Births, Deaths and Marriages Registration (Fees) Regulations 2019

The Regulations rest on a small set of statutory and administrative concepts.

• Fees expressed in fee units. Schedule 1 prescribes many fees as a multiple of a fee unit (for example, 5.18 fee units). The explanatory details explain that the fee-unit concept is taken from the Monetary Units Act 2004 and the monetary amount of a fee is calculated by multiplying the prescribed number of fee units by the current value of a fee unit (explanatory details, fee units paragraph; see also the reference to section 7 of the Monetary Units Act 2004).

• Nil fees for specific sensitive processes. Schedule 1 lists several applications as attracting a nil fee: applications to alter the sex recorded in a person’s birth registration (item 3, s 30A(3)(c)(ii)), the equivalent application for a child (item 3A, s 30B(3)(c)(ii)), applications for documents acknowledging a person’s or child’s name and sex (items 4 and 4A, s 30E(4)(d) and s 30EA(4)(d) respectively), and an application for search of the Register (item 6, s 45(2)(b)). Where a nil fee is prescribed, the Regulations do not require payment.

• Differentiation between searches and certified evidence. Schedule 1 distinguishes between an application for a search of the Register (item 6, nil) and the issue of a certificate certifying the results of a search (item 7, 3.42 fee units). This means a search as an administrative action is not charged under item 6, but an official certificate of results is charged under item 7.

• Historic-record exception for inspection and certified copies. Item 8 refers to inspection of and supply of certified copies of an entry in a register or related book that is in the possession of another person and not forwarded to the Registrar under s 31 of the Marriage Act 1898, relating to the period before 18 January 1853; that service is nil. The Schedule therefore explicitly treats certain historic marriage-entry materials as attracting no fee.

• Link to the principal Act. Regulation 5 makes the fees “for the purposes of the Act” those set out in Schedule 1. The Schedule explicitly cross-references sections of the Births, Deaths and Marriages Registration Act 1996 for each feeed activity. The Regulations therefore operate as subordinate secondary legislation that implements the fee dimension of statutory functions created by the Act.

• Annual and publication mechanics. The explanatory details state the Treasurer fixes the value of a fee unit under s 5 of the Monetary Units Act 2004 and must publish that value in the Government Gazette and a Victorian newspaper before 1 June preceding the financial year for which it applies. The Regulations also state that the amount of a calculated fee may be rounded to the nearest 10 cents.

• Sunset and amendment. The endnotes record that these Regulations will sunset 10 years after making under the Subordinate Legislation Act 1994, and the Table of Amendments shows the Regulations have been amended three times to date. The Schedule itself records which SR provisions amended it.

These main concepts determine how monetary obligations are identified, computed and updated, and which categories of application are exempted from payment.

Who pays. Natural or legal persons who make applications or requests listed in Schedule 1 will be affected to the extent a monetary fee applies. Schedule 1 identifies categories of application that attract a fee and categories that are nil. Examples of fee-bearing items are: applications to register a change of name (adult and child), which are each prescribed at 5.18 fee units (items 1 and 2, s 25(2) and s 26(2)); and the issue of a certificate certifying results of a search, at 3.42 fee units (item 7, s 46(1)). The person seeking the certificate will therefore incur the fee expressed in fee units converted to dollars for the relevant financial year. Item 5 prescribes a fee of 5.18 fee units for an application to add, alter or delete registrable information to an entry in the Register (item 5, s 43(6)). The Regulations therefore place monetary cost on name-change applicants and persons seeking formal amendments to register entries.

Who does not pay. Several categories are explicitly nil in Schedule 1, meaning no fee is prescribed by these Regulations for those services. Applications to alter the recorded sex in a person’s or child’s birth registration (items 3 and 3A, s 30A(3)(c)(ii) and s 30B(3)(c)(ii)) and applications for documents acknowledging name and sex (items 4 and 4A, s 30E(4)(d) and s 30EA(4)(d)) are nil. An application for search of the Register (item 6, s 45(2)(b)) is nil under the Schedule, while a formal certificate certifying the results of a search is charged (item 7). Inspection of and supply of a certified copy of certain historic marriage-related entries in the possession of another person relating to the period before 18 January 1853 is nil (item 8, s 57(3)). For those applications and services, the Regulations do not prescribe a monetary impost.

Administrative actors. The Treasurer is the executive actor who sets the dollar value of a fee unit annually under the Monetary Units Act 2004 and is required to publish that value in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year (explanatory details). The Registrar under the Births, Deaths and Marriages Registration Act 1996 will be the administrative recipient of applications and will operate under the Act; these Regulations do not specify internal Registrar procedures for payment, but they define which activities attract fees and how the fee amount is to be calculated.

Recipients and third parties. Item 8 concerns entries in the possession of “another person” which have not been forwarded to the Registrar under s 31 of the Marriage Act 1898. That addresses private custodians of historic register material. The Schedule therefore affects owners or custodians of such material insofar as it prescribes nil fees for inspection and certified copies of very early marriage-related registers.

Small-dollar scope. The monetary quantum per Schedule item is modest once translated into dollars via fee units. The explanatory details state that the fee unit for the financial year commencing 1 July 2025 is $16.81; converting the 5.18 fee unit items yields $87.0758, rounded to the nearest 10 cents gives $87.10, and converting the 3.42 unit item yields $57.4902, rounded to $57.50. Those calculations show the financial scale of the fees prescribed at that fee-unit value, but those dollar amounts will change when the Treasurer fixes a different fee-unit value for another financial year.

Who decides. The Schedule shows the Legislature (Governor in Council via subordinate regulation) decides which fees apply and their fee-unit quantum. The Treasurer decides the annual value of a fee unit under the Monetary Units Act 2004 and must publish it publicly prior to the relevant financial year. The Registrar implements the fees by processing applications under the principal Act.

Duties imposed by the Regulations are narrow and technical. The instrument does not impose new regulatory duties of conduct; instead it prescribes monetary charges for specific statutory actions under the principal Act and sets the mechanism for converting fee-unit figures into dollar amounts.

Duty to pay where fee prescribed. Where Schedule 1 prescribes a fee in fee units for a particular application or service, the person who seeks that service will bear the obligation to pay the corresponding dollar amount. The Regulations themselves do not specify payment timing, accepted payment methods, or enforcement mechanisms; those procedural details are likely to be governed by the Act and administrative practices of the Registrar. The relevant prescription is regulation 5: “For the purposes of the Act, the fees are those set out in Schedule 1.”

Duty to calculate fees using fee units. The explanatory details make it clear that the monetary amount of a prescribed fee is to be calculated by multiplying the number of fee units specified in Schedule 1 by the value of a fee unit, in accordance with section 7 of the Monetary Units Act 2004. The Regulations therefore import the calculation duty: any administrator or applicant calculating the payable amount must use the Treasurer’s fee-unit value for the financial year concerned and apply the multiplication rule under s 7 of the Monetary Units Act 2004 (explanatory details).

Duty to observe rounding. The explanatory details state that the amount of a calculated fee may be rounded to the nearest 10 cents. Those performing the calculation are therefore obliged to round the calculated dollar amount in accordance with that instruction.

Right to access certain services without fee. Schedule 1 confers a de facto right to make certain applications without paying a fee, because the Schedule prescribes nil for those items. Notable nil items include applications concerning alteration of sex on a person’s or child’s birth registration (items 3 and 3A), applications for a document acknowledging a person’s or child’s name and sex (items 4 and 4A), and applications for a search of the Register (item 6). Where nil is prescribed, the Regulations do not create a monetary barrier.

Right to verified certification for a fee. The Schedule creates a concrete right to obtain a certificate certifying the results of a Register search, but that right is subject to payment where item 7 prescribes a fee. The entitlement to a certificate remains, but it is tied to a fee expressed in fee units.

Publication obligation affecting users. The explanatory details impose an informational requirement on the Treasurer, not on applicants, by requiring publication in the Government Gazette and a Victorian newspaper of the fee-unit value before 1 June preceding the financial year. That is a right for users who wish to confirm the applicable fee-unit value for the year, and a duty for the Treasurer to make the information publicly available.

No express procedural duties for payment in the Regulations. The Regulations do not set out payment procedures, timeframes for payment, refund arrangements, or late-payment consequences. Those procedural rights and duties must be sought in the principal Act or administrative rules; they are not contained in this instrument.

In summary, the Regulations impose the duty to pay where a fee-unit quantum is specified and they set the calculation and rounding mechanism, while conferring nil-fee access for certain sensitive or historic processes. The procedural and enforcement details for paying, collecting and refunding fees fall outside the text of the Regulations.

The Regulations themselves do not create offences, penalties or enforcement mechanisms. The statutory text is limited to prescribing fees (regulation 5 and Schedule 1), stating the authorising provision (regulation 2), commencement (regulation 3), and a definition (regulation 4). There are no penalty clauses or enforcement provisions in the Regulations’ text as published.

Enforcement of payment obligations and consequences for non-payment are therefore matters outside this instrument. The Schedule cross-references sections of the Births, Deaths and Marriages Registration Act 1996 for the underlying services to which the fees relate. Any sanction, refusal, withholding of service, or administrative procedure for non-payment would need to be sought in the principal Act or in the Registrar’s procedural instruments; those are not part of this subordinate regulation and are not reproduced here.

Similarly, the Regulations adopt the fee-unit calculation method from the Monetary Units Act 2004 and require publication of fee-unit values by the Treasurer under that Act. The explanatory details reference sections 5 and 7 of the Monetary Units Act 2004, which govern fee-unit valuations and calculations. The Monetary Units Act 2004 may contain its own enforcement and compliance provisions relating to fee-unit administration; those are not contained in these Regulations but the explanatory details signal reliance on that Act for calculation mechanics.

Where Schedule 1 prescribes nil fees, there is nothing in these Regulations to permit charging a fee for those items. Administrative practice would need to implement nil-fee treatment for the listed items; if a registrar or agency sought to impose a fee contrary to the Schedule, the dispute would turn on the Act and the Regulations as the primary instruments, not on this regulation creating additional penalties.

The endnotes and Table of Amendments show that Schedule 1 has been amended by subsequent statutory rules. Non-compliance with the updated Schedule by officials would be a matter of administrative law and statutory interpretation; the Regulations themselves do not set out enforcement steps for officials who fail to apply the current Schedule. The Subordinate Legislation Act 1994 governs sunsetting of the Regulations and related procedural mechanisms for subordinate instruments; endnote 1 notes that the Regulations will sunset 10 years after the day of making. Non-compliance with publication requirements by the Treasurer under the Monetary Units Act 2004 (for example failing to publish the fee-unit value before 1 June) would be governed by that Act and general administrative law remedies, not by these Regulations.

In short, these Regulations prescribe monetary amounts and mechanics but do not establish penalties or an enforcement regime within their text; enforcement questions must be resolved by reference to the principal Act and other referred statutes cited in the explanatory details.

These Regulations are expressly subordinate to and operate in conjunction with several other statutes.

Births, Deaths and Marriages Registration Act 1996. The Regulations are made under section 59 of that Act (regulation 2) and give effect to fee obligations “for the purposes of the Act” (regulation 5). Schedule 1 links each fee to a specific section of the Act (for example s 25(2), s 26(2), s 30A(3)(c)(ii), s 43(6), s 46(1) and s 57(3)). Accordingly, these Regulations cannot be read in isolation: they only set the financial terms attached to statutory powers and procedures established by the principal Act.

Monetary Units Act 2004. The explanatory details make clear that fees are expressed by reference to fee units under the Monetary Units Act 2004 and that the amount of a fee is to be calculated in accordance with s 7 of that Act by multiplying the fee-unit quantity by the value of a fee unit. The Treasurer fixes the fee-unit value under s 5 of that Act. The Regulations therefore rely on the Monetary Units Act 2004 to convert Schedule figures into dollar amounts for any given financial year. The explanatory details further state that the Treasurer must publish the fee-unit value in the Government Gazette and a Victorian newspaper before 1 June preceding the financial year. That imposes an interlocking publication and timing regime derived from the Monetary Units Act 2004.

Subordinate Legislation Act 1994. The endnotes state that the Regulations will sunset 10 years after the day of making under s 5 of the Subordinate Legislation Act 1994. That is an automatic expiry mechanism external to the Regulations. Users and administrators must therefore track the Subordinate Legislation Act timetable when relying on these Regulations over the long term.

Interpretation of Legislation Act 1984. The endnotes contain commentary on the Interpretation of Legislation Act 1984 (ILA) and its effects on style, headings, examples and punctuation. Those notes are standard publication material but they indicate that headings, notes, punctuation and examples included in this Statutory Rule are part of the instrument under the ILA where applicable. The explanatory endnotes relying on the ILA modify how the instrument is to be read and located.

Marriage Act 1898. Item 8 in Schedule 1 cross-references s 31 of the Marriage Act 1898 in its description of entries “in the possession of another person which has not been forwarded to the Registrar under section 31 of the Marriage Act 1898, relating to the period before 18 January 1853.” That shows a specific interaction with historic material governed by the Marriage Act 1898 and identifies a particular subset of records for which inspection and certified copies are nil.

Publication law and administrative law. The Treasurer’s obligation to publish fee-unit values in a Gazette and a Victorian newspaper before 1 June creates an interface with publication requirements under administrative and public information law; compliance with that obligation affects users’ ability to determine current fee amounts. Any failure by the Treasurer to publish may be challenged under administrative law principles, though the Regulations do not set out remedies.

In practice, to apply these Regulations correctly one must consult the principal Act to determine eligibility and procedural steps for the application or service, consult the Monetary Units Act 2004 to obtain the fee-unit value and the method for calculating fees, and monitor Subordinate Legislation Act deadlines for sunsetting and any amendments recorded in the Table of Amendments. The Regulations are therefore a narrow but necessary link between programme design (the Act) and the practical cost to users (fee units and Treasurer determinations).

The Regulations have been amended since being made in 2019. The front matter shows the version incorporates amendments as at 11 November 2025 and the Table of Amendments sets out the subordinate instruments that altered the original Statutory Rule.

Original making and commencement. The Regulations were made on 10 September 2019 by the Governor in Council under section 59 of the Births, Deaths and Marriages Registration Act 1996 and came into operation on 21 September 2019 (endnote 1, General information; regulation 3). The instrument was designated S.R. No. 78/2019.

Post‑making amendments. The Schedule itself records that Sch. 1 was amended by S.R. Nos 25/2020 reg. 8, 9/2022 reg. 4, and 117/2025 reg. 3. The Table of Amendments provides more granular publication information:

• Births, Deaths and Marriages Registration and Births, Deaths and Marriages Registration (Fees) Amendment Regulations 2020, S.R. No. 25/2020: date of making 21 April 2020; commencement details show reg. 8 on 1 May 2020 (and reg. 3 for commencement of other provisions).

• Births, Deaths and Marriages Registration (Fees) Amendment Regulations 2022, S.R. No. 9/2022: date of making 15 February 2022; date of commencement 1 March 2022 (reg. 3).

• Births, Deaths and Marriages Registration (Fees) Amendment Regulations 2025, S.R. No. 117/2025: date of making 11 November 2025; date of commencement 11 November 2025.

The schedule notes at the head of the instrument indicate the current Version No. 004 incorporates amendments up to 11 November 2025.

Sunset. The endnotes state these Regulations will sunset 10 years after the day of making on 10 September 2029 under section 5 of the Subordinate Legislation Act 1994. That is an automatic expiry provision that obliges either re-making, revocation, or replacement of the instrument before or upon that date if the regime is to continue.

Publication of fee-unit value. The explanatory details record an administrative amendment mechanism external to the instrument: the Treasurer fixes the value of a fee unit for each financial year under the Monetary Units Act 2004, and must publish that value in the Government Gazette and a Victorian newspaper before 1 June preceding the financial year. The value for the financial year commencing 1 July 2025 is recorded as $16.81 in the explanatory details; this is not an amendment to the Regulations’ text but rather a published figure used to calculate fees.

Practical note on amendments. Because the Schedule is expressed in fee units and because the Legislature has amended the Schedule by subsequent SRs, practitioners must check the current consolidated version and recent statutory rules when calculating fees or advising clients. The Schedule itself records which items were amended by which SR paragraphs (Sch. 1 amended by S.R. Nos 25/2020 reg. 8, 9/2022 reg. 4, 117/2025 reg. 3), and the Table of Amendments gives the dates of making and commencement for those instruments.

In short, the Regulations were made in September 2019, have been amended at least three times (2020, 2022, 2025), and will sunset automatically on 10 September 2029 unless re-enacted or replaced.

This statutory instrument contains no reported litigation history, case citations, or references to judicial interpretation in its text. The document supplied is a consolidated regulatory instrument with endnotes, amendments and explanatory details; it does not include any decisions of courts or tribunals.

Because the Regulations are ancillary to the Births, Deaths and Marriages Registration Act 1996 and rely on the Monetary Units Act 2004 for fee-unit valuation, any litigation arising from application or interpretation of fees would most likely concern (a) whether a particular application falls within a Schedule item, (b) the correct calculation of a fee given the fee-unit value for a financial year, (c) whether a nil fee applies, or (d) procedural disputes about payment and supply of documents. None of those matters is litigated or referred to within this instrument. The Regulations do not record any judicial determinations about their construction.

Practitioners should therefore take away that:

• The Regulations themselves supply no precedent or judicially elaborated wording. To locate litigation bearing on fee disputes one would need to search judicial decisions under the principal Act (Births, Deaths and Marriages Registration Act 1996), decisions concerning the Monetary Units Act 2004 (if fee-unit publication or calculation is disputed), and administrative law decisions addressing procedural fairness or lawful exercise of Registrar discretions. Those materials are not included here.

• Because item descriptions in Schedule 1 cross-reference specific sections of the principal Act, litigation over scope is likely to turn on those primary Act provisions as well as the Schedule wording. The Schedule’s use of nil and fee-unit amounts creates straightforward factual and arithmetical issues for courts, but no cases are reported in the Regulations.

• The explanatory details’ statement of the fee-unit value for the 2025 financial year ($16.81) is administrative information, not adjudicative content. If a dispute arises over fee calculation for that year, the relevant source for the fee-unit value would be the Treasurer’s published determination in the Government Gazette and newspaper as required by the Monetary Units Act 2004; the Regulations’ explanatory details record that published value but do not constitute a judicial ruling.

In short, the Regulations provide no litigation history in the source text; any case law addressing their application must be located separately in judicial reports or databases dealing with the principal Act and associated administrative decisions.

Several practical and legal nuances in the Regulations can lead to errors if overlooked.

Fee units, not dollar amounts. Schedule 1 specifies many fees in fee units (for example, 5.18 fee units for change of name applications and 3.42 fee units for a search certificate). If a practitioner or client treats those numbers as dollars rather than fee units, they will miscalculate fees. The explanatory details explicitly require conversion under the Monetary Units Act 2004 by multiplying the fee-unit quantity by the fee-unit value for the applicable financial year (explanatory details). The fee-unit value is not fixed by these Regulations but by the Treasurer annually (Monetary Units Act s 5). Practitioners must therefore obtain the current fee-unit value as published in the Government Gazette and a Victorian newspaper before 1 June.

Rounding rule. After multiplication, the resulting dollar amount may be rounded to the nearest 10 cents (explanatory details). Forgetting the rounding rule can produce minor discrepancies in payable amounts, particularly for fees with fractional fee units such as 5.18.

Nil fees can be counterintuitive. Several items are explicitly nil: notably, applications to alter the recorded sex in a birth registration (items 3 and 3A) and applications for documents acknowledging name and sex (items 4 and 4A). It is easy to assume that any formal registration alteration will carry a fee, but the Schedule prescribes nil for these sensitive categories. Conversely, name-change applications for both adults and children are charged (items 1 and 2). The contrast between nil for sex-record amendments and paid fees for name changes can be a surprise for clients.

Search vs certificate distinction. Item 6 prescribes an application for search of the Register as nil, while item 7 prescribes a fee for the issue of a certificate certifying the results of a search (3.42 fee units). This means an applicant may obtain a search result without charge but will pay if they require an official certified certificate of that search. Misunderstanding this distinction can result in unanticipated charges for clients who seek documentary evidence rather than a simple search.

Historic-record exception specifics. Item 8 is narrowly worded: it applies to inspection and supply of a certified copy of an entry in a register, book of entries or register book in the possession of another person which has not been forwarded to the Registrar under s 31 of the Marriage Act 1898, and that relates to the period before 18 January 1853. That is a narrowly confined historic record exception. Assuming that all inspections of old records are free would be incorrect; the nil fee applies only where those precise conditions are met.

Dependency on external publications. The fee-unit value is fixed annually by the Treasurer and must be published in the Government Gazette and a Victorian newspaper before 1 June preceding the financial year. Failing to confirm the published fee-unit value could lead to using an outdated or incorrect multiplier when calculating dollar amounts. Practitioners must therefore check the Treasurer’s Gazette notice for the current financial year.

Sunset date. The Regulations will sunset 10 years after making on 10 September 2029 under the Subordinate Legislation Act 1994 (endnote 1). Advising clients or internal stakeholders without noting the sunset risk could result in reliance on an instrument that will expire unless re-enacted or replaced.

Amendment trail. The Schedule has been amended by S.R. Nos 25/2020 reg. 8, 9/2022 reg. 4 and 117/2025 reg. 3. If advice is based on an older printout or PDF that has not been consolidated, practitioners may miss later changes. Always check the consolidated version and the Table of Amendments.

No procedural specifics in the Regulations. These Regulations set the monetary quantum and mechanics but do not specify payment procedure, deadlines, or consequences for non-payment. Those practical steps likely appear in the principal Act or administrative guidance; assuming payment timeframes or refund rules from usual practice without checking the Act or Registrar guidance can be a source of error.

Interaction with the Marriage Act 1898. Item 8 references s 31 of the Marriage Act 1898. Misreading the interplay between the two Acts can cause incorrect application of the nil-fee rule for historic marriage registers. Confirm the specific conditions (possession by another person; period before 18 January 1853; not forwarded to the Registrar under s 31) before advising that a service is fee free.

In sum, common gotchas arise from misreading fee‑unit figures as dollars, ignoring the rounding rule, conflating free searches with free certified certificates, neglecting the Treasurer’s annual publication of fee-unit values, missing amendments, and overlooking the sunset provision.

The Regulations set out a straightforward compliance pathway that combines identification, calculation, and verification steps. The Regulations do not provide procedural payment rules or methods; those are likely to be in the principal Act or Registrar guidance. Nonetheless, the following steps, grounded in the Regulations and explanatory details, are the minimum necessary to comply as to fee calculation and confirmation.

1. Identify the correct Schedule item. Read Schedule 1 to determine whether the activity you or your client intends to pursue is listed and, if so, the Schedule item number and the corresponding section of the Births, Deaths and Marriages Registration Act 1996 cited in the Schedule. For example: application to register change of name (adult) is item 1 (s 25(2)); application to alter record of sex in a person's birth registration is item 3 (s 30A(3)(c)(ii)). This identification determines whether a fee is prescribed and whether it is nil or expressed in fee units (regulation 5; Schedule 1).

2. Check whether the Schedule prescribes nil. If the Schedule item specifies nil, no monetary payment is required under these Regulations for that particular application (see items 3, 3A, 4, 4A, 6, and 8 as applicable). If nil is specified, confirm whether there are any administrative charges under the principal Act or Registrar practice, because these Regulations alone do not bar other statutory or administrative fees if authorised elsewhere. The Regulations, however, do not themselves prescribe a fee in that instance.

3. Obtain the applicable fee-unit value for the relevant financial year. The explanatory details instruct that fees are provided by reference to fee units under the Monetary Units Act 2004 and that the Treasurer fixes the value of a fee unit for each financial year (explanatory details; Monetary Units Act 2004 s 5). The Treasurer must publish the fee-unit value in the Government Gazette and a Victorian newspaper before 1 June preceding the financial year. Therefore obtain the Treasurer’s Gazette notice for the relevant year to confirm the fee-unit value.

4. Calculate the dollar amount. Multiply the number of fee units specified in Schedule 1 by the value of a fee unit as fixed and published by the Treasurer for the relevant financial year, in accordance with section 7 of the Monetary Units Act 2004 (explanatory details). For example, using the fee-unit value stated in the explanatory details for the financial year commencing 1 July 2025 ($16.81): 5.18 fee units × $16.81 = $87.0758, rounded to the nearest 10 cents = $87.10; 3.42 fee units × $16.81 = $57.4902, rounded to $57.50. Apply rounding to the nearest 10 cents as directed in the explanatory details.

5. Verify whether the Registrar or the principal Act imposes further procedural steps. The Regulations do not specify how or when payment is to be tendered, the accepted forms of payment, or refund and late-payment consequences. Consult the Births, Deaths and Marriages Registration Act 1996 and the Registrar’s published guidance or forms to determine payment method, timing, documentation required, and any proof of payment to submit with the application.

6. Keep a record of the fee calculation and the Treasurer’s fee-unit publication. Retain the Gazette notice that contains the fee-unit value and a calculation demonstrating multiplication and rounding. That record will be necessary in case of any dispute about the correct fee or if a fee-unit value is updated during the period of application processing.

7. Monitor amendments and sunsetting. Because Schedule 1 has been amended several times and because the Regulations will sunset 10 years after the day of making (10 September 2029) under the Subordinate Legislation Act 1994, check the consolidated version of the Regulations and the Table of Amendments before finalising any fee advice or payment. Use the Table of Amendments and the front matter in consolidated legislation sources to confirm the current Schedule.

8. Distinguish between searches and certificates. If an applicant requires documentary evidence rather than an administrative search result, advise them that a certificate of search is charged under item 7. If they require only a search, item 6 may be nil. Confirm the difference with the Registrar’s procedural rules to determine whether an uncertified search result satisfies the applicant’s needs or whether a paid certificate is necessary.

9. For historic items involving other holders. If seeking inspection or a certified copy of entries in the possession of another person not forwarded to the Registrar under s 31 of the Marriage Act 1898 and relating to the period before 18 January 1853, check that those precise conditions are satisfied before relying on item 8’s nil fee. If those conditions are not met, other fees may apply.

10. When in doubt, seek clarification from the Registrar. Because these Regulations prescribe fee units and the calculation method but not payment mechanics, where a practitioner is uncertain about whether a fee applies, the correct dollar amount, or how payment should be made, confirm with the Registrar’s office or the agency’s published forms and guidance.

Following these steps aligns practical compliance with the Regulations’ text: identify the Schedule item (reg 5 and Schedule 1), obtain the Treasurer’s fee-unit value (explanatory details), multiply and apply rounding (explanatory details and Monetary Units Act 2004 s 7), and rely on the principal Act and Registrar guidance for payment procedures and timing.
