Biosecurity (First Point of Entry—Port of Christmas Island) Determination 2022

The Determination uses a small number of formal legal concepts drawn from the Act and defines a limited set of terms for local application. The key statutory concepts instantiated are first point of entry and biosecurity entry point, and the instrument sets classes of vessels and goods to which those designations apply.

First point of entry: A first point of entry is a place where a vessel or goods may be brought into Australian territory and where biosecurity controls under the Act apply. The Determination designates Port of Christmas Island as a first point of entry in two discrete ways: for vessels (specifically, for vessels other than passenger vessels) (s5) and for specified classes of goods (s6). The Determination’s Note 1 emphasises that the port is not a first point of entry for goods beyond those specifically listed in s6.

Biosecurity entry point: Separate from the high‑level first point of entry designation, the Determination sets out specific areas within Port of Christmas Island that are designated as biosecurity entry points for defined vessel types and classes of goods (ss7-8). These are mapped in table form in the instrument. For vessels, the tables pair particular vessel classes (for example non‑commercial vessels; vessels other than non‑commercial and passenger vessels) with specific moorings or berths (s7). For goods, the instrument pairs specific goods classes (for example freight containers, general goods; non‑commercial vessel waste) with specific areas such as Crane Berth, Rock Berth, Smith Point and Flying Fish Cove Jetty (s8).

Defined classes and special terms: The Determination provides local definitions to fix the scope of the goods classes it governs (s4). Notable defined terms include:

• freight container, explicitly limited to 20‑foot or 40‑foot reusable containers that can shift modes without unloading (s4);
• general goods, defined negatively as goods other than baggage, freight containers, live horses or waste (s4);
• inorganic bulk goods, defined as chemicals, ores, minerals or gases brought in bulk that do not contain animals, plants, organic compounds or microbes (s4);
• non‑commercial vessel and non‑commercial vessel baggage/waste, cross‑referenced to the Biosecurity Regulation 2016 for the non‑commercial vessel definition (s4).

Operational default obligations referenced from the Act: The Determination’s notes remind operators that broader statutory obligations in the Act interact with these designations. For example, the instrument notes that a vessel that has arrived at Port of Christmas Island must be brought to a biosecurity entry point “as soon as practicable” (referring to s246 of the Act) and that goods unloaded from a vessel must be brought to a biosecurity entry point as soon as practicable (referring to s147 of the Act). It also points to s173 and s174 of the Act where prohibited or conditionally non‑prohibited goods are dealt with (s6 Note 2).

Notification conditions: The Determination conditions the first point of entry designation on specified notice obligations (s9). Those obligations require owners and lessees to notify the Agriculture Department, in writing, if they become aware that there has been, or will be, a change to the business entity operating the port or a biosecurity entry point (s9(2)-(3)). Persons or bodies responsible for port operations must give the Agriculture Department “reasonable notice” before making certain listed procedural or facilities changes that may affect biosecurity risk management (s9(4)-(5)). The kinds of change that trigger the “reasonable notice” requirement are enumerated in s9(5) and include procedural changes that would affect identification or communication of biosecurity risks and changes to facilities or amenities required by biosecurity officials.

Authority and commencement: The Determination is made under the Act’s delegated power (s3 citing subsection 229(1) of the Act) and commenced on 16 March 2022 (s2).

The Determination directly affects several discrete groups of stakeholders by designating who must use specified areas within Port of Christmas Island and who must provide notice to the Agriculture Department.

Owners and lessees of Port of Christmas Island: Section 9 places direct written notice obligations on the owner (or, if there is more than one owner, an owner) and on the lessee (if any) (or, if there is more than one lessee, a lessee) of Port of Christmas Island. The owner and lessee obligations are triggered when they become aware that there has been, or will be, a change to the business entity operating the port or a biosecurity entry point (s9(2)-(3)). The instrument also makes the port’s designation conditional on those notice obligations (s9(1)).

Persons or bodies responsible for operations at the port: Section 9(4) and (5) require any person or body responsible for carrying out operations at the port to give the Agriculture Department reasonable written notice of proposed changes that fall within the enumerated categories in s9(5). Those categories relate to procedures for biosecurity measures, facilities and amenities for biosecurity officials, and procedures affecting identification and communication of biosecurity risks (s9(5)(a)-(e)).

Vessel masters and operators: The Determination designates the port as a first point of entry for vessels other than passenger vessels (s5) and specifies where those vessels must be brought within the port as biosecurity entry points (s7). The instrument’s note points to s246 of the Act for the general obligation that a vessel must be brought to a biosecurity entry point as soon as practicable. Practically, masters and operators of non‑passenger vessels arriving at Port of Christmas Island will need to plan arrival manoeuvres and berth selection around the designated biosecurity entry points listed in s7.

Operators or consignees of goods: The Determination makes Port of Christmas Island a first point of entry for several defined classes of goods (s6). That affects commercial importers, freight forwarders, stevedores and consignees moving:

• baggage other than passenger vessel baggage (s6(a));
• freight containers of the defined 20‑ or 40‑foot type (s4);
• general goods as defined (s4, s6(c));
• non‑commercial vessel waste (s6(d));
• waste unloaded from vessels operated by Australian Border Force and the Royal Australian Navy (s6(e)).

Stevedores and port service providers: The designation of specific physical areas for particular goods and vessels (ss7-8) affects port service providers who load, unload and handle goods and vessels. For example, Crane Berth is designated for freight containers and general goods (s8 item 2), whereas Flying Fish Cove Jetty is designated for non‑commercial vessel baggage and waste and for waste unloaded from ABF/RAN vessels (s8 item 3). Service providers will have to coordinate movements to and from those designated areas.

Government agencies and biosecurity officials: The Determination implicitly affects how biosecurity officials and human biosecurity officers operate at the port by specifying which parts of the port are intended for inspection and control and by requiring reasonable notice of changes to facilities or procedures that would affect officials’ ability to perform functions under the Act (s9(5)(b), (d)). The instrument specifically references the needs of biosecurity officials and human biosecurity officers (s9(5)(b)).

Exclusions and limits: Passenger vessels and passenger vessel baggage are excluded from the port’s first point of entry designation for vessels and certain baggage classes (s5; s6(a) excludes passenger vessel baggage). The Determination’s Note 1 reinforces that the port is not a first point of entry for goods other than those listed in s6.

Regulatory and compliance intermediaries: Freight forwarders, customs brokers and carriers will be affected by the mapping of goods to berths and the notification requirements, as those intermediaries are typically responsible for ensuring goods arrive and are presented at the appropriate statutory entry point and for coordinating the operational changes that would trigger s9 notice obligations.

Overall, the Determination distributes duties among port owners, lessees, operators, vessel masters, goods handlers and biosecurity officials by prescribing which parties must present vessels and goods at particular points and which parties must inform the Agriculture Department of material business and operational changes. The instrument names the relevant parties and specifies the textual thresholds that trigger obligations (for example becoming aware that a change has occurred or will occur (s9(2)-(3)) and proposed changes requiring reasonable notice (s9(4)-(5))).

The Determination imposes explicit duties and establishes the nominated rights of biosecurity officials to make use of designated port areas. The legal obligations are narrowly stated in the instrument; enforcement and sanctioning are left to the Act.

Designations creating operational duties

• Port of Christmas Island as first point of entry for vessels other than passenger vessels (s5) and for the listed classes of goods (s6). Those designations trigger the Act’s existing controls and procedures for vessels and goods presented at first points of entry (notes reference ss147 and 246 of the Act).
• Designation of specific areas within the port as biosecurity entry points for particular vessels and goods (ss7-8). Where a vessel arrives at the port it must be brought to a biosecurity entry point for that vessel "as soon as practicable" (instrument’s note referencing s246 of the Act). Similarly, goods unloaded from a vessel must be brought to the biosecurity entry point for those goods "as soon as practicable" (instrument’s note referencing s147 of the Act).

Notification duties (conditions)

• Owner’s duty: If an owner becomes aware that there has been, or will be, a change to the business entity operating Port of Christmas Island or a biosecurity entry point, the owner must give the Agriculture Department written notice as soon as practicable after becoming aware (s9(2)).
• Lessee’s duty: Equivalent duty placed on lessee(s) where a lessee becomes aware of such a change (s9(3)).
• Operational change notice: A person or body responsible for operations must give the Agriculture Department in writing reasonable notice of a proposed change identified in s9(5) (s9(4)). The instrument lists the types of change that are captured (s9(5)(a)-(e)), including procedural changes affecting biosecurity measures, changes to facilities and amenities for biosecurity officials, and changes affecting identification or communication of biosecurity risks.

Form and timing of notices

• Notices must be in writing (s9(2)-(4)). The owner/lessee obligation is triggered once they “become aware” that there has been, or will be, a change; they must give notice “as soon as practicable” after becoming aware (s9(2)-(3)). For proposed operational changes the trigger is a requirement to give “reasonable notice” (s9(4)).

Who decides and who acts

• The instrument itself was made by a delegate of the Director of Biosecurity (instrument header) under the Act (s3). The Determination specifies the areas to which biosecurity officials will have access and that vessels and goods must be directed to those areas in the ordinary course (s7-8). The Act’s powers and duties will determine the extent of officials’ actions at those designated points (the Determination references relevant Act sections for obligations to present vessels/goods to those points).

Rights under the Determination

• The Determination does not create affirmative private rights; it prescribes where vessels and goods must be presented and who must notify the Agriculture Department of certain changes. Rights to use particular berths beyond ordinary property and commercial rights are not granted by this instrument; instead, these designations set the legal framework within which biosecurity controls under the Act are exercised.

Scope limits embedded in definitions

• The instrument’s definitions narrow the universe of goods and containers governed by the Determination (s4). Freight container is limited to the 20‑ and 40‑foot reusable containers described in s4; inorganic bulk goods are limited to chemicals, ores, minerals or gases that do not contain biological material (s4). The practical effect is that other container types or goods may not attract the same first point of entry designation at this port.

Interaction with Act obligations

• The Determination repeatedly operates as a subordinate instrument that ties local operational detail to general Act obligations. The notes linking to ss147 and 246 of the Act are operationally important because those sections set the statutory framework that makes the “as soon as practicable” movement requirement meaningful in practice.

Absence of penalties in the Determination

• The Determination itself does not set penalties or an enforcement regime; it imposes duties and leaves enforcement, compliance mechanisms and penalties to the Act and related regulations (see s3 and the instrument as a determination under the Act).

The Determination does not itself set out penalties, infringement notices or detailed enforcement mechanisms. It is a subordinate legislative instrument made under subsection 229(1) of the Biosecurity Act 2015 (s3), so enforcement and sanctioning for failure to comply with duties created by the Act or its subsidiary instruments are governed by the Act and associated regulations rather than by this Determination. The instrument repeatedly uses mandatory language , for example the owner or lessee “must give the Agriculture Department, in writing, notice” (s9(2)-(3)), and a person or body “must give the Agriculture Department, in writing, reasonable notice” of certain proposed changes (s9(4)) , but it does not state what statutory consequences flow from non‑compliance.

Where enforcement mechanisms are likely to be located

• The Determination cross‑references parts of the Act that impose obligations on vessels and goods at first points of entry (notes referencing ss147 and 246 of the Act). Those Act provisions typically include powers for biosecurity officers to direct, detain, inspect, treat, require removal or take other control measures over vessels and goods, and also to impose civil and criminal sanctions for specified contraventions. Because those substantive powers and penalties sit in the Act, failing to bring a vessel or goods to the designated biosecurity entry point or failing to comply with directions by a biosecurity official would be matters for the Act’s enforcement provisions, not for the Determination itself.

Administrative enforcement and regulatory interface

• The Determination creates administrative duties (written notices, reasonable notice of proposed changes) that will be monitored by the Agriculture Department. The instrument makes it clear that the Agriculture Department is the point of notification (s9). The Department, in its capacity as the executive agency administering biosecurity law, will exercise administrative powers and enforcement action under the Act where necessary. The Determination does not elaborate how the Agriculture Department will process or act on notices, whether there is a requirement to acknowledge receipt, or whether failure to notify results in a specific regulatory sanction under this instrument.

Discretion and ambiguity relevant to enforcement

• The Determination uses non‑precise standards such as “as soon as practicable” (referenced in the instrument’s notes, linking to ss147 and 246 of the Act) and “reasonable notice” (s9(4)). These standards are fact‑based and leave scope for administrative discretion in deciding whether an operator has complied. That discretionary space means enforcement will involve factual assessment against those standards, and where contest arises, the Act’s enforcement procedures and any relevant administrative review or judicial review pathways would determine remedy or sanction.

Recordkeeping and evidentiary implications

• Because the written notice obligations are explicit (s9(2)-(4)), evidentiary compliance will depend on documentary records: who gave notice, when they became aware, the content of notices and whether “reasonable notice” was provided for proposed changes. The Determination does not prescribe a notice form, timing thresholds or content requirements beyond the fact of notification; these matters will be operationally important in an enforcement context but are not specified in the instrument.

In short, while the Determination imposes mandatory duties and maps physical points where biosecurity controls apply, it leaves the legal consequences of non‑compliance and the execution of enforcement powers to the Biosecurity Act 2015 and related instruments rather than containing them within the Determination itself (see s3 and the instrument’s use of Act cross‑references).

The Determination is a subordinate instrument under the Biosecurity Act 2015 and is expressly framed to operate within the Act’s broader statutory scheme. It cross‑references several provisions of the Act and other subordinate instruments, and it both relies on and limits itself to the Act’s definitions and powers.

Authority under the Biosecurity Act 2015

• The Determination is made under subsection 229(1) of the Act (s3). That subsection provides the statutory head of power for the director or delegate to make determinations such as first point of entry designations. The instrument therefore has effect only within the scope of the delegated power granted by the Act.

Definitions taken from the Act and related regulations

• The instrument states that a number of expressions used in it are defined in section 9 of the Act and it explicitly adopts or relies on Act definitions for terms such as goods and vessel (see s4 and accompanying note). For example, the instrument defines “goods” as goods as defined by section 19 of the Act and makes that definition operative for the Determination (s4). The instrument also adopts the definition of “non‑commercial vessel” from the Biosecurity Regulation 2016 (s4), thereby linking the Determination’s operation to a separate subordinate regulation.

Cross‑references to Act provisions

• The Determination’s notes draw attention to the interplay with specific Act provisions:
  • Notes to s6 reference ss173 and 174 of the Act regarding prohibited goods and conditionally non‑prohibited goods. This signals that even where the port is a first point of entry for a class of goods, separate Act rules about prohibited or conditionally non‑prohibited goods still apply.
  • Notes to ss7 and 8 reference s246 and s147 of the Act respectively, indicating that statutory obligations to bring a vessel or unloaded goods to a biosecurity entry point “as soon as practicable” are sourced in the Act. These references make plain that the Determination does not create new movement obligations, but specifies local locations to which the Act’s movement obligations apply.

Administrative interface with the Department

• The Determination requires written notices to the Agriculture Department in relation to ownership/lessee changes and proposed operational changes (s9). Those procedural requirements create an administrative information flow from private parties to the Department. How the Department exercises any consenting, monitoring or follow‑up (for example whether it must approve changes) is not stated in the Determination and will be governed by departmental practice and the Act’s powers.

Interaction with operational statutes and agency roles

• The Determination makes specific reference to waste unloaded from vessels operated by the Australian Border Force and the Royal Australian Navy (s6(e)). That reference identifies an operational overlap with other Commonwealth agencies that operate vessels within Australian territory. The Determination does not harmonise or alter those agencies’ statutory functions; instead it brings waste from those vessels within the port’s first point of entry for the listed purposes.

Subordinate instrument status and possible amendment

• The instrument itself contains a commencement table and a note that the table relates only to the instrument as originally made (s2). That indicates the Determination can be amended later under the Act’s processes for subordinate legislation; any such amendment would be recorded in amending instruments. The Determination does not amend or displace the Act but rather implements Act powers locally.

No contradiction to other Commonwealth or State laws stated

• The Determination does not identify conflicts with other Commonwealth, state or Territory legislation. Because biosecurity is a Commonwealth competence, the Determination functions as Commonwealth subordinate law in relation to federally regulated biosecurity matters at Port of Christmas Island. State or Territory laws affecting port operations (for example planning, land tenure or local port infrastructure regulation) are not addressed in the instrument; however, the Determination does not purport to override other legal obligations outside the Act’s remit.

In summary, the Determination is a locally targeted subordinate instrument that sets where the Act’s existing biosecurity controls will be exercised at Port of Christmas Island and creates an administrative notice interface with the Agriculture Department. The Act remains the primary legal source of enforcement powers, definitions and procedural obligations referenced by this Determination (see s3, and references to ss9, 19, 147, 173, 174 and 246 of the Act).

The Determination’s own commencement clause (s2) and the embedded commencement table record the instrument’s origination details. The instrument specifies that the whole of the instrument commenced on 16 March 2022 (s2 and commencement table). The instrument also contains a note that the commencement table relates only to the provisions of the instrument as originally made and that it will not be amended in the table to record later amendments of the instrument (s2(1)-(2)).

Instrument creation and signature

• The Determination was made on 8 March 2022 by Barbara Cooper, Assistant Secretary, Biosecurity Operations Division, Department of Agriculture, Water and the Environment, acting as a delegate of the Director of Biosecurity (instrument header). Section 3 records that the instrument is made under subsection 229(1) of the Biosecurity Act 2015.

No amending instruments recorded in this text

• The text provided does not contain any subsequent amending schedules, stamps or notes indicating amendments after the original making. The Determination itself warns that the commencement table will not be amended to record later amendments, so absence of further entries here does not preclude later amendments archived elsewhere. The instrument’s internal note at s2(2) about column 3 content not being part of the instrument also signals that the instrument’s public versions may carry editorial notes.

How to check for later amendments

• To determine whether there have been subsequent amendments, a reader must consult the official Commonwealth legislative registers (for example Federal Register of Legislation) for any later determinations or amending instruments made under the Act. The Determination explicitly situates its original commencement and leaves open the standard subordinate‑law process for subsequent amendment under the Act.

Practical implications of amendment history

• Because the Determination ties first point of entry status to specific operational and physical port areas and imposes notice obligations, any amendment to the instrument could change where vessels and goods must be presented and who must notify the Department. The instrument’s commencement and signature details provide the baseline from which any later changes would be measured.

In short, the text shows the Determination was made 8 March 2022 and commenced 16 March 2022, and there are no further amendments recorded within the supplied text. To confirm any later amendments or revocations, consult the authoritative legislative register.

The Determination text supplied does not reference any litigation, judicial review, administrative appeals, or case law arising from its operation. It contains no citations to cases and does not note any judicial or tribunal challenges. The instrument itself is a statutory delegate’s determination made under subsection 229(1) of the Biosecurity Act 2015 and does not include a litigation history section.

What is not present in the text

• There are no recorded decisions, court or tribunal proceedings, or citations to judicial consideration of the Determination in the instrument. The instrument does not identify any disputes about the validity, interpretation or application of its provisions.

Where litigation would be found

• Any challenge to the Determination’s validity or to administrative action taken under it would typically be located in federal courts or tribunals and may take the form of judicial review proceedings, merits review (where applicable), or statutory offence prosecutions under the Act if enforcement action followed alleged non‑compliance. Such proceedings would be recorded in litigation databases and court registries rather than in the Determination itself.

Checking for litigation

• To identify whether litigation or administrative review has occurred since the Determination’s commencement, consult public court records, tribunal decisions, government legal branch publications or the Federal Register of Legislation for any published notices of legal action. The supplied text contains no such records.

In practice, the absence of a litigation history in the instrument text means a reader should treat enforcement and adjudication questions as matters to be sourced in case law and administrative records external to the Determination.

This Determination contains several drafting and operational features that create concrete implementation points where parties should take care. The following are material issues evident from the instrument’s text and precise wording.

Narrow, literal definitions

• Freight container is narrowly defined as a reusable container described as a 20‑foot or 40‑foot container that can be transferred between transport modes without unloading goods (s4). Other container sizes or specialised containers are not captured by this definition and so may not fall within the Determination’s first point of entry designation for freight containers. Parties that use atypical container types should not assume they are covered.

Negative definition of general goods

• General goods are defined negatively as goods other than baggage, freight containers, live horses or waste (s4). That classification may create operational ambiguity for goods that sit near the boundary of those categories (for example specialised livestock equipment, or consignments mixed with baggage). The Determination does not provide guidance on borderline cases.

Selective coverage of goods

• Section 6 lists only certain goods as within the port’s first point of entry scope and Note 1 emphasises that other goods are not covered. Operators must not assume all imports or cargo classes will be handled under this Determination. The instrument cross‑references ss173 and 174 of the Act for prohibited or conditionally non‑prohibited goods (s6 Note 2), so the Act’s broader rules still apply.

Multiple owner/lessee wording

• The notice obligations in s9 are expressed as applying to “the owner (or, if there is more than one owner, an owner)” and similarly for lessees (s9(2)-(3)). The drafting means only one owner or one lessee must give the required notice, not necessarily all owners or all lessees. This creates a coordination risk: in joint ownership arrangements parties must allocate responsibility for notification and track who has actually provided the written notice. Failing to ensure an owner or lessee provides notice could create exposure under the Act when enforcement follows.

“Become aware” and timing standards

• The owner/lessee obligations are triggered when they “become aware” that a change has occurred or will occur, and they must give notice “as soon as practicable” after becoming aware (s9(2)-(3)). Both phrases are fact‑dependent and imprecise, which leaves scope for dispute about when the duty arose and whether the provided notice was timely. The Determination does not specify hours/days thresholds.

“Reasonable notice” for proposed changes

• Persons or bodies responsible for operations must give “reasonable notice” of proposed changes of the types listed in s9(5) (s9(4)). Reasonableness will be judged on the facts of each case, including the nature of the change, its likely impact on biosecurity officials’ ability to perform functions and the time available before implementation. The Determination does not define a minimum notice period.

Scope of proposed changes that trigger notice

• The list in s9(5) is broad in functional terms but specific in topics: procedures providing for biosecurity measures; changes to facilities or amenities for officials; changes affecting the ability to identify or inform officials of biosecurity risks; and other procedural changes that may affect the level of biosecurity risk associated with operations (s9(5)(a)-(e)). Determining whether a contemplated change falls within these descriptions will require an operational assessment and, potentially, consultation with the Agriculture Department.

Differing physical entry points for different goods and vessels

• The Determination maps particular vessels and goods to different physical parts of the port (ss7-8). For example, freight containers and general goods are directed to Crane Berth (s8 item 2), whereas non‑commercial vessel baggage and waste are directed to Flying Fish Cove Jetty (s8 item 3). Operationally, this means arrivals that mix classes of goods or vessels that shift role (for example a vessel that temporarily carries freight containers as well as crew with baggage) will need coordination to ensure each class is handled at its prescribed biosecurity entry point.

Exclusions for passenger vessels

• Section 5 states that Port of Christmas Island is a first point of entry for vessels other than passenger vessels. Coupled with s6(a), which excludes passenger vessel baggage from the port’s first point of entry coverage, operators of passenger vessels and passenger baggage should not assume the port is a first point of entry for that class; different arrangements will apply.

No procedural detail on notices

• The Determination requires notices to be in writing (s9(2)-(4)) but does not specify the content, address, required supporting documentation, or format. Parties must inquire of the Agriculture Department about preferred forms or address details and retain copies of notifications and acknowledgements to evidence compliance.

Interface with other agencies and operations

• The Determination includes waste from Australian Border Force and Royal Australian Navy vessels (s6(e)). That inclusion ties biosecurity control lines to vessels administered by other agencies whose operational needs may not align with commercial port schedules. Coordination across agency operational priorities will be necessary to meet the Determination’s requirements.

No express transitional provisions

• The Determination does not contain transitional provisions about changes in control or lessees that might already be underway at commencement. The “become aware” triggering language may capture both imminent and already completed changes from the point of awareness, but parties should not assume any grace period exists.

In short, the Determination’s detailed mapping and narrow definitions create clarity in some respects but also create practical risks around classification of goods, assignment of notification responsibility among multiple owners/lessees, timing standards expressed as “as soon as practicable” and “reasonable notice”, and operational coordination across berths and agencies. These are matters for port operators, owners and the Agriculture Department to manage operationally within the Act’s administrative framework.

Compliance with this Determination requires administrative processes, operational coordination and clear communication channels with the Agriculture Department. The Determination imposes concrete duties that should be implemented as standard operating procedures.

1. Map vessel and goods classes to physical entry points

• Review ss5-8 and prepare a port‑specific operational map showing which physical areas constitute the biosecurity entry points for each vessel class and goods class. For example, register that Crane Berth receives freight containers and general goods (s8 item 2), Flying Fish Cove Jetty receives non‑commercial vessel baggage and waste (s8 item 3), and that non‑commercial vessels should use Flying Fish Cove Moorings (s7 item 1). Make the map part of arrival/departure checklists used by masters, stevedores and port service providers.

2. Establish written notice procedures for owners and lessees

• Create a triggered notification protocol for owners and lessees to comply with s9(2)-(3). Assign a named person (or role) within ownership and leasing structures responsible for giving the required written notice when they become aware of a change to the business entity operating the port or a biosecurity entry point. Because the instrument’s wording requires only “an owner” or “a lessee” to notify, ensure that the nominated notifier is documented in ownership/lease agreements and that internal governance tracks the obligation to avoid duplication or non‑compliance.

3. Define “become aware” and documentation standards

• Develop an internal standard that records the date of “becoming aware” of a change (for example an incoming change notice, board resolution, executed sale agreement or other corporate notice) and requires written notice “as soon as practicable” thereafter. Because the Determination does not define timeframes, document the rationale for timeliness and retain evidence (emails, letters, time stamps) to demonstrate when the duty arose and when notice was given.

4. Draft a template written notice and maintain records

• Draft a written notice template to the Agriculture Department that includes: description of the change, effective date, contact details for the new/changed business entity, and documents evidencing the change (as attachments). Maintain a notice register with copies and proof of delivery. Because the Determination requires notices “in writing” (s9(2)-(4)), electronic notices should be sent to the official Department inbox and receipts retained.

5. Provide reasonable notice for proposed operational changes

• For proposed changes that fall within s9(5) (procedural changes impacting biosecurity measures, facility or amenities changes for officials, changes affecting risk identification or communication, and other procedural changes affecting biosecurity risk), give the Agriculture Department “reasonable notice” in writing. Because the Determination does not define reasonable notice, provide as much advance notice as operationally possible and offer to brief the Department on impact and mitigation measures. Consider offering a consultation window or impact assessment to demonstrate good faith and minimise risk of regulatory objection.

6. Coordinate arrival procedures with vessel masters and operators

• Update berth allocation and arrival checklists so masters and operators of vessels arriving at Port of Christmas Island bring their vessels and goods to the designated biosecurity entry points “as soon as practicable” (instrument notes referencing ss246 and 147 of the Act). Ensure shore teams, tugs and mooring crews understand which moorings/berths are designated for different vessel classes and goods categories and that those resources are available when arrivals occur.

7. Train port staff and service providers on goods classification

• Train stevedores, freight forwarders, customs brokers and other service providers to classify goods under the Determination’s definitions (s4, s6). Particular attention should be paid to freight container sizing (20‑/40‑foot containers only) and the negative definition of general goods. Implement checklists to separate consignments that must be handled at different designated areas.

8. Maintain facilities and amenities for biosecurity officials

• The Determination identifies changes to facilities or amenities available for biosecurity officials as a notifiable category (s9(5)(b)). Ensure current facilities meet Departmental expectations and, before changing access, office space, power, lighting or other amenities used by biosecurity officials, notify the Department and provide documentation on alternative arrangements.

9. Liaise with other agencies for ABF/RAN waste

• If handling waste unloaded from Australian Border Force or Royal Australian Navy vessels (s6(e)), coordinate with those agencies and the Agriculture Department to ensure the waste is directed to the designated biosecurity entry point and that handling arrangements meet both operational and security requirements.

10. Legal and administrative review

• Keep the Determination and its commencement details on file (s2). Regularly review the Federal Register of Legislation or Department guidance to identify any amendments or operational instructions that affect the Determination. Because enforcement is governed by the Act, ensure compliance processes also align with the Biosecurity Act 2015 and relevant regulations.

11. Document risk assessments for proposed procedural changes

• For any planned procedural change that potentially affects biosecurity risk identification or communication (s9(5)(c)-(d)), prepare a short written risk assessment to include with the notice to the Agriculture Department. This demonstrates proactive risk management and helps the Department assess whether additional mitigation is required.

12. Retain legal advice on borderline issues

• For borderline classification issues (for example unusual container sizes, mixed consignments or hybrid vessel uses), seek legal advice or formal clarification from the Agriculture Department before acting. Because the Determination creates obligations tied to precise classes and areas, a Departmental ruling or written confirmation will reduce operational uncertainty.

In summary, compliance requires organisational responsibility allocation (nominating who gives notices), documentation of awareness and notice dates, operational mapping to physical biosecurity entry points, advance consultation with the Agriculture Department for proposed changes, and recordkeeping to demonstrate timely written notice. These steps will mitigate the principal compliance risks that arise from the Determination’s notice standards and its mapping of goods and vessels to port areas.
