Biosecurity (First Point of Entry—Melbourne Tullamarine Airport) Determination 2019

The instrument is short and conceptually focused. The main concepts it introduces or invokes are these:

• First point of entry: The determination explicitly designates Melbourne Tullamarine Airport as a "first point of entry" for aircraft generally (s 5) and for all goods (s 6). Those declarations trigger rules in the Biosecurity Act 2015 that apply to first points of entry; the instrument references the Act for related matters (s 3, notes to ss 5-6).

• Biosecurity entry point: Within a first point of entry, the Act contemplates "biosecurity entry points" which are discrete areas where biosecurity processes occur. The determination designates specific areas at Melbourne Tullamarine Airport as biosecurity entry points for specified goods classes (s 8). The table in s 8 sets out goods classes (column 1) and the corresponding areas (column 2). Specifically, baggage is to be handled at Melbourne Tullamarine Airport International Terminal 2 and Melbourne Jet Base; live horses at the First Point Animal Services Animal Transfer Facility (s 8 table).

• Scope of 'goods' and 'aircraft': The instrument defines "Act" as the Biosecurity Act 2015 and provides local definitions for "aircraft" and "goods" that refer back to the Act. "Aircraft" means an aircraft as defined by s 9 of the Act that is subject to biosecurity control; "goods" means goods as defined by s 19 of the Act that are subject to biosecurity control or subject to an exposed goods order (s 4). Thus, the instrument’s application is limited to biosecurity‑controlled aircraft and goods as defined in the Act.

• Interaction with Act provisions: The determination explicitly points users to relevant Act provisions: sections 173 and 174 (prohibited goods and conditionally non‑prohibited goods) and section 147 (obligation to bring unloaded goods to a biosecurity entry point) are mentioned in notes to ss 5-6 and s 8. Section 238 (requirement that an aircraft be brought to a biosecurity entry point where one is designated) is referenced in the note to s 7. The instrument itself therefore relies on the Act for consequences, obligations and penalties that are not set out within the instrument (s 3 notes).

• Conditionality and notification duties: The instrument attaches conditions to the designation: owners and lessees must give written notice to the Agriculture Department of changes to the business entity operating the airport or a biosecurity entry point, "as soon as practicable" after becoming aware of the change (s 9(2)-(3)). Persons or bodies responsible for operations must provide "reasonable notice" in writing of proposed changes to specified procedures or facilities that may affect biosecurity risk or officials’ ability to perform their functions (s 9(4)-(5)). The changes covered by s 9(5) are enumerated and include procedural and facilities changes that may affect identification, information flow, or management of biosecurity risks.

• Delegation and administrative actor: The instrument is made by a delegate of the Director of Biosecurity, evidenced by the signing by an Assistant Secretary, Compliance Division, Department of Agriculture (cover). The Department of Agriculture is the recipient of notices required by s 9.

Each of these concepts is derived from specific clauses in the determination. The instrument does not itself set penalties or operational standards beyond the notification duties and the designation of specific areas for baggage and live horses; instead it operates by declaring the point of entry status and directing readers to the broader Act for enforcement and conduct rules (notes to ss 5-8, s 3).

The determination creates discrete, identifiable affected parties by operation of its designations and conditions:

• Airport owner(s): Section 9(2) places a written-notice duty on "the owner (or, if there is more than one owner, an owner) of Melbourne Tullamarine Airport" to inform the Agriculture Department in writing as soon as practicable after becoming aware that there has been, or will be, a change to the business entity operating the airport or a biosecurity entry point. The instrument thus imposes an ongoing administrative obligation on ownership.

• Lessees: Section 9(3) mirrors the owners’ obligation for "the lessee (if any) (or, if there is more than one lessee, a lessee) of Melbourne Tullamarine Airport". Lessees who become aware of changes must notify the Agriculture Department in writing as soon as practicable. Both owners and lessees therefore share notification obligations (s 9(2)-(3)).

• Persons or bodies responsible for carrying out operations: Section 9(4) requires that a person or body responsible for carrying out operations at the airport give the Agriculture Department reasonable written notice of proposed changes referred to in s 9(5). This captures operators, contractors and others carrying out operational functions, to the extent they are the party responsible for operations.

• Operators of aircraft and carriers of goods: The instrument declares the airport a first point of entry for aircraft and goods (s 5-6). Although it does not in itself impose unloading obligations for all goods, it triggers the Act’s first point of entry regime. The instrument’s notes explicitly reference obligations under the Act for unloading goods to biosecurity entry points (s 8 note 1 referencing s 147 of the Act) and for moving aircraft to biosecurity entry points where designated (s 7 note referencing s 238). Therefore aircraft operators and goods handlers must be attentive to whether the Act’s requirements apply in practice, including for the designated goods classes (baggage, live horses) handled at the specified biosecurity entry points.

• Biosecurity officials and human biosecurity officers: The instrument’s conditions (s 9(5)(b)-(d)) explicitly focus on maintaining facilities, amenities and procedures that enable biosecurity officials and human biosecurity officers to perform their functions at the airport and to be informed of identified biosecurity risks. While biosecurity officials are not made addressees of duties by the instrument, the determination imposes obligations on airport owners, lessees and operators to keep officials able to perform their functions.

• Specific goods sectors/handlers: The s 8 table identifies two goods classes with designated biosecurity entry points. Baggage handlers, customs/baggage management teams and the listed terminal and base (Melbourne Tullamarine Airport International Terminal 2 and Melbourne Jet Base) are required locations for baggage as a biosecurity entry point (s 8 table, Item 1). Live-horse handlers and the First Point Animal Services Animal Transfer Facility are the designated area for live horses (s 8 table, Item 2). These specific sectors will experience concrete operational effects from the instrument.

• The Agriculture Department (Department of Agriculture): The Department is the recipient of required notices (s 9) and, by implication, the administrative actor monitoring compliance and processing notifications.

Who does not bear new duties under the instrument: the determination does not designate any area as a biosecurity entry point for aircraft at Melbourne Tullamarine Airport (note under s 7), so the instrument does not itself create a requirement to bring aircraft to a designated aircraft entry point at this airport. The instrument also does not specify duties for other classes of goods beyond baggage and live horses; the notes make clear that the unloading requirement under s 147 of the Act does not apply to other goods for which no biosecurity entry point is designated (s 8 note 2).

In short, the instrument places administrative and operational notification burdens on owners, lessees and operators; it creates location-specific handling requirements for baggage and live horses; and it aligns airport operations with the statutory first point of entry framework in the Biosecurity Act 2015, thereby making aircraft operators and goods handlers parties who must observe the Act’s obligations when they intersect with this determination (s 4-9).

The instrument creates specific duties and operates alongside statutory duties in the Biosecurity Act 2015 that it references. The instrument itself contains the following operative duties:

• Declaration duties (state status): By declaring Melbourne Tullamarine Airport a first point of entry for aircraft and goods, the instrument activates the Biosecurity Act’s first point of entry regime for that location (s 5-6). The act of declaration is a status-setting duty of the instrument-maker, not a behavioural duty on third parties, but it has legal consequences under the Act.

• Biosecurity entry point designation for goods: The instrument designates particular areas as biosecurity entry points for particular goods. Under s 8, baggage must be brought to Melbourne Tullamarine Airport International Terminal 2 or Melbourne Jet Base, and live horses to the First Point Animal Services Animal Transfer Facility. The designation creates a legal destination for unloading those goods where the Act’s unloading rules apply (s 8 table; s 8 note 1 referencing s 147 of the Act).

• Notification duties on owners/lessees: Section 9(2) requires an owner (or, if multiple owners, an owner) to give the Agriculture Department written notice "as soon as practicable" after becoming aware that there has been, or will be, a change to the business entity operating the airport or a biosecurity entry point. Section 9(3) imposes a parallel obligation on a lessee (or, if multiple lessees, a lessee). These duties create an ongoing administrative requirement to report changes in operating entities.

• Notification duties on operators: Section 9(4) requires a person or body responsible for carrying out operations at the airport to give the Agriculture Department reasonable written notice of proposed changes referred to in s 9(5). Section 9(5) specifies the types of changes requiring notice: procedural changes affecting biosecurity measures (9(5)(a)); changes to facilities or amenities for biosecurity officials and human biosecurity officers (9(5)(b)); procedural changes that may affect the ability of operational staff to identify biosecurity risks or to inform officials (9(5)(c)-(d)); and other procedural changes that may contribute to or affect the level of biosecurity risk associated with operations (9(5)(e)).

• Written form and timing standards: The instrument requires notices to be in writing; timing standards are "as soon as practicable" for actual or impending changes to business entities, and "reasonable notice" for proposed operational changes (s 9(2)-(4)). Those formulations impose standards of promptness and reasonableness without fixed deadlines.

Rights and omissions in the instrument:

• No detailed procedural rights or appeal mechanisms are set out in the determination. The instrument does not create explicit rights for third parties beyond the location designations for baggage and live horses. It does not itself create penalties or enforcement procedures; it relies on the Biosecurity Act 2015 for enforcement norms and consequences (s 3 and notes referencing Act sections).

• The instrument does not designate any area as a biosecurity entry point for aircraft (s 7 note). That omission effectively means the instrument does not create a designated aircraft biosecurity entry point at Melbourne Tullamarine Airport; where an aircraft is subject to biosecurity control, the Act’s s 238 requirement to bring an aircraft to a biosecurity entry point will only operate if a biosecurity entry point for aircraft has been designated.

• The instrument limits the unloading obligation under s 147 of the Act to those goods which are designated as having a biosecurity entry point at the airport. The instrument expressly notes that no biosecurity entry points are designated for other goods, and therefore the unloading requirement in s 147 of the Act does not apply to unloading of those other goods at Melbourne Tullamarine Airport (s 8 note 2).

• Delegation: The instrument was made under the delegated authority in s 223(1) of the Act and signed by a delegate (cover). This records the administrative chain of decision-making and points to the Department as the relevant administrative counterparty for notices required under s 9.

In sum, the primary duties created by the instrument are notification duties on owners, lessees and operators; designation-driven location duties for baggage and live horses; and activation of the Act’s first point of entry framework. The instrument intentionally leaves enforcement and detailed procedural rights to the Biosecurity Act 2015, as signposted in its notes and authority clause.

The determination itself contains no standalone penalty schedule or enforcement mechanisms. It makes administrative designations and imposes notification duties but does not specify fines, offences or enforcement procedures within its text. Enforcement and penalties therefore derive from the Biosecurity Act 2015, to which this instrument expressly refers as the source of authority (s 3) and for specific obligations (notes under ss 5-8 refer to ss 147, 173, 174 and 238 of the Act). Because the instrument does not reproduce the Act’s enforcement provisions, readers must look to the Biosecurity Act 2015 for contraventions and applicable penalties, and for the powers of biosecurity officials and human biosecurity officers.

The instrument does, however, create operational obligations that can interact with enforcement under the Act:

• Requirement to bring goods to biosecurity entry points: The instrument designates biosecurity entry points for baggage and live horses (s 8). The instrument’s note 1 to s 8 points to section 147 of the Act, which requires that where an aircraft has arrived at a first point of entry and is carrying goods mentioned in the table that are to be unloaded, those goods must be brought to a biosecurity entry point for those goods "as soon as practicable" (note referencing s 147). While the instrument does not itself prescribe sanctions for failing to comply with s 147, failure to adhere to s 147 (as set out in the Act) would engage the Act’s enforcement mechanisms.

• Aircraft movement to biosecurity entry points: The instrument’s note to s 7 reminds readers that under section 238 of the Act an aircraft must be brought to a biosecurity entry point at a first point of entry if a biosecurity entry point for the aircraft exists at that first point of entry. The instrument explicitly states it does not designate any area at Melbourne Tullamarine Airport as a biosecurity entry point for aircraft. Consequently, while s 238 of the Act supplies enforcement power where aircraft biosecurity entry points exist, that enforcement hook is not activated at Tullamarine under this determination (s 7 note).

• Notification duties and potential compliance consequences: Section 9 places written-notice duties on owners, lessees and persons or bodies responsible for operations. The instrument sets timing standards ("as soon as practicable" and "reasonable notice") but does not define a specific time limit or specify consequences within this instrument for failing to comply with the notification obligation. Any enforcement for non-provision of required notices would therefore depend on the enforcement provisions of the Biosecurity Act 2015 or on administrative action by the Agriculture Department under its statutory powers.

• Administrative oversight: The Department of Agriculture is the recipient of notices and the administrative actor in the scheme. The instrument evidences a supervisory relationship: by requiring notification of changes that could affect biosecurity risk, the instrument gives the Department the information rights needed to exercise its responsibilities under the Biosecurity Act. The instrument does not, however, state how the Department will use those notices, whether it can veto proposed changes, or whether it may impose conditions as a result, those powers, if any, must be sourced in the Act.

For practical compliance and enforcement exposure, affected parties should therefore read the Biosecurity Act 2015 provisions referenced by the instrument (ss 147, 173, 174, 223, 238 and others referenced in the definition notes) to identify the precise offences, penalties and enforcement powers that attach to failure to comply with the obligations the instrument activates. The determination functions as a localisation mechanism for the Act’s national machinery; the Act provides the enforcement teeth.

This Determination operates solely as an instrument under the Biosecurity Act 2015. It expressly cites the Act as its source of authority (s 3) and relies on specific Act provisions to define its legal consequences. The instrument’s textual interactions with the Act are explicit and narrow:

• Delegated authority under the Act: The determination is made under subsection 223(1) of the Biosecurity Act 2015 (s 3). That is the instrument’s legal foundation and indicates the administrative delegation used to make the determination. The instrument does not itself amend the Act; it operates within the statutory framework the Act sets out.

• Definitions sourced from the Act: The instrument points to the Act for definitions. Section 4 notes that expressions are defined in s 9 of the Act, and the instrument adopts the Act’s definitions for "aircraft" and "goods" by reference (s 4). Thus the instrument’s scope is coterminous with the Act’s definitions of those terms.

• Operational cross‑references to Act sections: The instrument refers to Act provisions that govern prohibited goods and conditions (ss 173 and 174) and to provisions that require goods to be brought to a biosecurity entry point (s 147) and aircraft to be brought to a biosecurity entry point where designated (s 238) (notes to ss 5-8). These references signal that the instrument localises and triggers the Act’s substantive and procedural rules at Melbourne Tullamarine Airport rather than creating new, standalone substantive rules.

• No conflict clauses or interaction with other statutes: The instrument does not mention any other Commonwealth, state or territory laws, nor does it contain express provisions on primacy or interaction with other regulatory regimes (for example, customs, aviation safety or local government). That omission means that any interface with other regulatory systems must be managed through normal legal channels: where the Biosecurity Act and other laws overlap or require coordination, the instrument does not itself prescribe inter-agency arrangements. The instrument’s focus is biosecurity, referencing the Department of Agriculture as the administrative counterpart.

• Administrative interface with airport governance: Section 9 requires owners, lessees and operators to notify the Agriculture Department of changes to the business entity operating the airport or biosecurity entry points and to provide reasonable notice of proposed changes affecting biosecurity procedures or facilities (s 9(2)-(5)). This creates an administrative information-flow obligation between private airport governance structures and the Commonwealth Department, which will interact in practice with contractual and corporate arrangements governing the airport. The instrument does not deal with contractual enforcement between owners and lessees; it imposes an external statutory notification duty that operates in parallel to any private law arrangements.

• Limits of instrument’s operative reach: The instrument explicitly states that it does not designate aircraft biosecurity entry points at Melbourne Tullamarine Airport (s 7 note). It also explicitly states that biosecurity entry point designations are limited to the items listed in the s 8 table; consequently, the s 147 unloading requirement in the Act does not apply to other goods unloaded at the airport (s 8 note 2). These carve-outs show the instrument’s deliberate, limited interface with other statutory rules: it localises some Act obligations (baggage and live horses) and leaves others dormant at this airport.

In short, the instrument functions as a statutory localisation device under the Biosecurity Act 2015. It does not create cross-sectoral regulatory frameworks or modify other statutes; it enables certain Act provisions to apply at Melbourne Tullamarine Airport and requires operators and governance stakeholders to provide specified notices to the Agriculture Department to facilitate the Act’s administration at that site.

The instrument contains a concise commencement and history record. The relevant material in the text is:

• The signing and date: The instrument is dated 7 June 2019 and signed by Dean Merrilees, Assistant Secretary Compliance Division, Department of Agriculture (instrument cover). That records the date of making and the delegate who made the determination.

• Commencement detail: Section 2 contains a commencement table. The table states that the whole of this instrument commenced on 16 June 2019 (s 2 and commencement table). The instrument notes that the table relates only to the provisions of the instrument "as originally made" and "will not be amended to deal with any later amendments of this instrument" (s 2(2)). The instrument also records that any information in column 3 of the table is not part of the instrument and may be edited in published versions (s 2(2)).

• No textual amendments shown within the instrument: The instrument as provided contains no later amendment clauses or schedules and does not itself record any subsequent amendments or revocations. The instrument’s own text therefore records only the original making and commencement details (7 June 2019 signature, commencement 16 June 2019).

• Implication for users seeking changes: Because s 2 expressly states that the commencement table will not be amended to deal with later amendments to the instrument, any formal amendment history would appear in the official legislative instrument register or subsequent instruments under the Act rather than within this instrument’s text. The instrument as presented does not contain an amendment log.

• No internal transitional or sunset provisions: The instrument does not include transitional arrangements, expiration, or sunset clauses. Its effect as a determination continues until varied or revoked under the Act’s powers, but those mechanisms are not set out in this instrument.

Practitioners relying on this instrument should therefore treat the document as recording the 2019 making and commencement only. Any subsequent changes to the designation, to the list of biosecurity entry points, or to the notification conditions would appear in amending instruments or revocations under the Biosecurity Act 2015 and are not reflected inside this determination.

The determination itself contains no litigation references, case citations or recorded judicial history. The instrument is a short administrative determination and does not include any judicial review or court decisions within its text.

Relevant observations from the instrument:

• No cases or legal challenges are mentioned in the text. The instrument contains only administrative content: declarations, a table of designated biosecurity entry points for goods, and notification conditions (entire instrument).

• Enforcement, offences and penalties are matters governed by the Biosecurity Act 2015, which the determination invokes (s 3 and notes to ss 5-8). Any litigation concerning the application, interpretation, or enforcement of obligations arising from this determination would therefore rely on the Act’s statutory causes of action, powers and penalties. The determination does not itself create or document litigation pathways.

• Practical implication for legal research: The instrument does not supply litigation outcomes or authorities. For any dispute or enforcement matter arising from the application of this determination, such as a question about whether a particular area is a biosecurity entry point, whether a party complied with the notification requirements, or whether an unloading obligation applied, relevant disputes would turn on the text of the Biosecurity Act 2015, the content of this instrument and the factual matrix of airport operations.

Because the instrument contains no litigation history itself, practitioners seeking to determine whether this determination has been the subject of litigation will need to consult external case law databases and the administrative record outside the instrument text. The instrument as supplied does not provide such references.

The instrument contains several features that can produce operational surprises if read superficially. These are concrete mechanics and drafting choices that change who has duties and when those duties apply:

• Limited designation for aircraft: Although s 5 declares Melbourne Tullamarine Airport a first point of entry for aircraft generally, the instrument expressly does not designate any area of the airport as a biosecurity entry point for aircraft (note under s 7). Consequence: the specific statutory obligation under the Act to bring an aircraft to a biosecurity entry point at a first point of entry will not apply at Tullamarine because no aircraft biosecurity entry point is designated by this instrument (s 7 note referencing s 238). Practitioners may expect that "first point of entry" implies a biosecurity entry point for aircraft; here it does not.

• Narrow goods designations: The instrument designates biosecurity entry points for only two goods classes: baggage and live horses (s 8 table). The effect is that many other goods, while the airport is a first point of entry for all goods (s 6), do not have a designated biosecurity entry point at Tullamarine under this instrument. The instrument explicitly notes that the s 147 requirement to bring unloaded goods to a biosecurity entry point does not apply to other goods not listed in the s 8 table (s 8 note 2). This selective designation means the act of making the airport a first point of entry is not synonymous with designating entry points for all goods.

• Vague timing standards: The notification duties use imprecise temporal standards: "as soon as practicable" (s 9(2)-(3)) and "reasonable notice" for proposed changes (s 9(4)). These standards create compliance uncertainty as they do not set fixed deadlines. That imprecision can produce dispute about adequacy of notice and invites Departmental assessment of whether notice was given promptly or reasonably.

• Multiple owners/lessees language: The instrument frames notices to be given by "the owner (or, if there is more than one owner, an owner)" and similarly for lessees (s 9(2)-(3)). That drafting allows a single owner or lessee among many to satisfy the obligation to notify. This creates ambiguity in multi-party ownership structures about who is expected to take responsibility for notification and whether multiple notices are required. It also raises potential coordination questions in complex concessional or leased airport governance structures.

• Broad scope of operational changes requiring notice: Section 9(5) covers several types of changes: procedural changes affecting biosecurity measures (9(5)(a)); changes to facilities or amenities for biosecurity officials/human biosecurity officers (9(5)(b)); and changes that affect identification or notification of biosecurity risks (9(5)(c)-(e)). These are broadly phrased and could capture relatively minor operational adjustments if they plausibly affect biosecurity risk or officials’ ability to function. Organisations must therefore interpret the threshold for "may affect the ability" or "may affect the ability for biosecurity officials ... to be informed" conservatively or face after-the-fact Departmental scrutiny.

• Written-notice modality: Section 9 requires notices "in writing" (s 9(2)-(4)). The instrument does not prescribe an address, electronic delivery mechanism or substantive format for those notices. Parties must therefore confirm with the Agriculture Department the preferred recipients, addresses and record-keeping processes for compliance.

• Reliance on Act provisions outside the instrument: Several operational consequences depend on provisions of the Biosecurity Act 2015 that are not reproduced here. The instrument’s notes refer to ss 147, 173, 174 and 238 of the Act (notes to ss 5-8). Failure to consult those Act provisions may lead a party to misread their legal obligations and exposure. The instrument’s limited internal content means compliance requires cross-referencing the Act.

• No administrative remedies or Departmental expectations set out: The instrument does not specify how the Department might respond to notices, whether it will approve, disapprove, or impose conditions upon proposed changes, or how it will follow up. That absence leaves a gap about the operational consequences of giving notice and the Department's role in approving or constraining changes.

Each of these features flows from the instrument’s text (s 5-9 and the notes). Parties operating at Melbourne Tullamarine Airport should treat the instrument as imposing targeted obligations and as a trigger to coordinate with the Agriculture Department and to consult the Biosecurity Act for the full legal consequence of the designations and notices required.

Compliance under this instrument is primarily administrative and operational. The instrument itself prescribes a small set of concrete steps; the rest requires aligning airport operations with the Biosecurity Act 2015 provisions the instrument invokes. Key compliance actions grounded in the instrument are:

1. Treat the airport as a first point of entry:

   • Operational staff, carriers and goods handlers should note that Melbourne Tullamarine Airport is declared a first point of entry for aircraft generally and for all goods (s 5-6). That status means the Biosecurity Act’s first point of entry rules may apply; read the Act provisions referenced in the instrument (ss 147, 173, 174, 238) to determine specific operational obligations.

2. Direct baggage and live-horse arrivals to the designated biosecurity entry points:

   • Ensure baggage identified as goods subject to biosecurity control is brought to one of the designated areas in the s 8 table: Melbourne Tullamarine Airport International Terminal 2 and Melbourne Jet Base (s 8 table, Item 1). For live horses designated in s 8 table Item 2, ensure arrival and transfer processes use the First Point Animal Services Animal Transfer Facility.
   • Coordinate with terminal and facility managers to ensure access, physical routing and staffing correspond to the designation and to accommodate biosecurity officials, as the instrument contemplates the facilities are to be used for biosecurity entry point purposes (s 8).

3. Establish written-notice procedures and internal triggers:

   • Owners: create a written-notice protocol requiring any owner (or one owner among multiple) to notify the Agriculture Department in writing "as soon as practicable" after becoming aware of a change to the business entity operating the airport or a biosecurity entry point (s 9(2)). Document who within the ownership structure is responsible for monitoring and sending notices.
   • Lessees: put an equivalent protocol in place for lessees to provide the written notices required by s 9(3).
   • Operators/contractors: set up an internal sign-off and notification process so that any person or body responsible for operations provides the Agriculture Department with "reasonable notice" in writing of proposed operational changes covered by s 9(5). Define what your organisation will treat as "reasonable notice" for internal purposes and ensure timely escalation.
   • Record keeping: keep contemporaneous records of notices, dates when parties became "aware", and the content of the notices, since the statutory standards in the instrument hinge on subjective reasonable/ practicable timeframes (s 9(2)-(4)).

4. Map triggers under s 9(5) and assess proposed changes against them:

   • Before implementing changes to procedures, facilities, amenities, risk identification or reporting processes, perform an internal assessment against the categories listed in s 9(5)(a)-(e). If a proposed change "may affect" biosecurity risk management or the ability of officials to perform their functions, give the Department reasonable written notice (s 9(4)-(5)).
   • Examples drawn from the instrument’s categories include: changes to passenger flow, baggage handling procedures, animal transfer processes, staff roles in risk identification, or physical alterations that affect biosecurity officials’ workspace. The instrument requires notice where such changes may affect the ability of officials to perform functions or be informed of risks (s 9(5)(b)-(d)).

5. Confirm Departmental contact and delivery mechanics:

   • The instrument requires notices to be "in writing" to the Agriculture Department (s 9(2)-(4)). Practitioners should confirm the correct postal and electronic addresses, any departmental forms or PO boxes to use, and who within the Department should be the recipient. Because the instrument does not specify contact details or format, confirm those with the Department to avoid procedural non-compliance.

6. Coordinate contractual arrangements:

   • Owners and lessees should ensure lease, concession and contractor agreements allocate responsibilities so that notices required by s 9 are given promptly and by the appropriate party. The instrument’s language allows an owner or a lessee to give notice (s 9(2)-(3)), so contractual clarity will avoid duplication or gaps.

7. Train staff and maintain logs:

   • Train operational staff to recognise the classes of goods subject to designated biosecurity entry points (baggage and live horses) and to alert management where proposed changes trigger s 9 obligations. Maintain logs of changes, notices, and responses from the Department.

8. Cross-reference the Biosecurity Act provisions:

   • Because the instrument references Act provisions (ss 147, 173, 174, 238) for substantive obligations such as unloading duties and prohibited goods, compliance requires cross-referencing the Biosecurity Act to determine the legal consequences of non-compliance with those Act provisions at Melbourne Tullamarine Airport. Practically, ensure legal or compliance teams review the Act alongside this instrument.

9. Prepare for flexible timing standards:

   • The instrument’s temporal standards,"as soon as practicable" and "reasonable notice",are not numerically defined. Internal compliance protocols should set conservative internal deadlines (for example, immediate escalation on becoming aware of a change, and a defined minimum prior-notice period for proposed changes) while recognising that external assessment of adequacy rests with the Department.

10. Monitor for instrument amendments:

    • The instrument itself records only its initial making and commencement (s 2). Organisations should monitor the legislative instrument register or the Department’s communications for any amending determinations that change the designations or notification requirements.

These compliance steps are drawn from the instrument’s operative text (s 4-9 and the s 8 table). The instrument places few prescriptive operational requirements beyond notice, designation of locations for two goods classes and the legal status of the airport; the remainder of compliance is exercised through the interaction with the Biosecurity Act 2015 and with the Department’s administrative expectations.
