39 Retention of and access to records of complaints
(1) An international broadcasting licensee must retain records required under section 38 for a period of two years after the date on which the complaint was received.
(2) If the ACMA asks an international broadcasting licensee, in writing, to inspect a record mentioned in section 38 that is kept by the licensee, the licensee should, within a reasonable time after the request is made, produce the record (or a copy of the record) to the ACMA.
(3) If an international broadcasting licensee keeps records under subsection (1) it should take such steps as are reasonable in the circumstances:
(a) to protect the information from misuse, interference and loss, unauthorised access, modification or disclosure; and
(b) to ensure the information is disposed of, or destroyed, in a secure manner where the record is no longer necessary under this instrument or any other applicable laws.
