sec.39 Replacement of member removed from office by body corporate [SM, s 47 ]
If the reason for the vacancy is that the committee member is removed from office by ordinary resolution of the body corporate under subdivision 1 , the body corporate may, at the general meeting at which the resolution is passed, appoint a person who is eligible to be a member of the committee to fill the vacancy. It is not necessary for the body corporate to conduct an election to make an appointment under subsection (1) . (sec.39-ssec.1) If the reason for the vacancy is that the committee member is removed from office by ordinary resolution of the body corporate under subdivision 1 , the body corporate may, at the general meeting at which the resolution is passed, appoint a person who is eligible to be a member of the committee to fill the vacancy. (sec.39-ssec.2) It is not necessary for the body corporate to conduct an election to make an appointment under subsection (1) .
