Biosecurity (First Point of Entry—Coral Sea Marina, Airlie Beach) Determination 2020

The instrument relies on a small set of statutory and operational concepts drawn from the Biosecurity Act framework and applied to one physical location. Define and tie those concepts to the instrument text for operational clarity.

First point of entry: The instrument designates Coral Sea Marina, Airlie Beach as a "first point of entry" only for specified vessel and goods classes (ss 5-6). The effect of such a designation is procedural: vessels and goods arriving at that port in the designated classes must be brought to specified biosecurity entry points within the port (cf. notes to ss 7-8 and references to ss 147 and 246 of the Act).

Biosecurity entry point: The instrument identifies particular areas within the marina as the designated biosecurity entry points (the L‑Arm) for the classes in question (ss 7-8). The designation links physical geography to statutory duties that apply when vessels arrive or goods are to be unloaded.

Classes of vessel and goods: The instrument uses statutory definitions (s 4) to restrict the designation. "Non‑commercial vessel" is adopted from the Biosecurity Regulation 2016 (s 4); the instrument replicates the Aquatic categories it will regulate: non‑commercial vessels (s 5), non‑commercial vessel baggage and non‑commercial vessel waste (s 6). It also defines "goods" and "waste" in context: goods is defined by reference to s 19 of the Act and waste is treated as a subcategory of goods intended for disposal by the person in charge of the vessel (s 4).

Owner/lessee/operational responsibility: The instrument distinguishes responsibilities among owners, lessees and "a person or body that is responsible for carrying out operations" at the marina (s 10). Owners and lessees have immediate written notification obligations when they become aware of changes; persons responsible for operations must give "reasonable notice" of proposed operational changes that bear on biosecurity risk management (s 10(3)-(4)).

Director of Biosecurity satisfaction: The mosquito monitoring obligation is qualified by the Director’s satisfaction, a discretionary administrative benchmark: mosquito monitoring activities must be "activities that the Director of Biosecurity is satisfied are appropriate to manage the biosecurity risks (relating to mosquitoes)" at the marina (s 11(2)). That introduces a delegated standard without specifying metrics or protocols in the instrument.

Timing and procedural standards: The instrument repeatedly uses standards that require fact‑sensitive judgement rather than prescriptive technical rules: "as soon as practicable" for bringing vessels and goods to entry points (notes referring to ss 246 and 147 of the Act), "as soon as practicable" for notice of changes (s 10(1)-(2)), and "reasonable notice" for proposed operational changes (s 10(3)). Those phrases create compliance obligations whose operational content depends on circumstances and, for the mosquito monitoring, on the Director’s assessment.

Statutory and administrative layering: The instrument is subordinate legislation under the Act (s 3). It does not itself create offences or detailed enforcement mechanisms; instead, it situates the marina within the Act’s broader biosecurity regime by reference to other Act provisions (ss 147, 173, 174, 229(1), 246), and by imposing conditions that operate alongside the Act’s powers and duties.

The instrument names a narrow set of affected parties and identifies several who will be implicated by duties or operational requirements. The parties and their likely burdens are as follows, with direct citations.

Owners of Coral Sea Marina, Airlie Beach: The owner(s) have express duties. If they become aware that there has been or will be a change to the business entity operating the marina or a biosecurity entry point, an owner must give the Agriculture Department written notice "as soon as practicable" after becoming aware (s 10(1)). Owners must also ensure mosquito monitoring activities are carried out (s 11(1)). The owner therefore bears compliance costs for monitoring activities and for timely written notification.

Lessees of Coral Sea Marina, Airlie Beach: A lessee (if any) shares parallel obligations to owners. A lessee must give written notice to the Agriculture Department about changes to the business entity operating the marina or a biosecurity entry point "as soon as practicable" after becoming aware (s 10(2)). Lessees may also be required by s 11(1) to ensure mosquito monitoring activities are carried out, as the obligation is placed on "the owner (or, if there is more than one owner, an owner), or the lessee (if any) (or, if there is more than one lessee, a lessee)".

Persons or bodies responsible for carrying out operations at the marina: Those who fall into this category must give the Agriculture Department reasonable written notice of proposed changes to operations that are of certain kinds (s 10(3)-(4)). The specified kinds include changes to biosecurity procedures, facilities or amenities for officials, procedures affecting identification or reporting of biosecurity risks, and procedures affecting other factors contributing to biosecurity risk (s 10(4)(a)-(e)). Entities that operate the marina or run particular operational activities are therefore required to engage with the Department before making changes that could affect biosecurity risk management, creating a prospective approval or consultation vector.

Skippers and persons in charge of non‑commercial vessels and persons unloading goods: For the classes specified, vessels and goods arriving at Coral Sea Marina must be brought to the designated biosecurity entry points (L‑Arm) "as soon as practicable" (see notes to ss 7-8 and the tables in ss 7-8). The instrument thereby imposes movement and location constraints on captains and crew of non‑commercial vessels and on those unloading non‑commercial vessel baggage and waste, subject to the Act’s broader operational rules.

Biosecurity officials and the Director of Biosecurity: The Director’s role is active in the instrument. The Director’s satisfaction standard governs the acceptability of mosquito monitoring activities (s 11(2)), and the instrument contemplates interaction with biosecurity officials and human biosecurity officers performing functions at the marina (s 10(4)(b)-(d)). The instrument therefore creates duties to facilitate official activity (for example through facilities and amenity changes that require notification).

The Agriculture Department (Department of Agriculture, Water and the Environment): The instrument repeatedly requires written notices to "the Agriculture Department" and establishes that the Department is the recipient of those notices (s 10). The Department is therefore the administrative counterparty charged with receiving and acting on the information required by the instrument.

Indirectly affected parties: Visitors, berth holders, tour operators and marina service providers are not named in the instrument but will be affected operationally. If owners or lessees pass notification or mosquito‑monitoring costs through contractual arrangements, those downstream parties will bear some economic impact. The instrument does not itself specify cost allocation or contractual consequences; it only fixes who must provide the notice and who must ensure monitoring occurs.

Geographical and scope limits: The instrument affects Coral Sea Marina, Airlie Beach only, and only for the narrow classes listed (ss 5-8). The instrument’s Notes emphasise that the first point of entry designation does not apply to other vessels or other goods (Notes to ss 5-6). Any other first‑point determinations or restrictions on goods are governed by other Act provisions (ss 173-174).

The instrument imposes a compact set of duties and creates limited administrative rights or discretions, primarily attaching to the owner, lessee, operators and the Director of Biosecurity. Grounded in the text, the duties and rights are as follows.

Duties on owners and lessees to notify the Agriculture Department

• If an owner (or, if more than one owner, any owner) becomes aware that there has been, or will be, a change to the business entity operating Coral Sea Marina, Airlie Beach or a biosecurity entry point at the marina, that owner must give the Agriculture Department written notice as soon as practicable after becoming aware (s 10(1)).
• An equivalent duty is imposed on lessees (s 10(2)).
• These are positive procedural duties to provide written notice, with the temporal standard "as soon as practicable". The instrument does not define a timeframe in days but the language creates an expectation of promptness.

Duty to give reasonable notice of proposed operational changes

• A person or body responsible for carrying out operations at the marina must give the Agriculture Department reasonable notice of proposed changes of specified kinds (s 10(3)). Subsection 10(4) lists those kinds: changes to procedures for biosecurity measures, facilities or amenities for officials, procedures affecting identification or reporting of biosecurity risks, procedures for informing officials, and other procedure changes affecting factors that contribute to biosecurity risk (s 10(4)(a)-(e)).
• The duty is framed prospectively and uses the standard "reasonable notice", which invites case‑specific assessment.

Mosquito monitoring duty

• The owner (or one owner) or the lessee (or one lessee) must ensure that mosquito monitoring activities are carried out at the marina (s 11(1)).
• The monitoring activities must be ones that the Director of Biosecurity is satisfied are appropriate to manage mosquito‑related biosecurity risks to an acceptable level (s 11(2)). This is a delegated‑standards model: the instrument requires the activity but leaves the technical standard and acceptability assessment to the Director.

Movement and placement duties for vessels and goods

• The instrument designates the L‑Arm of the marina as the biosecurity entry point for non‑commercial vessels and for non‑commercial vessel baggage and waste (ss 7-8 and schedule tables).
• The Notes remind that a vessel that has arrived must be brought to a biosecurity entry point "as soon as practicable" (note to s 7, referencing s 246 of the Act), and that goods to be unloaded must be brought to the biosecurity entry point "as soon as practicable" (note to s 8, referencing s 147 of the Act). Those cross‑references import statutory duties from the Act that operate in conjunction with this instrument.

Director and Department discretions and engagement rights

• The Director retains a substantive administrative discretion to judge the appropriateness of mosquito monitoring activities (s 11(2)). That discretion determines whether particular monitoring arrangements meet the instrument’s condition.
• The Agriculture Department is the recipient of written notices and thus becomes the administrative body with which owners, lessees and operators must engage (s 10). The instrument implicitly grants the Department a role in reviewing proposed changes and monitoring compliance through receipt of notices.

Rights and absent express exemptions

• The instrument does not create express rights to compensation, funding or reimbursement for compliance costs. It does not specify an appeal mechanism against the Director’s satisfaction decision within the instrument itself.
• The instrument also does not provide exemptions from the notification or monitoring duties; any relief would need to be sought under the Act or other administrative mechanisms.

Operational consequences of the duties

• Owners, lessees and operators will need to create or update procedures to ensure prompt written notification to the Department (s 10). They must also ensure mosquito monitoring is established and defensible as appropriate under the Director’s test (s 11).
• Skippers and persons unloading goods must comply with movement obligations to the L‑Arm entry point when arriving with non‑commercial vessels or when unloading non‑commercial vessel baggage or waste (ss 5-8 and notes).

The determination itself does not set out specific penalty provisions in this text. Enforcement and penalty consequences are therefore to be located in, or derived from, the Biosecurity Act 2015 and its enforcement mechanisms; the instrument references relevant Act provisions where procedural obligations arise and leaves sanctioning to the Act’s general framework.

Textual signals about enforcement and statutory linkage

• The instrument is made under subsection 229(1) of the Act (s 3). That places the instrument within the Act’s delegated legislative framework and means non‑compliance with conditions attached to a first point of entry will interact with the Act’s enforcement tools.
• The instrument’s notes direct readers to ss 147 and 246 of the Act with respect to the duties to bring goods or vessels to a biosecurity entry point "as soon as practicable" (notes to ss 7-8). Those references indicate that statutory obligations under the Act apply in conjunction with the instrument’s designations.

Absence of instrument‑level penalties

• The instrument does not itself state any fines, criminal offences, infringement notices or specific enforcement powers. It does not specify who enforces the notification duty in s 10 or the mosquito monitoring duty in s 11, beyond directing notices to the Agriculture Department and qualifying monitoring by the Director’s satisfaction.

Implications for enforcement practice (as drawn from the instrument)

• Enforcement consequences for failing to comply with the instrument’s conditions will depend on the enforcement provisions and powers that exist in the Biosecurity Act (the instrument’s enabling statute). The instrument creates duties and conditions that can be the factual basis for administrative or statutory action under the Act; the specific sanctioning mechanism (for example, infringement notices, civil penalties, detention powers, directions, or prosecution) is not spelled out here.
• The Director of Biosecurity’s role in assessing the adequacy of mosquito monitoring (s 11(2)) is an administrative control point. If monitoring is not to the Director’s satisfaction, the Department can withhold administrative approval or take other steps available under the Act; the instrument itself does not list those steps.

Practical enforcement vectors

• The Department’s receipt of written notices under s 10 provides an information flow that can trigger compliance assessments or further directions. The notification requirement creates an administrative trail the Department may rely on to identify unnotified operational changes.
• The requirement that vessels and goods be brought to a biosecurity entry point as soon as practicable (notes to ss 7-8) ties the physical act of arrival and unloading to the Act’s operational enforcement apparatus; non‑compliance with those movement duties would be addressed under the Act.

Uncertainties left by the instrument

• Because the instrument does not define penalty types or amounts, persons affected must consult the Act for the range of enforcement tools and sanctions that may be applied in response to non‑compliance. The instrument’s cross‑references indicate where to look but do not displace the need to consult the Act for specifics.

This instrument is subordinate legislation made under the Biosecurity Act 2015 and is expressly framed as operating within, and in connection with, that Act. The interactions are primarily administrative and procedural: the determination defines how particular Act powers and duties apply at a particular place for specified classes of vessel and goods.

Statutory basis and hierarchy

• The instrument is made under s 229(1) of the Biosecurity Act 2015 (s 3). As a statutory instrument it sits below the Act and must be interpreted and applied consistently with the Act. Any inconsistency would be addressed under ordinary rules of statutory interpretation and administrative law; the instrument itself does not modify the Act.

Cross‑references to other Act provisions

• The instrument relies on definitions from s 9 and s 19 of the Act by reference (s 4). It therefore imports statutory meaning for terms such as "vessel" and "goods" and uses those meanings to specify which vessels and goods the designation covers.
• It explicitly directs readers to ss 173 and 174 of the Act "for other matters relating to whether particular goods may be brought into a particular first point of entry" (note to s 6). Those Act provisions determine whether goods are prohibited or conditionally non‑prohibited at first points of entry, signalling that the instrument does not displace those substantive restrictions.
• The instrument’s notes also direct users to ss 246 and 147 of the Act in relation to bringing vessels and goods to biosecurity entry points "as soon as practicable" (notes to ss 7-8). This ties the instrument’s place‑based designations to the Act’s movement duties and operational directions.

Administrative interface with the Department and Director

• The instrument requires notice to the Agriculture Department and refers to the Director of Biosecurity’s satisfaction standard (s 11(2)). Those administrative links place the Department and Director at the centre of compliance assessment and technical standard setting, and signal that the instrument is implemented through administrative rather than legislative detail.

Interaction with regulatory instruments and determinations

• The instrument draws the definition "non‑commercial vessel" from the Biosecurity Regulation 2016 (s 4). This demonstrates that the determination interacts with subordinate regulations and that other instruments under the Act’s regulatory architecture (including determinations under ss 173 and 174) can affect the practical applicability of the first point of entry designation.

Contractual and property law implications

• The instrument imposes duties on owners and lessees (ss 10-11). These duties will typically be given effect and allocated through leases, operating agreements and other contractual instruments between owners, lessees and operators. The instrument does not itself alter private law relationships, but it creates an external statutory requirement that private contracts should accommodate (for instance by allocating notification obligations, costs of mosquito monitoring, and cooperation with the Department).

Administrative law and discretion

• The Director of Biosecurity’s satisfaction requirement (s 11(2)) and the Department’s receipt of notices mean administrative law principles (reasonableness, procedural fairness, reviewability of delegated decisions) will govern some interactions. The instrument does not itself specify review or appeal processes; those lie in the Act and general administrative law.

Local government, health and environmental laws

• The instrument is silent on local planning, health or environmental statutes, but operators will need to ensure compliance with all applicable laws in carrying out monitoring and operational changes. The instrument’s requirement to provide notice of changes to facilities and procedures (s 10(3)-(4)) could overlap with other statutory regimes governing drainage, waste disposal, pest control, or public health, though those interactions are not specified here and would need to be managed on a site‑specific basis.

The instrument is self‑contained and provides minimal amendment history in the text. The operative points from the instrument are as follows.

Original making and commencement

• The instrument is titled Biosecurity (First Point of Entry,Coral Sea Marina, Airlie Beach) Determination 2020 and was made by a delegate of the Director of Biosecurity on 23 June 2020; the instrument records the signature of Barbara Cooper, Assistant Secretary, Compliance Division, Department of Agriculture, Water and the Environment (cover text and s 1). The commencement table in s 2 shows the whole instrument commenced the day after registration (noted as 24 June 2020).

Instrument note on the commencement table

• The instrument contains a formal note stating that the commencement table relates only to the provisions of the instrument as originally made and that it will not be amended to deal with later amendments to the instrument (s 2, paragraph below the table). This is a standard drafting form: the published commencement table is a historical record of original commencement rather than a live amendment log.

Absence of recorded amendments in the text

• There are no subsequent amendments, repeal provisions, or modification entries contained within the instrument text provided. The instrument does not include a schedule of amendments, repeals, or transitional provisions beyond the original commencement statement.

What to look for if tracking future amendments

• Any later amendment to the instrument would typically be recorded in the Federal Register of Legislation and in the instrument’s revision history on the legislation website. This instrument’s own internal note warns that the commencement table will not be updated to record later amendments, so users should consult the official consolidated legislative record to verify whether amendments have occurred since the original registration date.

Practical consequence of the limited amendment history

• As written, the instrument is a single, dated determination effected in June 2020. Any change to the designation (for example, expansion to other vessel or goods classes, change of biosecurity entry point location, revocation, or modification of conditions) would require a further legislative instrument under the Act and would be documented separately. The instrument itself places duties on owners and lessees to notify the Department about operational changes, but it does not provide mechanisms for the instrument’s own amendment, suspension or revocation; those are matters for the Act and administrative process.

The instrument text does not record any case law or litigation history. It names no judicial decisions, appeals or reviews concerning either the validity of the determination or the interpretation of its conditions. From the instrument itself the following observations can be made.

No cases or challenges recorded in the instrument

• The instrument contains no section or note referring to litigation, judicial review proceedings, or decisions interpreting its provisions. It therefore provides no internal litigation history.

Consequences of the absence of litigation history

• The practical legal meaning of several open‑ended phrases in the instrument,"as soon as practicable" (notification and movement obligations), "reasonable notice" (s 10(3)), and the Director’s satisfaction that mosquito monitoring activities are "appropriate" (s 11(2)),remains to be resolved in litigation or administrative decisions outside this text. The instrument itself does not clarify temporal metrics, evidentiary standards, or procedural steps that would reduce uncertainty in disputes.

Potential subjects of future litigation or administrative review (based on instrument text)

• Disputes are conceivable in areas the instrument leaves to judgment:
  • Whether a particular set of monitoring activities met the Director’s standard of appropriateness for mosquito risk management (s 11(2)).
  • Whether a person provided notice "as soon as practicable" upon becoming aware of a required change (s 10(1)-(2)).
  • Whether notice given constituted "reasonable notice" of proposed operational changes (s 10(3)), for example where an operator commences works shortly after advising the Department.
  • The precise geographic scope of the L‑Arm biosecurity entry point and whether particular berths or transient movements fell within or outside the designated "area" in ss 7-8.

Administrative review pathways

• Any person affected by a Department or Director decision (for example, a decision that monitoring is inadequate) would need to look to review and merits mechanisms available under the Act and the general administrative law framework. The instrument does not itself establish or limit judicial review rights.

Practical note for practitioners

• Because no litigation is recorded in this instrument, affected parties should anticipate that interpretive questions may be resolved by Department guidance, Director decisions, or, failing administrative resolution, judicial review. Parties should therefore document compliance steps, communications and the technical basis for monitoring activities to create an evidentiary record should disputes arise.

The instrument is short and specific, but several operational and legal pitfalls arise from what it requires (and what it leaves unspecified). Below are concrete areas where parties commonly encounter compliance risk, with citations to the instrument.

Narrow scope , do not assume broad coverage (ss 5-6)

• The designation is limited to non‑commercial vessels and to non‑commercial vessel baggage and waste. The instrument’s notes emphasise these limits: Coral Sea Marina is not a first point of entry for any other vessels or goods (Notes to ss 5-6). Actors who mistakenly treat the marina as a general first point of entry for commercial traffic or other goods risk non‑compliance with the Act.

Unspecified technical standard for mosquito monitoring (s 11)

• The owner or lessee must ensure mosquito monitoring activities are carried out, and those activities must be ones the Director of Biosecurity is "satisfied are appropriate" to manage mosquito risks (s 11(1)-(2)). The instrument does not define "appropriate", specify frequency, give methodology, or require reporting. That creates implementation uncertainty: monitoring that seems reasonable internally may still fall short of the Director’s expectations. Parties should not assume that an ad hoc or minimal monitoring regime will satisfy the Director.

Timing standards left open to interpretation (s 10(1)-(3); notes to ss 7-8)

• The instrument uses temporal standards without numeric time limits: "as soon as practicable" (owner/lessee notice and vessel/goods movement) and "reasonable notice" (proposed operational changes). The absence of a clear day count or procedural clock creates ambiguity and potential disputes. What is "as soon as practicable" in an emergency or during weekend hours? What constitutes reasonable notice for facility upgrades that require planning approval? The instrument leaves these questions to contextual assessment.

Notification obligations potentially overlapping multiple parties (s 10)

• The instrument places notice obligations on an owner (or any owner where more than one), on a lessee (or any lessee where more than one), and on persons or bodies responsible for operations (s 10(1)-(3)). In practice, the same change could trigger duties for multiple parties, and failure by one to notify cannot necessarily be remedied by another. Contracts between owners and lessees should clarify who gives notice and when.

No express record‑keeping or reporting mechanisms for monitoring (s 11)

• Although monitoring must be "carried out" and appropriate to the Director, the instrument does not require written reporting, record retention periods, or routine submission to the Department. Absent contractual or administrative directives, practitioners should not assume reporting is optional: it may be prudent to create documentation to demonstrate compliance in the event of inspection or dispute.

Location specificity , designated biosecurity entry point is the L‑Arm (ss 7-8)

• The L‑Arm is the only area designated as the biosecurity entry point for the specified classes. Arriving non‑commercial vessels or those unloading specified goods at other berths or anchorage locations in the marina may be non‑compliant. Operators should ensure that berth assignments and transient vessel movements are managed to route arrivals to the L‑Arm promptly.

Potential cost allocation issues are not addressed

• The instrument imposes duties (monitoring, notice) without specifying who pays. Owners and lessees should not assume that the Department will fund monitoring or upgrades to facilities required by biosecurity officials. Absent other agreements, costs fall on the owners/lessees required by the instrument.

Interaction with leases and third parties

• The label "lessee (if any)" suggests the marina may be operated under lease arrangements. Leases that do not allocate statutory notification or monitoring duties risk creating compliance gaps. Operators should review and, if necessary, amend agreements so that the responsible party is clear.

Department satisfaction and discretionary control

• The Director’s satisfaction is subjective within administrative law limits. Parties should engage early with the Department to seek clarity on acceptable monitoring methods. Waiting until a compliance notice is served risks corrective directions or enforcement action.

No specified appeals or dispute resolution in the instrument

• The instrument does not set out a mechanism to challenge the Director’s decision about monitoring adequacy within the instrument itself. Affected parties should consider administrative review options under the Act and general judicial review principles.

Compliance requires translating the instrument’s concise obligations into documented processes. The following steps are grounded in the instrument’s text (ss 4-11) and identify practical actions owners, lessees, operators and skippers should take.

1. Confirm whether the instrument applies to your vessel or goods

• Check that the vessel is a non‑commercial vessel and that the goods are non‑commercial vessel baggage or non‑commercial vessel waste (s 4 definitions; ss 5-6). If arriving with other vessel classes or goods, this determination does not make Coral Sea Marina a first point of entry for them.

2. Route arrivals and unloading to the L‑Arm

• Ensure procedures, berth allocations and mooring instructions direct non‑commercial vessels and the specified goods to the L‑Arm biosecurity entry point promptly on arrival (ss 7-8). "As soon as practicable" applies to bringing vessels and goods to the biosecurity entry point (notes to ss 7-8), so logistics should prioritise access to the L‑Arm.

3. Establish written notification protocols to the Agriculture Department

• Create templates and internal triggers for written notice to the Agriculture Department when an owner or lessee becomes aware of changes to the business entity operating the marina or the biosecurity entry point (s 10(1)-(2)). The statutory standard is "as soon as practicable", so log the date of awareness, the date of notification, and the content of the notice to demonstrate promptness.

4. Implement reasonable‑notice procedures for proposed operational changes

• If you are the person/body responsible for operations, prepare a process to provide "reasonable notice" to the Department before implementing changes of the kinds listed in s 10(4) (procedures for biosecurity measures, changes to facilities or amenities for officials, changes affecting identification and reporting of risks, etc.). Engage the Department early for guidance on expected notice periods to reduce the likelihood of later objections.

5. Design and document mosquito monitoring activities with Department engagement

• The owner or a lessee must ensure mosquito monitoring activities are carried out (s 11(1)). Because those activities must be ones the Director is satisfied are appropriate (s 11(2)), document the proposed monitoring program (methodology, frequency, locations, responsible personnel), and seek confirmation from the Director or Department that the program meets expectations. Retain records of engagement and any written approvals or feedback.

6. Allocate costs and responsibilities in leases and contracts

• Amend or confirm lease and operator agreements to allocate notification and monitoring responsibilities, including cost recovery, insurance coverage, and access. The instrument’s duties fall on owners, lessees and operators; private contractual clarity avoids compliance gaps and disputes about who must act.

7. Maintain facilities and amenities for biosecurity officials

• Review the marina’s facilities and amenity arrangements to ensure biosecurity officials and human biosecurity officers can perform functions (s 10(4)(b)). Where proposed changes could affect facilities or amenities, give reasonable notice as required and ensure that statutory duties to inform or identify risks are not impeded (s 10(4)(c)-(d)).

8. Keep contemporaneous records

• Although the instrument does not require specific records, keeping contemporaneous written records of notices sent to the Department, dates vessels arrived and were moved to the L‑Arm, mosquito monitoring data, and communications with biosecurity officials will assist in demonstrating compliance if reviewed by the Department or in subsequent disputes.

9. Seek early clarification where standards are uncertain

• For ambiguous temporal standards ("as soon as practicable", "reasonable notice") and the Director’s appropriateness standard for monitoring, obtain written guidance or confirmation from the Department. Early engagement reduces operational uncertainty.

10. Prepare to respond to Department queries or directions

• Given the Department receives notices and the Director has satisfaction powers, expect possible follow‑up requests. Designate a compliance contact and ensure capability to implement remedial actions reasonably promptly if the Department requests enhancements to monitoring or procedural changes.

11. Integrate biosecurity duties into operational risk management

• Incorporate notification, monitoring and movement obligations into existing safety and risk management plans for the marina. Assign responsibility, schedule regular reviews, and budget for monitoring equipment and any remediation required to meet the Director’s expectations.

Documentary checklist to create (s 10-11)

• Written notice templates for owner/lessee obligations.
• Standard operating procedures directing arrivals and unloading to the L‑Arm.
• Mosquito monitoring program documentation, including technical methodology and responsible persons.
• Lease/operator agreement clauses allocating duties and costs.
• Record log for arrival times, movement to L‑Arm, and monitoring results.

These steps follow directly from the instrument’s provisions (ss 5-11) and aim to operationalise the duties into defensible, documented practice that will assist owners, lessees and operators to meet the written notification and mosquito monitoring conditions and to ensure vessels and goods are directed to the specified biosecurity entry point.
