What it does
This Determination, titled the Broadcasting Services (Remote Indigenous Communities) Determination 2022, performs three discrete mechanical acts. First, it declares that the Australian Communications and Media Authority has made the instrument under the authority of section 8B of the Broadcasting Services Act 1992 (s3). Second, it repeals the prior Broadcasting Services (Remote Indigenous Communities) Determination 2011 (s4). Third, and substantively for users and regulated parties, it lists in Schedule 1 a set of named localities and communities that the ACMA determines to be “remote Indigenous communities for the purposes of the Act” (s6). The instrument commences at the start of the day after it is registered on the Federal Register of Legislation (s2), and it is dated 24 March 2022 with the two ACMA signatories recorded on the face.
The Determination does not itself create new offences, licensing conditions or explicit regulatory duties; it is a declaratory instrument that changes the statutory facts to which the Broadcasting Services Act 1992 applies by reference to the Act’s facility to have ACMA designate particular places as remote Indigenous communities (s6). The list in Schedule 1 is the operative content: it is a schedule of named communities organised by state and territory headings (Queensland, New South Wales, South Australia, a note for Western Australia, and the Northern Territory). The Schedule includes many localities, some given with alternative or parenthetical names (for example, “MER (MURRAY ISLAND)” or “KUBIN”), island names, mission and reserve names, and some entries that appear as broader geographic labels (for example, “ARNHEM LAND” in the Northern Territory list). The Determination does not include maps, coordinates, boundary descriptions or procedural detail for future amendment; it records the source authority (s3) and the statutory cross-reference to the Act’s definitions (s5 note). Any practical effects on rights, duties, licences or obligations will derive from how the Act applies to places designated under section 8B of the Act, not from provisions inside this Determination itself.
