Biosecurity (First Point of Entry—Port of Norfolk Island) Determination 2022

This instrument is compact and revolves around a small number of interlocking concepts derived from the Biosecurity Act 2015 as applied to Port of Norfolk Island. The key concepts are: first point of entry, biosecurity entry point (as to vessels and goods), classes of goods and vessels, defined terms, and conditions attaching to the determination.

First point of entry: The instrument designates the Port of Norfolk Island as a first point of entry for the categories specified. The term “first point of entry” is used in the instrument both for vessels (s 5) and for particular classes of goods (s 6). By designating a first point of entry, the instrument identifies the place at which certain Act obligations and procedures will be triggered for arrival into Australian territory, although the instrument itself does not restate those Act obligations. The instrument’s notes make explicit that other matters relating to whether particular goods may be brought into a particular first point of entry are governed by the Act (see s 6 note 2 referencing ss 173 and 174 of the Act).

Biosecurity entry points: A biosecurity entry point is a specific area within the port where vessels or goods must be brought for biosecurity processing. Part 3 lists biosecurity entry points for vessels (s 7) and for goods (s 8). The instrument ties classes of vessels or goods to discrete areas (for example, Cascade Bay Anchorage, Sydney Bay (Kingston) Anchorage and Ball Bay Anchorage for vessels; Ball Bay Anchorage, Cascade Bay Pier and Kingston Pier for goods). The instrument’s note to s 7 cites s 246 of the Act, which requires that a vessel arriving at the Port be brought to a biosecurity entry point “as soon as practicable” (the instrument does not reproduce s 246 but references it).

Classes of goods and vessels: The instrument uses defined classes rather than attempting to list individual items. Definitions in s 4 carve out the precise meaning of freight container, general goods, goods (cross‑referring to s 19 of the Act), inorganic bulk goods, non‑commercial vessel, non‑commercial vessel baggage, passenger vessel baggage, vessel and waste. The instrument then applies the designations to those classes. For example, s 6 designates the Port as a first point of entry for baggage other than passenger vessel baggage; for “general goods” (as defined in s 4); and for “non‑commercial vessel waste”.

Notification conditions: Section 9 imposes conditions that are prerequisites to the effect of the determination. It requires owners or lessees to notify the Agriculture Department in writing “as soon as practicable” of changes to the business entity operating the port or a biosecurity entry point (s 9(2)-(3)). It requires persons or bodies responsible for operations to give “reasonable” written notice to the Agriculture Department of proposed changes to procedures, facilities or other matters that may affect biosecurity risk (s 9(4)-(5)). The list in s 9(5) is detailed and shows the types of operational changes that must be notified (procedures for biosecurity measures, facilities or amenities for biosecurity officials and human biosecurity officers, processes for identification of biosecurity risks and for informing biosecurity officials, and procedures for managing other contributory factors).

Authority and linkage to the Act: The instrument is made pursuant to s 229(1) of the Biosecurity Act 2015 (s 3) and expressly refers to other Act provisions in notes (s 6 note 2; s 7 note; s 8 note). The instrument is therefore an administrative determination that interacts with statutory obligations and the Act’s enforcement regime rather than creating new criminal offences or civil penalties within the instrument itself.

Geographical and operational granularity: The instrument is granular about locations within Port of Norfolk Island and differentiates those locations by vessel and goods class. It is not an open‑ended designation; it specifies where biosecurity processing must happen for particular classes. That precision informs operational planning for vessel masters, operators unloading goods, port owners and lessees and for biosecurity officials.

The instrument identifies a set of actors affected by the designation and by the notification conditions, and it implicitly affects others through the links to the Biosecurity Act provisions cited in the notes.

Primary affected parties named in the instrument:

• Owners of Port of Norfolk Island: s 9(2) places a direct written notification duty on an owner (or, if more than one, an owner) to notify the Agriculture Department in writing as soon as practicable if they become aware that there has been, or will be, a change to the business entity operating the Port or a biosecurity entry point at the Port.
• Lessees of Port of Norfolk Island: s 9(3) imposes the same written notification obligation on lessees (or, if more than one, a lessee).
• Persons or bodies responsible for carrying out operations at the Port: s 9(4)-(5) requires that such persons or bodies give the Agriculture Department reasonable written notice of proposed changes to procedures, facilities or other operational matters that could affect biosecurity risk.
• Masters and persons in charge of vessels arriving at the Port: the instrument designates biosecurity entry points and the notes reference Act sections that require vessels to be brought to a biosecurity entry point as soon as practicable (s 7 note referencing s 246 of the Act). While the Act provision is not reproduced, the instrument’s designation directly affects where the person in charge must bring the vessel for biosecurity purposes.
• Individuals and businesses unloading goods from vessels: s 8 and the note to s 8 (referencing s 147 of the Act) indicate that goods unloaded from arriving vessels must be brought to the designated biosecurity entry points as soon as practicable. The instrument, by specifying which areas are biosecurity entry points for which goods (s 8), affects the logistical choices of those unloading goods.
• Biosecurity officials and human biosecurity officers: s 9(5)(b) references facilities or amenities available at the Port for biosecurity officials and human biosecurity officers to perform functions or exercise powers under the Act. The instrument therefore affects the physical and administrative environment in which officials will operate.

Secondary or implicit stakeholders:

• Vessel operators (commercial and non‑commercial), passenger vessel operators, freight operators and shippers: the distinctions made between non‑commercial vessels, passenger vessels and other vessels in s 7, and between classes of goods in s 6-8, alter operational obligations for these categories.
• Owners of goods and those responsible for waste: waste carried on non‑commercial vessels is a specified class (s 6), and non‑commercial vessel waste appears in s 6 and s 8, affecting persons disposing of such waste.
• The Agriculture Department (Department of Agriculture, Water and the Environment): s 9 requires notification to the Agriculture Department; the Department is the recipient of those statutory notices and will be the decision maker or administrator responding to them.

Who pays and who decides:

• Owners and lessees bear the burden of notifying the Department: they must give written notice “as soon as practicable” per ss 9(2)-(3). That is an administrative compliance cost for owners/lessees.
• Persons or bodies responsible for operations must give “reasonable” written notice of proposed operational changes (s 9(4)-(5)). Determination of what is “reasonable” will likely require administrative judgement by the Department or, if contested, may be assessed against common understandings of reasonableness, though the instrument itself does not define it.
• Biosecurity officials exercise powers under the Act at the designated biosecurity entry points. The instrument determines where those powers will be exercised in practice (ss 7-8).

Behaviour changes required:

• Vessel masters will need to plan arrivals around the specified anchorages and piers as designated biosecurity entry points (s 7).
• Operators unloading goods must bring those goods to the area designated for that class of goods (s 8).
• Port owners, lessees and operators must have internal processes to notify the Agriculture Department of relevant changes and to provide reasonable advance notice of operational changes that could affect biosecurity risk (s 9).

The instrument does not itself create fees, specific enforcement actions or rights of appeal; those are governed by the Biosecurity Act 2015 under which the instrument is made (s 3). The instrument’s effect is to channel where and how the Act’s powers and duties operate at Port of Norfolk Island and to impose administrative notification duties on owners, lessees and operators.

Duties created or clarified by this instrument are narrowly focused on designation, movement to designated points, and notification requirements for owners, lessees and operators. The instrument does not itself create new offences, criminal sanctions or fee regimes; it operates within the enforcement framework of the Biosecurity Act 2015 (s 3). The instrument’s notes invoke procedural duties under the Act that must be respected in practice.

Designations that create operational duties:

• Vessels: Port of Norfolk Island is a first point of entry for vessels generally (s 5). The instrument designates specific anchorages as biosecurity entry points for vessels (s 7). The note to s 7 cross‑references s 246 of the Act, which the instrument indicates requires an arriving vessel to be brought to a biosecurity entry point “as soon as practicable”. The instrument itself thus ties the duty to follow Act procedures to the particular locales specified.
• Goods: Port of Norfolk Island is a first point of entry only for baggage other than passenger vessel baggage, general goods, and non‑commercial vessel waste (s 6). Section 8 then designates areas within the Port as biosecurity entry points for particular goods classes. The note to s 8 references s 147 of the Act, which pertains to obligations when goods are unloaded from a vessel, indicating such goods must be brought to the designated biosecurity entry point as soon as practicable.

Express notification duties:

• Owners: If an owner (or an owner when there are multiple) becomes aware that there has been, or will be, a change to the business entity operating the Port or a biosecurity entry point, the owner must give the Agriculture Department written notice as soon as practicable (s 9(2)). The instrument accepts that where there are multiple owners a single owner’s notification suffices for the purpose of this obligation.
• Lessees: A parallel obligation applies to a lessee (or a lessee where there are multiple) under s 9(3).
• Operators/Persons responsible for operations: If a person or body responsible for carrying out operations at the Port proposes to make changes listed in s 9(5), they must give the Agriculture Department reasonable written notice of the proposed change (s 9(4)). Section 9(5) gives a detailed list of the kinds of changes that trigger this duty: changes to procedures that provide for biosecurity measures, changes to facilities or amenities for biosecurity officials and human biosecurity officers, changes to procedures affecting the ability to identify biosecurity risks, changes to procedures affecting how biosecurity officials are informed of identified risks, and changes to procedures for managing other factors that contribute to biosecurity risk.

Rights and omissions in the instrument:

• The instrument creates the right, in an administrative sense, for the Agriculture Department to be notified and to receive written notice of changes; it does not confer private rights or statutory benefits to port users. It does not, for example, grant exemptions from Act obligations or create a statutory entitlement to particular facilitation services at the port.
• The instrument does not specify enforcement mechanisms, penalties or appeal rights in relation to the notification duties; those matters remain within the Biosecurity Act’s enforcement architecture (s 3). The instrument does not define “reasonable” notice nor “as soon as practicable”, so those temporal standards will be applied in context and may be subject to administrative interpretation or legal contest under the Act framework.

Operational implications for duty‑holders:

• A vessel master or person in charge must plan to bring an arriving vessel to the designated biosecurity entry point area for that vessel class (s 7). The obligation to move vessels to the designated biosecurity entry point is anchored by the Act provisions the instrument references (s 7 note).
• Persons unloading goods must bring the goods to the biosecurity entry point area for that class of goods as soon as practicable after arrival (s 8 note). The instrument imposes the mapping of goods classes to physical locations; the Act governs the timing and related obligations.

Allocation of compliance responsibility:

• The instrument places primary notification responsibilities on owners and lessees and operational change notice responsibilities on those running port operations (s 9). It places the obligation to bring vessels and goods to biosecurity entry points indirectly on the person in charge of vessel operations or the party unloading goods through the Act references in the s 7 and s 8 notes. Thus, compliance tasks and costs will generally fall on port owners/lessees, operators and vessel masters or cargo handlers.

This determination itself does not specify penalties or set out an enforcement regime. It is made under subsection 229(1) of the Biosecurity Act 2015 (s 3), and it therefore operates within the Act’s enforcement and penalty provisions rather than creating bespoke sanctions. The instrument’s content is limited to designation and notification conditions; it repeatedly references Act provisions for procedural obligations (for example, ss 147 and 246 of the Act are cited in notes to ss 8 and 7 respectively), implying that enforcement measures and consequences for non‑compliance lie in the Act.

Points on enforcement and penalties drawn from the instrument:

• Absence of express penalties: Sections 5-9 do not create fines, criminal offences or civil penalty provisions within the instrument itself. The instrument’s function is administrative designation and conditionality.
• Reliance on the Biosecurity Act: The instrument explicitly sits under the Biosecurity Act (s 3). Enforcement powers, infringement notice regimes, civil penalties and criminal offences for contraventions of Act obligations are therefore the operative enforcement mechanisms, but the instrument does not restate them. Practitioners must therefore consult the Biosecurity Act 2015 and any relevant regulations or instruments for the specific enforcement and penalty provisions that will apply to non‑compliance with duties that the instrument engages (for example, duties to bring vessels or goods to biosecurity entry points, or to comply with biosecurity measures).
• Administrative compliance mechanisms: The instrument creates duties to notify the Agriculture Department. Non‑compliance with those written notification duties could be actionable under the Act if the Act contains specific offences or sanctions for failure to comply with instrument conditions or statutory directions. The instrument does not itself specify whether non‑notification will amount to a breach attracting penalties; that question is governed by the Act and any applicable subordinate legislation.
• Operational enforcement at entry points: The instrument designates specific locations where biosecurity officials will exercise powers. Enforcement activity (inspections, detentions, treatment, seizure) at those locations will be carried out by biosecurity officials and human biosecurity officers under the Act. The instrument’s notes explicitly refer to Act sections that require movement to biosecurity entry points and treatment of goods, embedding the instrument within the Act’s operational enforcement model.

Consequences for duty‑holders in practice:

• Because the instrument delegates substantive enforcement to the Act, duty‑holders (owners, lessees, operators, vessel masters, cargo handlers) face enforcement exposure under the Act for failing to comply with those substantive provisions. The instrument narrows the spatial scope of where Act powers will be engaged at Port of Norfolk Island, which in turn provides biosecurity officials with defined venues for inspection and enforcement activity.
• The instrument introduces administrative compliance costs (notification and advance notice duties). While it does not set monetary penalties for failing to meet those administrative duties, failure to comply may have regulatory or operational consequences under the Act.

For detailed penalty schedules, infringement notice amounts, and prosecutorial options, practitioners must refer to the Biosecurity Act 2015 and any relevant regulations or enforcement instruments; those instruments will determine the sanctions that flow from non‑compliance with the Act obligations the determination engages.

This instrument is an administrative instrument under the Biosecurity Act 2015 (s 3). Its legal effect and the duties it triggers are interdependent with specific provisions of the Act and with the Biosecurity Regulation 2016 to the extent the instrument relies on definitions and Act cross‑references.

Statutory basis and cross‑references:

• The instrument is made under subsection 229(1) of the Biosecurity Act 2015 (s 3). That connects it directly to the Act’s statutory framework for designating first points of entry and biosecurity entry points.
• Definitions in s 4 of the instrument cross‑refer to or mirror terms used in the Act. Notably, “goods” is stated to have the meaning given in section 19 of the Act (s 4). The instrument also notes that a number of expressions are defined in section 9 of the Act (s 4 note). The instrument therefore integrates Act definitions and ensures consistency with the Act’s conceptual framework.
• The instrument’s notes specifically reference several Act provisions: sections 147 (regarding goods brought to biosecurity entry points when unloaded), 173 and 174 (dealing with prohibited goods and conditionally non‑prohibited goods) and 246 (requiring vessels to be brought to biosecurity entry points). Those references signal that the substantive regulatory standards, prohibitions and procedural obligations remain located in the Act, while the instrument determines where those statutory mechanics are to be applied at Port of Norfolk Island.

Interaction with subordinate instruments and regulations:

• The instrument uses the term “non‑commercial vessel” and expressly states that the term has the same meaning as in the Biosecurity Regulation 2016 (s 4). That links the instrument’s classification of vessels to definitions in subordinate legislation, meaning that any changes in the Regulation’s definition would affect the scope of the instrument without the instrument itself being amended.
• The instrument is framed to work in tandem with the Act’s determinations and regulations. For example, s 6 note 2 tells readers to see sections 173 and 174 of the Act and “any determinations made under those sections” for matters relating to whether particular goods may be brought into a first point of entry. Thus, prohibited and conditionally non‑prohibited goods rules that appear elsewhere will interact with this instrument’s designation to determine admissibility at the Port.

Spatial and procedural interaction:

• By designating specific anchorages and piers as biosecurity entry points for particular classes, the instrument operationalises where the Act’s inspection, detention and treatment powers (as set out in the Act) will be exercised at Port of Norfolk Island. The Act’s spatially neutral powers to control biosecurity risk thus acquire geographic focus through this instrument.
• Notification duties in s 9 require owners, lessees and operators to inform the Agriculture Department of changes to the business entity or operational procedures, which interacts with the Department’s administrative oversight powers under the Act. The instrument thereby creates an administrative interface between port governance and the federal biosecurity regulator.

Limits on the instrument’s standalone legal effect:

• The instrument does not create standalone offences, nor does it purport to override or alter substantive Act provisions. It is a determinative instrument setting locations and triggering notification duties. Enforcement, prohibitions on goods, and other regulatory effects stem from the Act itself. Practitioners therefore need to consult both the instrument and the Biosecurity Act 2015 (and relevant regulations) to determine the full suite of legal obligations applicable to a given vessel, goods consignment or operational change.

Administrative custodianship and departmental role:

• Notifications required by ss 9(2)-(4) are to be given to the “Agriculture Department” (s 9). The Department is therefore the repository of the information required by the instrument and will be the administrative decision maker for any follow‑up. The instrument thereby creates a reporting channel from port owners, lessees and operators into the Department’s regulatory apparatus.

In short, the instrument operates as a geographically specific administrative determination that activates, localises and interfaces with substantive obligations, prohibitions and enforcement powers found in the Biosecurity Act 2015 and the Biosecurity Regulation 2016. It sets the where and identifies administrative reporting duties; the what, how and sanctions are left to the Act and subordinate instruments the determination references.

The instrument includes a commencement table and a note about its original form. The text records the creation and commencement details and contains a caveat regarding the commencement table that relates only to the instrument "as originally made".

Recorded dates and making authority:

• The determination was signed by Barbara Cooper as delegate of the Director of Biosecurity and dated 8 March 2022 (front matter). The instrument’s commencement provision (s 2) sets the commencement date for the whole instrument as 16 March 2022. The commencement table in s 2 states: “The whole of this instrument 16 March 2022. 16 March 2022.”
• Section 3 records the legal authority: the instrument is made under subsection 229(1) of the Biosecurity Act 2015.

Instrument self‑description of amendment status:

• Section 2 contains a note: “This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument.” That indicates the commencement table records the original state and warns that later amendments, if any, will not be reflected in that table within the instrument text itself.

No internal amendment entries:

• The instrument as provided contains no entries or text indicating any subsequent amendments to its provisions. It presents the instrument as originally made and commenced on the dates specified. The instrument therefore appears, on its face, to be the original determination as made on 8 March 2022 and commenced 16 March 2022.

Practical implications for users seeking amendment history:

• The instrument’s own text does not record any later amendments. To determine whether the instrument has been amended since original commencement, a practitioner would need to consult external legislative registers, the Commonwealth Gazette, or the Department’s legislative instrument records. The instrument’s caveat makes clear that the in‑instrument commencement table is not an amendment tracker.

No transitional or savings provisions:

• The instrument does not include transitional, savings or sunset clauses. It is a straight designation and condition instrument effective from the commencement date, with ongoing notification duties as set out in s 9. Any future repeal, replacement or amendment would be effected by separate administrative or legislative action and would need to be checked against external official records.

Recordation of administrative provenance:

• The instrument records its administrative provenance in the first pages (delegate’s signature, date, and role). That is the only provenance information contained in the instrument itself.

The instrument contains no references to litigation, court decisions or tribunal determinations. It is a statutory administrative instrument that sets administrative designations and notification conditions; the instrument itself does not record or indicate any legal challenges or judicial interpretations.

What the document shows and what it does not:

• The instrument shows who made it (a delegate of the Director of Biosecurity), the date it was made (8 March 2022), and its commencement date (16 March 2022). It does not record any judicial review proceedings, appeals, or litigation outcomes.
• There are no cases, litigation outcomes or legal disputes mentioned in the instrument text. The instrument is silent on whether any party challenged the determination, whether any injunctions or stays were sought or obtained, or whether any judicial or administrative review proceedings were initiated.

Implications for practitioners:

• Because no litigation history is recorded in this instrument, practitioners researching whether this determination has been subject to legal challenge must consult external sources: court databases, tribunal records and the Department’s public records. The instrument itself gives no information about whether its provisions have been interpreted or contested in litigation.
• Any legal questions about the scope, meaning or operation of the instrument in the context of the Biosecurity Act would need to be answered by reference to the Act, the instrument, any relevant subordinate legislation, and any external case law or administrative decisions. The instrument does not provide precedent or interpretation.

Note on administrative discretion and potential judicial review:

• The instrument is an administrative determination made under s 229(1) of the Biosecurity Act 2015. Administrative determinations of this kind can be the subject of judicial review or other legal challenge in appropriate circumstances; however, nothing in the instrument indicates that such proceedings have been brought or resolved in relation to this particular determination.

Overall, the instrument records no litigation history within its text. Any enquiry about litigation involving this determination must proceed to courts and administrative records outside of the instrument.

The instrument is concise but contains several practical traps and points of friction for affected parties. These “gotchas” arise from precise definitions, limited classes for first point designation, the split between designation and Act obligations, and the notification standards used in s 9.

1. Limited classes of goods designated as arriving at the port as a first point of entry

• Section 6 designates Port of Norfolk Island as a first point of entry only for three classes: baggage other than passenger vessel baggage, general goods, and non‑commercial vessel waste. The instrument’s Note 1 emphasises that the Port is not a first point of entry for any other goods. That means certain categories one might assume (for example, passenger vessel baggage, freight containers, live animals like live horses, or other specified goods) are not included by this instrument’s first point designation. Practitioners must therefore not assume the Port is a first point for all arrivals; the designation is narrow and must be matched to the goods class defined in the instrument (s 6 and s 4 definitions).

2. Discrepancy between “first point of entry” and “biosecurity entry point” for goods and vessels

• The instrument distinguishes a first point of entry (Part 2) from biosecurity entry points (Part 3). Being a first point of entry for certain goods does not automatically mean those goods can be processed at every area within the Port; s 8 lists specific areas per goods class. Conversely, Port of Norfolk Island is a first point of entry for vessels generally (s 5), but the biosecurity entry point table (s 7) differentiates which areas are appropriate for which vessel classes; for example, Ball Bay Anchorage is not for non‑commercial vessels or passenger vessels (s 7, item 2). Duty‑holders must therefore map goods and vessel classes to the specific locations the instrument designates.

3. Definitions narrow applicability

• Definitions in s 4 narrow certain commonly used terms. For example, “freight container” is limited to reusable 20‑foot or 40‑foot containers. Other container sizes or one‑off transport units may not be captured by that definition. “Inorganic bulk goods” is explicitly defined and excludes animals, plants, organic compounds and microbes; commodities that include trace organic material may not fall within that definition and could be treated differently under the Act. These definitional nuances can lead to classification disputes at the point of arrival.

4. Temporal standards are imprecise and administratively risky

• The instrument uses temporal standards without precise timeframes: owners/lessees must notify the Agriculture Department “as soon as practicable” when they become aware of certain changes (ss 9(2)-(3)); operators must give “reasonable” notice of proposed changes (s 9(4)). Those standards are context‑dependent and may expose duty‑holders to administrative disagreement about timeliness. The instrument does not define “reasonable” or “as soon as practicable”, which creates uncertainty and the need for conservative compliance practices (early notice, thorough record keeping).

5. “An owner” or “a lessee” suffices when there are multiple owners/lessees

• Sections 9(2)-(3) state that if there is more than one owner (or lessee), “an owner” (or “a lessee”) must give the written notice. That reduces coordination burdens but also creates a risk: if multiple owners believe another will notify, notifications may fall through the cracks. The instrument’s formulation assigns the obligation to “an owner” but does not specify how the obligation should be allocated among co‑owners. Practical governance arrangements are therefore required to ensure a notice is actually given.

6. Notifications tied to business entity changes and operational procedures

• The notification obligations cover a broad range of changes: business entity changes (s 9(2)-(3)) and procedural or facility changes that affect the identification or management of biosecurity risks (s 9(5)). The list in s 9(5) is extensive and may capture routine operational adjustments; operators must interpret whether a proposed change is the kind that requires “reasonable” notice. Failure to give notice because a change was deemed immaterial could result in regulatory friction.

7. The instrument is silent on how the Department will respond

• The instrument requires notice to the Agriculture Department but does not set response times, approval requirements, or procedural consequences. Duty‑holders cannot assume that written notice will be acknowledged or that operations may proceed while awaiting Department response. The absence of procedural detail implies a need for prudent advance engagement with the Department.

8. Spatial constraints on unloading and mooring

• The mapping of particular goods to specific areas (s 8) may impose logistical constraints. For example, all baggage (other than non‑commercial vessel baggage or passenger vessel baggage) and inorganic bulk goods are mapped to Ball Bay Anchorage, Cascade Bay Pier and Kingston Pier (s 8, item 1). General goods, non‑commercial vessel baggage and non‑commercial vessel waste are mapped to Cascade Bay Pier and Kingston Pier (s 8, item 2). Operators need to ensure appropriate berthing, access and transport arrangements for those locations; otherwise unloading may be delayed pending transfer to the appropriate biosecurity entry point.

9. Interaction with the Biosecurity Act and other determinations

• The instrument repeatedly defers to the Biosecurity Act for substantive matters (for example, prohibited goods under ss 173-174 of the Act, and vessel movement obligations under s 246). Users must consult the Act for substantive prohibitions and operational obligations. A common pitfall is to rely only on the instrument without cross‑referencing the Act’s requirements which actually carry penalties and operational rules.

10. No express transitional arrangements or exemptions recorded

• The instrument contains no transitional, grandfathering or exemption clauses. Any operational or ownership change that falls within s 9 may trigger notice obligations from the date of awareness. Parties assuming grandfathering or informal tolerances risk regulatory complications.

In practice, these gotchas mean that port owners, lessees, operators, vessel masters and cargo handlers should not treat the instrument as a standalone checklist. They must cross‑map definitions, goods and vessel classes, designated areas, and the Act’s procedural obligations, and should adopt conservative notification practices to minimise exposure to administrative dispute.

Compliance with this instrument requires three parallel tracks: (1) operational alignment of vessel movements and unloading with the designated biosecurity entry points; (2) administrative compliance with notification duties; and (3) procedural readiness to facilitate biosecurity officials at the designated locations. Below is a focused, source‑grounded checklist and recommended practices tied to the instrument’s provisions.

1. Map your operations to the instrument’s designations

• Identify whether your vessels or goods fall within the instrument’s defined classes. Use the instrument’s definitions in s 4: check whether goods are “general goods”, “inorganic bulk goods”, “waste” as defined, whether the vessel is a “non‑commercial vessel” (Biosecurity Regulation 2016 definition applies via s 4), and whether baggage is “passenger vessel baggage” or otherwise.
• Determine the correct biosecurity entry point area for each class using ss 7-8. For vessels, Cascade Bay Anchorage and Sydney Bay (Kingston) Anchorage are biosecurity entry points for all vessels (s 7, item 1); Ball Bay Anchorage is for vessels other than non‑commercial vessels and passenger vessels (s 7, item 2). For goods, map goods classes to Ball Bay Anchorage, Cascade Bay Pier and Kingston Pier as set out in s 8.

2. Operational planning for arrival and unloading

• Plan vessel arrivals so the vessel can be brought to the appropriate biosecurity entry point area promptly. The instrument’s note to s 7 cites s 246 of the Act requiring a vessel to be brought to a biosecurity entry point as soon as practicable after arrival; align berthing and anchoring plans accordingly.
• Prepare to bring goods unloaded from arriving vessels to the designated biosecurity entry point area as soon as practicable. The instrument’s note to s 8 cites s 147 of the Act for obligations when goods are unloaded; assume the requirement to bring goods to the designated biosecurity entry point is enforceable under the Act.

3. Put notification systems in place

• Owners and lessees: establish an internal escalation and notification protocol so that if any owner or any lessee becomes aware of a change to the business entity operating the Port or a biosecurity entry point, written notice to the Agriculture Department is provided “as soon as practicable” (ss 9(2)-(3)). Because the instrument allows “an owner” or “a lessee” to notify, designate a responsible party to avoid gaps where multiple owners/lessees assume another will notify.
• Operators and persons responsible for operations: devise a process to assess proposed operational changes against the list in s 9(5). For any proposed change to procedures for biosecurity measures, to facilities/amenities for biosecurity officials, to procedures affecting identification of biosecurity risks or informing officials, or to other procedures managing contributory factors, give the Agriculture Department reasonable written notice of the proposal (s 9(4)-(5)). When in doubt, provide notice to avoid later administrative dispute about whether notice was required.
• Recordkeeping: keep dated records of every written notice sent to the Agriculture Department, the identity of the person who sent it, and the information provided. Retain acknowledgements or correspondence from the Department.

4. Ensure facilities and amenities meet operational expectations

• Section 9(5)(b) expressly covers changes to facilities or amenities available for biosecurity officials and human biosecurity officers. Ensure designated piers and anchorages have the amenities required for officials to exercise their functions , for example, safe access, areas for inspection, and workspaces. If facilities are lacking, notify the Department proactively and plan upgrades or temporary arrangements.

5. Internal procedures to identify and communicate biosecurity risks

• Establish or update procedures for identifying biosecurity risks associated with port operations (s 9(5)(c)), and for informing biosecurity officials when risks are identified (s 9(5)(d)). Implement routine checks, staff training and reporting lines to ensure timely identification and notification.

6. Transportation and logistics alignment

• Coordinate ground transport and cargo handling to ensure goods unloaded at the Port can be moved to the specific biosecurity entry point area for the class of goods (s 8). For example, non‑commercial vessel waste must be taken to a designated area as set out in s 8. Confirm whether road access, vehicle permits or crane arrangements are available at the designated piers or anchorages.

7. Engage with the Agriculture Department early and document contacts

• Where changes are contemplated (ownership, operating entity, procedures, facilities), engage the Department early. Provide written notifications in a format that includes sufficient detail to describe the change, the parties involved, the timing and the expected effect on biosecurity risk. Keep copies of all communications and proof of postage/email transmission.

8. Clarify ambiguous terms with the Department where needed

• The instrument uses qualitative standards (“as soon as practicable”, “reasonable” notice). If parties face ambiguity about the timing or sufficiency of notice, seek clarification from the Agriculture Department and obtain written confirmation where practicable.

9. Coordinate among co‑owners and co‑lessees

• Since “an owner” or “a lessee” can discharge the notification duty if multiple owners/lessees exist (ss 9(2)-(3)), set contractual governance arrangements that specify who is responsible for statutory notifications. Include notification duties in any shareholders’ or joint venture agreements to avoid disputes and regulatory non‑compliance.

10. Maintain compliance with the Biosecurity Act and other determinations

• The instrument operates within the Biosecurity Act framework. Maintain compliance systems that track the Biosecurity Act’s requirements (for example, prohibitions under ss 173-174 as the instrument’s notes refer to) so that designation at Port of Norfolk Island is matched with compliance with the substantive Act provisions.

Practical checklist for immediate action by port duty‑holders:

• Confirm whether your operations fall within the classes listed in s 6 and s 8.
• Designate a named compliance officer responsible for written notifications to the Agriculture Department.
• Prepare templates for written notifications that capture the information set out in s 9(5).
• Audit facilities at Cascade Bay Pier, Kingston Pier and Ball Bay Anchorage to confirm they can support biosecurity inspections; remediate or arrange alternative access if not.
• Update arrival and unloading plans to ensure vessels and goods are brought to the correct designated areas “as soon as practicable”.
• Retain documentary evidence of compliance with notification duties and of operational arrangements made to meet the instrument’s requirements.

Following these steps will reduce regulatory risk and align port operations with the designations and conditions in the instrument.
