197 Application in relation to building work approved or commenced before commencement (1) This section applies in relation to building work: (a) that commenced after 31 August 1993 but before the commencement; or (b) for which a building permit was granted after 31 August 1993 but before the commencement. (2) An application for an occupancy permit in relation to building work made but not determined before the commencement: (a) is taken to be an application for occupancy certification; and (b) must be determined under Part 8 of this Act as in force after (3) Part 8 (as in force after the commencement) applies, as if a reference to a requirement under the Act or the Regulations (however expressed) in that Part, except as set out in the Table to section 195, were a reference to such a requirement that was in force when the building work commenced or the building permit was granted, to: (a) an application mentioned in subsection (2); or (b) an application for occupancy certification made after the
