Biosecurity (First Point of Entry— Townsville Airport and Royal Australian Air Force Base Townsville) Determination 2019

The instrument uses a small set of statutory concepts drawn from the Biosecurity Act 2015 and applies them to the Townsville facilities. The main concepts are first point of entry, biosecurity entry point, goods (and a specified exclusion), aircraft, and notification conditions.

• First point of entry: The instrument designates the two named locations as first points of entry. The phrase is defined in the Biosecurity Act and is adopted here (s 4 confirms that expressions defined in section 9 of the Act are used). The effect of that designation, as the instrument signals by cross-reference, is to bring the Act’s entry-point rules into effect in relation to arrivals at those locations (see s 5 and s 6, and the notes that reference other Act provisions).

• Biosecurity entry point: The instrument designates particular areas within the first points of entry as biosecurity entry points for a particular class of goods. This is the operational locus where biosecurity officials may perform functions and exercise powers under the Act. The instrument designates baggage areas at the Townsville Airport International Terminal and the RAAF Base Townsville Air Movements Terminal as biosecurity entry points for baggage (s 8, table Item 1). Notably, the instrument does not designate any area as a biosecurity entry point for aircraft (s 7 note).

• Goods and exclusions: The instrument defines goods with reference to section 19 of the Act and applies the first point of entry designation to goods generally, excluding live horses (s 6). The exclusion of live horses is explicit; the instrument leaves arrangements for that class of goods to other determinations or provisions.

• Aircraft: The instrument declares the two locations to be first points of entry for aircraft generally (s 5). However, because no aircraft biosecurity entry points are designated at those locations, the Act’s requirement to bring aircraft to a biosecurity entry point (where one exists) will not apply at these locations for aircraft (s 7 note).

• Notification/conditions: The determination is conditional. Section 9 sets out specific notification duties. Owners and lessees must give written notice "as soon as practicable" after becoming aware of certain changes in the business entity operating the airport/base or a biosecurity entry point (s 9(2)-(3)). Persons or bodies responsible for carrying out operations must give "reasonable notice" of proposed changes falling within a defined class (s 9(4)-(5)). The instrument lists the kinds of changes that trigger the duty: changes to procedures for biosecurity measures, changes to facilities/amenities for biosecurity officials, changes affecting the ability to identify biosecurity risks or inform biosecurity officials, and changes affecting other factors that contribute to biosecurity risk (s 9(5)(a)-(e)).

These concepts structure obligations and duties in concrete terms: physical routing of baggage to specified terminals; information flows from owners, lessees and operators to the Agriculture Department; and a framework where the broader enforcement and operational rules of the Biosecurity Act apply to activities manifested at those first points of entry.

The instrument identifies several discrete categories of affected persons and entities by operation or status at the two sites. The categories tie directly to duties and to who must take actions under the instrument.

• Owners: The instrument places notification duties on the owner, or where there is more than one owner, an owner, of Townsville Airport or RAAF Base Townsville (s 9(2)). If an owner becomes aware of a relevant change to the business entity operating the airport/base or a biosecurity entry point, the owner must give written notice to the Agriculture Department "as soon as practicable" after becoming aware (s 9(2)).

• Lessees: Parallel obligations apply to any lessee, or where there is more than one lessee, a lessee (s 9(3)). The lessee must give written notice in the same circumstances and within the same timeframe as for owners.

• Persons or bodies responsible for carrying out operations: If a person or body that is responsible for carrying out operations at the airport or base proposes a change within the enumerated classes, they must give the Agriculture Department "reasonable notice" of the proposed change (s 9(4)-(5)). This category can include operators contracted to provide ground handling, terminal management, air movements operations, or other operational responsibilities; the instrument does not define the term and therefore leaves its scope to the facts at each facility.

• Biosecurity officials and human biosecurity officers: The instrument contemplates biosecurity officials and human biosecurity officers exercising functions or powers under the Biosecurity Act at the designated biosecurity entry points (note in s 4 and s 9(5)(b)-(d)). While the instrument does not name specific officials, it creates an infrastructure expectation at the designated areas.

• Aircraft operators and crew: The instrument designates the two sites as first points of entry for aircraft generally (s 5). However, because no aircraft biosecurity entry points are designated (s 7 note), aircraft operators are affected only by the first-point-of-entry designation rather than by an obligation in this instrument to bring aircraft to a biosecurity entry point.

• Travellers and persons with baggage: The instrument designates specific baggage areas as biosecurity entry points for baggage (s 8, Item 1). Travellers and cargo handlers whose baggage falls within the Act’s definition of goods and biosecurity control will, in practical terms, be routed to those terminals for biosecurity checks. The instrument’s Note 1 points to Act obligations (s 147) that goods to be unloaded must be brought to a biosecurity entry point as soon as practicable.

• Importers and consignors of goods (other than live horses): The first point of entry declaration for goods (other than live horses) (s 6) brings incoming goods within the entry-point regime, subject to the further delineation in s 8 where only baggage areas are formally designated as biosecurity entry points. The instrument therefore affects parties responsible for unloading or handling goods arriving at those locations.

• The Department of Agriculture: The instrument places an express, ongoing information-receiving role on the Agriculture Department; recipients of notices are required to be the Agriculture Department (s 9(2)-(4)). The Department is the regulatory interlocutor for the townsville designations and any changes the site operators may make.

Who pays and who decides. The instrument does not prescribe fee arrangements or cost-recovery; it does, however, transfer ongoing information costs and some procedural obligations to owners, lessees and operators via the written-notice duties (s 9). Decisions about whether to make the required notices, when they are triggered, and whether proposed changes require "reasonable notice" sit with those owners, lessees and persons/bodies responsible for operations, subject to the Department’s oversight under the Act. The instrument does not allocate costs for changing facilities or providing amenities (s 9(5)(b)), nor does it specify the Department’s administrative response to notified changes.

Finally, the explicit exclusion of live horses from the goods designation (s 6) means that consignors, agents, owners and handlers of live horses will not be covered by this instrument’s first point of entry designation and should contend with other determinations or specific arrangements outside this instrument.

The instrument creates a concise set of duties, mostly procedural and information-oriented, and does not create bespoke rights in private parties beyond the regulatory corridor it establishes. The duties fall into three clusters: entry-point routing/physical designation, notification duties, and obligations implied by cross-reference to the Act.

• Routing and biosecurity entry point duties for goods: Where baggage is unloaded and the aircraft has arrived at Townsville Airport or RAAF Base Townsville, the instrument designates specific areas as biosecurity entry points for baggage (s 8, Item 1). The instrument does not restate the statutory obligation in the Biosecurity Act but the notes make plain that goods that are to be unloaded must be brought to a biosecurity entry point "as soon as practicable" (see s 8 Note 1, which refers to s 147 of the Act). Practically, this means that handlers and parties unloading baggage should present baggage at the Townsville Airport International Terminal or the RAAF Base Air Movements Terminal where biosecurity entry points for baggage are designated.

• First point of entry duties for aircraft: The instrument designates the locations as first points of entry for aircraft generally (s 5). The Act (as noted) requires an aircraft to be brought to a biosecurity entry point at a first point of entry if a biosecurity entry point for aircraft exists there (s 7 note, referring to s 238 of the Act). This instrument, however, does not designate any aircraft biosecurity entry point at the two locations (s 7 note). Consequently, this instrument does not impose, by itself, a duty on aircraft to be brought into a designated aircraft biosecurity entry point at these locations.

• Notification duties on owners and lessees: The instrument imposes an immediate duty on owners (or, where there are multiple owners, an owner) and on lessees (or, where multiple, a lessee) to give the Agriculture Department written notice "as soon as practicable" after becoming aware that there has been, or will be, a change in the business entity operating the airport/base or a biosecurity entry point at those sites (s 9(2)-(3)). The duty is triggered by awareness of changes to the business entity operating the facility or a biosecurity entry point.

• Notice duty on persons/bodies responsible for operations: Where a person or body responsible for carrying out operations proposes to make certain types of change (listed in s 9(5)), that person or body must give the Agriculture Department "reasonable notice" of the proposed change (s 9(4)-(5)). The enumerated changes include procedural changes affecting biosecurity measures, changes to facilities or amenities for biosecurity staff, changes affecting identification or communication of biosecurity risks, and other procedural changes that may affect levels of biosecurity risk (s 9(5)(a)-(e)).

• Rights and protections: The instrument itself does not create affirmative statutory rights for private parties such as entitlements to access, compensation, or contractual protections. It does, by designating biosecurity entry points for baggage, create an expectation that biosecurity officials will exercise functions and powers at those locations (s 8 and s 9(5)(b)-(d)). The instrument gives the Agriculture Department the right to be notified and to receive notice on proposed operational changes. Beyond this, rights, appeal mechanisms, or procedural protections are within the Biosecurity Act itself; this instrument does not instantiate them.

Ambiguities in duty language and practical implications. Two features of the instrument affect how those duties will be interpreted and performed.

• Timing standards: The instrument uses "as soon as practicable" (s 9(2)-(3)) and "reasonable notice" (s 9(4)) without defining either phrase. Those are standard statutory terms but leave room for dispute about when the notification obligation is satisfied. The instrument imposes a written-notice form requirement but does not prescribe delivery method, content, or address.

• Who must notify in multi-party arrangements: For owners and lessees the instrument reduces the duty where there are multiple holders to require notice from "an owner" or "a lessee" (s 9(2)-(3)). That drafting allocates a practical onus on at least one participant in multi-owner or multi-lessee arrangements but does not specify how that responsibility is to be coordinated or what happens if no party gives notice.

Overall, the duties are largely administrative and information-driven, creating trigger points for the Agriculture Department to be informed about business or operational changes that could affect the capacity to manage biosecurity risk at the designated first points of entry.

The determination itself contains no express penalty provisions and does not specify enforcement mechanisms or sanctions within its text. It is an administrative designation made under subsection 223(1) of the Biosecurity Act 2015 (s 3), and the instrument repeatedly cross-references substantive provisions of the Act (see notes to ss 7 and 8 referencing ss 147 and 238, and the definitions invocation at s 4). That structure indicates that enforcement, any relevant offences, and the exercise of powers in response to non-compliance arise under the Biosecurity Act rather than under this instrument.

What the instrument does provide for enforcement contextually:

• It creates obligations (notifications and routing of baggage) that, if not complied with, would likely be actionable under the Act’s compliance and enforcement framework. The instrument itself does not enumerate those consequences but anchors the obligations to the Act by reference (s 3; s 4 notes).

• The notes explicitly direct readers to provisions of the Act for related matters: sections 173 and 174 are noted as dealing with prohibited and conditionally non-prohibited goods (see the note in s 6), section 147 is referenced in relation to unloaded goods being brought to a biosecurity entry point (s 8 Note 1), and section 238 is referenced concerning aircraft being required to be brought to a biosecurity entry point if one exists at the first point of entry (s 7 Note). Enforcement of the obligations that flow from those Act provisions will be governed by the Act’s enforcement provisions, not by this instrument.

Limitations in enforcement clarity:

• This instrument does not specify how the Agriculture Department will treat failure to provide notice "as soon as practicable" or failure to provide "reasonable notice" of proposed changes. It does not prescribe notice format, recipient contact details, or timeframes, which creates practical uncertainty about enforcement triggers.

• The instrument designates baggage areas as biosecurity entry points (s 8), and the Act’s ss referred to in the notes (for example, s 147) set the legal consequences for goods management; however, the instrument does not provide operational enforcement details such as who will physically prevent unloading outside designated areas, how inspections will be scheduled at the designated areas, or how biosecurity officials will be accommodated logistically.

In short, sanctions and enforcement mechanisms are not housed in the determination itself; they are available under the Biosecurity Act to the extent the Act provides for enforcement of duties that the instrument brings into effect by designation. Users should therefore treat this instrument as a procedural and locational designation that routes obligations into the Biosecurity Act enforcement system rather than as an autonomous enforcement instrument.

This instrument operates as a delegated administrative determination made under the Biosecurity Act 2015 and therefore interacts primarily with the Act. The instrument explicitly imports Act definitions and cross-references multiple sections of the Act; it does not, on its face, amend other statutes or create direct intersections with other legislative regimes.

Key cross-references and interactions cited in the text:

• Definitions and scope: Section 4 of the instrument adopts the Act’s terminology. It states that a number of expressions used are defined in section 9 of the Act and then defines "Act", "aircraft" and "goods" for the instrument’s purposes with explicit references to the Act (s 4). Consequently, the instrument’s scope and effect are tied to the Act’s statutory definitions and thresholds (for example, what constitutes "goods" under s 19 of the Act).

• Making authority: The instrument is made under subsection 223(1) of the Act (s 3). The Biosecurity Act therefore provides the legal authority and framework under which first points of entry and biosecurity entry points are specified.

• Operational obligations in the Act: The instrument points readers to other Act provisions for obligations and consequences. For example, the instrument cites s 147 of the Act in relation to the requirement for goods to be brought to a biosecurity entry point when unloaded (s 8 Note 1), and s 238 in relation to aircraft obligations where a biosecurity entry point for aircraft exists at a first point of entry (s 7 Note). The instrument also references ss 173 and 174 as relevant to determining whether particular goods are prohibited or conditionally non-prohibited at a first point of entry (s 6 Note). Those cross-references indicate that the instrument functions within the Act’s statutory architecture rather than as a stand-alone regime.

• Administrative coordination: The instrument imposes a duty to notify the Agriculture Department of changes (s 9). That creates an administrative interaction between private parties (owners, lessees, operators) and the Department, and the Department’s response will be determined by the Act’s administrative powers and policy settings.

• Military facility considerations: Part of the designated first point of entry is a Royal Australian Air Force base. The instrument does not delineate how obligations interact with military security, access or operational restrictions that may be governed by other laws or defence policies. It assigns notice duties and designates a biosecurity entry point within the RAAF Air Movements Terminal (s 8 Item 1(b)), but it does not modify defence governance or stipulate how access and coordination will be managed in practice. Therefore, in operational terms, co-ordination with Defence administrative arrangements will be necessary but the instrument itself does not prescribe that coordination detail.

• No express interaction with customs, quarantine or aviation security statutes: The instrument does not mention or purport to displace any obligations under customs, immigration, aviation safety, or security laws. It operates in parallel to those regimes by specifying where biosecurity functions are to be performed, and by reference to the Act’s powers.

Overall, the instrument should be understood as a localisation instrument: it applies the Biosecurity Act’s entry-point machinery to particular physical facilities and classes of arrival. Legal intersections with other legislative regimes (including Defence operations and aviation or customs regimes) are left to operational arrangements and the Act’s normal interfacing mechanisms; the instrument does not create or resolve those inter-regime tensions.

The instrument records its making and commencement but does not itself contain any later amendments within the provided text. The explicit historical details in the instrument are:

• The instrument was made by Dean Merrilees as delegate of the Director of Biosecurity; it is dated 7 June 2019 and signed by an Assistant Secretary in the Compliance Division of the Department of Agriculture (the instrument’s heading and signature block).

• The commencement table at section 2 records that "the whole of this instrument" commenced on 16 June 2019 (s 2(1) and the commencement table). The instrument also contains a note that the commencement table relates only to the provisions of the instrument as originally made, and that it will not be amended to deal with later amendments in the instrument itself (s 2 Note and accompanying text).

• There are no textual amendments, revocations, or later entries recorded in the instrument as provided. No amendment dates, amendment instruments, or saving provisions appear in the supplied text.

Implications from the instrument’s recorded history:

• The instrument’s status as of the text provided is the original determination made in June 2019 and in force from 16 June 2019. Any changes to the designation, additional biosecurity entry point designations, or revocations would appear in later determinations or amendments, but none are included here.

• The instrument’s note about the commencement table not being amended to reflect later changes is a standard drafting note; it does not itself change the legal effect of any subsequent amendment instrument. It simply signals that the version provided is the original made instrument.

If parties require the current operative text or any subsequent amendments, they should consult the refreshed Commonwealth instrument registers or the Department’s current determinations lists, because this document does not purport to record any post-commencement modification or revocation.

The instrument’s text contains no record of litigation, judicial review, or court decisions that interpret or apply it. There are no case names, judicial references, or appeals recorded in the supplied document. The instrument is purely a statutory administrative determination made under the Biosecurity Act 2015 (s 3).

What the instrument discloses by omission:

• Because the text contains no litigation history, it provides no judicial interpretation of the meaning of its key phrases such as "as soon as practicable" or "reasonable notice", nor any case law on the application of the owners’ or lessees’ notification duties, or on the practical interplay with Defence or airport operational regimes.

• The absence of litigation references in the instrument does not indicate that none may exist after its commencement; it simply means that no such litigation is recorded in this instrument text. Legal practitioners or interested parties seeking judicial treatment should search court and tribunal records and commentary referencing this determination or its practical application.

Practical consequence for users:

• Because there is no internal litigation history to guide interpretation, questions about ambiguous phrasing, the precise scope of "person or body responsible for carrying out operations", and the adequacy or timing of notices will need to be resolved either through direct clarification from the Agriculture Department, administrative correspondence, or through legal proceedings if disputes arise. The instrument’s cross-reference to the Act means that the Act’s general interpretive and enforcement apparatus will also be relevant.

Several features of the instrument can produce practical compliance traps or unexpected operational consequences if not carefully managed. These are matters of textual design, drafting choices, and the interaction with the Biosecurity Act as the enforcing statute.

• Aircraft designation but no aircraft biosecurity entry point: The instrument designates the locations as first points of entry for aircraft (s 5) but does not designate any biosecurity entry point for aircraft (s 7 note). Under the Biosecurity Act, an aircraft must be brought to a biosecurity entry point at a first point of entry only if there exists a biosecurity entry point for aircraft at that location (s 7 note referring to s 238 of the Act). Concretely, this means that the presence of a first point of entry in this instrument does not of itself impose on aircraft the duty to go to a designated aircraft entry point at these sites. Parties should not assume that aircraft are required, under this instrument, to remain within a specific aircraft area for biosecurity check at Townsville.

• Baggage-only biosecurity entry point designation: The instrument designates baggage areas at two specific terminals as biosecurity entry points for baggage (s 8, Item 1). It does not designate biosecurity entry points for other goods. Where goods other than baggage are unloaded at these locations, the statutory obligation to bring unloaded goods to a biosecurity entry point (s 147 of the Act) will not apply in respect of those other goods because no biosecurity entry points for those goods were designated (s 8 Note 2). In practice, that creates a difference between baggage, which must be routed to the designated baggage areas, and other goods, which may not be subject to the same physical routing obligations under this instrument.

• Exclusion of live horses: The instrument’s explicit carve-out of live horses from the goods first point of entry designation (s 6) means handlers and consignors of live horses must look to other determinations or specific legal arrangements. Treating live horses as excluded is a specific, non-obvious exclusion that could be overlooked by handlers who assume all animals are swept into the first point of entry regime here.

• Vague timing standards: "As soon as practicable" and "reasonable notice" are standard, but imprecise, legal standards (ss 9(2), 9(3), 9(4)). The instrument does not provide a definitional gloss or timeframe. Parties required to give notice should be aware that the Department may assess compliance by reference to objective reasonableness or to statutory interpretations in the Act, but the instrument leaves room for dispute over what constitutes adequate timing and content of notice.

• Single-notifier approach in multiple-owner/lessee situations: The drafting reduces the obligation in multi-owner or multi-lessee situations to "an owner" or "a lessee" being required to notify (ss 9(2)-(3)). This drafting avoids making every owner or every lessee a separate notifier but creates potential coordination and accountability issues: which owner or lessee will take responsibility? The instrument does not stipulate who bears the onus if no one acts.

• Operational interface with Defence: The instrument designates an area within an active RAAF base as a biosecurity entry point for baggage (s 8 Item 1(b)). It does not resolve practical access, security, or jurisdictional arrangements between Defence and the Agriculture Department. Where biosecurity entry point activity requires access by civilian biosecurity officials to secure military areas, additional protocols and inter-agency arrangements will be necessary; the instrument does not create them.

• Lack of procedural detail for notices: The instrument mandates written notice to the Agriculture Department but provides no address, preferred recipient, content requirements, or record-keeping directions (s 9(2)-(4)). This creates administrative risk: a notice could be held non-compliant if it does not reach the correct desk, is not sufficiently descriptive, or is disputed as untimely.

• Unclear consequences for non-notice: The instrument imposes notification duties but does not itself set out consequences for non-notice. The enforcement pathway is the Act, but the instrument’s silence about specific administrative consequences creates uncertainty as to what operational responses or sanctions the Department may deploy in response to late or omitted notices.

• Narrow scope of designated biosecurity entry points: Because the instrument designates only baggage areas, many types of goods that might arrive at or be transhipped through the first points of entry are not assigned a biosecurity entry point here. That narrowness can produce operational confusion at the unloading stage about where goods must be brought, and whether the Act’s s 147 obligations apply.

Overall, compliance risk is predominantly administrative and coordination-focused: ensuring timely written notice, correctly identifying which changes trigger notice duties, and managing inter-agency and Defence access arrangements. Parties should not assume broad, automatic obligations for aircraft movement or for all goods beyond the baggage designation without confirming the Act and any other determinations that may apply.

To satisfy the determination’s obligations and to reduce operational risk, owners, lessees and persons or bodies responsible for operations should adopt a short set of practical measures that flow directly from the instrument’s text.

1. Establish a notice protocol and responsible officer(s)

• Nominate a responsible officer (or small team) tasked with monitoring changes to business entities, operational procedures, and facilities that fall within the instrument’s notification triggers (s 9(2)-(5)). Given the instrument allows an owner (where multiple owners exist) or a lessee (where multiple lessees exist) to provide notice, allocate internal responsibility to ensure that at least one authorised notifier is on call.
• Maintain contact details for the Agriculture Department and a record of notice submissions. The instrument requires written notice but does not prescribe address or delivery method (s 9(2)-(4)), so use departmental contact channels and retain proof of delivery and content.

2. Define triggers and create internal checklists

• Map the changes listed in s 9(5)(a)-(e) to operational processes. The listed changes include procedural changes affecting biosecurity measures, facilities or amenities for biosecurity officials, procedures for identifying or informing about biosecurity risks, and other procedures affecting biosecurity risk levels.
• For each category, create an internal checklist to determine whether a proposed or actual change falls within those categories and thus triggers the duty to give "reasonable notice" (s 9(4)) or to give notice "as soon as practicable" (s 9(2)-(3)).

3. Document proposed changes and give reasonable notice

• For proposed changes, prepare a written notice that describes the proposed change, the anticipated timing, the operational rationale, and an assessment of the effect (if any) on biosecurity identification, communication and mitigation (s 9(4)-(5)). The instrument requires "reasonable notice" but does not define the period; include a proposed timeline and offer to consult with the Department to avoid later disputes about adequacy.

4. Record retrospective changes and notify as soon as practicable

• If an owner or lessee becomes aware of a change that has occurred (or will occur) that affects the business entity operating the airport or a biosecurity entry point, provide written notice "as soon as practicable" after becoming aware (s 9(2)-(3)). Keep contemporaneous records of when the party became aware and when notice was produced and sent.

5. Coordinate with Defence and other site stakeholders

• Where operations are within RAAF Base Townsville, coordinate early with Defence counterparts regarding access, secure-area protocols and presence of biosecurity officials in the Air Movements Terminal (s 8 Item 1(b); s 9(5)(b)-(d)). The instrument does not itself resolve access or security logistics.

6. Ensure baggage routing complies with designated biosecurity entry points

• For aircraft arriving at Townsville Airport or RAAF Base Townsville, ensure baggage that is to be unloaded is routed to the designated baggage biosecurity entry points listed in s 8 (Townsville Airport International Terminal and RAAF Base Townsville Air Movements Terminal). Note that the instrument designates baggage only, and other goods are not given designated biosecurity entry points in this instrument (s 8 Note 2). Keep logistic plans and signage aligned with those specified areas.

7. Distinguish live horses and other excluded goods

• Do not treat live horses as covered by the first point of entry designation for goods under this instrument (s 6). Confirm alternative determinations or specific regulatory arrangements for the handling and arrival of live horses.

8. Keep contemporaneous records of notices and responses

• Maintain detailed records of all notices provided to the Agriculture Department, including date of awareness, date of notice, delivery method, and any responses received. The instrument requires written notice but does not specify content or response expectations; meticulous record-keeping will mitigate compliance disputes given the indeterminate standards of "as soon as practicable" and "reasonable notice" (s 9).

9. Review other Biosecurity Act determinations and Act provisions

• The instrument points to ss 147, 173, 174 and 238 of the Act for other operational consequences and for issues such as prohibited goods and conditional permissions (s 6 Note; s 7 Note; s 8 Note 1). Review those Act provisions and any other instruments made under them to ensure full compliance across goods classes and aircraft operations.

10. Seek direct clarification from the Department where uncertainty exists

• Because the instrument does not set out precise contact protocols, definitions of timing standards, or enforcement responses, obtain written clarification from the Agriculture Department when there is doubt about whether a change triggers a notice duty, what constitutes reasonable notice, or how the Department expects to be informed. Record that clarification.

By following these steps, affected parties will align their procedures to the instrument’s written-notice and routing obligations (s 8; s 9). The instrument’s practical risk is administrative and coordination-related: it does not create complex substantive obligations but it does require timely and documented interactions with the Agriculture Department and clear operational arrangements for the designated baggage entry points.
