Plain English Summary

2/10 complexity

This declaration stops certain major sporting events from moving exclusively to pay TV just before they happen.

Under normal rules, sporting events are taken off the "protected list" 42 days (1,008 hours) before they start. Once off the list, subscription TV channels can buy exclusive rights to show them, locking out free-to-air networks.

This instrument extends the protection for events listed in Item 6B of a 1994 Broadcasting Notice—specifically those happening in November 2001. It keeps these events on the free-to-air protected list past the usual 42-day deadline.

Why does this matter? The Minister found that at least one commercial free-to-air TV station (like Seven, Nine, or Ten) hadn't yet had a fair opportunity to buy the broadcast rights. This rule ensures these events remain available on free television rather than disappearing behind a paywall.
