125 Amendment or cancellation of certain building orders (1) An owner, or an owner's agent, required to comply with a building order made after the issue of a fire upgrading report may, if there is a change in circumstances after the original fire upgrading report is made, request the Director to amend or cancel the building order. (2) On a request being made, the Director may: (a) refuse to amend or cancel the building order; or (b) issue an amended fire upgrading report; or (c) cancel the fire upgrading report. (3) Where, within the prescribed time, the Director has not decided the request, he or she is taken to have refused the request. (4) An owner or the owner's agent may, in accordance with Part 11, not later than 28 days after the decision of the Director under subsection (2), appeal against the decision.
