Biosecurity (First Point of Entry—Gold Coast Airport) Determination 2019

The instrument operates by using a small set of statutory designations and procedural conditions. The core legal concepts in it are "first point of entry", "biosecurity entry point", "goods", "aircraft", and the notification conditions imposed on owners, lessees and operational bodies.

First point of entry: The instrument designates Gold Coast Airport as a first point of entry for two categories: aircraft (generally) and goods other than live horses (s5-6). The term "first point of entry" is not restated in the instrument but is used as the legal status that triggers other statutory obligations under the Biosecurity Act 2015; the instrument states that it is made under subsection 223(1) of that Act (s3) and cross‑refers in notes to other Act provisions dealing with entry and unloading (for example, s147 and s238 of the Act).

Biosecurity entry point: The instrument designates particular areas within the airport as biosecurity entry points only for certain goods. It designates baggage areas in the International Terminal and the Platinum Business Aviation Centre Terminal as biosecurity entry points for the class "Baggage" (s8 table). The instrument explicitly does not designate any area as a biosecurity entry point for aircraft (note to s7). The interplay between "first point of entry" and "biosecurity entry point" is important because, as the instrument notes, the statutory duty to bring an aircraft to a biosecurity entry point at a first point of entry applies only where a biosecurity entry point for aircraft exists at that first point of entry (note to s7, referencing s238 of the Act).

Goods and aircraft definitions: The instrument imports definitions from the Act. It expressly defines "Act" as the Biosecurity Act 2015 and repeats that "aircraft" and "goods" are as defined by the Act, with a local clarification that "goods" for this instrument means goods that are subject to biosecurity control or goods in relation to which an exposed goods order is in force (s4). That local clarification limits the operational reach of the instrument to goods within the Act's biosecurity ambit.

Procedural conditions: Part 4 imposes notification duties on owners, lessees and operational persons or bodies. Owners and lessees must provide written notice to the Agriculture Department "as soon as practicable" after becoming aware of a business entity change operating the airport or a biosecurity entry point (s9(2)-(3)). Persons or bodies responsible for operations must give the Agriculture Department "reasonable notice" in writing of proposed changes of the types listed in s9(5); those listed changes include modifications to procedures for biosecurity measures, facilities or amenities for biosecurity officials, and changes that may affect identification or communication of biosecurity risks (s9(4)-(5)). The instrument uses mandatory language "must" for these requirements (s9(2)-(4)).

Cross‑references to the Biosecurity Act: The instrument repeatedly places itself within the Act's framework. Notes in s6 and s8 direct the reader to ss173 and 174 of the Act for matters about prohibited or conditionally non‑prohibited goods, and to s147 of the Act for the duty to bring unloaded goods to a biosecurity entry point (notes to s6 and s8). The note to s7 references s238 of the Act on the duty to bring aircraft to a biosecurity entry point. The instrument therefore functions as a territorial and spatial specification of where Act obligations apply at Gold Coast Airport and as a source of procedural notification obligations to the Agriculture Department.

The instrument’s text identifies a limited set of affected parties and specifies the Department of Agriculture as the recipient of required notices. The parties affected by designation, duties and operational constraints are:

• Owners of Gold Coast Airport: An owner who becomes aware of a change to the business entity operating the airport or a biosecurity entry point must give written notice to the Agriculture Department as soon as practicable (s9(2)). The instrument contemplates multiple owners, and requires that an owner, if there is more than one, perform the notification (s9(2)).

• Lessees of Gold Coast Airport: Parallel obligations attach to lessees. If a lessee becomes aware of a change to the business entity operating the airport or a biosecurity entry point, the lessee (or, where there is more than one, a lessee) must give the Agriculture Department written notice as soon as practicable (s9(3)). The instrument therefore imposes duties on both proprietorial and leasehold interests.

• Persons or bodies responsible for carrying out operations at Gold Coast Airport: Where such a person or body proposes to make certain specified changes to procedures, facilities or amenities that affect biosecurity risk management or the ability to identify or communicate biosecurity risks, that person or body must give the Agriculture Department reasonable written notice of the proposed change (s9(4)-(5)). The instrument does not spell out an exhaustive list of "persons or bodies", but the phrasing captures operators, contractors, or others responsible for operational activities at the airport.

• The Agriculture Department: Identified in the instrument as the recipient of written notices under s9. The instrument uses the short form "Agriculture Department" in ss9(2)-(4). The Department is therefore the official locus for receiving information about ownership, leasehold changes and proposed operational changes that could affect biosecurity.

• Aircraft operators and goods handlers: Because Gold Coast Airport is declared a first point of entry for aircraft (s5) and for goods other than live horses (s6), aircraft operators who bring aircraft to Gold Coast Airport and parties handling goods to be unloaded at the airport are affected. The instrument’s note to s8 refers to the statutory obligation, in the Act, that goods unloaded from an arriving aircraft must be brought to a biosecurity entry point as soon as practicable if the aircraft is carrying goods mentioned in the table (s8 note referencing s147 of the Act). The instrument directly designates baggage as a class of goods subject to a biosecurity entry point at specified terminal areas (s8), so baggage handlers and operators at those terminals are specifically affected.

• Biosecurity officials and human biosecurity officers: While not directly made subject to duties by the instrument, the instrument refers to facilities and amenities for biosecurity officials and human biosecurity officers to perform functions or exercise powers under the Act (s9(5)(b)). Changes to those facilities trigger the notification requirements in s9(4)-(5). That implies a practical effect on where and how officials may operate at the airport.

• Owners/lessees or operational bodies involved in changes to procedures: The instrument places prospective duties on organisations proposing procedural changes that relate to identification, communication or management of biosecurity risks (s9(5)(a)-(e)). Those entities must give reasonable notice before making those changes.

Excluded and limited participants: The instrument explicitly excludes live horses from the goods designation at the first point of entry (s6). It also explicitly does not designate any area as a biosecurity entry point for aircraft (note to s7), which limits the immediate effect on aircraft arrival handling at the airport. The instrument also narrows biosecurity entry points for goods to particular baggage areas (s8 table), so goods other than baggage may not be covered by the designated entry points.

Finally, the instrument’s duties use the words "must" and require written notice either "as soon as practicable" or "reasonable notice" (s9(2)-(4)). Those temporal standards will affect how owners, lessees and operators organise internal compliance procedures and communications with the Agriculture Department.

The determination imposes a set of discrete duties and creates corresponding spatial designations that give rise to operational expectations. The instrument uses mandatory language for the duties it imposes and otherwise relies on the Biosecurity Act for statutory powers and additional duties. Below are the principal duties and the affirmative legal effects that follow from the instrument’s designations.

Principal duties set by this instrument

• Owners’ notification duty: An owner, or an owner where there are multiple owners, who becomes aware that there has been, or will be, a change to the business entity operating Gold Coast Airport or a biosecurity entry point at the airport, must give the Agriculture Department written notice as soon as practicable after becoming aware (s9(2)). The duty is explicitly to provide written notice, and the timing standard used is "as soon as practicable" (s9(2)).

• Lessees’ notification duty: A lessee, or a lessee where there are multiple lessees, who becomes aware that there has been, or will be, a change to the business entity operating Gold Coast Airport or a biosecurity entry point at the airport, must give the Agriculture Department written notice as soon as practicable after becoming aware (s9(3)). The instrument duplicates the owners’ duty, applying it to leasehold interests (s9(3)).

• Operational change notification duty: A person or body responsible for carrying out operations at Gold Coast Airport proposing to make a change of the types specified in s9(5) must give the Agriculture Department reasonable written notice of the proposed change (s9(4)). The types of change include changes to procedures for biosecurity measures, changes to facilities or amenities for biosecurity officials, and changes that may affect the ability to identify or communicate biosecurity risks (s9(5)(a)-(e)).

Obligations tied to designations and Act cross‑references

• First point of entry designation: By declaring Gold Coast Airport to be a first point of entry for aircraft generally (s5) and for goods other than live horses (s6), the instrument places the airport within the statutory regime triggered by that status. The instrument does not itself restate all statutory duties that flow from first point of entry status, but it does reference relevant Act provisions in notes (for example, notes to s6 and s8 referencing ss173, 174 and s147 of the Act).

• Biosecurity entry point designation for baggage: The instrument designates, for goods that fall within the class "Baggage", the Gold Coast Airport International Terminal and the Platinum Business Aviation Centre Terminal as biosecurity entry points (s8). Where those designated areas are relevant to arriving aircraft or unloaded goods, statutory duties under the Act concerning movement to biosecurity entry points are engaged, as the instrument highlights in the notes (s8 note referencing s147 of the Act).

Rights and limits in the instrument

• The instrument itself does not create express private rights or compensation mechanisms. It creates a legal status and procedural duties. The presence of "must" in s9 makes the notification obligations mandatory on the specified categories of private parties. The instrument is silent on any corollary right to veto changes by private parties, or on any administrative discretion or approval requirement by the Agriculture Department in response to notifications. The instrument uses standards of timing but does not define or quantify them, using "as soon as practicable" and "reasonable notice" (s9(2)-(4)).

• Absence of aircraft biosecurity entry points: The instrument explicitly does not designate any area as a biosecurity entry point for aircraft (note to s7). The practical legal effect is that the Act’s statutory requirement to bring an aircraft to a biosecurity entry point at a first point of entry applies only if there is a biosecurity entry point for aircraft at that first point of entry, which is not the case under this determination (note to s7, referencing s238 of the Act).

Interpretation and operational interaction

• The instrument depends on the Biosecurity Act for the broader enforcement and contextual legal obligations. For example, the note to s6 directs attention to sections 173 and 174 of the Act, which concern prohibited and conditionally non‑prohibited goods; the note to s8 directs attention to s147 of the Act concerning the unloading of goods and bringing them to a biosecurity entry point (s6 note; s8 note). The instrument therefore supplies location‑based designations and procedural notification duties and relies on the Act for substantive obligations and enforcement mechanisms.

• The phraseology "an owner (or, if there is more than one owner, an owner)" and the mirror formulation for lessees (s9(2)-(3)) create a duty that can be satisfied by a single owner or lessee where multiple exist. That drafting distributes the notification burden in a way that does not require collective action by all owners or lessees, but the instrument does not specify how to determine which owner or lessee is to notify in cases of dispute.

The determination itself sets no penalties, fine levels or enforcement procedures. It is an instrument made under subsection 223(1) of the Biosecurity Act 2015 (s3), and it therefore operates within the Act’s regulatory and enforcement framework rather than establishing new standalone enforcement mechanisms.

Textual absence of penalties in the instrument

• The instrument contains mandatory obligations using the word "must" in the notification duties set out in s9(2)-(4), but it does not specify consequences or penalties for failure to comply with those duties. There are no offence provisions, pecuniary penalties, or administrative sanction mechanisms stated in the instrument text.

Delegation to the Biosecurity Act for enforcement

• The instrument’s notes explicitly refer to provisions of the Biosecurity Act 2015 for other operational duties. For example, the notes refer to s147 (relating to unloading goods and bringing them to a biosecurity entry point) and s238 (relating to bringing aircraft to a biosecurity entry point) of the Act (notes to s8 and s7 respectively), and to ss173-174 (prohibited and conditionally non‑prohibited goods) in the note to s6. Those references indicate that the Act contains the substantive enforcement and penalty regime applicable to actions or failures whose relevance is identified in this instrument. The instrument itself does not reproduce or summarise those sanctions.

Practical enforcement consequences implied by the instrument

• Because the instrument imposes mandatory written notification duties on owners, lessees and certain operational bodies (s9(2)-(4)), failure to provide required notices could be relevant to downstream enforcement actions by the Agriculture Department or to the exercise of powers under the Act. The instrument does not spell out those downstream consequences; the Act will supply the legal basis for any compliance action or penalty.

• The designation of specific areas as biosecurity entry points for baggage (s8) interacts with the Act’s obligations about movement of goods to biosecurity entry points (note to s8 referencing s147). Where the Act prescribes consequences for failing to bring goods to a biosecurity entry point, those consequences would arise from the Act, not from the instrument. The instrument places actors in a position where non‑compliance with Act duties will be cognisable by the regulator.

Administrative discretion and role of the Agriculture Department

• The instrument designates the Agriculture Department as the recipient of required notices (s9(2)-(4)). It leaves unsettled how the Department will use notice information, whether it will require further documentation, or whether it will exercise administrative powers such as requiring corrective measures. Those aspects of enforcement, if they arise, will depend on the powers and procedures provided in the Biosecurity Act and in departmental practice, not on the instrument itself.

Operational risk and uncertainty

• Two temporal standards used by the instrument, "as soon as practicable" and "reasonable notice" (s9(2)-(4)), are inherently fact‑sensitive. The instrument does not quantify them, which creates interpretive uncertainty about timeliness and therefore about when enforcement action might be triggered by delay or omission. The instrument’s silence on specific enforcement pathways leaves that uncertainty to be resolved under the Act and administrative practice.

In short, enforcement of obligations established or triggered by this determination will rely on the Act’s provisions and on departmental practices. The instrument creates mandatory duties and designations but contains no standalone penalty or enforcement clauses.

This determination is a delegated instrument created under the Biosecurity Act 2015, and it expressly situates itself within that Act’s legal framework by cross‑referencing multiple Act provisions. The instrument interacts with the Act in three principal ways: it exercises a statutory power to designate first points of entry and biosecurity entry points; it relies on substantive obligations and consequences set out in the Act; and it gives practical effect, in spatial terms, to Act duties at Gold Coast Airport.

Statutory basis and subordinate role

• The instrument is made under subsection 223(1) of the Biosecurity Act 2015 (s3). That identifies it as a delegated instrument that brings the airport within statutory categories that the Act contemplates. As a subordinate instrument, it does not amend or replace the Act; rather, it specifies particular facts or locations to which the Act’s operative provisions apply.

Cross‑references to specific Act provisions

• The instrument contains notes and direct references to multiple provisions of the Act. It identifies the Act as the Biosecurity Act 2015 and refers to the Act’s definitions for "aircraft" (s4) and "goods" (s4, referring to s19 of the Act). The instrument’s notes reference:

  • Section 147 of the Act: the note to s8 states that if an aircraft has arrived at Gold Coast Airport and is carrying goods mentioned in the table that are to be unloaded from the aircraft, those goods must be brought to a biosecurity entry point for those goods as soon as practicable (s8 note referencing s147).

  • Sections 173 and 174 of the Act: the note to s6 directs readers to those sections for matters relating to whether particular goods may be brought into a particular first point of entry, indicating interaction with provisions on prohibited and conditionally non‑prohibited goods (s6 note referencing ss173 and 174).

  • Section 238 of the Act: the note to s7 explains that an aircraft must be brought to a biosecurity entry point at a first point of entry if there is a biosecurity entry point for the aircraft at that first point of entry, and that this determination does not designate any area of Gold Coast Airport as a biosecurity entry point for aircraft (s7 note referencing s238).

• These cross‑references show that the instrument’s practical effect is to anchor the Act’s substantive obligations and restrictions to particular spatial locations at Gold Coast Airport and to impose procedural notification duties that facilitate the Act’s administration.

Interplay with definitions and orders in the Act

• The instrument defines "goods" for its purposes as goods that are subject to biosecurity control or goods in relation to which an exposed goods order is in force (s4). That brings within the instrument’s reach goods that are already captured by Act orders or control measures. Conversely, goods outside the Act’s definition or not subject to an exposed goods order fall outside the instrument’s spatial designation.

• The instrument also excludes live horses from the goods designation at Gold Coast Airport (s6). That exclusion means that any statutory rules in the Act that apply at a "first point of entry" for goods will not be applied at Gold Coast Airport in respect of live horses unless there is another instrument or provision that brings live horses within scope.

Administrative interface and departmental functions

• The instrument imposes written notification duties to the Agriculture Department (s9). That creates an administrative interface: owners, lessees and operational bodies must communicate changes or proposed changes to the Department, enabling the Department to apply Act powers sensitively to on‑the‑ground circumstances.

• Where the instrument requires "reasonable notice" of proposed changes to procedures, facilities or amenities that may affect biosecurity risk management (s9(4)-(5)), the instrument assumes that the Department will use that notice either to assess risk, to request further information, or to exercise powers under the Act. The instrument does not specify subsequent procedural steps, so the Act’s provisions on information gathering, directions, or requirements will govern follow‑up.

Limits of the instrument in relation to other laws

• The instrument does not displace other statutory or regulatory obligations that may apply at the airport, such as aviation security, customs, immigration, or planning laws. It is narrow in scope: it designates point of entry status and particular biocontrol entry point areas, and it imposes notification duties; it does not purport to harmonise or override other regulatory regimes.

• The instrument’s commencement table includes a note that the table relates only to the provisions as originally made and will not be amended to deal with later amendments of the instrument (s2), which interacts with processes for legislative amendment and consolidation under the broader legislative regime. That procedural detail may matter if the Act or other instruments are amended later.

In summary, the determination functions as a spatial and procedural extension of the Biosecurity Act 2015 at Gold Coast Airport, and it relies on the Act for substantive duties, enforcement, and definitions. The determination’s operational effect is therefore conditional on, and mediated by, the Act.

The instrument’s text contains its making date and commencement information and expressly records that the commencement table refers only to the instrument as originally made. The document provides a minimal internal amendment history, which is effectively "none recorded" within the instrument itself.

Key documentary dates

• The instrument was made by Dean Merrilees as delegate of the Director of Biosecurity and is dated 7 June 2019 (signature block). The commencement provision states that "the whole of this instrument" commenced on 16 June 2019 (s2 and tabular commencement information). The instrument therefore became effective nine days after it was dated.

Notes about the commencement table and amendment practice

• Section 2 contains a tabular commencement clause. It states that each provision specified in the table commences, or is taken to have commenced, in accordance with the date specified (s2). The table lists "The whole of this instrument" and the date "16 June 2019" (s2 table). A note immediately following the table states that "This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument." That indicates that the table as printed is a snapshot of the instrument in its original form and is not a dynamic record of subsequent amendments.

• Subsection 2(2) adds that any information in column 3 of the table is not part of the instrument and may be edited in any published version. That is an administrative drafting note about publication, not a substantive amendment.

No amendments recorded in the instrument

• The instrument does not contain any schedules or notes indicating subsequent amendments, revocations or replacements. There is no internal record of variation, and no amending instruments are listed in the text provided. The only statements about amendment relate to the commencement table’s treatment in republication (s2).

Implications for practitioners

• Where users need to know whether the instrument has been amended after the original making, the instrument itself flags that such information will not appear in the printed commencement table. Practitioners should therefore consult the official legislative register or the authorised database that records subsequent amendments to delegated legislation if they require an up‑to‑date legal status beyond the instrument’s original text.

• The instrument’s signature block indicates the delegate and the office holder at the time of making: Dean Merrilees, Assistant Secretary, Compliance Division, Department of Agriculture, dated 7 June 2019. The instrument contains no subsequent signature or attestation indicating amendment.

In short, this instrument records only its original making and commencement; it contains no internal amendment history or variation notices. Any amendments or revocations would be documented outside the instrument itself in the formal legislative record.

The determination, as supplied, contains no references to litigation, judicial review, or administrative proceedings. There are no cases named, no annotations describing disputes, and no internal notes reporting legal challenges. The text is silent on any litigation history.

What the instrument records

• The instrument contains only the details of the designation, the commencement date, the authority under which it was made (subsection 223(1) of the Biosecurity Act 2015), the definitions used, the designated areas and the notification conditions (Parts 1-4). There are no sections or notes that reference court determinations, tribunal decisions, or administrative merits review outcomes.

Practical consequences of the absence of litigation history

• The absence of litigation history in the instrument means that one cannot, from this instrument alone, infer whether its legal validity or practical application has been the subject of dispute. The instrument does not include transitional or saving provisions that deal with ongoing litigation, and it does not record any consultation responses or explanatory memorandum content.

• When assessing legal risk, practitioners must therefore treat the instrument as a current regulatory specification without any recorded internal history of judicial interpretation. Any contested legal questions arising from how the instrument interacts with the Biosecurity Act 2015 or with other statutory regimes would need to be researched in external sources, such as court judgments, tribunal decisions or administrative records, none of which are included in this instrument.

How disputes would be handled (instrument’s silence)

• The instrument does not state procedures for review or appeal of decisions the Agriculture Department might make in relation to notices under s9, nor does it state how disputes about whether a change falls within the notification requirements should be resolved. Any such processes would arise from the Biosecurity Act 2015 or general administrative law, but the instrument contains no record of litigation or of adjudicative outcomes bearing on its interpretation or application.

In summary, the instrument provides no litigation history within its text. Practitioners seeking to determine whether the instrument has been interpreted or challenged in court must consult external judicial records or administrative determinations, because this instrument itself contains no such material.

The instrument is short and precise, but a number of practical pitfalls and interpretive risks arise directly from its choices of language, scope and cross‑references. These are matters to watch for when advising clients, drafting operational procedures, or assessing compliance risk.

1. "As soon as practicable" and "reasonable notice" are open temporal standards (s9(2)-(4))

• The notification duties use two different, fact‑sensitive timing standards: "as soon as practicable" for notices of changes that have occurred or will occur (s9(2)-(3)), and "reasonable notice" for notices of proposed changes (s9(4)). Neither term is defined in the instrument. That creates uncertainty about how quickly owners, lessees and operational bodies must act, and thus uncertainty about potential administrative consequences. Practitioners should treat time frames conservatively and document the reasons for timing decisions.

2. Single‑actor duty where multiple owners or lessees exist (s9(2)-(3))

• The drafting requires "an owner" or "a lessee" to give notice "if there is more than one owner" or "if there is more than one lessee" (s9(2)-(3)). That means a single owner or lessee can satisfy the statutory duty even where multiple persons share ownership or leasehold. The instrument does not allocate responsibility among multiple owners/lessees, so parties may face internal disputes about who must notify the Agriculture Department in practice. Contractual arrangements and internal governance documents should be updated to assign notification responsibility clearly.

3. Narrow physical designation for biosecurity entry points (s8)

• The instrument designates only baggage areas in two terminals as biosecurity entry points for the class "Baggage" (s8 table). Goods other than baggage, and goods not listed in the table, are not assigned specified biosecurity entry points by this determination. The instrument explicitly notes that the requirement in section 147 of the Act to bring unloaded goods to a biosecurity entry point does not apply to unloading of those other goods at Gold Coast Airport because the instrument does not designate biosecurity entry points for them (s8 Note 2). Operators handling non‑baggage goods must therefore verify whether other instruments or the Act itself impose obligations in their cases.

4. Aircraft are a first point of entry but have no designated biosecurity entry points here (s5 and note to s7)

• Gold Coast Airport is a first point of entry for aircraft generally (s5), but the instrument explicitly states that it does not designate any area of Gold Coast Airport as a biosecurity entry point for aircraft (note to s7). Because the Act requires an arriving aircraft to be brought to a biosecurity entry point at a first point of entry only where such a biosecurity entry point exists (note to s7, referencing s238 of the Act), aircraft operators and airport managers should not assume that the usual aircraft biosecurity entry‑point procedures under the Act apply at Gold Coast Airport unless a separate designation exists. That nuance may be overlooked in operational planning.

5. Goods excluded from the first point of entry designation: live horses (s6)

• The instrument declares Gold Coast Airport to be a first point of entry for goods other than live horses (s6). Live horses are therefore excluded from the instrument’s goods scope and must be handled in accordance with whatever other instruments, orders or Act provisions apply elsewhere. If stakeholders assume that all goods are covered at Gold Coast Airport, they risk missing the special‑case handling required for excluded goods.

6. Reliance on Act provisions for substantive duties and prohibited goods (notes to s6 and s8)

• The instrument directs readers to the Biosecurity Act 2015 for substantive questions such as whether particular goods may be brought into the first point of entry, citing ss173 and 174 (s6 note). It also refers to the Act’s requirement to bring certain unloaded goods to a biosecurity entry point (s8 note referencing s147). Practitioners must therefore consult the Act and any related determinations or orders to determine substantive prohibitions or conditions. Treating this instrument in isolation can lead to incorrect operational conclusions.

7. Written notice requirement, but no prescribed format or address (s9(2)-(4))

• s9 requires written notices to the Agriculture Department but does not specify a prescribed address, a preferred form, or necessary contents. Absent centralised departmental guidance, notices may be at risk of being defective, misplaced, or treated as non‑compliant. Parties should establish a conservative procedure that records delivery method, recipients, and copies retained.

8. Facilities and amenities for biosecurity officials implicated by proposed changes (s9(5)(b))

• The instrument requires reasonable advance notice of proposed changes to facilities or amenities available for biosecurity officials and human biosecurity officers to perform functions or exercise powers under the Act (s9(5)(b)). Redesigns of terminal spaces, contractor changes affecting rooms or utilities used by officials, or reallocation of office space can trigger notification duties. Contractors and facilities managers need to engage early with airport governance to ensure notification and coordination.

9. Ambiguity about which "person or body" is responsible for operations (s9(4))

• The instrument requires those "responsible for carrying out operations at Gold Coast Airport" to give reasonable notice of proposed changes (s9(4)). That phrase is broad and could include airport operators, ground handlers, terminal operators, security providers, or tenants. Parties should determine and document who is treated as responsible for the purposes of s9 to avoid compliance gaps.

10. Publication and amendment tracking caveat (s2)

• The commencement table contains a caution that column 3 is not part of the instrument and that the table relates only to the instrument as originally made (s2). Practitioners relying on printed versions should be aware that amendments, if any, will not be reflected within the instrument’s commencement table and must check the authoritative legislative register for current status.

These "gotchas" flow directly from the instrument’s drafting choices. Addressing them requires conservative compliance planning, clear allocation of notification obligations among owners and lessees, formal notice procedures directed to the Agriculture Department, and cross‑checking with the Biosecurity Act for substantive duties and consequences.

Compliance requires aligning airport governance, contractual arrangements, procedural manuals and operational planning with the instrument’s spatial designations and notification duties, and with the Act provisions to which the instrument refers. The steps below are a practical compliance checklist grounded in the instrument’s text.

1. Identify status and affected areas on site (s5-8)

• Confirm that Gold Coast Airport is a legally declared first point of entry for aircraft (s5) and for goods other than live horses (s6). Map the physical areas designated as biosecurity entry points for the class "Baggage": Gold Coast Airport International Terminal and Platinum Business Aviation Centre Terminal (s8 table). Ensure signage and operational routing for baggage reflect those designated areas.

2. Determine organisational responsibility for notifications (s9(2)-(4))

• Decide who within the ownership and lessee groups will hold responsibility for notification duties. The instrument requires "an owner" or "a lessee" to notify where there are multiple owners or lessees (s9(2)-(3)). Allocate this duty by contract or governance resolution so that a single, clearly identified point of contact will provide written notices to the Agriculture Department.

• For operational changes, identify which persons or bodies are "responsible for carrying out operations at Gold Coast Airport" in relation to the kinds of changes listed in s9(5). Assign a nominated official for giving "reasonable notice" under s9(4).

3. Establish written notice procedures and recordkeeping (s9(2)-(4))

• The instrument requires written notice to the Agriculture Department (s9(2)-(4)). Establish procedures for drafting, signing, delivering and retaining copies of all notices. Use registered mail or email with read receipts and internal logs so that the timing of "as soon as practicable" and "reasonable notice" can be evidenced.

• Notices should include the identity of the notifier, the nature of the change (or proposed change), relevant dates, and a point of contact for the Department. While the instrument does not prescribe a template, including those elements will reduce the risk of the Department treating a notice as deficient.

4. Interpret timing standards conservatively (s9(2)-(4))

• Because the instrument uses "as soon as practicable" for changes that have occurred or will occur (s9(2)-(3)) and "reasonable notice" for proposed changes (s9(4)), adopt conservative internal time frames. For example, require immediate internal notification and a short deadline for external written notice when changes are discovered, and for proposed changes provide notice sufficiently far in advance to allow the Department to assess potential biosecurity impacts.

5. Plan terminal and baggage handling workflows (s8)

• Ensure baggage handlers and arrival procedures direct arriving baggage to the designated biosecurity entry point areas (Gold Coast Airport International Terminal and Platinum Business Aviation Centre Terminal) as required by the Act’s unloading rules referenced in the instrument (s8 note referencing s147). Even though the instrument does not itself set the unloading duty, it links to the Act provision that does, so practical workflows should be adjusted to ensure baggage can be taken to the designated areas "as soon as practicable" after unloading (s8 note).

6. Coordinate on facilities and amenities for biosecurity officials (s9(5)(b))

• Because proposed changes to facilities or amenities used by biosecurity or human biosecurity officers trigger a notification duty (s9(5)(b)), include the Department in planning meetings for redesigns of terminal spaces, offices or utility services that affect where officials work. Where contractors or tenants propose changes, require them contractually to notify the designated compliance officer so that a timely Departmental notice can be given if needed.

7. Audit contracts and third‑party responsibilities (s9(4)-(5))

• Amend contracts with ground handlers, terminal operators and other service providers to require them to notify the airport compliance officer of any proposed changes to procedures, staffing, systems or facilities that may affect biosecurity risk identification, communication, or mitigation (s9(5)(a)-(e)). That will enable the airport to meet its own notification duties to the Agriculture Department.

8. Maintain cross‑reference to Biosecurity Act obligations (notes to s6 and s8)

• Keep a maintained legal reference to the Biosecurity Act provisions cited in the instrument, in particular ss147, 173 and 174, and s238, and the Act’s definitions referenced in s4. The instrument relies on those Act sections for substantive obligations about unloading, prohibited goods, and obligations to bring aircraft to biosecurity entry points where they exist. Compliance requires ensuring actions at Gold Coast Airport meet both the instrument’s procedural requirements and the Act’s substantive duties.

9. Prepare for excluded goods and special cases (s6)

• Remember that live horses are excluded from the goods first point of entry designation (s6). For live animal movements, confirm whether separate instruments, orders or Act provisions apply and prepare separate handling procedures accordingly.

10. Document governance and evidence of notification

• Keep a central register of all written notices given to the Agriculture Department, including date, method of delivery, recipient, and the content of the notice. Where multiple owners or lessees exist, maintain records showing which owner or lessee provided notice and why that party was selected under the instrument’s "an owner" or "a lessee" wording (s9(2)-(3)). Retain correspondence with the Department confirming receipt or requesting clarifications.

11. Liaise early with the Agriculture Department

• Given the instrument’s silence on how the Department will use notifications and on what constitutes "reasonable notice", obtain early clarification from the Agriculture Department about preferred notice content, addresses, and likely lead times. While the instrument does not require pre‑approval of changes, early engagement reduces the risk of later operational disruption.

12. Review and update emergency and contingency plans

• If operational changes could affect the ability to identify or communicate biosecurity risks (s9(5)(c)-(d)), update contingency plans and incident response procedures. Ensuring that communications protocols and staff responsibilities are documented will assist in meeting the instrument’s notification requirements and in demonstrating that steps were taken to manage biosecurity risks.

By following these steps, owners, lessees and operational bodies at Gold Coast Airport can align their procedures with the instrument’s spatial designations and notification duties, while ensuring coordination with the Biosecurity Act 2015 obligations to which the instrument points.
