Botanic Gardens and Parks Regulations 1999

Designated land: The regulations apply only to the land prescribed in regulation 4, namely all land within Class A Reserve No. 45409 (Bold Park). That geographic limitation is decisive: the prohibitions and powers set out in the regulations operate only in respect of that land (regulation 4). Any analysis of these regulations must therefore treat them as localised, not freestanding statewide park law.

Permission as a gating concept: Many prohibitions use the form “must not, without permission,” making the Authority’s grant of permission the single operative exception to otherwise general bans (see regulation 5 and repeated across Parts 2-6). Regulation 5 elaborates the nature of permission: it is the permission of the Authority (regulation 5(1)), may be refused, may be granted generally or for a specific instance, may be conditional (including by fee) and may be amended or revoked (regulation 5(2)-(3)). Importantly, permission must be in writing and obtained before the activity commences (regulation 5(4)), and failure to comply with a condition is taken as a lapse of the permission in any subsequent prosecution (regulation 5(5)). The text therefore places procedural obligations on would‑be users and gives the Authority broad discretion over access to, and use of, the land.

Signs, park management officers and directions: The Authority may erect traffic signs and is required to erect signs when closing parts of the land (regulation 6 and regulation 9). A park management officer may give directions to regulate vehicle use and may mark tyres to monitor parking durations (regulations 9(4) and 14A). The inscriptions on signs “operate according to their tenor” (regulation 6(4), 9(2)), a statutory device that treats sign inscriptions as legally operative instruments creating obligations on members of the public.

Environmental protection packaging: A substantial block of the regulations is devoted to protections for flora, fungi and fauna (regulations 19-21), protection of rocky and soil surfaces (regulation 23), and anti‑litter and dog excrement rules (regulations 24-25). These provisions are framed as absolute prohibitions unless permission or valid authorisation under other written law exists. For example, damaging, destroying or taking flora or fungi is prohibited without permission or other authorisation (regulation 19(1)).

Control of commercial and public activities: The Authority controls trading, commercial photography, public meetings, sporting events, public speaking, marriage ceremonies and collections on the land (regulations 27-30). Regulation 28 separately prohibits still or motion photography for public display or commercial promotion without permission. Regulation 29(1)(b) expressly prevents public speaking on the land unless permitted. The Authority can therefore control both commercial use and expressive activities by the permission regime.

Vehicle and traffic regulation: The regulations impose a default ban on using motor vehicles except on specified areas (regulation 11), prohibit several classes of vehicles (regulation 10), set a speed limit (40 km/h, regulation 12), and create parking, standing and footpath rules (regulations 13-14). Several vehicle-related definitions are drawn from external road legislation (regulation 3).

Enforcement architecture: The regulations set fines in the text, and Schedule 2 prescribes modified penalties that can be enforced by infringement notice (regulation 45). Schedule 1 gives standard forms for notices and infringement processes (Forms 1-3). Regulation 50 enables the Authority to recover the costs of removing a vehicle etc. as a debt. Regulation 43A fixes a statutory “relevant amount” at $5,000,000 relevant to the definition in section 11(4) of the Act, signalling an interaction between the Authority’s liabilities or financial tests and this threshold.

Cross-references to other statutes: The regulations repeatedly rely on external definitions and authorisations (see regulation 3 and specific references in regulations 10, 19, 20, 23, 24, 32 and elsewhere). Those cross-references mean the practical scope of duties and offences depends on how the other laws define terms such as “bicycle,” “motor vehicle,” “firearm,” and “litter.”

Defences and exceptions: The primary express defence is in regulation 8, which permits entry where necessary to prevent or mitigate injury to a person or damage to property. There are operational exceptions for emergency vehicles acting in the course of duties (regulation 18), and for police carrying firearms in the course of duty (regulation 32(2)). Several offences are subject to “without permission or without authorisation (however described) under another written law,” creating space for activity authorised by other statutes.

Overall, the main concepts are a geographically delimited regulatory regime, permission as the central control point, signage and park management officers as the implementation tools, and a detailed set of prohibited acts aimed at protecting biodiversity, controlling use, and regulating events and commerce on Bold Park.

Owners and drivers of vehicles: The regulations regulate the behaviour of vehicle drivers and vehicle owners on the designated land. There are rules about where motor vehicles and bicycles can be used (regulations 11 and 15), what classes of vehicles are prohibited (regulation 10), speed limits (regulation 12), standing and parking rules (regulations 13-14, 14A) and a specific offence for removing tyre marks placed by a park management officer (regulation 14A(3)). Vehicle owners are particularly affected by regulation 49 and Form 1 procedures under section 49 of the Act: the Authority can require vehicle owners to identify the driver of an alleged vehicle offence and unless the owner proves otherwise they can be deemed to have committed the offence (Form 1). Regulation 50 allows the Authority to recover removal costs from vehicle owners in court as a debt.

Members of the public visiting Bold Park: The general public who enter Bold Park are bound by a wide range of prohibitions: entry must be by an Authority-provided entrance (regulation 7(2)); certain parts of the land (those predominantly of native flora or set apart for cultivation) may not be entered without permission (regulation 7(1), (3)); and the Authority may close the park or parts of it (regulation 6). In practice, casual visitors are subject to behavioural rules (noise, indecent language, indecent acts, nuisance , regulations 38-42), anti‑litter and dog excrement obligations (regulations 24-25), and fishing/trapping/interaction prohibitions with fauna (regulation 20).

Commercial operators and event organisers: Persons seeking to sell goods, provide services for reward, organise events, conduct public speaking, hold concerts, or perform commercial photography for display or promotion are directly affected and must obtain written permission (regulations 27-30, 28). The Authority may impose fees or conditions on permissions (regulation 5(2)(b)(iii)), and may refuse or revoke permission (regulation 5(2)-(3)). The permission requirement extends to modest commercial activities such as collecting money or distribution of printed materials (regulation 27(3), 29(1)(d)), so commercial and fundraising activity is squarely in scope.

Researchers, conservationists and contractors: Activities that involve manipulation of flora, fungi, fauna, soil, rocks, or erecting structures require permission or other written-law authorisation (regulations 19-20, 23, 26). Contractors carrying goods, materials or performing maintenance for the Authority or for lessees/licencees are permitted uses under regulation 10(1)(g) but other contractors will need permission. Researchers seeking to collect specimens will need prior written permission unless another written law authorises them.

People with disabilities: The regulations accommodate disability parking permits as defined in regulation 14(3). Parking in areas designated for people with disabilities is an offence unless a current Australian Disability Parking Permit and the ACROD card are displayed and the permit holder is a driver or passenger (regulation 14(1A)). The regulations therefore create a special class of parking entitlement tied to an external national permit system.

Law enforcement and emergency services: Police and emergency vehicles have specific exceptions: emergency vehicles on duty may stop, stand or park anywhere and exceed the speed limit where safe and expedient (regulation 18), and police carrying firearms in the course of duty are excepted from the firearms prohibition (regulation 32(2)). Park management officers have enforcement functions (regulation 9(4) gives powers to give directions; regulation 14A(2) authorises tyre marking), and impersonation of a park management officer is a criminal offence (regulation 49).

Owners or users of pets and wildlife carers: Bringing an animal or bird onto the designated land is prohibited without permission (regulation 21(1)), subject to a leashed‑dog exception (regulation 21(3)). The Authority can determine by resolution that feeding particular animals is prohibited (regulation 22(1)) and must notify by signs or other means before enforcement (regulation 22(2)). Wildlife carers or persons acting under other written-law authorisations remain able to act under those other legal permits (regulations 19 and 20 provide the caveat “or without authorization under another written law”).

Park management and the Authority: The Authority is the principal decision-maker: it erects signs, determines closures (regulation 6), decides permissions and conditions (regulation 5), prescribes prohibited feeding by resolution (regulation 22), sets and enforces traffic signs (regulation 9), and recovers removal costs (regulation 50). Authority decisions shape who can do what on the designated land. Park management officers implement and enforce the rules on the ground. The regulations therefore transfer substantial operational discretion to the Authority and its officers.

Finally, persons who might be held civilly liable: regulation 43A sets a "relevant amount" of $5,000,000 for the definition in section 11(4) of the Act; that figure will affect any statutory financial test in the Act itself and therefore relates to liabilities or thresholds that could affect trustees, contractors or suppliers engaged by the Authority.

In sum, the regulations affect a wide range of users of Bold Park: visitors, vehicle owners, commercial and expressive actors, contractors, researchers, emergency services and the Authority itself. Compliance hinges on whether the Authority grants written permission and on adherence to signposted directions and fee/condition regimes imposed by the Authority.

Duties to obtain written permission: The dominant duty across the Regulations is that an act or activity must not be undertaken without the Authority’s written permission. Regulation 5 makes permission the default exception to many prohibitions. The duty is proactive: permission must be obtained before the act is done or the activity commences (regulation 5(4)). The Regulation also makes compliance with any condition a continuing duty: in prosecutions, failure to observe a condition is taken to mean the permission lapsed for the period the condition was not met (regulation 5(5)).

Duty to obey traffic signs and park management officers: Regulation 9(3) requires persons to comply with the inscription on traffic signs erected by the Authority, and regulation 9(4) requires persons to comply with signals or directions by a park management officer regarding use, parking or movement of vehicles. Both carry penalties (regulation 9(3) penalty $2,000; Schedule 2 modified penalties are $200). The inscriptions on signs “operate according to their tenor” (regulation 9(2)), which gives signs legal force.

Duty to use designated entrances and tracks: Regulation 7(2) requires persons to enter the designated land only through an entrance provided by the Authority unless they have permission. Regulation 7(1) further restricts access to parts of the land comprised predominantly of native flora except on designated roads, tracks or paths.

Duties to protect flora, fauna and the natural surface: Multiple prohibitions require persons not to damage, destroy, remove, interfere with or take flora, fauna, rocks, soil or the natural surface without permission or other written-law authorisation (regulations 19-20, 23). There are also prohibitions on removing stakes, labels or protective fencing around flora or fungi (regulation 19(2)) and on interfering with nests or habitats (regulation 20(4)).

Duties on vehicle owners: Vehicle owners can be required under section 49 of the Act (Form 1 reproduced at Schedule 1) to identify drivers and may be treated as the offender in default. Owners are liable for costs of removal (regulation 50), and there are multiple separate parking and standing duties (regulations 13-14 and related Schedule 2 entries) including a requirement not to remove park management tyre marks (regulation 14A(3)).

Duties related to events, commerce and expressive activities: The regulations prohibit organising or holding fetes, concerts, public meetings, sporting events, public speaking or collecting money without permission (regulation 29 and 30). Regulation 28 specifically requires permission for commercial photography intended for public display or promotion. Regulation 27 bans selling goods or services without permission and selling or distributing printed matter (even if free) without permission (regulation 27(3)-(4)).

Rights and limited exceptions: The primary explicit exceptions are for emergency vehicles performing duties (regulation 18), for police using firearms in the course of duty (regulation 32(2)), and for acts authorised under other written laws (numerous provisions state “without permission, or without authorization under another written law”). The defence in regulation 8 allows entry otherwise prohibited where the accused can prove the act was necessary to prevent or mitigate injury to a person or damage to property. Disability parking rights are recognised through external permits (regulation 14(1A)). The regulations also preserve the Authority’s ability to allow permitted uses, and to grant, condition, amend or revoke permissions (regulation 5(2)-(3)).

Procedural rights and obligations: Permissions must be in writing and are obtained before the activity begins (regulation 5(4)), but the regulations do not contain a detailed administrative procedure for applying for permission, nor do they specify timeframes for decisions. The Authority may require payment of a fee or charge as a condition of permission (regulation 5(2)(b)(iii)), creating a transactional right to use the land subject to payment.

Enforcement rights allocated to the Authority: Park management officers have the right to give directions, erect signs, mark tyres and issue infringement notices (regulations 9, 14A, Part 7 provisions and Schedule 1). The Authority has the right to recover removal costs through a court as a debt (regulation 50).

In short, the Regulations impose proactive duties to obtain written permission for a wide range of activities, create duties to comply with signage and officers’ directions, and protect natural assets by outlawing interference unless authorised. Rights are mainly limited to statutorily carved exceptions (emergency services, other‑law authorisations, disability permits) and the Authority’s discretionary permission framework.

Statutory fines and offence framing: Penalties for contraventions are stated throughout the regulations and commonly appear as fines of $1,000 or $2,000 in the text (for example: entry to closed parts , regulation 6(5) , penalty $1,000; failure to comply with a traffic sign , regulation 9(3) , penalty $2,000; damaging flora/fungi , regulation 19(1) , penalty $2,000). The regulations adopt a two-layer enforcement model: the full statutory penalty in the regulation text and lower prescribed modified penalties in Schedule 2 for enforcement by infringement notice.

Modified penalties and infringement notices: Regulation 45 prescribes which offences are subject to modified penalties for the purposes of section 51(2) of the Act. Schedule 2 lists many contraventions with fixed modified penalties ranging commonly from $100 to $300 (for example many entry and parking offences are $100-$150; traffic sign or park management direction non‑compliance is $200 in Schedule 2 items 6-7). The Schedule also provides a graduated scale for speed limit offences under regulation 12 (Item 10: $100 for up to 9 km/h over; up to $400 for more than 40 km/h over). Infringement notices must take the form in Schedule 1 (Form 2, regulation 46), and withdrawal of infringement notices must comply with Form 3 (regulation 47).

Infringement process and owner identification: Regulation 44 prescribes Form 1 as the required form for notices under section 49(3) of the Act, used to require vehicle owners to identify the driver. Form 1 warns an owner that, unless they provide the driver's identity or satisfy the chief executive officer that the vehicle had been stolen or was being unlawfully used (or pay the modified penalty if issued), they will be deemed to have committed the offence. This mechanism shifts enforcement burden onto vehicle owners and supports enforcement of vehicle-related contraventions where the driver may not be present.

Park management officer powers and operational enforcement: Park management officers can erect traffic signs (regulation 9(1)), give directions about vehicle use (regulation 9(4)), mark tyres to record parking durations (regulation 14A(2)), and , implicitly , issue the notices and infringement notices referenced in Schedule 1. It is an offence to impersonate a park management officer (regulation 49), supporting integrity of that enforcement function.

Recovery of removal costs: Regulation 50 expressly authorises the Authority to recover the costs of exercising the power in section 28(2)(c) of the Act (which relates to removal of vehicles, animals or other things) from the owner in a court of competent jurisdiction as a debt due to the Authority. That creates a civil remedy in addition to regulatory fines for costs associated with tow‑away or removal operations.

Specific procedural constraints and defences: The regulations provide limited procedural protections. Regulation 8 creates a defence to entry offences where the act was necessary to prevent or mitigate injury to a person or damage to property. Emergency vehicles are exempted from speed limits and parking/standing restrictions while acting in the course of duty and where safe and expedient (regulation 18). Other general protections may exist where an activity is authorised “under another written law,” but those are not expanded within the Regulations.

Penalties for obstructive behaviour towards enforcement: Removing a notice attached to or left on a vehicle under section 49(4) or 52(2)(b) is an offence if done by someone other than the owner/driver/person in charge (regulation 48) with a penalty of $1,000. Impersonation of a park management officer has a $2,000 penalty (regulation 49). These provisions deter obstruction of enforcement procedures.

Breadth and calibration of penalties: The statutory penalties in the text are often $1,000-$2,000, but many of these are accompanied by modified penalties in Schedule 2 set considerably lower. The Schedule includes many low-level offences with $100 modified penalties (items 1-5, 11 etc.). The presence of a large number of modified penalty items indicates an administrative preference to handle many contraventions informally via infringement notices rather than charging every matter to court.

Record‑keeping, signs and notice requirements: Regulation 6(3) requires the Authority to erect and maintain sufficient signs when it closes land or paths. Regulation 22(2) requires that before enforcing a feeding prohibition the Authority must have erected signs or otherwise notified the public. These provisions place procedural notice obligations on the Authority as part of the enforcement architecture.

In sum, enforcement combines criminal fines and an administrative infringement system, armoured by park management officers empowered to give directions and to mark tyres. Civil recovery of removal costs provides an additional enforcement lever. Procedural protections for accused persons are limited to a specific necessity defence and statutory exceptions for emergency services and other lawful authorisations.

Express cross‑references: The Regulations explicitly import definitions and concepts from several other statutes. Regulation 3 draws in definitions: “bicycle” and “carriageway” have meanings given in the Road Traffic Code 2000 regulation 3(1); “motor vehicle” and “road” are defined in the Road Traffic (Administration) Act 2008 section 4. Regulation 10 uses the Road Traffic (Vehicles) Act 2012 for the definition of “omnibus.” Regulation 10 also references the Control of Vehicles (Off-road Areas) Act 1978 for the definition of “off-road vehicle.” Regulation 24(2) imports the definition of “litter” from the Litter Act 1979. Regulation 32(4) imports the meaning of “firearm” from the Firearms Act 2024. These cross‑references mean the substantive scope of terms, and therefore of offences, depends on the current versions of those external instruments.

Interaction with the Botanic Gardens and Parks Authority Act 1998: Numerous provisions of the Regulations cross‑refer to sections of the Act. For example, regulation 4 prescribes land for the purposes of the Act’s definition of “designated land” (referencing section 3 of the Act indirectly), regulation 6(2) limits the Authority’s closure power to the purpose in section 53(2)(c) of the Act, and regulation 50 references the Authority’s power in section 28(2)(c) to remove vehicles etc. Regulation 43A sets the “relevant amount” used in the Act's section 11(4) at $5,000,000. Forms and enforcement procedures reference sections 49, 51 and 52 of the Act (Forms 1-3 and regulations 44-47). The Regulations therefore function as delegated legislation implementing and operationalising powers and processes established in the parent Act.

Permits, authorisations and other written-law rights: Many prohibitions are subject to the caveat “or without authorization (however described) under another written law” (see regulations 19 and 20). That preserves activity authorised under other statutes , for example scientific permits, wildlife management authorisations or other statutory licences. Practitioners must therefore check for overlapping or supplanting authorisations in external laws before assuming an activity is prohibited.

Disability parking scheme interaction: Regulation 14(3) conceptually imports the national ACROD Disability Parking Program and the Australian Disability Parking Permit as components of the “disability parking permit” that qualifies a vehicle to park in designated disability bays. That external dependence requires officers to recognise permits issued under a national program rather than a locally issued card.

Traffic law interface: Several vehicle and traffic prohibitions are linked to road legislation. Since “use of a vehicle” and “stand” are defined with reference to the Road Traffic Code and Road Traffic (Administration) Act, enforcement and interpretation of vehicle rules on the park will intersect with state road law. For example, what counts as a “road” or “carriageway” or “footpath” for the purposes of regulations 11, 13 and 14 will be governed by those external definitions.

Firearms and other dangerous items: Regulation 32(4) imports the Firearms Act 2024 definition of “firearm,” and regulation 32(2) provides that carriage or use by a police officer in the course of duty is not an offence. Practitioners must reconcile police powers under criminal law and use of firearms in operational policing with the park prohibition.

Enforcement and collection procedures: The Regulations rely on the Act’s processes for service and management of infringement notices and owner identification (section 49), and for modified penalties (section 51). The forms in Schedule 1 are to be used for those Act‑based procedures. Recovery of debts (regulation 50) uses courts of competent jurisdiction, and so civil recovery principles and procedures from general law apply.

Amendment dependencies and timelines: The compilation table shows the Regulations have been amended at various times (2015, 2016, 2022 and through a 2024 regulation affecting the firearms cross‑reference with a 2025 commencement). Practitioners must therefore ensure they read the current version of the external statutes (for example the Road Traffic Code 2000 and the Firearms Act 2024) as their definitions and commencement dates may change the legal effect of the Regulations.

In sum, the Regulations are tightly integrated with other state and national instruments. Interpretation and enforcement require cross‑checking definitions and authorisations in road traffic, litter, firearms and other statutes. The Regulations preserve other statutory authorisations and rely on the parent Act for enforcement processes, so the complete legal picture for any activity requires reading the Regulations together with the referenced laws.

Compilation and amending instruments: The compilation table at the end of the Regulations records the principal instrument and its subsequent amendments. The original Botanic Gardens and Parks Regulations 1999 were published 30 June 1999 and commenced 1 July 1999. Amending instruments recorded in the compilation table include the Botanic Gardens and Parks Amendment Regulations 2014 (published 8 January 2015, various provisions commenced 27 April 2015), the Botanic Gardens and Parks Amendment Regulations 2016 (published 9 September 2016, most provisions commenced 10 September 2016), the Botanic Gardens and Parks Amendment Regulations 2022 (SL 2022/13, 11 February 2022), and the Environment Regulations Amendment (Firearms) Regulations 2024 (SL 2024/298, affects regulation 32 and commenced 31 March 2025 per the compilation table).

Substantive insertions and changes over time: The text includes footnotes and inserted regulation markers showing specific insertions and amendments. Notable insertions and changes include:

• Regulation 14A (Marking tyres) was inserted (Gazette 9 Sep 2016). This added an operational tool for park management officers to determine parking durations and a specific offence (14A(3)) for removing marks.

• Regulation 31A (Decorations) was inserted (Gazette 9 Sep 2016), adding an explicit ban on attaching decorations without permission.

• Regulations 33, 33A and 33B (Lighting fires; Portable gas barbecues or cookers; Portable generators) were inserted (Gazette 9 Sep 2016), strengthening controls on open flames and portable equipment.

• Regulation 43A (Relevant amount) was inserted by SL 2022/13 to set the amount to $5,000,000 for purposes of the Act’s section 11(4).

• Regulation 32 has been amended to incorporate the Firearms Act 2024 definition of “firearm” (SL 2024/298), reflecting an inter-instrument update that required re-alignment with contemporary firearms legislation.

• Various amendments in 2014 and 2016 updated definitions, penalties, inserted new prohibitions and adjusted penalty amounts. For example, the Gazette notes in 2016 saw a suite of changes (Gazette 9 Sep 2016 p. 3872-3882) that modernised enforcement tools and expanded prohibited items/activities.

Deletion and re-numbering: Schedule 2 shows at least one deleted item ("[17. deleted]") and one deleted row in the modified penalties table; the regulation footnotes note that some items were deleted in amendment rounds. Practitioners must therefore use the consolidated version and check the compilation table for dates of amendments to ensure they are relying on the current instrument.

Form changes and procedural updates: Schedule 1 and the associated regulations (44-47) have been amended (Gazette 9 Sep 2016 p. 3877-3878) to prescribe the forms for notices, infringement notices and withdrawal notices. These changes standardise administrative procedures for enforcement.

Temporal effects and commencements: The compilation table supplies commencement dates for amendments , some changes take effect a day after publication while others specify later commencement dates. The 2024 firearms-related amendment has a delayed commencement recorded in the compilation table (commencing 31 March 2025). That pattern means some amendments may require practitioners to check the precise commencement clause of each amending instrument.

Document provenance and licensing: The Regulations carry the © State of Western Australia 2025 notice and are compiled with editorial notes, footnotes and defined term lists. Amendments are recorded by Gazette references; the Regulations include editorial guidance on defined terms which is not part of the law but aids interpretation.

In practice, the amendments show a trend toward: (a) increased operational enforcement tools (tyre marking, more precise parking rules); (b) tighter controls on portable equipment and fires; (c) alignment with newer state statutes (firearms); and (d) more granular offence and penalty schedules to enable administrative enforcement via infringement notices. Each change reallocates discretion and compliance burden in small ways that affect on-the-ground management of Bold Park.

The Regulations as presented include no judicial decisions, judicial citations, or litigation history. The text of the Regulations does not name any cases, and the compilation table and notes list only amending instruments and commencement dates. Therefore, based on the source provided, there is no reported litigation history or court authority interpreting these Regulations in the materials supplied.

Practical implication for practitioners: Because no case law is supplied in the Regulations, questions of statutory interpretation, the practical scope of “permission,” the limits of park management officer powers, and the interplay with external statutes (for example the Road Traffic Code, Firearms Act or the Litter Act) would need to be addressed by reference to contemporaneous case law and administrative decisions outside this document. In the absence of reported judicial treatment embedded in the Regulation text, enforcement and legal risk assessments should assume that statutory text and administrative practice will determine outcomes until judicial authorities develop interpretive guidance.

Potential litigation focal points (based on textual features): While the source does not record cases, the Regulations contain several provisions that are naturally contestable and therefore likely candidates for litigation or administrative review in practice. These include:

• The scope and revocability of written permissions (regulation 5(2)-(4)): disputes could arise over whether the Authority properly exercised discretion to refuse, grant with conditions or revoke permission, and whether conditions were reasonable or properly communicated.

• Owner identification under Form 1 and section 49 of the Act: owners may dispute being deemed the offender if they were not driving or if the vehicle was stolen; procedural fairness of notice and the sufficiency of evidence could be litigated.

• The sufficiency of signage for closures or feeding prohibitions (regulations 6(3) and 22(2)): enforcement might be challenged where signage is inadequate or not properly sited.

• The “other written law” authorisation caveat in environmental protection provisions (regulations 19-20, 23): conflicts of permit conditions between agencies could generate disputes.

• The marking of tyres and the prohibition on removing marks (regulation 14A): disputes about evidence collection and privacy could arise.

• The interfacing with external road traffic definitions and offences, particularly where behaviour is simultaneously regulated by the Road Traffic Code and these Regulations: allocation of regulatory responsibility might be contentious.

Because none of these litigated outcomes appear in the text provided, practitioners must remain alert to future case law and administrative determinations that will clarify these tensions.

Geographic scope is narrow but the language is broad: Although many prohibitions read as general public‑space rules, regulation 4 prescribes the designated land as Bold Park only. A common mistake is to assume these Regulations apply to other botanic gardens or parks; they do not, unless other land is separately prescribed. Always confirm the land description in regulation 4 before applying the rules.

Permission must be in writing and obtained before action: Regulation 5(4) requires written permission obtained before the act or activity commences. Verbal assurances or after‑the‑fact licences do not meet the regulatory requirement. In prosecutions, failure to hold a prior written permission is decisive because most offences are framed as “without permission” , this is both a compliance trap and an enforcement pivot.

Permissions are easily conditioned and revocable: The Authority may grant permission on terms including fees (regulation 5(2)(b)) and may amend or revoke permissions (regulation 5(3)). Regulation 5(5) states that where permission is given subject to a condition, in prosecution the permission lapses during any period when the condition was not observed. The consequence is that conditional permissions create ongoing compliance risk: a minor breach of a condition can transform an authorised activity into an offence.

Authority signage has legal force, and its inscriptions “operate according to their tenor”: Multiple regulations state that inscriptions on signs operate according to their tenor (regulations 6(4) and 9(2)). That means that what is written on a sign can create obligations; however, the Regulations place a corresponding duty on the Authority to erect sufficient signs when closing land (regulation 6(3)). A “gotcha” is enforcement relying on signs that are not adequately placed or visible; regulation 22(2) expressly conditions the offence for feeding animals on the Authority having erected signs or otherwise notified the public.

Owner identification procedure can transfer liability to vehicle owners: Form 1 (regulation 44) and the supporting section 49(3) process can make vehicle owners liable unless they identify the driver, prove theft/unlawful use, or pay a modified penalty. Owners with shared vehicles or commercial fleets must manage record-keeping to avoid being deemed offenders.

Overlap with other laws requires cross-checking: Several key terms are defined externally (regulation 3). Misreading the Regulations without checking the Road Traffic Code 2000, the Road Traffic (Administration) Act 2008, Firearms Act 2024, Litter Act 1979 and others will lead to misapplication. For example, what counts as a “footpath,” or whether an “electric personal transporter” is a permitted device, depends on these external definitions.

Modified penalties are lower but acceptance waives court adjudication: Many offences carry low modified penalties in Schedule 2 (often $100-$200). Paying a modified penalty resolves the matter but bars court adjudication unless the person declines the infringement notice and opts for court. The simpler sanction might seem convenient, but it is also a waiver of the right to argue the matter in court.

Emergency and other exceptions are limited: Emergency vehicle drivers have a qualified exception (regulation 18) but only when “expedient and safe” and in the course of duties specified. The defence in regulation 8 applies only to charges under specific entry offences (regulation 6(5) and regulation 7(1), (2), (3)) and requires proof that the act was necessary to prevent or mitigate injury/damage , that is a burden on the accused.

Enforcement evidence involves physical markers: Marking tyres (regulation 14A) is an evidence-collection tool. Removal of such a mark without permission is an offence (regulation 14A(3)). This means evidence of overstay can be a physical chalk mark; removal of marks by third parties can create evidentiary disputes.

Commercial and expressive activities are tightly regulated: Regulated areas include public speaking (regulation 29(1)(b)), collection of money (regulation 29(1)(d)), and commercial photography (regulation 28). A “gotcha” is assuming protest or fundraising will be tolerated as public space , without permission these activities are offences and carry modified penalties.

Disability parking regime is specific and external: Regulation 14(1A) ties disability parking to a particular national permit document (Australian Disability Parking Permit and ACROD Parking Program Card). International visitors or people with other documentary evidence must ensure they possess the specific items recognised by the regulation.

Ambiguity in “other written law” authorisations: Several prohibitions are subject to the caveat “or without authorization (however described) under another written law,” but there is no guidance as to which external permits suffice. Practitioners must check external statutes and whether the Authority’s administrative practice recognises those permits.

Penalties vs. modified penalties inconsistency: Some offences carry a $2,000 penalty in the text but a modified penalty of $200 in Schedule 2 (for example failing to comply with traffic signs , regulation 9(3) text penalty $2,000; Schedule 2 item 6 gives $200). This duality is not inconsistent but practitioners must recognise that a person served with an infringement notice will face the modified penalty rather than the higher statutory fine unless the matter is prosecuted in court.

No public application procedure in the Regulations: Regulation 5 requires written permissions but contains no procedural prescription for applying, decision timelines, or review rights. That absence means administrative processes will be governed by the Authority’s internal procedures or by general administrative law principles. For applicants, the lack of predictable timeframes is a compliance risk.

In short, the most common practical pitfalls are assuming geographic breadth, relying on verbal permission, ignoring the need for prior written permission or conditions, neglecting cross‑checks with other statutes, and failing to prepare for owner identification procedures and tyre marking enforcement.

Obtain written permission before regulated activity: The single most important compliance step is to secure written permission from the Authority before undertaking any activity where the Regulations state “must not, without permission.” Regulation 5(4) requires this formality. Applications should specify the activity, dates, number of participants, and any equipment to be used; include contact details, proof of insurance if relevant, and be prepared for fees or conditions. Keep the written permission on hand while on the designated land to produce it if an enforcement officer asks.

Identify applicable definitions and external authorisations: Before any activity involving vehicles, photography, fauna/flora handling, or weapons, verify the relevant external definitions and authorisations cited in regulation 3 and elsewhere. For vehicle classification questions consult the Road Traffic Code 2000 and Road Traffic (Administration) Act 2008 definitions referenced; for firearms, consult the Firearms Act 2024; for litter and waste matters consult the Litter Act 1979. If another written law provides an authorisation that covers the activity, retain documentary proof of that authorisation on site.

Prepare documentation for vehicle owners and drivers: Vehicle owners should keep records identifying regular drivers, service logs, and evidence of theft or unlawful use should they wish to rely on the defences contemplated by Form 1 (regulation 44). Fleets or hire companies should institute record-keeping protocols so that owner identification notices can be answered within 28 days if served.

Observe signage and park management officer directions: Compliance requires obeying traffic signs erected under regulation 9 and directions from park management officers (regulation 9(3)-(4)). The inscriptions on signs are legally operative (regulation 9(2)), so signage must be followed even if a visitor believes it unnecessary. Keep a copy of any written permission with conditions and ensure all conditions are continuously met; failure to do so is taken as a lapse of permission in prosecution (regulation 5(5)).

For events and commercial activities, plan early and accept conditions: Commercial operators, event organisers, and anyone intending to engage in public speaking, collection of funds, or commercial photography must plan well ahead and budget for permission fees and any conditions. Because the Authority may impose conditions relating to location, timing, crowd control, and insurance, plan operations with those contingencies in mind.

Comply with parking rules and be aware of tyre marking: Park only in designated parking areas and, where bays are marked, ensure vehicles are entirely within the bay (regulation 14(1)(e)). Avoid parking in disability bays unless the required documents are displayed and the permit holder is present (regulation 14(1A)). Expect tyre marking by park management officers; do not remove marks (regulation 14A(3)), as that is a specific offence.

Respect flora, fauna, rocks and soil: Do not gather or interfere with plants, fungi or animals unless you have written permission or another statutory authorisation (regulations 19-20, 23). Researchers and contractors should apply for necessary research or removal permits and retain all approvals with them. Removal of stakes, labels or protective fencing is an offence (regulation 19(2)).

Avoid prohibited items and activities: Do not bring firearms, spearguns, catapults, or other weapons onto the land without permission (regulation 32). Similarly, do not light fires or use portable barbecues or generators without permission (regulations 33, 33A, 33B) and do not possess fireworks or other explosive devices without permission (regulation 34).

If served an infringement notice or Form 1, act promptly: Infringement notices must be paid within 28 days (Form 2) to avoid court prosecution; Form 1 requires owner identification within 28 days or payment of the modified penalty if issued. Consider whether you wish to contest an infringement by election to proceed to court; paying a modified penalty resolves the matter administratively but waives a contested hearing.

Maintain public-amenity and noise standards: Abide by the offensive behaviour provisions (regulations 37-42). Avoid indecent language, indecent acts, loud or offensive noise, and acts likely to cause nuisance. Seek prior permission for amplified sound or events likely to generate noise complaints.

Record and display disability permits properly: If eligible for disability parking, display the Australian Disability Parking Permit and the ACROD card as prescribed (regulation 14(3)) and ensure the permit holder is present in the vehicle.

When in doubt, request clarification in writing: Because the Regulations give the Authority broad discretion and do not prescribe detailed application processes, where activity is borderline or uncertain, seek written confirmation from the Authority. Obtain written clarifications about signage, closures and permitted paths to reduce the risk of enforcement action.

Consider insurance, indemnities and risk allocation: For commercial activities, events or works that may impact flora/fauna or the natural surface, obtain appropriate public liability insurance and be prepared to indemnify the Authority if required by permission conditions.

Monitor updates to related legislation: Keep service subscriptions or check the State legislation website for amendments to the Regulations and to the external instruments referenced (Road Traffic Code 2000; Firearms Act 2024; etc.), since changes to those instruments can change the scope of permissions and offences. The compilation table records multiple amendments; staying current prevents compliance lapses tied to new prohibitions or redefinition of terms.

In summary, compliance is practical and document-driven: obtain written permission in advance, keep permissions and other statutory authorisations on hand, obey signs and officer directions, conform to parking and environmental protections, and respond promptly to enforcement notices. Where planning commercial or public events, build in time and budget for permission processes and for meeting any conditions imposed by the Authority.
