What it does
This Declaration (the Biosecurity (Ship Sanitation Certification Scheme,Ports) Declaration 2016) names, by instrument, the ports at which vessels may be inspected for the purposes of the ship sanitation certification scheme. The instrument states its name in section 1 (s 1). It is made under the power in subsection 256(1) of the Biosecurity Act 2015, which is the statutory authority recorded in section 3 (s 3). Two operative definitional points appear in section 4 (s 4): “Act” is defined to mean the Biosecurity Act 2015, and “ship sanitation certification scheme” is defined to mean the scheme prescribed by Part 5 of the Biosecurity (Human Health) Regulation 2016.
Section 5 (s 5) is the operative schedule: it declares that “Each port specified in the following table is a port at which a vessel may be inspected for the purposes of the ship sanitation certification scheme.” The instrument then supplies a table that groups ports by State or Territory and lists specific ports under each. The table contains eight numbered items corresponding to New South Wales, Victoria, Queensland, Western Australia, South Australia, Tasmania, Northern Territory and Christmas Island, and under each State or Territory lists specific named ports (for example, “Sydney”, “Port Botany” and “Port Kembla” under New South Wales, “Melbourne” and “Geelong” under Victoria, “Brisbane” and “Townsville” under Queensland, “Fremantle” and “Port Hedland” under Western Australia, and “Christmas Island” under that territory).
Mechanically, the Declaration does not itself create the ship sanitation certification scheme or set inspection procedures, standards, penalties or administrative processes. Instead it designates geographic locations , specific ports , at which the scheme’s inspection powers may be exercised, as described in the instrument’s own text (s 5) and its definition that ties the scheme to Part 5 of the Biosecurity (Human Health) Regulation 2016 (s 4). The instrument therefore operates as a location-limiting declaration: it identifies the places where the regulatory scheme prescribed elsewhere may be applied.
