40 Entry on other premises

(1) An authorised officer may: (a) with the consent of the occupier of any premises; or (b) under a warrant issued under section 41 in respect of the premises; enter the premises and exercise any inspection powers in relation to those premises. (2) An authorised officer is not entitled to exercise any of the powers referred to in paragraph (1)(a) if: (a) the occupier or person in charge of the premises has required the authorised officer to produce proof of his or her identity for inspection by the occupier or person in charge; and (b) the authorised officer fails to produce his or her identity card.
