) 3 years beginning on the day of its issue;
(b) any development period applying to the building work.
Note A building approval ends if a further approval is issued for the same
building work (see s 34).
(2) If the development period applying to the building work is extended,
the certifier may extend the period of operation of the building
approval to a day that is no later than the day the extended
development period ends.
(3) However, subsection (2) does not authorise the extension of the
period of validity of a building approval to a day that is more than
3 years after the day the approval was issued.
(4) To remove any doubt, a building approval, or part of the building
approval, does not operate while the approval or part is suspended.
Note A building approval, or part of the approval, may be suspended under
s 53.
development period means a period within which, under another law
in force in the ACT or a condition of the relevant lease, the building
work must be completed.
