Biosecurity (First Point of Entry—Port of Melville Bay) Determination 2019

Several technical concepts drive the instrument’s operation and scope. Each is defined or referenced in the text and links the instrument to the underlying Act.

First point of entry. The instrument declares Port of Melville Bay to be a first point of entry for specified vessels and goods (ss 5-6). The instrument does not restate the Act’s definition of a first point of entry; it makes the administrative designation that triggers the Act’s inbound biosecurity regime for the classes listed.

Biosecurity entry point. The instrument designates specific areas of the port as biosecurity entry points for particular classes of vessel and goods (ss 7-8). The designated areas are named: Cargo Wharf, Export Wharf and Tanker Wharf for vessels (s 7); Tanker Wharf for inorganic bulk goods (s 8). The instrument’s notes link these designations to the Act’s operational duties to bring arriving vessels or goods to a biosecurity entry point “as soon as practicable” where the Act makes that requirement (see notes to ss 7-8 referencing ss 246 and 147 of the Act).

Classes of vessel and goods. The instrument excludes non‑commercial vessels and passenger vessels from the port’s vessel designation (s 5). It includes baggage carried on a non‑excluded vessel and inorganic bulk goods as goods for which the port is a first point of entry (s 6). The instrument defines “inorganic bulk goods” narrowly as chemicals, ores, minerals or gases brought into Australian territory in bulk that do not contain animals, plants, organic compounds or microbes (s 4). The instrument relies on the Act’s definitions for “vessel” and “goods” by reference to the Act (s 4; notes citing ss 9 and 19 of the Act).

Authority and linkage to the Act. The instrument is made under s 229(1) of the Act (s 3). It repeatedly refers readers to particular provisions of the Act for related matters: s 173 and s 174 on prohibited and conditionally non‑prohibited goods (note to s 6), s 147 on unloading of goods (note to s 8), and s 246 on the requirement to bring an arrived vessel to a biosecurity entry point (note to s 7). The instrument therefore functions as an administrative designation that operates within the Act’s substantive and enforcement framework.

Conditions and notice obligations. Part 4 places procedural obligations on owners, lessees, and persons or bodies responsible for operations at the port to notify the Agriculture Department about changes affecting biosecurity risk management or the business entity operating the port or biosecurity entry points (s 9(2)-(5)). The instrument specifies the sorts of changes that trigger the “reasonable notice” requirement for proposed changes (s 9(5)(a)-(e)), including changes to procedures, facilities or amenities that affect the ability of officials to perform functions under the Act or identify and be informed of biosecurity risks.

Reference points and exclusions. The instrument explicitly notes what it does not do. It states that the port is not a first point of entry for any goods other than the classes listed (note to s 6). It also notes that it does not designate biosecurity entry points for other goods for which the port is a first point of entry, so the Act’s unloading requirement in s 147 does not apply to those goods (note to s 8). Those exclusions are operationally important and reduce the instrument’s operational footprint to a narrowly defined set of vessel and goods classes.

The instrument affects a small, defined set of actors through designation and procedural obligations. The primary parties named in the instrument are owners of Port of Melville Bay, lessees (if any), persons or bodies responsible for carrying out operations at the port, vessels and their operators or masters, and the Department of Agriculture (the Agriculture Department), which receives notices and receives the benefit of the designation.

Owners and lessees. Owners and lessees of Port of Melville Bay face express notification duties. If an owner or any one of several owners becomes aware of an actual or impending change to the business entity operating the port or a biosecurity entry point, that owner must give the Agriculture Department written notice “as soon as practicable” (s 9(2)). The same requirement is placed on a lessee or where there are multiple lessees any one must give the written notice (s 9(3)). Those duties assign responsibility to the property right‑holders to inform the regulator about organisational changes that could affect biosecurity management.

Persons or bodies responsible for operations. A person or body responsible for carrying out operations at the port who proposes a change in specified procedures, facilities, amenities or other measures that may affect biosecurity risk must give the Agriculture Department reasonable written notice of the proposed change (s 9(4)-(5)). The instrument does not define “responsible for carrying out operations”, so it may capture port operators, terminal operators, stevedores or other operational contractors depending on contractual arrangements.

Vessel operators and masters. Vessels other than non‑commercial and passenger vessels are subject to the first point of entry designation for the port (s 5). For such vessels arriving at Port of Melville Bay the Act requires them to be brought to a biosecurity entry point “as soon as practicable” (note to s 7 referencing s 246 of the Act). The instrument therefore affects masters and operators of commercial vessels trading to the port by directing their approach and berthing to the designated wharfs.

Owners/operators of goods. The instrument names classes of goods, baggage carried on non‑excluded vessels and inorganic bulk goods, that are within the port’s first point of entry designation (s 6). Those bringing inorganic bulk goods to the port must have those goods brought to the Tanker Wharf biosecurity entry point for unloading where the Act’s s 147 requirement applies (note to s 8). Owners, shippers and stevedores handling inorganic bulk goods will be directly affected in unloading location and procedure.

Regulator and biosecurity officials. The Agriculture Department is the recipient of the notices required by s 9. Biosecurity officials and human biosecurity officers have their functions and powers under the Act; the instrument anticipates that those officials will use designated biosecurity entry points to perform functions set out in the Act (see s 9(5)(b) and the notes to ss 7-8).

Excluded classes. Non‑commercial vessels and passenger vessels are excluded from the port’s vessel designation (s 5). For those vessels the instrument does not make the port a first point of entry, so different obligations under the Act or other determinations may apply or not apply.

Intermediaries and contractors. Stevedores, terminal operators and service providers that manage the Cargo Wharf, Export Wharf and Tanker Wharf will be affected operationally by the designations and by notices of procedural or facility changes under s 9(4)-(5). They may also bear coordination costs to ensure arriving vessels and inorganic bulk goods are routed to the designated entry points.

The instrument creates targeted duties and establishes designations that trigger duties in the Act. It itself imposes limited duties; rights and enforcement mechanisms largely remain with the Act. The instrument’s operative duties are set out in Part 4 and in the designation provisions in Parts 2 and 3.

Duties to bring vessels and goods to biosecurity entry points. Where the Act requires it, an arrived vessel must be brought to a designated biosecurity entry point at the port “as soon as practicable” (note to s 7 referencing s 246 of the Act). Likewise, where the Act requires unloading to a biosecurity entry point, inorganic bulk goods carried by a vessel must be brought to the Tanker Wharf as soon as practicable for unloading (note to s 8 referencing s 147 of the Act). The instrument does not itself restate the operational content of ss 246 or 147; it designates where that Act‑level requirement will be met at Port of Melville Bay.

Notification duties on owners and lessees. Owners (or any one owner among multiple) and lessees (or any one lessee among multiple) of Port of Melville Bay must give the Agriculture Department prompt written notice if they become aware that there has been, or will be, a change to the business entity operating the port or a biosecurity entry point (s 9(2)-(3)). The duty is triggered on awareness of an actual or prospective change and requires written communication to the Department “as soon as practicable”.

Duty to give reasonable notice for proposed operational changes. A person or body responsible for port operations that proposes to make any of the changes listed in s 9(5) must give the Agriculture Department reasonable written notice of the proposed change (s 9(4)-(5)). The enumerated changes include modifications to procedures for biosecurity measures, to facilities or amenities for biosecurity officials and human biosecurity officers, to procedures affecting identification of biosecurity risks, to procedures affecting information flows to officials, and to procedures for managing other factors affecting biosecurity risk (s 9(5)(a)-(e)).

Rights implicit in designation. The instrument confers no affirmative private rights; rather it allocates responsibilities and specifies physical locations (biosecurity entry points). Commercial actors gain the predictability of knowing which wharfs are the designated entry points for particular vessel and goods classes (ss 7-8). That predictability informs operational planning, berthing and stevedoring arrangements.

Scope limitations and exclusions. The instrument limits its own scope to named classes of vessels and goods and to specified areas of the port (ss 5-8). It explicitly notes that Port of Melville Bay is not a first point of entry for any goods other than those listed (note to s 6). It also notes that for goods not designated as having a biosecurity entry point at the port the Act’s unloading requirement in s 147 does not apply to unloading those goods at the port (note to s 8). These limitations constrain the breadth of duties arising at this port under the determination.

Procedural formality. Notices required by ss 9(2)-(4) must be in writing and delivered to the Agriculture Department. The instrument sets the required form and recipient for the notifications but leaves timing standards,“as soon as practicable” and “reasonable notice”,to be construed in context and potentially under the Act.

Authority and legal basis. The instrument is made under s 229(1) of the Act (s 3). Where the instrument triggers duties in the Act (for example to bring vessels to biosecurity entry points or to unload goods at a designated point), those duties arise under the Act itself (see the notes to ss 7-8 referencing ss 246 and 147). The instrument adds a layer of port‑specific designation and process rather than creating a new standalone regulatory regime.

The determination itself does not set out specific penalties or enforcement mechanisms. It operates as an administrative determination under the Act and therefore interacts with the Act’s enforcement framework. The instrument repeatedly refers to the Act for substantive consequences of failure to meet obligations that the Act creates or makes operative at the first point of entry (see s 3 and notes to ss 6-8).

No penalty provisions in the instrument. The text contains no express civil or criminal penalty provisions, no infringement notice scheme, and no explicit power to issue directions or impose sanctions within the instrument. The instrument’s Part 4 imposes notification duties on owners, lessees and operational parties, but does not itself specify penalties for failing to give those notices (s 9).

Enforcement lies with the Act. Because the instrument is made under subsection 229(1) of the Biosecurity Act 2015 (s 3), enforcement of obligations that derive from the instrument’s designations will depend on the Act’s enforcement powers and sanctioning provisions. The instrument references the Act in relation to duties to bring vessels and goods to biosecurity entry points (notes to ss 7 and 8 referencing ss 246 and 147 respectively) and directs readers to the Act for matters such as prohibited goods and conditionally non‑prohibited goods (note to s 6 referencing ss 173 and 174). Those Act provisions will need to be consulted to identify the specific enforcement tools, penalties, or remedial measures that could be applied for non‑compliance.

Administrative oversight and disclosure obligations. The instrument designates the Agriculture Department as the recipient of written notices required under s 9. The Department is the administrative hub for monitoring changes to business entities, procedural changes and proposed operational changes that could affect biosecurity risk management. The instrument thus creates a compliance and information flow to the Department that the Department may use under the Act to assess and, if necessary, act in accordance with the Act’s enforcement powers.

Practical enforcement implications. Practically, failure to bring designated vessels or inorganic bulk goods to the named biosecurity entry points when required under the Act may engage the Act’s operational powers (for example, powers to direct movement, inspection, treatment, detention or seizure), though those powers and their conditions are not spelled out in this instrument. Likewise, failure by owners, lessees or operational parties to give required written notices may expose them to regulatory follow up under the Act. The instrument itself leaves the content and exercise of enforcement powers to the Act.

Uncertainty in standards for compliance. The instrument uses standards such as “as soon as practicable” and “reasonable notice” without quantifying them (ss 9(2), 9(3), 9(4) and notes to ss 7-8). Those standards are potentially fact specific and will likely be interpreted with reference to the Act, administrative practice and context at the port. The instrument therefore places some compliance discretion and interpretative burden on regulated parties and on the Agriculture Department.

The instrument is tightly linked to the Biosecurity Act 2015 and, by reference, to the Biosecurity Regulation 2016. It operates as a port‑specific administrative determination that functions inside that broader statutory regime.

Legal basis in the Act. The instrument is made under subsection 229(1) of the Biosecurity Act 2015 (s 3). It explicitly references the Act’s definitions and provisions: “vessel” and other expressions are used as defined in s 9 of the Act (s 4 note); “goods” is used as defined in s 19 of the Act and the instrument’s definition of goods situates them in the Act’s framework (s 4). The instrument depends on the Act for substantive duties and enforcement, as seen in notes that direct readers to ss 173, 174, 147 and 246 of the Act for prohibited goods, conditionally non‑prohibited goods, unloading duties and vessel movement to biosecurity entry points respectively (notes to ss 6-8).

Relationship to the Biosecurity Regulation 2016. The instrument incorporates by reference the definition of “non‑commercial vessel” from the Biosecurity Regulation 2016 (s 4). That means some aspects of scope turn on the Regulation’s definition, which is external to the instrument.

Complementarity with Act provisions. By designating the port as a first point of entry for specific vessel and goods classes and by designating particular wharfs as biosecurity entry points, the instrument tells operators where Act‑level duties are to be performed at Port of Melville Bay. For example, where the Act requires a vessel to be brought to a biosecurity entry point (s 246 of the Act), the instrument supplies the specific locations (s 7). Where the Act requires goods to be unloaded at a biosecurity entry point (s 147 of the Act), the instrument supplies the designated location for inorganic bulk goods (s 8).

Limits and exclusions that affect interaction. The instrument’s exclusions shape how the Act applies at the port. The port is not a first point of entry for goods other than those listed (note to s 6). The instrument also states it does not designate biosecurity entry points for goods other than those listed, and so the Act’s unloading duty in s 147 does not apply to unloading of those other goods at the port (note to s 8). Those carve‑outs will be important in determining which Act obligations are engaged at the port for particular goods.

Operational interface with administrative processes. The instrument requires written notices to the Agriculture Department about changes to operators, procedures and facilities that affect biosecurity risk management (s 9). Those notice obligations interact with the Department’s administrative functions under the Act, including risk assessment, allocation of biosecurity officials, and possible application of the Act’s control measures. The instrument does not alter how the Act’s statutory powers are exercised, but it creates an information flow that the Department can use within its statutory remit.

No interaction with other statutes within the instrument. The instrument itself does not reference other Commonwealth statutes (such as customs, shipping or workplace safety laws). It is narrowly focused on biosecurity and explicitly relies on the Act and the Regulation for definitions and for operational context.

Interpretative dependencies. Because the instrument uses terms and standards from the Act and Regulation and does not quantify timeframes or thresholds for “as soon as practicable” or “reasonable notice”, regulated parties will need to interpret their duties by reference to the Act, administrative guidance and practice at the Department. The instrument therefore creates an interpretative dependence on the Act and on how the Agriculture Department applies the Act’s standards in practice.

The instrument includes a commencement table and records its original commencement date. It contains no internal amendments, amendment powers or subsequent amendment entries.

Original making and commencement. The determination is dated 7 June 2019 and signed by Dean Merrilees as delegate of the Director of Biosecurity (the instrument header and signature block). The commencement table records that the whole instrument commenced on 16 June 2019 (s 2 and the commencement table). The instrument states that the commencement table relates only to the provisions of the instrument as originally made and that it will not be amended to deal with later amendments (s 2(1)-(2)). The instrument therefore has a clear single‑date commencement entry.

No amendments recorded in the instrument. The document contains no later‑dated amendments, no schedules adding or removing designated areas, and no saving provisions. It does not include transitional arrangements or sunset dates. The instrument’s Note to the commencement table makes explicit that the table refers only to the original instrument.

Amendment mechanism. The instrument is made under subsection 229(1) of the Biosecurity Act 2015 (s 3). Any amendment to the instrument would need to be made under the authority of that subsection or under any other enabling provision in the Act. The instrument itself does not specify a delegated amendment power or procedural conditions for amendment beyond the general statutory framework.

Public record and versioning. The instrument contains a note that column 3 of the commencement table is not part of the instrument and that information may be inserted into that column or edited in published versions (s 2(2)). That is an editorial note about publication rather than an amendment. There are no recorded later editions or version numbers in the text provided.

Implication for practitioners. Because the instrument is short and contains no recorded amendments, practitioners should assume that the instrument as drafted is the operative instrument unless and until the Department issues a later determination or the Act is amended. Parties affected by the instrument should monitor the Agriculture Department for any future determinations or changes to first point of entry designations, and should cross‑check the Act and Regulation for any statutory amendments that alter the instrument’s legal context.

The instrument itself contains no recorded litigation history. There are no cases named in the text, no references to judicial interpretation, and no annotations or notes within the instrument describing legal challenges. The document is a straightforward administrative determination.

Absence of litigation record in the instrument. The instrument does not identify any disputes, appeals, or reviews that have been lodged in relation to its designation of Port of Melville Bay, its biosecurity entry point designations, or its notification conditions. The text does not include references to tribunal determinations or court decisions.

Implications of the absence. The absence of litigation history in the instrument means there is no statutory or judicial interpretative guidance embedded in the document itself. Any ambiguities in standards such as “as soon as practicable” or “reasonable notice” have not been crystallised by reference to judicial interpretation in this text. Parties seeking legal certainty will need to search external sources, the Act, any administrative guidance issued by the Agriculture Department, and any case law arising under the Act or related determinations,to obtain interpretative precedents.

Practical approach for disputed matters. If a party needs to challenge or clarify the application of the instrument, for example, whether a proposed change at the port required written notice or whether a vessel’s arrival was to be brought to a designated berth as soon as practicable, the relevant procedural avenues will be those provided under the Act and administrative law generally. The instrument itself does not set out appeal routes, merits review procedures or judicial review mechanisms.

Monitor for action under the Act. Because the instrument operates within the Biosecurity Act 2015 framework, any enforcement action, directions or penalties that might give rise to litigation would likely be traceable to enforcement steps taken under the Act rather than under the instrument alone. Parties should therefore monitor any administrative actions taken by the Agriculture Department that rely on this instrument for their legal basis.

The instrument is concise but contains several operational features and gaps that create practical risks and potential compliance traps. These are matters for attention because they affect who must act, when and how, and because the instrument leaves some standards open to context‑specific interpretation.

Unquantified time standards. Several duties are framed in open‑ended temporal terms: “as soon as practicable” for bringing vessels or goods to biosecurity entry points where the Act requires it (notes to ss 7-8 referencing ss 246 and 147), and “as soon as practicable” for owners and lessees to notify the Agriculture Department of a change (ss 9(2)-(3)). “Reasonable notice” is the standard for proposed operational changes (s 9(4)). Those standards are fact specific and not quantified in the instrument. In practice they can lead to disputes about timeliness and will require interpretation against operational realities at the port and potentially against the Act’s jurisprudence or administrative guidance.

Who must notify. The instrument places notification duties on “the owner (or, if there is more than one owner, an owner)” and “the lessee (if any) (or, if there is more than one lessee, a lessee)” (ss 9(2)-(3)). That formulation means that where there are multiple owners or lessees any one of them can meet the duty by giving notice. That can produce ambiguity about who is responsible for ensuring the notice is given and about whether an owner or lessee who does not provide notice remains at risk. The instrument does not clarify internal allocation of responsibility or the consequences of duplicate or conflicting notices.

Who counts as “responsible for carrying out operations”. The instrument requires persons or bodies responsible for carrying out operations at the port to give reasonable notice for proposed operational changes (s 9(4)). The instrument does not define who falls within that description. Depending on contractual arrangements, this could include port authorities, terminal operators, stevedores, cargo handlers or other service providers. Parties should establish internal protocols to determine who is the designated notifier to the Department.

Narrow goods designation and misreading risk. The instrument makes the port a first point of entry for baggage carried on non‑excluded vessels and for inorganic bulk goods only (s 6 and note 1). It explicitly states the port is not a first point of entry for other goods (note to s 6) and that no biosecurity entry points are designated for any other goods (note to s 8). A common operational mistake would be to assume the port is a first point of entry for all goods; practitioners must note the narrow scope.

Potential operational friction with berthing and logistics. Vessels have to be brought to designated wharfs (Cargo, Export, Tanker) for biosecurity processing where the Act’s requirements apply (s 7). That can create berthing competition, scheduling friction, and logistical costs if, for example, a vessel has been contracted to a different berth or requires cargo operations at an alternate location. The instrument does not provide a mechanism to arbitrate berth allocation or priority, so operational arrangements must be coordinated locally.

Reliance on external definitions. The instrument uses terms defined in the Act and Regulation. For instance, “non‑commercial vessel” is defined by reference to the Biosecurity Regulation 2016 (s 4). Parties need to consult the Act and Regulation to determine whether a particular vessel falls within the exclusion, rather than relying solely on the instrument.

No penalty specifications in the instrument. The instrument does not state the consequences of failing to give the written notices required by s 9, nor does it specify sanctions for failing to bring vessels or goods to designated entry points beyond referencing the Act. Parties should not assume the instrument is merely advisory; enforcement and penalty exposure will be governed by the Act, and the Department may treat non‑compliance as a matter for action under Act powers.

Single port focus and dependency on Department practice. The instrument is specific to Port of Melville Bay and does not establish national standards. Consequently the practical effect of the instrument will depend heavily on how the Agriculture Department implements its oversight, how promptly it acknowledges notices, what follow up it requires, and what operational expectations it communicates. Those administrative practices are not set out in the instrument itself.

Recordkeeping and evidence. Notices must be in writing (s 9(2)-(4)), but the instrument does not prescribe delivery method, address details beyond the recipient as “the Agriculture Department”, or retention periods. Parties should ensure delivery methods provide robust proof of receipt and maintain internal records of notices to demonstrate compliance.

The instrument imposes a limited set of procedural and operational obligations. Compliance focuses on notification, routing of vessels and goods to designated berths when the Act requires it, and internal process adjustments to ensure the port’s operations do not frustrate biosecurity functions. The following steps will help owners, lessees, operators and vessel masters meet the instrument’s requirements.

1. Map who is “owner”, “lessee” and “responsible for carrying out operations”. Establish an internal register identifying the legal owners, any lessees and the entities responsible for operational control at Port of Melville Bay. Because the instrument permits any one owner or lessee among multiple to give the required notices (ss 9(2)-(3)), parties should allocate notification responsibility contractually and document the nominated notifier to avoid gaps.

2. Set up written‑notice procedures to the Agriculture Department. The instrument requires notices to be in writing (ss 9(2)-(4)). Create a standard form notice template that captures: a description of the change, the effective date or proposed date, the party making the change, and contact details. Establish a delivery method that generates proof of delivery, registered mail, secure email with delivery/read receipts, or hand‑delivered and signed acknowledgements. Maintain internal logs of all notices and acknowledgements.

3. Clarify timing triggers for “as soon as practicable” and “reasonable notice” in practice. Although the instrument leaves those standards open, practical compliance requires internal thresholds. For ownership or lessee changes (ss 9(2)-(3)), aim to serve notice immediately on formal change or within a short, conservative timeframe (for example within 48-72 hours of becoming aware), subject to legal or commercial constraints. For proposed operational changes (s 9(4)), set an internal minimum notice period that is sensitive to the nature of the change, more complex procedural or facility changes should have longer lead times that allow the Agriculture Department to consider operational impacts.

4. Identify which operations trigger notice under s 9(5). Review current procedures and planned operational changes against the list in s 9(5)(a)-(e). If any change could affect biosecurity measures, facilities for officials, the ability to identify risks, information flows to officials, or the management of contributing factors to biosecurity risk, prepare a written proposal and provide reasonable notice to the Department. Do not assume minor operational changes are excluded; conduct a risk‑review checklist.

5. Coordinate berth and cargo planning with vessel operators and stevedores. For vessels that are not non‑commercial or passenger vessels, ensure berth plans take into account that Cargo Wharf, Export Wharf and Tanker Wharf are the designated biosecurity entry points for vessels (s 7). For inorganic bulk goods, ensure plans route them to Tanker Wharf for unloading where the Act requires unloading at a biosecurity entry point (s 8 and the note referencing s 147 of the Act). Incorporate these designations into voyage plans, berthing schedules and terminal operating procedures, and brief masters and agents accordingly.

6. Verify vessel and goods classification. Before arrival, verify whether a vessel is a non‑commercial vessel or passenger vessel under the Regulation and whether goods are inorganic bulk goods as defined by the instrument (s 4). For baggage carried on a vessel, confirm whether the vessel is excluded by s 6’s vessel exclusions for baggage to be within the port’s first point of entry. Document the classification decision and the legal basis for it.

7. Maintain facilities and amenities for officials. The instrument identifies potential changes to facilities or amenities for biosecurity officials as a trigger for notice (s 9(5)(b)). Ensure that physical arrangements at the designated wharfs (Cargo, Export, Tanker) meet current requirements for officials to carry out inspections and other functions, and that planned facility changes are reviewed for biosecurity implications before implementation.

8. Ensure information flows to biosecurity officials. The instrument highlights procedures that may affect officials’ ability to be informed of identified risks (s 9(5)(d)). Develop protocols for immediate reporting of identified biosecurity risks, including contact points, escalation procedures, and secure data sharing arrangements with the Agriculture Department.

9. Keep contemporaneous records of operations and notices. Create a compliance file that holds all written notices, correspondence with the Agriculture Department, voyage plans, berth allocations, cargo manifests for inorganic bulk goods, and internal risk assessments. That documentation will be essential if the Department queries a change or if a dispute arises about timeliness or sufficiency of notice.

10. Engage with the Agriculture Department proactively. Because the instrument relies on the Department to receive notices and to exercise powers under the Act, maintain a point of contact and consider seeking confirmation of receipt and any regulatory expectations following notice. If a proposed change is significant, request a meeting with the Department to discuss timing and mitigation measures.

11. Liaise with contractors and tenants. Incorporate the notification and routing requirements into contracts with terminal operators, stevedores, agents and other contractors. Ensure contractual clauses require immediate communication of any planned changes that fall within s 9(5) and assign responsibility for giving notice where appropriate.

12. Legal and insurance review. Given the potential for operational disruption if vessels are required to re‑berth to designated wharfs “as soon as practicable”, review voyage charters, stevedoring contracts and insurance arrangements to ensure they reflect the port’s designation and the possibility of regulatory directions under the Act.

13. Monitor changes in the Act and Regulation. Because the instrument depends on the Biosecurity Act 2015 and the Biosecurity Regulation 2016 for definitions and enforcement, regularly check for amendments to those instruments that may change the port’s obligations, the definitions of vessel classes, or the Act’s operational powers.

By following these steps and documenting decisions and notices, owners, lessees and operators can translate the instrument’s concise obligations into operational practice and reduce the risk of non‑compliance or dispute.
