131 Modification of application of Building Regulations (1) The Appeals Board may by determination, on application by an owner of land (including a public authority), an owner's agent or the Director, modify the application of the Regulations to land, a building or building work or determine that a provision of the Regulations does not apply to the land, building or building work or applies subject to the conditions the Board specifies and, on the Board so doing, the Regulations do not apply, or apply subject to those conditions, accordingly. (2) The Appeals Board may, before making a determination under subsection (1), require a report from a reporting authority on the subject of the application and may not make a determination unless it is satisfied that it is not detrimental to the public interest to do so. (3) An application under this section must be in accordance with this Part.
