What it does
The Biosecurity (Negative Pratique) Instrument 2016 is a legislative instrument made under subsection 49(1) of the Biosecurity Act 2015. It sets out the specific classes of incoming aircraft or vessels and the requirements those aircraft or vessels must meet before a biosecurity officer may grant pratique. Pratique is the permission granted under section 48 of the Act for an incoming aircraft or vessel to enter a landing place or port in Australian territory. Without pratique, the aircraft or vessel is prohibited from landing or docking.
The instrument creates a three‑item table that defines the classes and attaches distinct requirements to each class. Item 1 covers aircraft for which the prescribed disinsection measures were not taken and will not have been taken before arrival (except those exempt under section 7(3) of the Biosecurity (Human Health) Regulation 2016). For these aircraft, the operator must arrange for the prescribed disinsection to be carried out on arrival in a manner and time approved by the Director of Human Biosecurity, and under the supervision of a biosecurity officer.
Item 2 covers aircraft or vessels for which a pre‑arrival report or additional/corrected information included details about an individual who has or had signs or symptoms of a listed human disease, died during the journey, or was exposed to a listed human disease. It also covers aircraft or vessels where a biosecurity officer has notified the person in charge of a known or suspected case. For these, the operator must satisfy an assessing officer that the level of human health risk is acceptable, and if requested allow the unloading or loading of things, or the disembarkation or embarkation of persons.
Item 3 covers three types of vessels: cruise vessels, non‑commercial vessels, and vessels (other than non‑commercial vessels) for which a pre‑arrival report was required but not given. For these vessels, the operator must similarly satisfy an assessing officer that the human health risk is acceptable and comply with requests for unloading, loading, disembarkation, or embarkation.
