sec.88 Easements over common property—executed document

This section applies if— before the commencement, a body corporate had, under former section 34, executed a lot owner agreement in relation to common property (the transaction ); and immediately before the commencement, an instrument had not been lodged for registration under the Land Title Act 1994 to give effect to the transaction. Former section 34 continues to apply in relation to the copy of the lot owner agreement that must accompany the instrument lodged for registration under the Land Title Act 1994 . s 88 ins 2024 SL No. 40 s 59 (sec.88-ssec.1) This section applies if— before the commencement, a body corporate had, under former section 34, executed a lot owner agreement in relation to common property (the transaction ); and immediately before the commencement, an instrument had not been lodged for registration under the Land Title Act 1994 to give effect to the transaction. (sec.88-ssec.2) Former section 34 continues to apply in relation to the copy of the lot owner agreement that must accompany the instrument lodged for registration under the Land Title Act 1994 .
