What it does
This instrument, the Biosecurity (First Point of Entry,Perth Airport) Determination 2019, mechanically designates Perth Airport as a first point of entry and designates specific biosecurity entry points for certain goods. It is made under subsection 223(1) of the Biosecurity Act 2015 (see s 3 of the instrument). The instrument:
- Declares Perth Airport to be a first point of entry for aircraft generally (s 5).
- Declares Perth Airport to be a first point of entry for all goods (s 6).
- Does not designate any area of Perth Airport as a biosecurity entry point for aircraft (s 7).
- Designates specific areas within Perth Airport as biosecurity entry points for particular goods identified in the instrument’s table (s 8). The table in s 8 designates a set of terminals for baggage (Perth Airport International Terminal 1; Perth Airport International Terminal 3; the terminal located at 26 Newton Road; the terminal at 131 Fauntleroy Avenue; and the terminal at 145 Fauntleroy Avenue) and designates “QANTAS CTO” as the biosecurity entry point area for live horses.
The instrument also imposes procedural conditions on owners, lessees and persons or bodies responsible for operations at Perth Airport (s 9). Those conditions require written notification, in prescribed timeframes, to the Agriculture Department of changes to business entities operating the airport or its biosecurity entry points, and reasonable written notice of proposed operational changes that affect biosecurity procedures, facilities, the ability to identify or communicate biosecurity risks, or other factors affecting biosecurity risk management.
The instrument repeatedly refers to provisions of the Biosecurity Act 2015. It notes that other statutory provisions govern whether particular goods may be brought into a first point of entry (see notes referring to s 173 and s 174 of the Act) and that section 147 of the Act requires goods unloaded from an aircraft at a first point of entry to be brought to a biosecurity entry point if one is designated for those goods. The instrument itself does not create or define criminal or civil penalties; enforcement and penalties, where relevant, are matters of the Biosecurity Act and its enforcement regime.
