Births, Deaths and Marriages Registration Regulations 2011

The Regulations operationalise a set of core administrative concepts required by the Act, by prescribing required data fields, procedural thresholds and authorised access. The main concepts and where they appear in the Regulations are:

• Required particulars and the scope of notices/statements: For births a notice under s 12(1) must include specified particulars (r 4). The birth registration statement under s 14 must include detailed parental information, gestation, weight, multiple-birth ordering, Indigenous status, and donor particulars where conception resulted from a fertilisation procedure (r 5). For deaths, a doctor’s notice under s 36(1) and a funeral director’s statement under s 38 are prescribed to carry particular items (r 8, r 9). Registrar entries to the Register for births and deaths must include designated particulars (r 6, r 10). The Regulations note the optional nature of a still-born child’s name (r 5 note; r 6 note, referring to s 21 of the Act).

• Parent, place and related definitions: The Regulations adapt definitions from other statutes. The term parent is expanded to include mothers and fathers, mothers and co‑parents as defined in the Family Relationships Act 1975, and parents under orders made under the Surrogacy Act 2019 (r 3). "Place" of an event requires either an address or, where none exists, a statement identifying the general location (r 3). Registered relationship and de facto relationship meanings are drawn from other statutes (r 3).

• Donor information: If a child was conceived via a fertilisation procedure, the birth registration statement and Register entry must, where known, include the donor’s name, sex or gender identity, date of birth and place of birth (r 5(ea), r 6(da)). The obligation is expressly qualified by the words "if known" in those clauses.

• Sex and gender identity: Part 3A creates a prescriptive list of recognised sex or gender identities: male, female, non-binary, and indeterminate/intersex/unspecified (r 7A). Register entries for change of sex or gender identity must record the person’s name, new sex or gender identity, birth particulars and the date the entry was made (r 7B). The Regulations also specify what counselling-only clinical treatment means for the purpose of the Act: at least three separate counselling sessions aggregating 135 minutes, or counselling occurring over at least six months (r 7C).

• Access to pre-change information: The Regulations prescribe a closed list of persons and public bodies who "may be allowed access" to Register information showing a person's sex or gender identity before a registered change (r 7D). That list includes spouses/domestic partners, parents/guardians, executors/administrators, specified law‑enforcement and prosecutorial bodies, anti‑corruption offices, and legal practitioners authorised by the person or specified others (r 7D(a)-(e)).

• Administrative review: The Regulations confer jurisdiction on the South Australian Civil and Administrative Tribunal (SACAT) to review Chief Executive decisions under s 25A of the Act, and prescribe who may apply for review in relation to decisions about a particular child (court-appointed guardians under the Children and Young People (Safety) Act 2017, biological parents/co‑parents, and the child), and the time limit for such applications,28 days or longer if the Tribunal permits (r 6A).

• Disposal outside cemeteries: Where remains are interred in a "prescribed area" outside a cemetery or natural burial ground, the Regulations require the address, certificate of title reference and GPS coordinates of the interment site to be included in the funeral director’s statement and in the Register entry (r 9(ma), r 10(2)).

• Registrar’s signature and fees: The Regulations authorise production of a facsimile of the Registrar’s signature and seal by computer as an authorised method (r 11), and permit the Registrar to charge a fee for services relating to registration that are not otherwise subject to a fee prescribed in the Act (r 12).

These concepts determine the specific data the State will collect about individuals and events, the categories used for sex and gender data, thresholds for clinical evidence in gender/sex change cases, and the boundaries of authorised access. Each concept is anchored to particular regulation numbers cited above and operates within the Act’s framework (the Regulations repeatedly reference the Act’s relevant sections for the required notices, statements and entries).

The Regulations affect a wide range of individuals and organisations involved in the recording of births, deaths and changes of identity, and those who may seek access to or review of Register information. Key affected parties are:

• Parents and children: Parents (as defined in r 3, including mothers, fathers, co‑parents under the Family Relationships Act and parents under Surrogacy Act orders) are obliged to supply particular information in birth registration statements (r 5). Children are directly affected where the Regulations create mechanisms for recording changes of name and changes of sex or gender identity (r 7, r 7B), and where the child or their guardians may apply to SACAT to review Chief Executive decisions (r 6A(2)).

• Biological donors and donor-conceived persons: Where a child was conceived by a fertilisation procedure, the Regulations require donor particulars "if known" to be included on the birth registration statement and in the Register (r 5(ea), r 6(da)). This places donor identity fields into the core registration dataset where available.

• Health professionals: Doctors and midwives must provide the business address and particulars required in notices and statements about births (r 4(e), r 5(q)). Doctors must supply specified particulars when notifying a death (r 8). Where a doctor's certificate of cause of death is given, the funeral director’s statement must include the doctor’s name and business address (r 9(m)(i); r 10(n)).

• Funeral directors and persons responsible for disposal: Funeral directors (or persons providing statements under s 38) must include extensive particulars for disposal of human remains, including relationship status information for adult deceased persons, parental information for minors, and specifics for interments outside cemeteries (r 9). They must provide names and addresses of persons who give the Registrar statements and those who provided information (r 9(n), r 9(o)).

• Registrars and the Registrar’s office: The Registrar is responsible for making entries in the Register conforming to the prescribed particulars (r 6, r 7, r 7B, r 10), is authorised to use a facsimile of the signature and seal produced by computer (r 11), and may charge fees for non-prescribed services (r 12).

• South Australian Civil and Administrative Tribunal (SACAT): SACAT is conferred jurisdiction to review Chief Executive decisions under s 25A of the Act as prescribed in r 6A. This creates a formal administrative-review route affecting guardians, biological parents/co‑parents, and the child when decisions about a child are at issue.

• Law enforcement, prosecutorial and integrity agencies: The Regulations permit access to pre-change sex or gender identity information by a closed list of bodies, including South Australia Police, police forces of other States/Territories, Australian Federal Police, Australian Crime Commission, offices of Directors of Public Prosecutions (State/Commonwealth/other State/Territory), the Independent Commissioner Against Corruption, and the Office for Public Integrity (r 7D(d)(i)-(vi)). Access may be authorised to these bodies for particular purposes.

• Executors, administrators, spouses, parents and guardians: These private persons are included in the r 7D list and may be allowed access to pre-change sex or gender identity information (r 7D(a)-(c)).

• Legal practitioners authorised by persons: A legal practitioner may be allowed access if authorised by the person whose record is at issue, a child of the person, or persons listed in r 7D (r 7D(e)).

• Owners of private land used for interment and relevant land registries: Where remains are interred outside a cemetery on private land designated as a prescribed area, the Regulations force disclosure of the property address, certificate-of-title reference and GPS coordinates (r 9(ma), r 10(2)), affecting land owners and the Registrar’s recordkeeping obligations.

• Entities that interact with relationships and surrogacy laws: The Regulations draw on the Family Relationships Act, Relationships Register Act 2016 and Surrogacy Act 2019 for definitions, so persons in registered relationships, de facto relationships and parties to surrogacy orders are affected in how relationship status is recorded and treated in registration data (r 3; r 5(l), r 6(i), r 9(f), r 10(1)(h)).

Overall, data suppliers (parents, doctors, midwives, funeral directors), data controllers (Registrar), reviewers (SACAT), and a defined list of persons and public bodies that may be granted access to sensitive pre-change information are materially affected by the Regulations’ prescriptions and the Record's data model.

The Regulations impose precise duties on data suppliers and the Registrar, and create specific access rights and review rights for certain persons.

Duties:

• To supply specified particulars in a birth notice: A birth notice given under s 12(1) must include whether the child was born alive, date and place of birth, the child’s sex (if determined), the mother's name and usual residential address, and the name and business address of the doctor or midwife responsible for professional care (r 4). This is a supplier duty (typically the person required under s 12(1) of the Act).

• To provide comprehensive information in a birth registration statement: A birth registration statement lodged under s 14 must include gestation period, whether the child was live‑born, date/place of birth, sex, birth weight, name (if live-born), donor particulars if conceived via fertilisation procedure, multiple-birth details, parental names and birth names, parental birth dates/ages/occupations/addresses, periods of residence in Australia for parents born overseas, marriage/registered relationship particulars, previous children of parents and of mother by other persons, Indigenous status of parents, and the doctor/midwife’s name and business address (r 5). The statement must therefore collect substantial demographic and family-history data.

• To include prescribed particulars in Register entries: Entries under s 17(1) (births) and s 39(1) (deaths) must include the particular items set out in r 6 and r 10 respectively. For births, donor particulars are to be recorded where relevant and known (r 6(da)). For deaths, where remains are interred outside a cemetery the Register must record the property address, certificate-of-title reference and GPS coordinates (r 10(2)).

• For death notifications and disposal statements: A doctor’s notice under s 36(1) must include the deceased’s name, date of birth, age, sex/gender identity, date/place of death and Indigenous status (r 8). A funeral director’s statement under s 38 must include extensive biographical and relationship information, marriage and registered‑relationship history, occupation if 15 or older, previous children, parents’ names, and authorisation details where applicable (r 9).

• To supply particulars about interments outside cemeteries: Funeral directors must obtain the property address, certificate of title reference and GPS coordinates where remains were interred outside a cemetery or natural burial ground (r 9(ma); r 10(2)).

• To meet specified counselling thresholds where a person relies on counselling-only clinical treatment as "appropriate clinical treatment" for a change of sex or gender identity: The prescribed threshold is either at least three counselling sessions aggregating 135 minutes, or counselling sessions occurring over at least six months (r 7C).

Registrar duties and authorities:

• To make Register entries including the prescribed particulars for births, deaths, name changes and sex/gender identity changes (r 6, r 7, r 7B, r 10).
• To permit access to pre-change sex/gender identity information only to prescribed persons and bodies, and to legal practitioners authorised by the person or other authorised persons (r 7D).
• To use a computer-produced facsimile of signature and seal (r 11).
• To charge a fee for services related to registration that are not otherwise prescribed under the Act (r 12).

Rights and review mechanisms:

• Review rights via SACAT are created for specific applicants in relation to decisions under s 25A of the Act. A person who is a court-appointed guardian (Children and Young People (Safety) Act 2017), a biological parent or co‑parent (Family Relationships Act 1975), or the child, may apply to SACAT within 28 days after notice of the decision, or longer if the Tribunal allows (r 6A(2)-(3)). This is a statutory administrative-review right.

• Access rights: A closed category of people and bodies may be allowed access to information on, or extracts/certificates from, the Register showing a person's sex or gender identity before registration of a change (r 7D). Access is discretionary ("may be allowed"), and the list defines who is eligible for that discretionary access (r 7D(a)-(e)).

Limitations and qualifications embedded in duties:

• Many obligations are qualified by "if known" language, particularly for donor particulars in the context of fertilisation procedure conceptions (r 5(ea), r 6(da)). This explicitly recognises incomplete knowledge as a practical limit on data collection.

• Age-based triggers for particular items: the funeral director’s statement requires additional relationship and marital status information only if the deceased was of or over the age of 16 (r 9(f)) and occupation information if the deceased was of or over the age of 15 (r 9(h); r 10(1)(j)).

• The Regulations make certain items optional; the note in r 5 and r 6 about still-born children clarifies the birth registration statement "may, but need not" state a still-born child’s name, referencing s 21 of the Act.

The Regulations thus allocate clear data-supply responsibilities to parents and professionals, impose recording obligations on the Registrar, create a bounded administrative-review right via SACAT, and give a defined cohort of persons and public bodies potential access to sensitive pre-change identity information.

The Regulations themselves do not set out monetary penalties or criminal offences. They are framed as technical prescriptions that specify what particulars must be included in the statutory notices, statements and Register entries required under the Act. The Regulations repeatedly reference procedural obligations under the Act (for example notices under s 12(1) and statements under s 14 for births, notices under s 36(1) and statements under s 38 for deaths, entries under s 17(1) and s 39(1)), and therefore enforcement mechanisms and penalties for non‑compliance, if any, are provided in the principal Act rather than in these subordinate instruments. The Regulations’ function is to define content and process details rather than to recast the Act’s penalty regime.

The Regulations do, however, institute administrative controls which imply enforcement modalities or operational checks:

• Discretionary access to pre-change sex/gender identity information is limited to a specified list of persons and bodies (r 7D). The discretionary nature ("may be allowed") implies an administrative decision-making process within the Registrar’s office that will assess access requests against the list; enforcement here is procedural, only authorised categories may be permitted access. The Regulations identify the classes (r 7D(a)-(e)), which include law enforcement, prosecutorial and integrity bodies (r 7D(d)), and private persons with close connections to the subject (r 7D(a)-(c)). The Regulations do not outline the procedural steps for granting access (who decides or what test applies), but they do define eligible requestors.

• Review and internal oversight: The Regulations confer jurisdiction on SACAT to review Chief Executive decisions under s 25A of the Act (r 6A(1)). The availability of an external administrative review body provides an avenue to challenge Chief Executive decisions affecting children, and SACAT’s jurisdiction is an enforcement channel for reviewable decisions.

• Documentary authorisations for disposal: Where disposal authorisations or doctor’s certificates are required (for example a doctor’s certificate under s 36(3) or an authorisation issued under the Coroners Act 2003), the Regulations require the inclusion of the name and business address of the doctor, or the date and issuer of the Coroner’s authorisation, in the funeral director’s statement (r 9(m)). These fields create audit trails and enable verification and potential follow-up if discrepancies arise.

• Fees: The Registrar may charge a fee for services for which no fee is prescribed in the Act (r 12). While not a penalty, the ability to charge fees introduces a compliance cost for applicants and parties seeking Registrar services where Act-prescribed fees are silent.

Because the Regulations do not themselves create offences or penalties, those seeking a complete picture of enforceable sanctions for non-compliance must consult the Act. The Regulations’ design points to administrative enforcement, data checking, access control, and review by SACAT,rather than directly specifying penalties. The Regulations also create evidentiary and traceability obligations (for example inclusion of doctor/funeral director details and GPS coordinates for off‑cemetery interments) which will facilitate enforcement action under the Act or other statutes (for example Coroners Act or Burial and Cremation Act) where those statutes provide punitive consequences.

The Regulations are closely tied to, and repeatedly cross‑refer to, other South Australian and Commonwealth statutes. Explicit connections in the text create definitional dependencies and procedural linkages:

• Births, Deaths and Marriages Registration Act 1996 (the Act): The Regulations operate under the Act and reference numerous Act provisions (for example notices under s 12(1), statements under s 14, Register entries under s 17(1) and s 39(1), change-of-name provisions s 28(1), change-of-sex or gender identity provisions Pt 4A including s 29H and s 29M, and review provisions s 25A). The Regulations therefore function as the subordinate instrument that fills out the Act’s procedural and evidentiary requirements; any enforcement regime set out in the Act applies to the particulars and processes prescribed here.

• Family Relationships Act 1975 (Commonwealth): The meaning of "de facto relationship" and the term co‑parent used in respect of parents are imported from federal family law definitions (r 3). This affects how relationship status and parental status are captured on birth and death records (r 5(l), r 6(i), r 9(f), r 10(1)(h)).

• Relationships Register Act 2016: The Regulations use the term registered relationship as defined in that Act and require particulars about the place at which a registered relationship was entered into (r 3; r 5(l), r 6(i)). They permit reporting of corresponding law registered relationships in other jurisdictions (r 3).

• Surrogacy Act 2019: The definition of parent includes the parent of a child under an order under section 18 of the Surrogacy Act 2019, which brings into scope parents whose legal parentage arises through surrogacy orders (r 3).

• Burial and Cremation Act 2013: The Regulations reference "prescribed area" as that Act defines it (r 3). Where interment occurs in a prescribed area outside a cemetery or natural burial ground the Regulations require address, certificate-of-title reference and GPS coordinates to be included (r 9(ma), r 10(2)). This links the Registrar’s data obligations to the burial law regime.

• Coroners Act 2003: Where a disposal of human remains follows an authorisation under the Coroners Act, the funeral director’s statement must include the date of issue and the name of the person who issued it (r 9(m)(ii)). This creates an information bridge between coronial processes and registration records.

• Children and Young People (Safety) Act 2017: Court-appointed guardians as defined under s 38A of the Act are given standing to apply to SACAT to review decisions about children (r 3 and r 6A(2)(a)). The Regulations therefore align review rights with the guardianship framework in that Act.

• Legislation Revision and Publication Act 2002: The legislative history records that certain provisions were omitted or affected under that Act (Legislative history). The Regulations, through their legislative history, show iterative changes consistent with the broader statute revision regime.

Implications of these interactions:

• The Regulations’ definitions and eligibility criteria for certain rights and duties rely on external statutes, which means changes to those statutes may affect how the Registrar operates without an immediate amendment to these Regulations. For example, federal definitions of de facto relationship feed into the data fields that the Registrar must collect.

• The donor-information fields (r 5(ea), r 6(da)) interact with Commonwealth and State regimes concerning assisted reproductive technology and donor anonymity; the Regulations require recording donor particulars "if known" but do not purport to override donor privacy, consent regimes or any confidentiality protections that may exist under other statutes or contractual arrangements. Any conflict or interface between donor-recording obligations and other legal protections would need to be resolved by reference to the primary statutes and common law, which are not set out here.

• The Record’s access rules for pre-change sex/gender identity information intersect with investigative and prosecutorial agencies (r 7D(d)). That provides a legal conduit for those agencies to obtain previous sex or gender identity information when permitted, potentially in the course of law enforcement or anti-corruption activity.

• Coroners’ authorisations and burial law obligations are connected to the Register’s disposal entries, meaning coronial determinations and land-titling information will be incorporated into the Registrar’s records where applicable (r 9(m)(ii); r 10(2)).

• The SACAT conferral (r 6A) creates an administrative review interface aligning the administrative decisions of the Chief Executive under the Act with the Tribunal system, and the standing to apply is cross‑referenced to guardianship and family law statuses drawn from other Acts.

In short, the Regulations do not operate in isolation; they are a node within a network of family law, coronial, burial/land, surrogacy and tribunal statutes. Practitioners should therefore read these Regulations in tandem with the Act and with the cited statutes to understand fully how duties, rights and data flows interact across legislative schemes.

The Regulations include a detailed legislative history that documents the original 2011 instrument and multiple subsequent amendments and substitutions. The principal regulations were made in 2011 (Gazette 25.8.2011 p3698; commencement 1.9.2011: r 2) and have been varied repeatedly. The legislative history lists the amending instruments, their Gazette references and commencement dates, and provides a table of which provisions were varied by which instrument. Significant amendment milestones apparent from the record include:

• 2012-2016: Early variations and substitutions to schedules and definitions occurred in 2012 (100/2012, commencement 1.7.2012), 2013 (88/2013), 2014 (6/2014; 152/2014), 2015 (143/2015) and 2016 (113/2016; 225/2016). The 225/2016 instrument (commencement 17.9.2016) inserted fertilisation procedure and donor-related particulars into the birth information requirements (r 5 and r 6) and adjusted definitions (see Provisions varied: r 5, r 6 and the variation of Pt 2). The 6/2014 instrument added and later led to r 10(2) addressing interments outside cemeteries (1.2.2014 commencement).

• 2017: A cluster of changes occurred in 2017. Instrument 60/2017 (commencement 23.5.2017) introduced Part 3A (r 8 insertion) and varied a number of parts including r 4-7 and r 8-11. Instrument 214/2017 (commencement 25.8.2017) inserted definitions for "parent", "place", "registered relationship", and "de facto relationship" into r 3 and effected other changes to r 5, r 6 and r 9-r 10 as noted in the Provisions varied table. Instrument 357/2017 (inserted r 6A) conferred jurisdiction on SACAT to review Chief Executive decisions under the Act (commencement 22.10.2018 for that insertion).

• Part 3A creation: The material forming Part 3A dealing with registration of change of sex or gender identity was inserted by 60/2017 (commencement 23.5.2017), creating r 7A-7D. These provisions introduced recognised sex/gender categories (male, female, non-binary, indeterminate/intersex/unspecified), set the counselling-only threshold (r 7C), and prescribed who may access pre-change sex/gender identity information (r 7D).

• 2018-2020: Instruments in 2018 (139/2018; 175/2018), 2019 (76/2019), and 2020 (94/2020; 213/2020) further varied provisions. Notably, 94/2020 (commencement 1.7.2020) substituted r 12 and altered the Schedule content and deleted Sch 1 or Sch 2 in whole/part as recorded. Instrument 213/2020 (commencement 1.9.2020) varied definitions including "parent" (per the Provisions varied table).

• Ongoing updates to schedules and technical provisions: The legislative history shows repeated substitution and variation of schedules (Sch 1 and Sch 2) across multiple years (2012-2019) and the deletion of Sch 1 by 94/2020. The history also records technical omissions in r 2 under the Legislation Revision and Publication Act 2002 effective 1.7.2012.

The "Provisions varied" section in the legislative history enumerates specific regulation clauses that were inserted or varied and links those changes to the instrument numbers and commencement dates. For example:

• r 3 was varied to include "court appointed guardian" (225/2016 r 4, 17.9.2016), and later to include "de facto relationship" and "parent" (214/2017 r 4(1)-(2), 25.8.2017).
• r 5 and r 6 (birth particulars) were varied by instruments across 2016-2017: 225/2016, 60/2017, 214/2017.
• Pt 3A including r 7A-7D was inserted by 60/2017 r 8 on 23.5.2017.
• r 6A was inserted by 357/2017 r 4 with effect from 22.10.2018.

Historical versions of the Regulations are listed (from 1.7.2012 through 1.7.2020 and several interim dates), signalling that practitioners must consult the current consolidated text when advising. The legislative history entry also contains a note that references to other legislation or titles in the Regulations may be obsolete if those other enactments have changed, signalling the need to check cross-referenced Acts for current wording.

In short, the Regulations have been the subject of recurrent amendment, with particularly significant additions in 2016 (donor/fertility information), 2017 (Part 3A, recognised gender identities and access rules) and 2018-2020 (procedural tweaks and substitution of fees provision). The history identifies which clauses were moved or inserted by which instruments, allowing readers to trace the policy and technical evolution.

The text of the Regulations itself does not include any case law or a litigation history. There are no judicial decisions, tribunal determinations or litigation summaries referenced in the Regulations or in the legislative history supplied. The document records administrative and statutory changes, but it does not report any court or tribunal cases that interpret or apply these Regulations.

Practical consequences of the absence of litigation in the source:

• No precedent or appellate interpretation of the specific wording in these Regulations is provided within the instrument. Where questions of construction or conflict arise between the Regulations and the Act or other statutes, practitioners will need to look to decisions of courts or tribunals concerning the Act or related statutes, but none are cited here.

• The Regulations themselves create an administrative-review channel that is potentially significant in practice: r 6A confers jurisdiction on the South Australian Civil and Administrative Tribunal to review Chief Executive decisions under s 25A of the Act, and identifies who may apply (court-appointed guardians, biological parents/co-parents, or the child) and the 28-day application period (r 6A(1)-(3)). That provides a foreseeable forum (SACAT) where disputes about the Registrar’s decisions and Chief Executive actions can be litigated or otherwise adjudicated administratively. The source specifies SACAT jurisdiction but does not include any SACAT decisions or further procedural details.

• Where enforcement or disputes involve penalties or offences, the operative penalty provisions are located in the principal Act or other statutes cited (for example Coroners Act, Burial and Cremation Act), none of which are contained within the Regulations text provided. For litigation outcomes on issues such as donor-info disclosure, access to pre-change records, privacy challenges, or the sufficiency of "appropriate clinical treatment", practitioners will need to consult case law databases and relevant tribunal/judicial decisions not contained in the instrument.

• Users of these Regulations should therefore treat the text as the authoritative operative instrument for prescribed particulars and administrative mechanics, but should complement it with searches for case law under the Births, Deaths and Marriages Registration Act 1996 and related statutes to discover any judicial interpretation that bears on the application of these particular regulations.

In summary, no litigation history is recorded in the Regulations; however, the instrument creates specific administrative review rights (SACAT, r 6A) which provide a predictable forum in which litigation or review may occur, and practitioners will need to canvass external jurisprudence for interpretation and enforcement developments not reflected in the Regulations themselves.

Several practical pitfalls and operational frictions are embedded in the Regulations’ detail. The following items are concrete rules, omissions and tensions to watch for in practice.

Donor information is conditional and may be missing: The Regulations require donor particulars for births conceived by fertilisation procedures only "if known" (r 5(ea), r 6(da)). Practitioners should not assume donor data will be available; the "if known" qualification limits data completeness and creates uncertainty for registrars and downstream users. For donor‑conceived persons seeking records, the presence of donor data in the Register will depend on whether it was known and provided at registration.

“Place” may be a general location: The definition of place requires either an address or, where none exists, "a statement identifying the general location" (r 3). For births, deaths or relationship entries occurring in unaddressed locations (for example remote sites), a generic location statement will suffice, but that may present complications for later verification or law enforcement needs that depend on precise addresses.

Still‑born naming optionality: In the case of a still‑born child, the registration statement "may, but need not" state the child's name (r 5 note; r 6 note). This optionality affects record completeness and the ability of parents/others to obtain documentation that records a name for a still-born child; practitioners need to advise clients about this choice and its consequences for certificates.

Pre-change sex/gender identity access list is relatively broad and discretionary: The Regulations permit access to pre-change sex/gender identity information to an enumerated list of persons and bodies (r 7D). That list includes spouses/domestic partners, parents/guardians, executors/administrators and several law-enforcement and prosecutorial agencies (r 7D(a)-(d)). The provision is discretionary ("may be allowed") and permits a legal practitioner authorised by the person or certain others to access records (r 7D(e)). In practice practitioners should ensure rigorous authorisation protocols and careful recordkeeping of who has been granted access. The presence of multiple state and federal investigative agencies in the list means that access can be sought for investigative purposes; the procedure and test for authorising access are not detailed in the Regulations.

Counselling thresholds are precise and potentially restrictive: For situations in which counselling-only is relied upon as "appropriate clinical treatment" for a change of sex/gender identity, the Regulations prescribe either at least three separate counselling sessions aggregating 135 minutes, or counselling over at least six months (r 7C). The numeric threshold (135 minutes over three sessions) or the temporal threshold (six months) are rigidly stated; practitioners should ensure evidence presented meets one of these exact permutations, because the Regulations tie their meaning to section 29H(3) of the Act.

Age thresholds for death particulars vary: For deaths, the requirements vary by age: marital and registered relationship data are required only if the deceased was of or over age 16 (r 9(f); r 10(1)(h)), and occupation is required if the deceased was of or over age 15 (r 9(h); r 10(1)(j)). These discrete age thresholds may be overlooked by providers preparing s 38 statements and can result in incomplete records if not properly checked.

Interment outside cemeteries requires land‑titling details and GPS coordinates: For remains interred in a prescribed area outside a cemetery or natural burial ground, the funeral director’s statement and Register entry must include the property address, the certificate of title reference, and the GPS coordinates of the interment site (r 9(ma); r 10(2)). Failure to collect property-title references or GPS coordinates will leave the statement non-compliant. In practice contractors and funeral directors may need protocols to obtain title references or to arrange accurate GPS capture.

Registrar fee discretion may create unpredictability: The Registrar may charge a fee for providing a service related to the registration of a registrable event where no Act-prescribed fee exists (r 12). This creates a domain of fees determined by the Registrar rather than by Parliament, so practitioners should check the Registrar’s published fee schedule for any services that appear to fall into this gap.

Facsimile signature authorised: The production of a facsimile of the Registrar’s signature and seal by computer is an authorised method (r 11). While convenient, reliance on computer-produced facsimiles requires suitable record‑management and cyber‑security protocols to prevent forgery or unauthorised reproduction; the Regulations authorise the technique but do not prescribe the technical safeguards.

Conferral of SACAT jurisdiction has a short time limit: An application for review to SACAT of a Chief Executive decision relating to a particular child must be made within 28 days after notice of the decision (r 6A(3)). Practitioners must be alert to the short limitation period; SACAT may allow longer periods but that is discretionary.

Definitions cross‑referenced to other Acts: Key definitions (for example "de facto relationship", "fertilisation procedure", "parent", "registered relationship") are imported from other statutes (r 3). Changes in those external Acts, or differing interpretations, will affect how the Registrar must treat those categories. Practitioners must therefore consult the current versions of the cross‑referenced Acts when advising clients.

Limited procedural detail for access decisions: The Regulations specify who may be allowed access to pre-change information (r 7D) but do not set out the process for deciding or documenting access, nor do they set out appeal mechanisms in relation to access decisions. This leaves a procedural gap that registrars, requestors and advisers must navigate with reference to the Act and administrative practice.

Taken together, these "gotchas" are operational and legal friction points that will need handling in practice: data incompleteness, precise evidence thresholds, age-based detail differences, and discretionary access decisions implemented without detailed procedural rules.

To ensure compliance with the Regulations, data suppliers (parents, doctors, midwives, funeral directors) and the Registrar should adopt systematic processes that capture all prescribed particulars, meet evidentiary thresholds, control access to sensitive pre-change information and document decisions. Below are concrete compliance steps tied to regulation numbers.

For births (r 4-r 6):

• At the point of birth notification under s 12(1), ensure notices include whether the child was born alive, date and place of birth, the child’s sex if determined, mother’s name and usual residential address, and the name and business address of the doctor or midwife responsible for the mother’s care (r 4). Design standardised forms that prompt for each field.

• When preparing a birth registration statement under s 14, collect and record gestation period (weeks), whether the child was born alive, date/place of birth, sex if determined, birth weight in grams, name (if baby was born alive), and multiple-birth details (total number and order) (r 5(a)-(f)). Include fields for previous children of parents and of the mother by other fathers (r 5(m)-(n)), and Aboriginal or Torres Strait Islander status of mother and father (r 5(o)-(p)).

• If conception occurred via a fertilisation procedure, capture donor-related particulars where known: donor name (if known), donor sex or gender identity (if known), and donor date and place of birth (if known) (r 5(ea)). Ensure consent/recording practices reflect existing ART/assisted reproduction confidentiality regimes where applicable.

• Record parental details precisely: mother’s and father’s names (including birth/adoption birth names where different), dates/ages of birth, place of birth, occupation and usual residential address; and if parents were born overseas record the period(s) of residence in Australia in aggregate (r 5(g)-(k)).

• Implement data validation checks for fields such as "place" where an address may be absent; in such cases capture a general location description as defined in r 3.

• For Register entries, ensure that all items specified in r 6 are recorded, including signatures of persons who signed the birth registration statement and their relationships to the child (r 6(k)).

For change of name and change of sex/gender identity (r 6A, r 7, r 7A-7D):

• For change of name entries, include the person’s name immediately before registration (and any previously registered names), the name after registration, date and place of birth, sex or gender identity, and the date the entry was made (r 7).

• For change of sex or gender identity, ensure Register entries contain the person’s name, the sex or gender identity following registration (one of the recognised categories in r 7A), date and place of birth, and the date of entry (r 7A, r 7B).

• When relying on counselling-only to meet the "appropriate clinical treatment" requirement, ensure documentary evidence meets one of the two prescribed tests: at least three separate counselling sessions aggregating 135 minutes, or counselling over at least six months (r 7C). Record the dates/duration of sessions and the qualifications of counsellors as part of the evidentiary package.

• Implement an access-request protocol for pre-change sex/gender identity information that verifies the requester’s eligibility under r 7D, records authorisations from the person, child or eligible third parties where a legal practitioner seeks access, and preserves an audit trail of decisions to grant or deny access.

For deaths and disposal of remains (r 8-r 10):

• Doctors notifying deaths must provide the deceased’s name, date of birth, age at last birthday, sex/gender identity (if known), date/place of death, and Indigenous status (r 8). Hospitals and practitioners should have a checklist to ensure these data items are completed.

• Funeral directors and those giving statements under s 38 must capture extensive particulars (r 9); implement forms that capture marriage/relationship histories for those aged 16 or older, de facto relationships, lists of children and parents, occupation if 15 or older, and any doctor’s certificate or coronial authorisation details (r 9(f)-(m)). For disposals outside cemeteries, ensure collection of property address, certificate of title reference and GPS coordinates (r 9(ma); r 10(2)).

• Ensure the Register’s death entry includes cause of death as certified by a doctor under s 36(3) and the length of time that the deceased had the illness or condition that caused death (r 10(1)(n)).

Registrar processes and administrative matters (r 11, r 12):

• Use an authorised facsimile signature/seal produced by computer in accordance with r 11. Put in place technical controls to protect the facsimile, log its use, and ensure only authorised staff can produce Registrar-signed documents.

• Publish or make available the Registrar’s fee policy for services not otherwise prescribed under the Act, because r 12 authorises charging fees for such services. Ensure fees are transparent and recorded in invoices and receipt processes.

Review and appeal steps (r 6A):

• Ensure decisions that are reviewable under s 25A of the Act are accompanied by written notices that enable affected parties to exercise their r 6A SACAT rights. Where the decision relates to a particular child, inform potential applicants (court-appointed guardians under Children and Young People (Safety) Act 2017, biological parents/co-parents, and the child) of the 28-day application period (r 6A(2)-(3)).

Record‑keeping, privacy and information security:

• Because the Regulations require sensitive data (for example pre-change sex/gender identity, donor details, Indigenous status), implement robust access controls consistent with r 7D: only authorised persons and bodies should obtain pre-change information and every access should be logged, justified and documented.

• Maintain a retention/archiving policy aligned to the Act and to other applicable legal requirements (the Regulations do not specify retention periods). Ensure that when donor or other personal data is collected, appropriate consent or privacy assessments are recorded.

Operational checklists and staff training:

• Create standard operating procedures and checklists for each category of event: birth notifications and statements, death notifications and s 38 statements, change-of-name filings, change-of-sex/gender-identity filings, and interments outside cemeteries. Embed prompts for optional matters (for example still-born child naming) and age-based triggers for additional particulars.

• Train staff on the precise counselling thresholds in r 7C, the "if known" donor fields in r 5(ea)/r 6(da), and the authorised access list in r 7D, so that evidence and access requests are not rejected or granted in error.

Cross-referencing and legal alignment:

• Because several definitions and procedures rely on other statutes (r 3), ensure compliance checks reference the current statutory text of the Family Relationships Act 1975, Relationships Register Act 2016, Surrogacy Act 2019 and Burial and Cremation Act 2013 where the Regulations import definitions or refer to those regimes.

By implementing precise data-capture templates, evidence standards consistent with r 7C, restricted access procedures for pre-change information, and clear fee and signature controls, registrars and data suppliers can operationally comply with the Regulations’ prescriptions and create an auditable trail for review and enforcement.
