Biosecurity (First Point of Entry—Cocos (Keeling) Islands Port) Determination 2022

The instrument is short but it establishes and ties together a set of related technical concepts used to manage biosecurity risk at a named port. These concepts are defined in situ or by reference to the Act and regulation, and they serve as the legal triggers for duties and operational steps.

First point of entry: The instrument makes Cocos (Keeling) Islands Port a first point of entry for particular arrivals. There are two separate first point of entry declarations: one for vessels (s 5) and one for classes of goods (s 6). The port is a first point of entry for vessels other than passenger vessels (s 5). For goods, the instrument specifies four classes (s 6): baggage other than passenger vessel baggage; 20‑foot‑long freight containers; general goods (defined as goods other than baggage, freight containers, live horses or waste) and non‑commercial vessel waste. The instrument also includes an express note that the port is not a first point of entry for any other goods (note to s 6), which circumscribes the scope of the port’s first point of entry function.

Biosecurity entry point: Distinct from the port‑level first point of entry declaration, the instrument designates precise areas within the port as biosecurity entry points for particular vessels and for particular classes of goods (ss 7-8). The two tables perform this mapping. For vessels, each table item links a class of vessel with an area (for example, non‑commercial vessels to Direction Island Anchorage; other vessels to Blue Holes Anchorage, Viva Energy Tanker Moorings, and Rumah Baru, West Island) (s 7, table). For goods, the table identifies Rumah Baru, West Island as the biosecurity entry point for the main goods classes the instrument covers, and also lists Viva Energy Tanker Moorings and Rumah Baru as the areas for inorganic bulk goods (s 8, table).

“Goods” as legal term: The instrument reproduces a two‑part definition for “goods” by reference to s 19 of the Act: goods that are subject to biosecurity control or goods in relation to which an exposed goods order is in force (s 4). The instrument also defines “general goods” narrowly (s 4). “Freight container” is defined as a reusable container known as a 20‑foot or 40‑foot container (s 4), but the instrument’s operational choice to designate only 20‑foot‑long freight containers as a first point of entry (s 6(b)) creates a distinction between 20‑foot and 40‑foot containers for the purposes of the port’s first point of entry function.

Relationship to the Act and regulation: The instrument is expressly made under s 229(1) of the Biosecurity Act 2015 (s 3) and it notes that a number of expressions are defined in s 9 of the Act (s 4 note). It also relies on the Biosecurity Regulation 2016 for certain definitions (s 4). In several places the instrument points the user back to specific Act provisions: ss 173-174 on prohibited and conditionally non‑prohibited goods (note to s 6), s 246 on the obligation to bring a vessel to a biosecurity entry point as soon as practicable (note to s 7), and s 147 on the obligation to bring goods unloaded from a vessel to a biosecurity entry point as soon as practicable (note to s 8). These cross‑references indicate that the instrument operates within the Act’s existing compliance and operational framework rather than creating a standalone compliance regime.

Conditions and notice obligations: The instrument places ongoing conditions on the determination that require written notice to the Agriculture Department when particular changes occur (s 9(2)-(3)), and reasonable notice in advance of proposed operational changes that may affect biosecurity risk management (s 9(4)-(5)). The list of change types in s 9(5) describes the scope of changes that must be notified, from procedural changes that affect identification of biosecurity risks (s 9(5)(c)) to physical changes to facilities and amenities available to biosecurity officials (s 9(5)(b)).

Temporal operation: The instrument provides a commencement table which states the whole instrument commenced on 16 December 2022 (s 2). It also contains an editorial note that the commencement table relates only to the instrument as originally made and will not be updated to reflect later amendments (s 2(2)). The instrument as written is therefore the original instrument and includes no amendments in the text provided.

These main concepts determine the operational mechanics: which arrivals are covered, where they must be brought within the port, what classes of goods are included or excluded, who must notify the Agriculture Department when ownership or operational arrangements change, and what types of changes require advance notice.

The instrument assigns rights and duties that affect a defined set of parties connected with Cocos (Keeling) Islands Port. The parties identifiable from the instrument are the Director of Biosecurity (and the delegate who made the instrument), the Agriculture Department (as recipient of specified notices), owners and lessees of the port, persons or bodies responsible for carrying out operations at the port, vessel masters or persons in charge of vessels, passengers and cargo interests associated with particular classes of goods, and biosecurity officials/human biosecurity officers who exercise powers under the Act.

Decision‑maker and recipient:

• The determination is made under authority of the Biosecurity Act 2015 by an Assistant Secretary, Biosecurity Operations Division, as delegate of the Director of Biosecurity (instrument preamble; s 3). That identifies the administrative decision‑maker who made the instrument.
• The Agriculture Department is the recipient of written notices required under the conditions in s 9, and therefore becomes the repository of information on ownership, lessee or operational changes relevant to biosecurity risk management.

Owners and lessees:

• The instrument imposes duties on “the owner (or, if there is more than one owner, an owner)” to give written notice to the Agriculture Department if they become aware of a change to the business entity operating the port or a biosecurity entry point at the port (s 9(2)).
• A parallel duty is imposed on “the lessee (if any) (or, if there is more than one lessee, a lessee)” to give written notice on the same trigger (s 9(3)).
• The drafting choice that allows any one owner or any one lessee to discharge the notice obligation (rather than requiring all owners or all lessees) affects coordination and who practically must monitor and notify. The instrument does not define “owner” or “lessee” in its text; it notes that definitions are in s 9 of the Act (s 4 note).

Operators and operational bodies:

• A person or body responsible for carrying out operations at the port is required to give the Agriculture Department reasonable notice of a proposed change where that change is one of the specific categories listed in s 9(5) (s 9(4)). The categories include procedural changes affecting biosecurity measures, changes to facilities or amenities for officers, and changes affecting the ability to identify or communicate identified biosecurity risks (s 9(5)(a)-(e)). This imposes an anticipatory procedural duty on operators who oversee day‑to‑day operations.

Vessels, masters and cargo interests:

• Masters or persons in charge must bring arriving vessels to the designated biosecurity entry point for that vessel as soon as practicable , the instrument reiterates the statutory expectation in the note to s 7 by reference to s 246 of the Act. Although the instrument does not restate the Act’s content, the note signals that vessel movements post‑arrival are governed by that Act provision.
• Goods unloaded from arriving vessels that are covered by the goods classes must similarly be brought to the designated biosecurity entry point “as soon as practicable” (note to s 8 referencing s 147 of the Act). This implicates cargo handlers and freight forwarders moving affected goods.

Biosecurity officials:

• The instrument contemplates the presence and operational needs of biosecurity officials and human biosecurity officers (s 9(5)(b)-(d)). The conditions specifically require notification where there will be changes to facilities or amenities available to these officers to perform functions under the Act (s 9(5)(b)) or changes that affect their ability to be informed of identified biosecurity risks (s 9(5)(d)). Those officials are therefore a direct stakeholder in the port’s infrastructure and procedural arrangements.

Third parties and service providers:

• Parties who provide berthing, anchorage or cargo handling at the named areas , for example, entities operating at Direction Island Anchorage, Blue Holes Anchorage, Viva Energy Tanker Moorings, and Rumah Baru, West Island , will be affected by the designation because the instrument ties where vessels and goods must be brought for biosecurity management (ss 7-8). The instrument names specific areas; any entity that schedules or provides services at those areas must ensure compliance with the vessel/goods movement expectations noted.

Excluded or differently treated parties:

• The instrument expressly excludes passenger vessels from the port’s first point of entry status for vessels (s 5) and excludes passenger vessel baggage from the baggage class that is a first point of entry (s 6(a)). That changes which arrivals and which baggage classes are governed by this determination at this port compared with other ports that might be first points of entry for passenger vessels or for passenger baggage.

Overall, the instrument distributes notification and operational duties across port owners, lessees, operators, and vessel/cargo parties, while situating the Department of Agriculture as the administrative recipient of specified notices and the Director’s office as the decision‑maker who made the determination under statutory delegated authority.

This instrument creates categorical operational designations and it imposes a discrete set of duties, mainly reporting and movement obligations, while vesting the Director’s office with the authority to make the determination (s 3). The instrument itself does not create an extensive regulatory code of rights and penalties; rather it interacts with and relies on provisions of the Biosecurity Act for enforcement and for other operational outcomes.

Principal duties in the instrument

• Duty to bring vessels to designated biosecurity entry points: The instrument designates particular areas as biosecurity entry points for different classes of vessels (s 7). The accompanying note reminds users that a vessel that has arrived must be brought to a biosecurity entry point as soon as practicable (see s 246 of the Act). That places an operational duty on the person in charge of the vessel to move the vessel within the port to the relevant area promptly after arrival. The instrument does not restate s 246; it cross‑references it, making the statutory duty operative.

• Duty to bring goods to designated biosecurity entry points: The instrument designates areas as biosecurity entry points for defined classes of goods (s 8). The instrument adds a note that if a vessel has arrived and is carrying goods that are to be unloaded, those goods must be brought to a biosecurity entry point as soon as practicable (see s 147 of the Act). That imposes a duty on persons unloading and handling goods to ensure they are placed in the correct area for biosecurity inspection or control.

• Notification duties for owners and lessees: A condition on the determination requires that an owner (or, if multiple owners, an owner) provide written notice to the Agriculture Department as soon as practicable after becoming aware of a change to the business entity operating the port or a biosecurity entry point at the port (s 9(2)). A corresponding duty is placed on a lessee (or, if multiple lessees, a lessee) to provide the same written notice (s 9(3)). The phrasing “an owner” and “a lessee” means any one owner or any one lessee can discharge the notification duty; the instrument does not require unanimity.

• Duty to give reasonable notice of proposed operational changes: A person or body responsible for carrying out operations at the port who proposes to make a change described in s 9(5) must give the Agriculture Department reasonable notice of the proposed change (s 9(4)). The instrument lists five categories of changes that trigger this requirement (s 9(5)(a)-(e)), including procedural changes to biosecurity management, changes to facilities and amenities for biosecurity officers, and changes affecting identification or communication of biosecurity risks.

Form and timing of notices

• The required notices to the Agriculture Department must be in writing (s 9(2)-(4)). Timing rules differ by trigger: where an owner/lessee becomes aware of a change, the notice must be given “as soon as practicable” after becoming aware (s 9(2)-(3)). For proposed changes by an operator, the notice must be “reasonable” , an anticipatory standard , which requires the person or body proposing the change to give the Department notice in sufficient time for the Department to consider the proposed change (s 9(4)). The instrument leaves “reasonable” and “as soon as practicable” undefined, so their application will depend on the facts and the expectations set by the Department.

Rights and administrative positioning

• The instrument is made by a delegate of the Director of Biosecurity (preamble and s 3). That identifies the administrative authority that may make similar determinations under s 229(1) of the Act. The instrument itself does not give private rights of action or compensation mechanisms; it performs an administrative designation and attaches notification conditions. Any enforcement, appeals, or review processes would be those provided under the Biosecurity Act or general administrative law, not within this instrument.

• The instrument vests the Agriculture Department with the role of recipient of notifications and, implicitly, the decision‑maker that will assess proposed changes and presumably take steps to ensure the port continues to meet the prerequisites of being a first point of entry. The instrument does not state the Department’s specific powers on receiving notice, but it makes the Department the point of contact for the changes listed.

Scope limitations and exclusions

• The instrument’s explicit exclusions are operational duties on arrivals limited to the classes specified. Passenger vessels are excluded from the port’s first point of entry status for vessels (s 5). Passenger vessel baggage is excluded from the baggage class listed in s 6(a). The instrument also expressly states the port is not a first point of entry for any other goods beyond those specified (note to s 6). Those exclusions reduce the scope of duties to defined categories rather than applying them port‑wide to all arrivals.

In sum, the instrument imposes written notification duties on owners, lessees and operators; movement duties to bring arriving vessels and goods to designated biosecurity entry points as soon as practicable (insofar as those duties are set out in the Act and are cross‑referenced in the instrument); and it designates specific areas within the port for biosecurity handling. The instrument does not set out penalties itself; it situates the duties within the wider Biosecurity Act framework for compliance and enforcement.

The instrument itself contains no express penalty provisions and does not specify enforcement mechanisms within its text. The determination relies on the Biosecurity Act 2015 framework for enforcement and compliance. The instrument is made under subsection 229(1) of the Biosecurity Act (s 3), and it repeatedly cross‑refers to statutory sections that create operational obligations , for instance, the notes referencing ss 147 and 246 of the Act concerning the requirement to bring goods and vessels to a biosecurity entry point as soon as practicable (notes to ss 7 and 8) and references to ss 173-174 on prohibited and conditionally non‑prohibited goods (note to s 6). Enforcement therefore must be read against the Act’s regime rather than the determination itself.

What the instrument does state about enforcement‑adjacent matters

• The instrument formalises where and for which classes of arrivals the Act’s operational powers and duties will be exercised at Cocos (Keeling) Islands Port. By designating first points of entry and biosecurity entry points, the instrument specifies the locales to which the Act’s operational powers will be applied. The notes remind relevant parties that statutory duties in the Act apply when a vessel arrives (s 7 note) and when goods are unloaded (s 8 note). While the instrument does not repeat the Act’s enforcement provisions, it thereby ensures the Act’s powers and penalties can be applied in those designated locations.

• The instrument imposes conditions (s 9) requiring notification of certain changes to ownership, lessee arrangements and operations. While s 9 prescribes written notice obligations and timing standards (“as soon as practicable” and “reasonable notice”), the instrument does not state what consequences flow from a failure to provide the notices. Those consequences, if any, will arise under the Act or general administrative law or policy. The instrument therefore creates an administrative compliance expectation without setting out the sanctioning regime.

Implications for enforcement activity

• Because the instrument identifies specific biosecurity entry points, biosecurity officials and human biosecurity officers will have identified locations where they may exercise their functions and powers under the Act. The instrument’s designations therefore facilitate enforcement by aligning arrival locations with the practical locations of inspection, detention, treatment or other statutory measures. The instrument’s requirement that the port maintain facilities or amenities for biosecurity officers (and to notify the Department of changes in those facilities) is an enforcement enabler because it seeks to ensure officials can access suitable infrastructure to exercise their powers (s 9(5)(b)).

• The instrument’s cross‑references to the Act signal that the sanctions, directions and powers provided under the Act for non‑compliance remain the operational toolset. Practically, enforcement at the port will therefore depend on the Act’s existing provisions regarding inspection, detention, seizure, directions and penalties. Users of this instrument should therefore assume enforcement will be governed by the Act and should consult the Act for the specific enforcement and penalty regime; the instrument only sets the spatial and class boundaries within which those powers are engaged.

Absence of instrument‑level penalty clauses

• The absence of penalties in the instrument means that s 9’s notification obligations and the movement duties flagged by the notes are regulatory obligations whose breach will be actionable or penalised only to the extent the Act provides. The instrument does not purport to create separate criminal or civil offences, nor does it purport to create administrative fines. This keeps the instrument narrowly focused on designation and notification conditions rather than on enforcement architecture.

In short, enforcement and penalties are not created or elaborated by this determination; they will be applied under the Biosecurity Act 2015 to the classes of vessels and goods and to the designated areas that this instrument identifies.

The determination operates expressly as an instrument under the Biosecurity Act 2015 and interacts with the Act and the Biosecurity Regulation 2016 by reference. The instrument repeatedly points users back to specific Act provisions and notes that a number of expressions are defined by the Act or the Regulation. The interaction is therefore one of delegation and specification by which the Act supplies the substantive legal powers and the instrument supplies port‑specific designations.

Primary statutory relationship

• Enabling power: The instrument is made under subsection 229(1) of the Biosecurity Act 2015 (s 3). That shows the instrument is a statutory instrument in the Biosecurity Act framework, exercising an authority given by the Act to make determinations about first points of entry and biosecurity entry points. The instrument therefore sits subordinate to the Act; any rights, obligations or enforcement powers invoked by the instrument are exercisable only to the extent permitted by the Act.

• Definitions and cross‑references: The instrument notes that a number of expressions it uses are defined in s 9 of the Act (s 4 note) and it imports definitions from the Biosecurity Regulation 2016 for terms such as container and non‑commercial vessel (s 4). That means the instrument’s operational effect depends on statutory and regulatory definitions beyond the instrument itself. Users must therefore read the instrument in conjunction with the Act and the Regulation to determine the full scope of the terms.

Operational cross‑references to statutory obligations

• Prohibited and conditionally non‑prohibited goods: The instrument points to ss 173-174 of the Act in the note to s 6 to indicate that whether particular goods may be brought into a first point of entry is governed by those Act provisions. Therefore, the instrument does not itself decide whether particular goods are prohibited or conditionally permitted; it simply identifies whether the port is a first point of entry for specified goods classes. Any legal question about whether a particular item is permitted to enter will depend on ss 173-174 of the Act.

• Movement duties and timing standards: Notes to ss 7 and 8 refer to ss 246 and 147 of the Act respectively concerning the requirement to bring arriving vessels and unloaded goods to a biosecurity entry point “as soon as practicable.” Those statutory provisions will determine the legal content and enforcement of the prompt‑movement obligations that the instrument references.

Regulatory hierarchy and practical interaction

• The instrument sits below the Act and the Biosecurity Regulation in the legislative hierarchy. It provides port‑level specification that activates the Act’s general powers in a particular place. That means port operators, owners, lessees, and vessel/cargo interests must apply the Act’s standards as shaped by the instrument’s local designations.

• Because the instrument imports terms from the Regulation (s 4), compliance will require familiarity with the Regulation’s definitions and any obligations the Regulation sets out that interlink with first point of entry or biosecurity entry point determinations. For example, the instrument uses the term “non‑commercial vessel” and states that it has the same meaning as in the Biosecurity Regulation 2016 (s 4). The port‑level treatment of non‑commercial vessels therefore depends on the Regulation’s definition.

Administrative law and procedural interaction

• The instrument is an administrative determination; any procedural or merits review rights arising from decisions that flow from the instrument (for example, actions by biosecurity officials at the designated entry points) will be governed by the administrative law framework and by the review avenues available under the Biosecurity Act or general administrative law. The instrument itself does not create new review routes.

• The notice obligations in s 9 require owners, lessees and operators to interact administratively with the Agriculture Department. That interaction will be governed by the Department’s administrative processes and any policy guidance it issues about how it will respond to notices and proposed changes. The instrument leaves those procedural responses to the Department; it establishes the duty to notify in writing but does not prescribe the Department’s response options.

Other possible statutory intersections

• While the instrument references only the Biosecurity Act and the Biosecurity Regulation explicitly, practical operation of the designated areas may implicate other statutory regimes (for example, maritime safety and port management laws) in day‑to‑day implementation. The instrument does not address those interactions; it confines itself to biosecurity designations and notification obligations. Users should therefore consider intersecting statutory duties (outside the text provided) for operational matters such as anchorage rights, mooring permissions, or hazardous materials handling, but such considerations are beyond the instrument’s text.

In summary, the instrument is a port‑specific specification implemented under the Biosecurity Act 2015 and the Biosecurity Regulation 2016 definitions. It interacts by invoking and relying upon the Act’s substantive and enforcement provisions through cross‑reference; it prescribes notification duties to the Agriculture Department; and it leaves the Act as the source of penalties, process and the content of the movement obligations it invokes.

The instrument includes a commencement table and an editorial note about the table, but it contains no records of amendments within the text provided. The information in s 2 performs both a temporal function and an administrative function describing the instrument’s commencement.

Key recorded history in the instrument

• Original commencement: The instrument states that the whole of the instrument commenced on 16 December 2022 (s 2 and the commencement table). This identifies the date on which the determinations and conditions became operative.

• Editorial note about the commencement table: The instrument contains an editorial note to the effect that the commencement table relates only to the provisions of this instrument as originally made and will not be amended to deal with later amendments of the instrument (s 2(2)). That is a standard drafting note that clarifies that the table records the instrument’s original commencement and will not be updated in sources that publish subsequent amendments.

Absence of recorded amendments in the text provided

• The instrument as presented contains no subsequent amendment entries, no amendment schedule, and no notation of repeal or replacement. There are no later commencement or amendment dates recorded within this text. The instrument therefore appears to be the original instrument made on 29 November 2022 (preamble dated) and commenced on 16 December 2022 (s 2).

• The instrument contains no transitional provisions or savings clauses indicating staged implementation or prior instruments that it replaces. The text does not indicate the instrument modifies an earlier first point of entry determination for Cocos (Keeling) Islands Port; it simply records a fresh determination.

Practical note for users

• Because the instrument itself notes that the commencement table will not be amended in published versions to reflect later amendments (s 2(2)), users who need the current status of the instrument should check authoritative consolidated registers or the Department’s records for any later instruments or amendments. The instrument makes no representation within its text about any amendments made after the original making.

• Any change to the instrument itself would be effected by a new determination or an amending instrument issued under the Biosecurity Act 2015. The instrument does not contain a mechanism for amendment other than the ordinary statutory process under the Act. The text provided offers no amendment history beyond the original making.

In short, the instrument records one event: its making and commencement in late 2022. The text contains no subsequent amendments or historical entries beyond the original commencement and the making‑date entry in the preamble.

The instrument as provided contains no litigation history, no references to cases, judicial decisions, or appeals, and names no judicial or tribunal decisions. The instrument’s primary content is administrative designation and conditions; it includes no litigation record.

What the instrument shows and what it does not

• No cases named: The instrument references only statutory provisions and regulatory definitions; it does not cite or summarise any judicial decisions or administrative tribunal findings. There are no named cases or judicial authorities within the text.

• No recorded disputes or proceedings: The instrument contains no indication of ongoing litigation about its validity, scope or application, nor does it indicate that it resulted from or responded to litigation or legal challenge.

Consequences for research and legal practice

• Absence of litigation in the instrument does not mean the determinations will not be the subject of litigation in the future. It simply means that, as of the instrument’s text, there were no judicial decisions recorded within the instrument itself. Practitioners seeking to know whether any judicial review or statutory appeal has been brought against the determination would need to consult court or tribunal records and consolidated legislative databases; that information is not contained in the instrument.

• Because the instrument cross‑references provisions of the Biosecurity Act (for example ss 147, 173, 174, 229, 246) and relies on definitions in the Biosecurity Regulation 2016, litigation related to the instrument could arise in the future over the meaning or application of those statutory provisions as applied to the port’s designations, the sufficiency of notices given under s 9, or the adequacy of facilities and procedures at designated biosecurity entry points. None of that litigation, however, is recorded in the instrument.

Practical implications for counsel and compliance officers

• Counsel advising clients about operational or compliance risk should not rely on the instrument to identify litigation precedents. The instrument supplies the directions and duties; it does not summarise judicial interpretation. To assess litigation risk, advisers will need to search for any subsequent cases or administrative decisions that engage the instrument and the Biosecurity Act in practice.

• For now, the legal obligations and likely enforcement mechanisms remain grounded in the Biosecurity Act itself; any legal contests would therefore engage the Act’s enforcement and review framework. The instrument does not itself indicate any litigation history or contested application.

In short, the instrument contains no litigation history or cases. Practitioners should therefore treat it as an administrative instrument that may be applied, enforced, or contested under the Biosecurity Act, but any litigation history must be sought in external judicial or tribunal records rather than within the instrument’s text.

This instrument’s brevity and focused drafting leave several practical points where careful reading is required. These are not judgments about policy; they are operational and legal features that parties should note because they create compliance choices, coordination requirements, or potential uncertainty.

1. Distinction between “first point of entry” and “biosecurity entry point”

• The instrument uses two separate legal constructs. Part 2 (ss 5-6) designates the port as a first point of entry for specified vessels and specified classes of goods; Part 3 (ss 7-8) designates specific areas within the port as biosecurity entry points for vessels and goods. The two are related but distinct: being a first point of entry at the port does not itself prescribe which anchorage or mooring within the port a vessel must proceed to; the biosecurity entry point table does that (ss 7-8). Users must therefore comply with both the port‑level designation and the area‑level directions.

2. 20‑foot vs 40‑foot containers

• The definition of “freight container” in s 4 includes both 20‑foot and 40‑foot containers, yet s 6(b) designates “20‑foot‑long freight containers” only. The instrument’s express Note 1 to s 6 confirms the port is not a first point of entry for any other goods. The practical effect is that 40‑foot freight containers are not covered by this first point of entry designation for goods at this port. That is a precision that will matter to freight forwarders and shipping lines when deciding how to route containers and which port functions to use.

3. Passenger vessels and baggage treated differently

• The port is a first point of entry for vessels other than passenger vessels (s 5). Baggage “other than passenger vessel baggage” is a designated goods class (s 6(a)). Passenger vessels and passenger baggage therefore fall outside the instrument’s first point of entry designation and may be subject to different arrangements under the Act or other determinations. Those handling passenger movements should not assume the instrument applies to them.

4. Subjective timing standards , “as soon as practicable” and “reasonable notice”

• The instrument requires owners/lessees to notify the Agriculture Department “as soon as practicable” after becoming aware of a change (s 9(2)-(3)), and requires operators to give “reasonable notice” of proposed changes (s 9(4)). Both phrases are inherently context dependent. Parties should not treat them as precise deadlines; rather, they require judgment about what is appropriate in the circumstances. That invites potential dispute about timeliness unless parties document expectations and keep contemporaneous records of when they became aware and when notices were sent.

5. Any one owner/lessee may notify

• The instrument’s drafting allows an owner or, if multiple owners, any one owner, to discharge the notification duty (s 9(2)); similarly for lessees (s 9(3)). In multi‑owner or multi‑lessee situations, this relieves the need for unanimous notification but generates practical risk if no owner or lessee takes responsibility. Parties connected with the port should designate a responsible notifier in writing to ensure compliance.

6. Broad categories of change that trigger notification

• The list of proposed changes that require “reasonable notice” in s 9(5) is wide. It includes procedural changes to biosecurity measures, changes to facilities or amenities for officials, and changes that may affect identification or communication of biosecurity risks (s 9(5)(a)-(e)). Operators contemplating operational adjustments should evaluate whether a proposed change touches any of the categories and plan to notify the Department in advance rather than risk late notification.

7. No instrument‑level enforcement text

• The instrument does not state the consequences of failing to notify, or failing to bring vessels/goods to biosecurity entry points. Enforcement and penalties will arise under the Biosecurity Act. Parties should therefore treat the instrument’s duties as triggers for statutory enforcement under the Act rather than as independent statutory offences.

8. Specific named locations

• The instrument names specific areas (Direction Island Anchorage; Blue Holes Anchorage; Viva Energy Tanker Moorings; Rumah Baru, West Island). Operationally, the choice of these places matters: arrival planning, anchoring, berthing, tug availability and cargo handling must be arranged to ensure vessels and goods can reach the designated biosecurity entry point “as soon as practicable.” Coordination failures could lead to breaches of statutory obligations referenced in the instrument.

9. “Goods” defined by the Act

• The instrument uses the Act’s definition of “goods” (s 4) , goods that are subject to biosecurity control or to which an exposed goods order applies. Whether a particular item is included therefore depends on the Act’s substantive definitions and any exposed goods orders. Parties should not assume the instrument’s goods classes automatically capture or exclude particular commodities without checking the Act’s substantive application to the particular item.

10. Interaction with other port or maritime requirements

• The instrument does not address other statutory or contractual port obligations (for example, mooring rights, commercial port charges, or hazardous cargo restrictions). Users must account for other legal and commercial requirements when moving vessels and goods to the designated biosecurity entry points.

Those points are concrete operational “gotchas” that result from the instrument’s precise language and cross‑references. Parties should treat them as prompts to adapt operational planning, recordkeeping and communications with the Agriculture Department and with other port service providers.

Compliance with this determination requires a mix of spatial, procedural and administrative actions. The instrument focuses obligations on movement of vessels and goods to designated biosecurity entry points and on written notification to the Agriculture Department of certain changes. The following steps translate the instrument’s provisions into a practical compliance checklist grounded in the text.

1. Identify whether your arrival or cargo is covered

• Vessels: Confirm whether the arriving vessel is a passenger vessel. The port is a first point of entry for vessels other than passenger vessels (s 5). If the vessel is not a passenger vessel, it is within the scope of the port’s first point of entry designation.
• Goods: Determine if goods on board are among the listed classes: baggage other than passenger vessel baggage; 20‑foot‑long freight containers; general goods (as defined in s 4); or non‑commercial vessel waste (s 6). If goods fall outside those classes, the instrument’s first point of entry designation does not apply to them (note to s 6).

2. Plan vessel movements to the designated biosecurity entry point

• Consult the vessel biosecurity entry point table in s 7 to identify the correct area:
  • Non‑commercial vessels: Direction Island Anchorage (s 7, table item 1).
  • Vessels other than non‑commercial vessels and passenger vessels: Blue Holes Anchorage; Viva Energy Tanker Moorings; Rumah Baru, West Island (s 7, table item 2).
• Arrange to bring the arrived vessel to the relevant biosecurity entry point “as soon as practicable,” consistent with s 246 of the Act (note to s 7). Document expected timings and movements to demonstrate promptness in case of later queries.

3. Plan cargo handling and movements to the goods biosecurity entry point

• Use the goods table in s 8 to identify where goods must be brought after unloading:
  • 20‑foot freight containers, baggage other than passenger vessel baggage, general goods, and non‑commercial vessel waste must be brought to Rumah Baru, West Island (s 8, table item 1).
  • Inorganic bulk goods must be brought to Viva Energy Tanker Moorings or Rumah Baru, West Island (s 8, table item 2).
• Ensure cargo handlers and freight forwarders are instructed to move goods to the appropriate area “as soon as practicable” after unloading, as required by s 147 of the Act (note to s 8). Maintain transport and handling schedules reflecting this requirement.

4. Prepare notification processes for owners and lessees

• Establish a written notification protocol so that an owner (or if multiple owners, at least one nominated owner) will give the Agriculture Department written notice as soon as practicable after becoming aware of a change to the business entity operating the port or a biosecurity entry point (s 9(2)).
• Establish a corresponding protocol for lessees (if any) so that a lessee will give the Agriculture Department written notice as soon as practicable after becoming aware of a relevant change (s 9(3)).
• Because the instrument allows any one owner or any one lessee to satisfy the duty, document who is the responsible notifier in multi‑party ownership or leasing situations to avoid lapses.

5. Prepare advance notice procedures for proposed operational changes

• If your organisation is “a person or body that is responsible for carrying out operations at the port,” adopt a policy to assess proposed changes against the categories in s 9(5) and give the Agriculture Department reasonable written notice of any proposed changes that fall within those categories (s 9(4)-(5)).
• The categories include procedural changes to biosecurity measures (s 9(5)(a)), changes to facilities and amenities for biosecurity officials (s 9(5)(b)), procedural changes affecting the identification of biosecurity risks (s 9(5)(c)), changes affecting how officials are informed of identified risks (s 9(5)(d)), and other changes affecting the level of biosecurity risk associated with operations (s 9(5)(e)).
• “Reasonable notice” is a context‑sensitive standard; document the rationale for the period of notice provided and keep contemporaneous records of communications.

6. Keep notices in writing and maintain records

• The instrument requires notices to be in writing (s 9(2)-(4)). Retain copies of every written notice, the date the notifying party became aware of the change (where applicable), the date the notice was sent, and any acknowledgement from the Agriculture Department. This paper trail will be essential if questions arise about timeliness or sufficiency of notice.

7. Maintain facilities, amenities and procedures for biosecurity officials

• The instrument highlights the need for facilities and amenities for biosecurity officials to perform functions under the Act (s 9(5)(b)). Maintain or plan for suitable inspection areas, lighting, access, communications and safety arrangements at the designated biosecurity entry points so officials can exercise their functions. If a change is proposed in those facilities, give reasonable notice to the Department.

8. Coordinate with service providers at the named areas

• The instrument names specific areas (Direction Island Anchorage; Blue Holes Anchorage; Viva Energy Tanker Moorings; Rumah Baru, West Island) as the designated biosecurity entry points (ss 7-8). Coordinate tug, pilotage, mooring, berth and cargo handling services to ensure vessels and goods can be brought to the required areas promptly. Ensure commercial arrangements do not prevent compliance with the “as soon as practicable” obligations referenced in the instrument.

9. Train operational staff on the precise scope of the instrument

• Ensure masters, persons in charge of vessels, cargo handlers, freight forwarders and port operations staff understand which vessels and goods are affected and where they must be brought after arrival or unloading (ss 5-8). Training should include identification of 20‑foot freight containers (vs 40‑foot), the exclusion of passenger vessels and passenger baggage, and the notification obligations in s 9.

10. Liaise with the Agriculture Department where there is doubt

• If there is uncertainty whether a proposed change falls within s 9(5), give the Agriculture Department written notice describing the change and seek confirmation of whether further action or approval is required. Early engagement reduces the risk of an alleged late or insufficient notice.

11. Review and document internal responsibilities for multi‑party ownership/lessee arrangements

• In multi‑owner or multi‑lessee situations, document which party (or designated representative) is responsible for notification duties, and how that party will be informed promptly of ownership or lessee changes so notices can be sent “as soon as practicable” (s 9(2)-(3)).

12. Keep statutory cross‑references under review

• The instrument refers to the Biosecurity Act for key content (ss 147, 173-174, 246 and the definitions in s 9) and to the Biosecurity Regulation 2016 for some definitions. For full compliance, ensure advisers review those statutory and regulatory sources alongside the instrument. The instrument is a port‑specific implementation; compliance requires understanding the Act and Regulation too.

Following these steps will align operational arrangements with the port’s designation as a first point of entry for the listed vessel and goods classes and will meet the instrument’s written notice conditions. Documentation, early engagement with the Agriculture Department and clear assignment of notification responsibilities are central compliance controls under the determination.
