Blood Donation (Limitation of Liability) Act 1985

The Act builds on a small set of defined legal constructs and operational mechanics. The definitions in s 3 drive the rest of the statute.

• AIDS and AIDS related action. “AIDS” is defined to include the disease in any stage, its antibodies and its virus (s 3). An “AIDS related action” is a civil action brought by or on behalf of a person who claims to have contracted AIDS through specified transfusion or handling events, or by dependants/estate for death resulting from such infection (s 3). The scope is therefore event-driven: the cause-of-action must be traced to blood supplied by the Society or a hospital, or to involvement in taking/testing/preparing/processing/handling/supplying/administering that blood (s 3).
• Actors protected and their activities. The Act repeatedly references the Society (the Australian Red Cross Society), hospitals (public and non-public, defined by reference to the Health Services Act 2016), employees and specified persons performing blood-related tasks, medical practitioners, and persons acting on behalf of medical practitioners (s 3; ss 5-6, 9-10). The protection attaches to activities such as taking, testing, preparing, processing, handling, supplying, labelling, documenting and administering blood/blood products (ss 5-6, 9-10).
• Donor declarations and timing. The donor declaration is a required procedural element. In Part II the Act refers to a declaration made “under the Transmissible Diseases Regulations” obtained from the donor “within the 12 hours immediately preceding the donation” (s 5(1)(a)(i)(A)). In Part III the requirement is a “donor declaration” made within the “prescribed period immediately preceding the donation” (s 9(1)(a)(i)(A)), and the Act prescribes who may receive and sign the declaration (s 11). The Act allows the Governor to adopt or prescribe the form and to adopt material from Transmissible Diseases Regulations (s 14; s 3 definition).
• Testing standards and certification. Part II relies on testing “using such equipment and in accordance with such a method as were then required by good medical practice” (s 5(1)(a)(i)(B)). Part III moves testing to an approval model: “approved equipment” and an “approved method”, an approved-form certificate “purporting to be signed or initialled by an approved person” attached to the container, and label endorsement rules for blood products (ss 9(1)(a)(i)(B), 10(1)(c)-(d), 13).
• Exceptions to the defences. The statutory defences are subject to exceptions: where defendants or employees are guilty of negligence or wilful misconduct in the handling or administration chain; where, after taking blood, they have reasonable grounds to believe a donor’s declaration might be false or the blood may contain AIDS and fail to take reasonable steps; and where administering hospitals or practitioners themselves are negligent in storage/handling/labelling or have reasonable grounds to suspect contamination and fail to act (ss 5(1)(ii), 5(2), 6(2); ss 9(1)(ii), 9(2), 10(2)).
• Emergency life-saving exception. A recurring feature is that, if not less than two medical practitioners believe the patient will likely die without blood or blood products and it is not reasonably practicable to obtain suitably tested supplies, the mere administration of untested blood does not by itself defeat the statutory defences (ss 5(3), 6(3), 9(3), 10(3)).
• Donor immunity with narrow carve-out. Donors receive immunity from proceedings “by reason only” of a recipient contracting AIDS from their donated blood or derived products, but this immunity does not apply if the donor is convicted under s 170 of The Criminal Code for matters connected to their declaration (ss 7, 12).
• Administrative delegation. The Act depends on subordinate instruments: Transmissible Diseases Regulations (as defined in s 3) for initial forms and process, approvals by the Chief Health Officer (defined by reference to the Public Health Act 2016) for equipment, methods and approved persons, and regulations made by the Governor (s 14). The evidentiary privileges (s 13) also rely on laboratory personnel and endorsed statements.

These concepts create a compliance‑driven shield: adherence to specified documentary, testing and certification steps produces a statutory defence; deviation, negligence, or reasonable suspicions that are not reported and acted on remove the defence.

The Act’s coverage is actor-specific and activity-specific. Identify the parties who are directly affected by the statutory mechanics.

• Society (Australian Red Cross Society). The Society is the primary institutional beneficiary of the statutory defences: Parts II and III explicitly provide that actions against the Society may be defended where prescribed declarations and testing/certification/label requirements are met and there is no negligence or wilful misconduct (ss 5(1)(a), 9(1)(a)). The Society also has duties to cause testing and to attach certificates/labels where required (ss 5(1)(a)(i)(B), 9(1)(a)(i)(B), 10(1)(d)).
• Hospitals and health service providers. “Hospital” includes public hospitals as defined by the Health Services Act 2016 (the health service provider), and other hospitals (person conducting/managing the hospital) (s 3). Hospitals that supply blood or administer blood/blood products are within the Act’s coverage; the Act provides defences to actions against hospitals where compliance is shown, and separately addresses hospitals that administer blood (ss 5-6, 9-10).
• Medical practitioners and persons acting on their behalf. Medical practitioners and authorised persons who administer or authorise administration of blood are subject to the statutory defences; these defences depend on the supplying Society or hospital having complied with declaration and testing obligations, and that the practitioner is not negligent or wilfully misconducting in storage, handling, labelling or administration (ss 6(1)(b), 10(1)(b); ss 6(2), 10(2)).
• Employees, volunteers and third parties involved in the blood chain. Employees of, or persons working without payment for, the Society or hospital and other persons who take blood on behalf of the Society or hospital are protected by the statutory defences provided they were not guilty of negligence or wilful misconduct and acted according to the required procedures (ss 5(1)(a)(ii), 9(1)(a)(ii)). However, if they had reasonable grounds to believe a donor declaration might be false or the blood might contain AIDS and did not report and take reasonable steps, the defence does not apply (ss 5(2)(b), 9(2)(b)).
• Donors. Donors are given statutory protection from civil or criminal proceedings that arise only from transmission of AIDS to a recipient, except for criminal liability under s 170 of The Criminal Code in respect of donor declarations (ss 7(1)-(2), 12(1)-(2)). The Act imposes no civil liability on donors for mere causation absent criminality.
• Recipients and their dependants/estates. Persons who contract AIDS as a result of transfusion and their dependants or estates are the class authorised to bring “AIDS related actions” (s 3). The Act changes the legal landscape available to such plaintiffs by making the statutory defences available to defendants; plaintiffs must navigate the evidentiary regime and prove that the defences are displaced by negligence, wilful misconduct, or the statutory exceptions (ss 5-6, 9-10, 13).
• Laboratories and laboratory heads. The person in charge of the laboratory that performs testing is specifically implicated because a certificate purporting to be signed by that person is treated as evidence of testing and results (s 13(a)). Laboratories will therefore be integrated in the evidentiary chain.
• Regulators and the Chief Health Officer. The Chief Health Officer is given gatekeeping functions by the Act’s definition of “approved” (s 3) and by the reliance on approvals for equipment, methods and approved persons (ss 9(1)(a)(i)(B), 10(1)(d), 13). The Governor’s regulation‑making power (s 14) also affects agencies responsible for public health and for producing the Transmissible Diseases Regulations.

The Act therefore affects suppliers of blood, the institutions and personnel who process and administer it, donors, recipients and their estates, and regulatory authorities who set or approve technical standards. The statutory shield materially alters defendants’ exposure in civil litigation and the practical allocation of documentation, testing and labelling responsibilities among these actors.

The Act imposes procedural duties on suppliers and confers statutory defences and limited immunities. The duties and rights are proceduralised and evidence-focused.

Duties and procedural obligations

• Obtain donor declarations within the required timeframe. For blood covered by Part II the Society or hospital must obtain a declaration from the donor “within the 12 hours immediately preceding the donation” (s 5(1)(a)(i)(A)). For blood covered by Part III the Society or hospital must obtain a “donor declaration” within the “prescribed period immediately preceding the donation” (s 9(1)(a)(i)(A)). Section 11 prescribes who may receive and sign donor declarations: persons authorised to permit statutory declarations, designated officers under the Human Tissue and Transplant Act 1982 (or delegates), medical practitioners, staff members of the Society’s blood transfusion service, or registered nurses employed for taking tissue (s 11(1); s 11(2) defines tissue).
• Test blood samples prior to supply for administration. Under Part II testing must be done “using such equipment and in accordance with such a method as were then required by good medical practice” (s 5(1)(a)(i)(B)). Part III requires testing “using approved equipment and in accordance with an approved method”, and an approved-form certificate purporting to be signed by an approved person must be attached to the container (s 9(1)(a)(i)(B)).
• Attach labels or endorsed statements for blood products. Part III requires that, for blood products, an endorsed statement in an approved form be attached to the container or outer container (s 10(1)(c)). The effect of such endorsements is codified in evidentiary terms in s 13(b).
• Report and act on reasonable grounds to suspect false declaration or contamination. If, after taking blood, the Society, hospital, employee or other person has reasonable grounds to believe a donor’s declaration might be false or that the blood might contain AIDS, they must take “all reasonable steps” to ensure the blood is not administered (s 5(2)(a); s 9(2)(a)); employees and other persons must report such grounds to the Society or hospital and take “all reasonable steps” to ensure the blood is not administered (s 5(2)(b); s 9(2)(b)).
• Maintain standards of non‑negligence and avoid wilful misconduct. The statutory defences are available only if the defendant and relevant staff were not guilty of negligence or wilful misconduct in the taking, testing, certification, storage, preparation, processing, handling, supplying, labelling, documenting or administering the blood (ss 5(1)(a)(ii), 9(1)(a)(ii), 6(1)(e), 10(1)(d)(iii)).

Rights and protections

• Statutory defences against AIDS related actions. Where the procedural duties are met and the actor was not negligent or guilty of wilful misconduct, the Society, hospitals, employees and persons administering blood have a statutory defence to AIDS related actions (ss 5(1), 6(1), 9(1), 10(1)). The defence framework is central: compliance yields immunity from suit in the defined circumstances.
• Donor immunity. Donors have no civil or criminal proceedings lying against them merely by reason of a recipient contracting AIDS from their donated blood, except where they have been found guilty under s 170 of The Criminal Code in respect of their declaration (ss 7(1)-(2), 12(1)-(2)).
• Evidentiary presumptions and admissibility. Certificates from the person in charge of the testing laboratory and endorsed labelling statements are specifically made admissible as evidence of testing and results (s 13). This eases defendants’ evidentiary burden where proper documentation accompanies the blood.
• Emergency exceptions. The Act protects actors who administer untested blood in life-or-death emergencies where two medical practitioners form the requisite opinion, in that the administration of untested blood does not by itself defeat a statutory defence (ss 5(3), 6(3), 9(3), 10(3)).

Preserved legal liabilities

• The Act does not abrogate liability where negligence or wilful misconduct is shown, or where reasonable suspicions existed and were not acted upon. These carve-outs expose actors to ordinary civil liability in those circumstances (ss 5(1)(a)(ii), 5(2), 6(2); ss 9(1)(a)(ii), 9(2), 10(2)).
• The Act does not remove criminal liability under s 170 of The Criminal Code for improper donor declarations (ss 7(2), 12(2) refer to s 170). It also does not affect liability under the Workers Compensation and Injury Management Act 2023 for employers to pay compensation for workers who contract AIDS in the course of employment (s 3A).

Delegated authorities and regulation

• The Governor has regulation-making authority to prescribe necessary matters and to adopt the form of donor declarations, or adapt Transmissible Diseases Regulations (s 14).
• “Approved” items are those approved by the Chief Health Officer by instrument in writing (s 3), which is the mechanism used in Part III to define approved equipment, methods and persons (ss 9(1)(a)(i)(B), 9(1)(a)(i)(B) and 10).

In short, rights and defences hinge on documentary and laboratory procedural compliance; duties are operational: collect the declaration, test according to the required standard, attach certificates and labels, report reasonable suspicions and avoid negligence or wilful misconduct.

The Act structures liability by creating statutory defences and evidentiary presumptions rather than prescribing new criminal penalties; enforcement operates through three mechanisms: continued availability of ordinary civil actions subject to statutory defences, criminal liability retained in limited respects, and regulation-backed administrative standards.

Civil enforcement and burden shifting

• Plaintiffs retain the right to bring AIDS related actions as defined in s 3 (s 3). The Act does not abolish civil causes of action; it provides defendants with a statutory defence if they meet procedural and substantive conditions (ss 5-6, 9-10). Practically, civil enforcement remains possible against actors who cannot satisfy the statutory defences because they failed to obtain donor declarations, failed to test or certify appropriately, had reasonable grounds and did not act, or were negligent or guilty of wilful misconduct.
• The evidentiary provisions (s 13) make a laboratory certificate and endorsed statements on labels admissible and conclusive evidence of testing and labelling matters stated. That evidentiary rule materially affects enforcement: it reduces the plaintiff’s ability to challenge testing and labeling where certificates/statements exist, and transfers to the plaintiff the task of showing negligence, wilful misconduct or the existence of reasonable grounds not acted upon.

Criminal liability preserved and limited

• The Act specifically preserves criminal proceedings under section 170 of The Criminal Code against donors in relation to false donor declarations (ss 7(2), 12(2)). The statute does not create additional criminal offences; rather it preserves the applicability of pre-existing criminal law in relation to donor declarations.
• No other criminal sanctions are introduced in the Act. Where wilful misconduct or other criminal conduct beyond s 170 may exist, ordinary criminal law applies; the Act does not create enhanced criminal penalties but also does not immunise actors from criminal exposure where the conduct falls under general criminal statutes.

Workers’ compensation and statutory insurance-type liability

• The Act expressly excludes its application to liabilities under the Workers Compensation and Injury Management Act 2023: nothing in this Act applies in relation to any liability of the Society, a hospital, a medical practitioner or any other person under the workers’ compensation legislation to pay compensation or provide other benefits for injury or death resulting from contraction of AIDS of a worker in employment (s 3A(1)). That provision preserves statutory compensation lines irrespective of the Act’s defences.
• The Act does not create an administrative enforcement regime (no inspectorate powers, no administrative fines). Enforcement is primarily in the hands of civil litigants and ordinary criminal prosecutors.

Regulatory enforcement and discretion

• The Governor’s power to make regulations (s 14) and the Chief Health Officer’s ability to “approve” equipment, methods and persons (s 3 definition of “approved”) delegate significant technical rule‑making to executive instruments. These delegations create implementation risk: enforcement of standards will be via compliance with regulations and approvals, but the Act does not itself provide a statutory inspector or enforcement process for breaches of regulations; noncompliance affects litigation outcomes (availability of defences).
• Hospital and laboratory governance and professional disciplinary regimes (e.g. under the Health Practitioner Regulation National Law (WA) referenced in the Act for medical practitioner and nurse definitions) intersect with the Act’s standards for negligence and wilful misconduct, but the Act itself does not set professional disciplinary penalties (s 3, s 11).

Practical enforcement implication

• The Act makes documentation, testing and labelling the focal point of civil litigation. The readily‑produced certificate attached to the container and endorsed label statements are treated as evidence; their absence or deficiency will be central to enforcement actions and to whether defendants can invoke the statutory defence (ss 9(1)(a)(i)(B), 10(1)(c)-(d), 13).

Overall, penalties in the Act are consequence-based rather than express fines: failure to comply removes the statutory defence and leaves actors exposed to ordinary civil and (in restricted respects) criminal liability; regulatory compliance is enforced indirectly via its effect on litigation outcomes.

The Act cross-references and preserves interactions with a number of other statutory regimes and subordinate instruments. The statutory text itself names the relevant external instruments and integrates them in the Act’s mechanics.

Key legislative interactions

• Public Health Act 2016. “Chief Health Officer” is defined by reference to s 4(1) of the Public Health Act 2016 (s 3). The Act anticipates that the Chief Health Officer will be the approving authority for equipment, methods and persons in Part III (s 3 definition of “approved”; ss 9(1)(a)(i)(B), 10(1)(d) reference “approved” items). This ties technical standards for testing, certification and approved persons to the public health regulator’s instruments.
• Health Services Act 2016. The definition of “hospital” for public hospitals explicitly references the Health Services Act 2016 s 6 and identifies the health service provider as the operative hospital entity for public hospitals; non-public hospitals are defined by reference to the person conducting or managing the hospital (s 3). This allocates responsibility to the hospital entity recognised by the Health Services Act 2016.
• Health Practitioner Regulation National Law (WA). The Act uses the Health Practitioner Regulation National Law (WA) to define “medical practitioner” and to identify registered nurses by reference to the Register of Nurses (s 3; s 11(1)(e)). Professional registration and discipline regimes under that National Law will operate alongside the Act; for example, allegations of negligence or professional misconduct are relevant to whether the statutory defences are displaced.
• The Criminal Code. The Act preserves criminal liability under s 170 of The Criminal Code in respect of false donor declarations (ss 7(2), 12(2) reference s 170). The Act does not otherwise displace criminal law; general criminal offences remain available where conduct falls within existing criminal statutes.
• Workers Compensation and Injury Management Act 2023. The Act expressly does not apply to liabilities under the workers’ compensation statute for injuries or death resulting from contraction of AIDS in the course of employment (s 3A(1)). That preserves the statutory compensation framework irrespective of the Act’s civil‑liability limitations.
• Transmissible Diseases Regulations and predecessor instruments. The Act refers to Transmissible Diseases Regulations , regulations made under the Health (Miscellaneous Provisions) Act 1911 or the Public Health Act 2016 that require persons donating blood to make a declaration (s 3). Part II relies on declarations “made under the Transmissible Diseases Regulations” (s 5(1)(a)(i)(A)). Section 14 preserves the Governor’s power to adopt or adapt Transmissible Diseases Regulations’ forms for donor declarations.
• Human Tissue and Transplant Act 1982. Section 11(1)(b) authorises designated officers or delegates under that Act as persons before whom donor declarations may be made and who may sign and endorse the declaration (s 11(1)(b)). The Act thereby links donor declaration witnessing to the organ/tissue regulatory regime.
• Regulations under this Act. Section 14 authorises the Governor to make regulations prescribing matters required or convenient for giving effect to the Act, including prescribing or adopting the form of the donor declaration, with the power to adopt Transmissible Diseases Regulations with or without modification. The interplay is statutory: the principal Act sets the defence framework, subordinate laws set the technical details.

Consequences and cross‑jurisdictional considerations

• Administrative standards vs judicial standards. The Act sets technical rules via approvals and regulations, but legal liability turns on judicial findings of negligence, wilful misconduct or failure to take reasonable steps on suspicion. Thus agency standards (approved equipment/methods) will inform but not wholly determine court findings about what constitutes reasonable steps or negligence.
• Professional disciplinary regimes remain in place. The Act’s definition‑crossing to the Health Practitioner Regulation National Law (WA) and Health Services Act 2016 means that professional regulatory action (e.g. by boards) can proceed independent of civil litigation under the Act; the Act does not limit those regimes.
• Temporal transition. The Act creates two regimes (Parts II and III) which depend on a proclamation day (specified in compilation notes as 15 September 1986). Legal practitioners must identify which Part applies to the transfusion event under dispute (ss 4, 8; Compilation table; Other notes).
• Evidence law. Section 13 creates a statutory evidentiary rule, making certain lab certificates and endorsed statements admissible evidence of testing and labelling matters. This intersects with general evidence law but is a statutory simplification specific to AIDS related actions under the Act.

In short, the Act is not stand-alone; its legal effect is mediated by public health approvals, hospital governance rules, professional registration law, criminal law, workers’ compensation, and regulations that will supply the technical specificity on which the statutory defences depend.

The compilation table and marginal notes in the Act show its amendment history and timing details. The Act has been amended several times, often to align definitions or to reflect shifts in health regulation and related statutes.

Principal amendments and dates

• Original Act and commencement. The Blood Donation (Limitation of Liability) Act 1985 (No. 88 of 1985) received assent on 4 December 1985 and is deemed to have commenced on 30 June 1985 (s 2; Compilation table).
• Amendment in 1987. The Blood Donation (Limitation of Liability) Amendment Act 1987 (No. 52 of 1987) was assented to on 30 October 1987 and operates back to 30 June 1985 for certain provisions (compiled notes show s 3A was inserted in 1987) (Compilation table; s 3A notes).
• Hospitals Amendment Act 1994. Section 18 of the Hospitals Amendment Act 1994 (No. 103 of 1994) made amendments, with commencement 3 February 1995 (Compilation table entries).
• Workers’ Compensation Reform Act 2004. Sections 156 and 174 of that Act (No. 42 of 2004) amended the 1985 Act; the compilation table identifies commencement details in late 2004 and 2005 (Compilation table).
• Nurses and Midwives Act 2006, Medical Practitioners Act 2008, and Health Practitioner Regulation National Law (WA) Act 2010 amendments. These Acts changed how medical practitioners and nurses are defined and referenced in the 1985 Act (s 3 amendments: Nos 50 of 2006, 22 of 2008, 35 of 2010) to align with contemporary registration frameworks (s 3 marginal note shows amendments).
• Health Services Act 2016 and Public Health (Consequential Provisions) Act 2016. Amendments in 2016 (No. 11 of 2016; No. 19 of 2016) revised definitions and cross-references to newer health statutes, including adopting the Public Health Act 2016 terminology for the Chief Health Officer and aligning the hospital definition to the Health Services Act 2016 (s 3 amendments).
• Health Practitioner Regulation National Law (WA) Amendment Act 2018 (No. 4 of 2018) changed s 11 and related nurse definitions, aligning them with the national law (Compilation table).
• Workers Compensation and Injury Management Act 2023. Section 709 of No. 21 of 2023 amended the Act to insert s 3A, clarifying that this Act does not apply to liabilities under the updated workers’ compensation statute, with the 2023 Act commencing 1 July 2024 (Compilation table; s 3A inserted and amended notes).

Textual amendments of operational significance

• Shift from Transmissible Diseases Regulations model to an approval/regulation model. Part II and Part III differ in the mechanics of declarations and testing: Part II refers to declarations under Transmissible Diseases Regulations and testing “required by good medical practice” (s 5(1)(a)(i)(A)-(B)); Part III, as amended, relies on “donor declaration” within the prescribed period and “approved equipment”/“approved methods” with attached certificates and endorsed labels (ss 9-10). The insertion of Part III mechanics reflects regulatory evolution toward specifying approved equipment, methods and certification processes (ss 9-10).
• Definitions updated to contemporary statutes. The Act’s cross‑references to later health and professional regulation statutes over time required textual amendments to s 3 and s 11 so that terms like “Chief Health Officer”, “hospital”, “medical practitioner” and registered nurse reference current legislation (s 3 and s 11 marginal notes show amendments).

Practical note on commencement and proclamation timing

• The Act’s two-part structure turns on a proclamation day used in ss 4 and 8. Compilation notes indicate the proclamation day was fixed as 15 September 1986 (Other notes). Practitioners should apply the correct Part to the relevant transfusion event based on that date.

Regulatory instruments and forms

• The Act’s operational detail is left to regulation (s 14). The Governor’s regulation power and the Chief Health Officer’s approval powers provide the mechanism by which the Act’s technical requirements have and will be specified. Amendments that changed which parent health statutes governed approvals and declarations altered the locus of regulatory activity rather than the statutory defences’ core logic.

The compilation table records these adjustments and shows the Act’s statutory environment has been updated periodically to remain consistent with health and professional regulation reforms.

The statutory text and compilation provided contain no case law, reported decisions, or judicial interpretations. The Act as supplied does not name any judicial decisions or litigation outcomes. Accordingly:

• No cases are cited in the source material. The Act contains no headnotes or annotated case references in the provided compilation.
• The Act establishes legal issues that would naturally be litigated, principally whether defendants complied with donor declaration, testing, certification and labelling obligations; whether defendants or staff were negligent or guilty of wilful misconduct; and whether reasonable grounds to suspect false declarations or contamination existed and were acted upon (ss 5-6, 9-10). Those factual and legal questions would be matters for courts, but the source provides no record of judicial findings.

Areas likely to generate litigation (based on the text)

Although the source does not contain litigation history, the Act creates points of legal contest that parties would reasonably litigate:

• Temporal applicability (Part II v Part III). Disputes could arise over whether the transfusion event falls within the initial period (30 June 1985 to proclamation day) or the subsequent period (on or after proclamation day), and whether the prescribed forms and timing requirements were satisfied (ss 4, 8; Compilation table).
• Interpretation of “reasonable grounds” and “all reasonable steps”. The Act conditions the availability of defences on the absence of reasonable grounds to suspect false declarations or contamination, or on having taken “all reasonable steps” if such grounds arose (ss 5(2), 9(2)). Courts would need to apply extant standards for reasonableness in negligence and statutory contexts to those phrases.
• Negligence and wilful misconduct. The Act preserves normal liability where negligence or wilful misconduct in the test/take/storage/handling/label/administration chain is proved (ss 5(1)(a)(ii), 9(1)(a)(ii), 6(2), 10(2)). Litigation would likely focus on operational practices and standards of care.
• Sufficiency of lab certificates and endorsed statements as evidence. Section 13 makes certificates and endorsed statements admissible evidence. Disputes could centre on the authenticity and scope of those certificates/statements, the authority of the signatory, and whether the certificate accurately records testing and results.
• The scope of “approved” equipment, methods and persons. Where Part III applies, litigants may contest whether the equipment, method or person involved was truly “approved” under the Act’s delegated processes (s 3, ss 9-10).

Because the Act declaratively makes these issues central to liability, litigation would be the principal venue for resolving them, but the source contains no record of any decisions. Legal advisers should therefore search jurisdictional law reports and databases for subsequent cases applying or interpreting the Act when litigation strategy is required.

Practitioners and compliance officers should be alert to a set of practical traps and technical points where failure to observe the statute’s precise mechanics will defeat the statutory defences or impose unexpected liabilities.

1. Two different regimes with different procedural thresholds. The initial regime (Part II) requires declarations “under the Transmissible Diseases Regulations” and testing “required by good medical practice” with a tight 12‑hour pre-donation declaration timing (s 5(1)(a)(i)(A)-(B)). The subsequent regime (Part III) requires a “donor declaration” within a “prescribed period” and testing with “approved” equipment and methods plus required certificates and label endorsements (ss 9-10). Don’t conflate the two; apply the correct Part based on when the transfusion event occurred (ss 4, 8; Other notes: proclamation day 15 Sep 1986).
2. The prescribed period vs 12 hours. Part II’s 12-hour requirement is explicit (s 5(1)(a)(i)(A)). Part III substitutes a “prescribed period” (s 9(1)(a)(i)(A)), which will be defined in regulations. Compliance requires knowing which temporal rule applies and the content of the regulations.
3. Who may witness/sign donor declarations. Section 11 lists discrete categories of persons before whom donor declarations may be made and who must sign, date and endorse the declaration with time and the category of witness. Failure to have the declaration signed by an authorised person (for example, relying on an unauthorised staff member) will jeopardise the defence (s 11(1)). Note the specific inclusion of designated officers under the Human Tissue and Transplant Act 1982, medical practitioners, staff of the Society’s blood transfusion service, and certain registered nurses (s 11(1)(a)-(e)).
4. Donor immunity is limited. Donors are immune from proceedings only “by reason only” of transmission absent a conviction under s 170 of The Criminal Code in relation to their declaration (ss 7(1)-(2), 12(1)-(2)). Donors who have committed other culpable acts beyond s 170 may still face proceedings if those acts supply independent legal grounds.
5. Certificates and endorsed labels are compelling but must be attached correctly. Under Part III a certificate in an approved form “purporting to be signed or initialled by an approved person” must be attached to the container, and endorsed statements are evidence (ss 9(1)(a)(i)(B), 10(1)(c)-(d), 13). Absent or improperly attached certificates/labels will likely preclude the evidentiary advantage.
6. “Reasonable grounds” and “all reasonable steps” are factual. The Act requires action if reasonable grounds arise. Those are fact-sensitive and not defined by the statute; institutions must have clear internal reporting and quarantine procedures because courts will assess whether the respondent took “all reasonable steps” (ss 5(2), 9(2)).
7. Emergency exceptions require two practitioners’ opinions. The life-or-death exception requires the opinion of not less than two medical practitioners, and their assessment that it was not reasonably practicable to obtain tested blood/products (ss 5(3), 6(3), 9(3), 10(3)). Documented contemporaneous opinions will be essential to rely on the exception.
8. Delegated technical standards are pivotal. Part III depends on approvals by the Chief Health Officer and regulations (s 3 definition of “approved”; s 14). If approvals or regulatory standards are changed, operational processes must be updated immediately to preserve defences.
9. Interaction with workers’ compensation. Section 3A carves out workers’ compensation liability from the Act. Employers and institutional risk managers must treat workers’ compensation claims independently even where the Act limits civil liability.
10. Evidentiary simplification does not equal conclusive proof. Section 13 makes certificates/statements evidence of matters stated; it does not create irrebuttable presumptions. Plaintiffs can still challenge authenticity, accuracy or the competence of the approver where appropriate, but the statutory rule makes the documents potent evidence for defendants.

These are concrete implementation and litigation risks embedded within the Act’s textual mechanics. Operationally, the statute places a premium on proven record-keeping, authorised signatures, approved testing equipment/methods, proper labelling/certification and prompt reporting of suspicions.

For institutions, practitioners and laboratories that supply, test, prepare or administer blood or blood products, the Act sets out compliance tasks that translate into specific operational controls. The following is a regimen derived directly from the Act’s requirements (cite sections where necessary).

1. Establish and document donor-declaration procedures

• Ensure donor declarations are obtained within the relevant time window: for events covered by Part II that means within 12 hours immediately preceding donation (s 5(1)(a)(i)(A)); for events covered by Part III follow the “prescribed period” set in regulations (s 9(1)(a)(i)(A)).
• Use the form prescribed or adopted under s 14 or the Transmissible Diseases Regulations as the Act requires; ensure the declaration form conforms to the governor’s regulations or derivative instruments (s 14; s 3 definition of donor declaration).
• Train staff on who may lawfully receive and sign declarations. Section 11 identifies authorised persons: those authorised to permit statutory declarations, designated officers or delegates under the Human Tissue and Transplant Act 1982, medical practitioners, staff of the Society’s blood transfusion service, and registered nurses employed for taking tissue (s 11(1)(a)-(e)). Ensure the signatory records the time and category on the declaration as required (s 11(1)).

2. Maintain approved testing standards and certification

• Where Part III applies, secure and document approvals from the Chief Health Officer for equipment, methods and persons as required by the Act’s “approved” mechanism (s 3 definition; ss 9(1)(a)(i)(B), 10(1)(d)).
• Ensure testing is performed using the approved equipment and approved method; retain test records.
• Attach a certificate in the approved form purporting to be signed or initialled by an approved person to the container in which the relevant blood or blood product is contained (s 9(1)(a)(i)(B), 10(1)(d)(ii)). Confirm processes for initialling/signing, secure chain-of-custody, and consistent placement of certificates.

3. Label blood products as required

• For blood products, ensure that an endorsed statement in an approved form is attached to the container or outer container as required by s 10(1)(c). Follow any regulation that prescribes wording or format.
• Maintain procedures to guarantee labels remain attached and legible through storage, transport and administration.

4. Implement reporting and quarantine procedures for reasonable suspicions

• Create clear protocols requiring staff to report any reasonable grounds to believe a donor declaration may be false or that the blood might contain AIDS to the Society or hospital immediately (ss 5(2)(b)(iii)-(iv), 9(2)(b)(iii)-(iv)).
• Document investigations, communications, quarantining of suspect units and decision-making steps; “all reasonable steps” taken should be recorded to preserve the statutory defence where doubts arise (ss 5(2), 9(2)).

5. Avoid negligence and wilful misconduct in core activities

• Maintain written standard operating procedures for taking, testing, certifying, storing, preparing, processing, handling, supplying, labelling, documenting and administering blood and products (ss 5(1)(a)(ii), 9(1)(a)(ii)). Ensure staff training, supervision, competency testing and audit trails.
• Regularly audit compliance with procedures and approved methods; record corrective actions and retraining to show a continuing compliance culture.

6. Create emergency protocols consistent with the two-medical-practitioner exception

• For life‑threatening situations, ensure there is a process for obtaining the contemporaneous opinions of not less than two medical practitioners, and record their reasons that obtaining tested blood was not reasonably practicable (ss 5(3), 6(3), 9(3), 10(3)). Keep signed records attached to the patient file to rely upon the exception if litigation follows.

7. Laboratory governance and evidentiary chain

• Identify the person in charge of the laboratory who will sign the certificate required by s 13(a); ensure they understand the evidentiary role of their signature.
• Maintain lab registers, test logs, chain-of-custody documents and archived samples where practicable, to defend the accuracy of certificates if challenged.

8. Regulatory liaison and document control

• Monitor and obtain copies of any regulations made under s 14, and any approvals or instruments issued by the Chief Health Officer concerning approved equipment, methods, forms or persons. Update operational documents promptly after regulatory changes.
• Ensure that forms in use are the forms prescribed or adopted by regulations under s 14 or consistent with Transmissible Diseases Regulations where applicable.

9. Governance for donors and staff

• Inform donors of the legal significance of donor declarations, including the criminal liability preserved under s 170 of The Criminal Code. Ensure staff are aware of the limits of donor immunity (ss 7, 12).
• Integrate the Act’s compliance requirements into insurance and risk management, but remember the Act does not preclude ordinary civil liability where negligence or wilful misconduct is proved.

10. Coordination with employment and workers’ compensation responsibilities

• Treat any case involving a worker who contracts AIDS in the course of employment as a workers’ compensation matter separate from the Act’s liability limitation (s 3A). Ensure reporting and benefits obligations under the Workers Compensation and Injury Management Act 2023 are complied with.

Record-keeping is the single most important compliance measure under the Act: documented donor declarations signed by authorised persons, laboratory certificates signed by the person in charge, endorsed labels for blood products, contemporaneous medical opinions in emergencies, and internal reporting of any reasonable grounds will determine whether the statutory defences can be successfully invoked (ss 5-6, 9-13, 11).
