81 Effect of disagreement (1) If the relevant person is notified by the owner of an adjoining property that the owner disagrees to the proposed protection works being carried out, the relevant person must refer the proposal for the protection works to the Director and notify the owner of the adjoining property of the referral. (2) On receiving the referral, the Director must examine the proposal for the protection works and determine whether the work is appropriate. Building Act 1993 92 (3) The Director may make such inquiries and request such additional information as the Director thinks fit for the purpose of making a determination, but need not give a party a hearing. (4) The Director must give the relevant person and the owner of the adjoining property notice in writing of the determination.
