Births, Deaths and Marriages Registration Regulation 1998

Determinability of sex: Several provisions condition the inclusion of a child's sex on whether the sex is “determinable” (s 4(1)(b); s 5(1)(b)). The regulation does not define “determinable” locally; the concept functions as an operational trigger that allows omission where sex cannot be reasonably recorded at birth.

Parental roles and naming: The regulation uses the term “birth parent” as defined in the Act (Dictionary: “birth parent,see the Act, section 4B”). It permits use of “mother” or “father” to describe either or both parents in the registration particulars (s 5(2)). That drafting choice is a mechanism to reconcile biological, legal and social parentage in the register fields.

Multiple births and stillborns: The regulation creates nuanced rules for multiple births and stillbirths. It allows a stillborn child to be omitted from a multiple birth entry if there was no heartbeat before 20 weeks gestation and, after consulting the other parent, the birth parent decides not to include the stillborn child (s 5(3)). Similarly, particulars of a stillborn need not be given in the list of other children of the relationship where the same conditions apply (s 5(4)). The regulation also expressly allows the birth parent to avoid consulting the other parent where consultation is not reasonably practicable or appropriate, and provides illustrative examples (s 5(5)).

Substitute parental responsibility and consent: Section 8 prescribes who must give consent in particular care and guardianship circumstances. The regulation implements the Act’s references to “a stated person with parental responsibility” by mapping specific statutory situations to the individual(s) who must consent (s 8(2) and table 8). Cross‑statutory particulars: For civil unions and civil partnerships the regulation prescribes an expanded set of particulars tied to the relevant registering Acts: Civil Unions Act 2012 particulars for registration and ending of civil unions (ss 8A, 8B), Civil Partnerships Act and Domestic Relationships Act particulars for civil partnerships and their endings (ss 8C, 8D). Birth parents and other parents: Birth parents must provide or be the subject of the particulars listed in s 4 and s 5. The regulation requires the name and residence of the birth parent (s 4(1)(g)), and for registration requires names, former names, occupations and places of birth for parents (s 5(1)(f)-(i)). Duties to notify and register births

• Notification: The person giving notice of a birth must provide the particulars listed in s 4(1): hospital name if the child was born in, or brought to, a hospital within 24 hours (s 4(1)(a)); sex if determinable (s 4(1)(b)); date of birth (s 4(1)(c)); live or stillborn status (s 4(1)(d)); weight in grams (s 4(1)(e), s 4(2)(a)); period of gestation in completed weeks where stillborn (s 4(2)(b)); multiplicity (s 4(1)(f)); name and place of residence of the birth parent (s 4(1)(g)); name of doctor or midwife responsible (s 4(1)(h)); adoption indication if known (s 4(1)(i)); and name and occupation of the person giving notice (s 4(1)(j)).
• Registration: The registrant (or person supplying information for registration) must provide the more extensive particulars in s 5(1), including child’s name (s 5(1)(a)); sex if determinable (s 5(1)(b)); date and place of birth (s 5(1)(c)); live or stillborn status (s 5(1)(d)); multiplicity and sequencing where multiple birth (s 5(1)(e)); parent particulars including former names, occupation and place of residence (s 5(1)(f)-(i)); parents’ relationship status and, where married/civil unioned/civil partnered, date and place of that relationship (s 5(1)(j)-(k)); names and ages of other children of the relationship (s 5(1)(l)); number of deceased children of the relationship (s 5(1)(m)); name of at least one witness to the birth (s 5(1)(n)); and particulars of the person providing the information (s 5(1)(o)).

Duties in special birth circumstances

• Multiple births and stillbirths: The regulation allows omission of particular stillborn children in multiple births where the child showed no sign of a heartbeat before 20 weeks gestation and the birth parent, after consulting the other parent where reasonably practicable and appropriate, decides not to include the child (s 5(3)-(4)). The regulation creates an obligation on the birth parent to consult the other parent unless consultation is not reasonably practicable or appropriate, and provides factual examples where consultation may be omitted (s 5(5)).

Duties for change entries and sex alterations

• Change of name entries: Under s 5A the person lodging a change‑of‑name entry must supply prior names, the name shown on the original birth certificate, the changed name, sex and date/place of birth of the person, and the names and former names of the person’s parents (ss 5A(a)-(g)).
• Altering register for change of sex: An applicant under Act s 24(1) or s 24(2) must provide the particulars in s 6(1): name, former names, place of residence, date and place of birth (s 6(1)(a)), parent names if known (s 6(1)(b)-(c)), and the sex shown on the original birth certificate (s 6(1)(d)).

Duties for funeral directors and disposition of remains

• Notification of death by funeral director: Section 9(1) lists the specifics to be provided: date and place of death, sex, date/place of birth, Indigenous status (with the tripartite test in s 9(2)), usual occupation, length of time in Australia if born outside Australia, domestic partnership information, children's details, parents’ particulars, disposal date, and identity and address of funeral director who arranged the disposal (s 9(1)(a)-(o)).

Rights and authorised access

• Persons who may request that information about sex be shown on a birth certificate are prescribed in s 7: a parent or person with parental responsibility for the person; an executor or administrator of the person’s estate; and a lawyer authorised by such a person (s 7(a)-(c)). The regulation therefore contains an express right to seek sex information on a certificate, limited to enumerated classes.
• Persons with parental responsibility: The table in s 8 gives a right/duty to consent to specified applications to persons holding certain statutory responsibility. Practical enforcement drivers: The most likely enforcement mechanisms in day‑to‑day practice are (a) prosecution for failure to supply required particulars where the Act makes that an offence; (b) administrative consequences such as refusal or delay in registration where particulars are incomplete; and (c) corrective entries or amendments where incorrect particulars are detected. The regulation increases enforceability by reducing ambiguity about what information must be supplied and recorded.

Penalty quantum and parties: The stated penalty unit values apply to offences against the law as a whole at the republication date; therefore, where the Act prescribes a number of penalty units for an offence, multiply by $160 for individuals and $810 for corporations to calculate fines.
