Biosecurity (First Point of Entry—Cocos (Keeling) Islands Airport) Determination 2021

Definitions and scope

• The instrument defines its governing terms by reference to the Biosecurity Act 2015. It states expressly that many expressions used are defined in s 9 of the Act and adopts the Act as the definitional source (s 4, note and the definition of Act). Two specific terms are defined within the instrument: 'aircraft' and 'goods'. 'Aircraft' is used as shorthand for the Act’s definition of aircraft that are subject to biosecurity control (s 4). 'Goods' is defined by reference to s 19 of the Act, but qualified in the instrument as goods that are either subject to biosecurity control or subject to an exposed goods order (s 4).
• The instrument excludes live horses from the goods classification for the purpose of designating the airport as a first point of entry (s 6).

First point of entry and biosecurity entry point

• 'First point of entry' is a statutory concept from the Act; this instrument designates Cocos (Keeling) Islands Airport as such for aircraft generally (s 5) and for goods other than live horses (s 6).
• A separate concept is 'biosecurity entry point', the specific physical areas where biosecurity processes are to occur. The instrument does not designate any area of the airport as a biosecurity entry point for aircraft (s 7, note). For goods, the instrument designates a single area as a biosecurity entry point: baggage to the International Terminal (s 8 and the table).

Conditionality and procedural requirements

• The designation of the airport as a first point of entry is subject to conditions set out in Part 4 (s 9(1)). Those conditions are narrowly framed as notification obligations on owners, lessees and persons or bodies responsible for operations at the airport (s 9(2)-(4)).
• Owners and lessees must provide written notice to the Agriculture Department as soon as practicable after becoming aware of changes to the business entity operating the airport or a biosecurity entry point at the airport (s 9(2)-(3)).
• Persons or bodies responsible for carrying out operations must give reasonable written notice of proposed changes to certain procedures, facilities or amenities that could affect biosecurity risk management or the ability of biosecurity officials to perform their functions (s 9(4) and (5)).

Interplay with the Act

• The instrument contains notes that cross‑refer to specific statutory duties in the Act. It reminds users that if an aircraft has a biosecurity entry point at a first point of entry, the aircraft must be brought to that point (citing s 238 of the Act) , then clarifies that no biosecurity entry point for aircraft is designated here (s 7, note). For goods, the instrument notes the obligation (under s 147 of the Act, referenced in the s 8 note) to bring goods to a biosecurity entry point when unloading, and points out the designation here applies only to baggage (s 8, notes). The instrument also points to ss 173 and 174 of the Act concerning prohibited or conditionally non‑prohibited goods (s 6, note).

Administrative provenance

• The determination is made by a delegated officer acting under s 223(1) of the Act (s 3). The instrument includes an explicit commencement table fixing the operative date as 16 June 2021 (s 2 and the table).

The main concepts therefore combine site designation (first point of entry and one biosecurity entry point), narrowly framed notification conditions, and explicit linkage to the Act’s operational provisions, while leaving substantive enforcement and procedural detail to the Act itself and to interaction with the Agriculture Department.

Primary stakeholders

• Owners of Cocos (Keeling) Islands Airport: The instrument places a written, time‑sensitive notification obligation on an owner (or, if there is more than one, on an owner) when the owner becomes aware of changes to the business entity operating the airport or to a biosecurity entry point at the airport (s 9(2)). Owners therefore bear direct compliance duties under the conditions attached to the determination.
• Lessees of Cocos (Keeling) Islands Airport: Similarly, a lessee (or, if more than one, a lessee) must give written notice as soon as practicable when becoming aware of the same categories of change (s 9(3)). Where lessees exist, they share the notification burden with owners.
• Persons or bodies responsible for carrying out operations at the airport: If such persons or bodies propose changes that fall within the matters listed in s 9(5), they must give the Agriculture Department reasonable written notice of the proposed change (s 9(4)). This captures private contractors, airport operators, ground handlers, or other operational entities that control procedures, facilities or amenities relevant to biosecurity operations.

Other affected parties

• Airlines and aircraft operators: The airport is a first point of entry for aircraft generally (s 5). Aircraft subject to biosecurity control, when operating into a first point of entry, are subject to the Act’s requirements about being brought to biosecurity entry points if those exist (note under s 7 referring to s 238 of the Act). Although this determination does not designate a biosecurity entry point for aircraft at this airport (s 7), aircraft operators must nevertheless be aware they are operating into a first point of entry and may be subject to other Act obligations and to the Department’s operational directions.
• Importers, freight forwarders, handlers and passengers: The airport is a first point of entry for goods other than live horses (s 6). Baggage is specifically designated to the International Terminal as the biosecurity entry point (s 8). Persons bringing goods into the airport that are subject to biosecurity control or exposed goods orders (as the instrument defines 'goods' in s 4) are affected by the requirement noted in s 8 that goods to be unloaded must be brought to the entry point as soon as practicable (note referencing s 147 of the Act). The instrument does not designate biosecurity entry points for other goods, so those goods are not captured by that unloading requirement (s 8 note).
• The Agriculture Department: The Department of Agriculture, Water and the Environment (referred to in the instrument as the 'Agriculture Department') is the recipient of the written notices required by s 9(2)-(4). The Department therefore receives information flows about changes to operators, procedures and facilities, which can affect resourcing and oversight needs.

Entities not covered or explicitly excluded

• Live horse importers: The instrument explicitly excludes live horses from the goods designation as a first point of entry (s 6). That exclusion means live horses are not covered by the first point of entry status conferred by this instrument and importers of live horses must consult other determinations or Act provisions (s 6 note referencing ss 173 and 174 of the Act).

Who decides

• The determination was made by a delegate of the Director of Biosecurity under s 223(1) of the Act (s 3 and cover sheet naming Barbara Cooper). Operational decisions about the application of the Act, enforcement and any further designations (for example, whether to designate a biosecurity entry point for aircraft) rest with the Department under the Act, not within this instrument.

In short, primary legal obligations under the instrument fall on owners, lessees and operational responsible persons at the airport to provide notices to the Agriculture Department. Aircraft operators, passengers and importers must operate with the airport’s status as a first point of entry in mind and must comply with the Act’s operational requirements as they apply.

Duties created by this determination

• Owners’ notification duty: If an owner becomes aware of a change to the business entity operating the airport or a biosecurity entry point at the airport, that owner must give the Agriculture Department written notice as soon as practicable (s 9(2)). The instrument identifies who must act when there are multiple owners , any one owner must provide the notice (s 9(2) first line).
• Lessees’ notification duty: Likewise, if a lessee becomes aware of such a change, that lessee must give the Agriculture Department written notice as soon as practicable (s 9(3)). Where more than one lessee exists, any one lessee may discharge the obligation (s 9(3)).
• Responsible operator’s obligation to give reasonable notice: A person or body responsible for carrying out operations at the airport proposing a change of the kinds listed in s 9(5) must give the Agriculture Department reasonable written notice of the proposed change (s 9(4)). This is a pre‑proposal notice obligation rather than an after‑the‑fact notification.

Content and timing standards

• Timing standards differ by subsection: owners and lessees are required to report 'as soon as practicable' after becoming aware of a change (s 9(2)-(3)); responsible operators must give 'reasonable notice' of proposed changes (s 9(4)). The instrument does not quantify these standards or prescribe content requirements beyond the description of the type of change in s 9(5).
• Writing requirement: All notices required by s 9 must be 'in writing' and directed to the Agriculture Department (s 9(2)-(4)).

Scope of the changes that trigger obligations

• The instrument defines the covered changes in s 9(5). They include:
  • procedural changes governing biosecurity measures at the airport (s 9(5)(a));
  • changes to facilities or amenities available for biosecurity officials and human biosecurity officers to perform functions or exercise powers under the Act at the airport (s 9(5)(b));
  • changes to procedures that may affect the ability of operational staff to identify biosecurity risks (s 9(5)(c));
  • changes to procedures that may affect the ability for biosecurity officials to be informed of identified biosecurity risks (s 9(5)(d));
  • changes to procedures for managing any other factors that may contribute to or affect the level of biosecurity risk associated with airport operations (s 9(5)(e)).

Rights and administrative positions

• The instrument does not create express private rights or entitlements for third parties. It is a regulatory determination that creates obligations on owners, lessees and operational responsible persons.
• The instrument vests certain administrative discretion in the Agriculture Department and the Department’s officers by making the Department the notice recipient and by leaving the assessment of what constitutes 'reasonable notice' or an adequate written notification to operational judgement; however the instrument itself does not specify how the Department will exercise discretion or what procedural outcomes will follow from notices received.

Interaction with Act obligations

• The instrument does not substitute for the Act. It locates the airport within the Act’s architecture: designation as a first point of entry brings certain Act obligations into play (for example, obligations referenced in the instrument’s notes such as ss 147 and 238 of the Act). The instrument creates duties specific to the determination (s 9) while relying on the Act to provide enforcement and offence frameworks.

What the instrument does not do

• It does not set fee regimes, sanctions, or procedural rules for how the Agriculture Department must process or respond to notices. It does not prescribe the content of notices beyond the kinds of changes to be reported. It does not designate any area as a biosecurity entry point for aircraft (s 7). It does not create a biosecurity entry point for goods other than baggage (s 8, note).

Absence of express penalties in the instrument

• The determination itself contains no penalty provisions and does not set out enforcement steps tied specifically to failure to comply with s 9. The instrument is a statutory determination made under s 223(1) of the Biosecurity Act 2015 (s 3) and the notes reference operative provisions of the Act for related duties (for example, the notes referencing ss 147 and 238 of the Act in Parts 2-3).

Enforcement context under the Act

• Because the instrument is made under the Act, enforcement, compliance powers, and penalties that apply to contraventions of the Act or of determinations made under it are matters for the Biosecurity Act 2015 itself rather than for the instrument. The instrument therefore relies on the Act’s enforcement architecture; the instrument does not itself elaborate those mechanisms.

Practical enforcement implications

• The instrument’s conditions (Part 4, s 9) make the airport’s status as a first point of entry contingent on the notified state of affairs and on ongoing notification; non‑compliance with those conditions could, in practice, give the Department cause to review, vary or revoke the determination under the powers of the Act, or to apply enforcement measures available under the Act. The instrument does not set out that process or the consequences in this text; it identifies obligations that the Department can monitor, but the instrument does not describe the Department’s follow‑up or sanctions.

Who enforces

• The Agriculture Department is the recipient of the notices required by s 9 and, as the agency responsible for biosecurity functions under the Act, it is the likely administrative actor to take any compliance or enforcement action available under the Act in response to non‑compliance. The instrument itself does not specify enforcement roles beyond making the Department the notice recipient.

Notice and administrative discretion

• The instrument leaves assessment thresholds undefined for 'as soon as practicable' and 'reasonable notice'. That creates a role for Departmental discretion in determining whether a given written notice complies with the s 9 requirements and whether any follow‑up enforcement response is necessary. The instrument does not prescribe appeal pathways or specific administrative review mechanisms for decisions based on these notices.

Summary

• The instrument imposes duties without creating bespoke penalties in the instrument text. Enforcement and sanctions lie within the Biosecurity Act 2015 framework referenced in the instrument (s 3 and the various notes). Practitioners should therefore treat the instrument’s obligations as operative inputs to the Act’s enforcement model rather than as standalone offence provisions.

Direct statutory connections in the instrument

• The instrument is made under subsection 223(1) of the Biosecurity Act 2015 (s 3). It expressly relies on terms and substantive duties defined in the Act: it notes that a number of expressions used are defined in s 9 of the Act and adopts the Act as the definitional baseline (s 4, note).
• The instrument’s defined term 'goods' refers to s 19 of the Act (s 4).
• The instrument’s notes explicitly link its operation to several sections of the Act: s 238 (regarding aircraft and biosecurity entry points) is cited in the note to s 7; s 147 (regarding goods being brought to a biosecurity entry point when unloading) is cited in the note to s 8; and ss 173 and 174 (re prohibited and conditionally non‑prohibited goods) are cited in the note to s 6.

Operational overlap and trigger mechanics

• Designation of a first point of entry by this instrument is a trigger for the application of the Act’s provisions on movement and handling at first points of entry. For example, if the Act requires goods unloaded at a first point of entry to be brought to a biosecurity entry point, that Act requirement becomes relevant here for goods for which a biosecurity entry point is designated (s 8 note referring to s 147 of the Act). The instrument therefore interacts by activating specific Act duties linked to location designations.
• Conversely, where the instrument does not designate biosecurity entry points (for example, none for aircraft, s 7), then certain Act provisions that require movement to a biosecurity entry point do not operate at this airport for those categories (s 7 note clarifies this effect).

Scope limitations and vertical interactions

• The instrument’s exclusion of live horses from the goods designation (s 6) creates an interactional blank: the airport is not a first point of entry for live horses under this instrument and therefore Act provisions that operate by reference to a first point of entry designation will not apply via this determination to live horses at this airport. The instrument suggests consultation of ss 173 and 174 of the Act for 'other matters' concerning whether particular goods may be brought into a first point of entry (s 6 note). That indicates that other determinations or Act rules may govern live horses.
• Where the instrument designates baggage as a biosecurity entry point in the International Terminal (s 8), Act obligations that apply to goods unloaded at a first point of entry and destined for a designated biosecurity entry point will apply to baggage at that terminal (s 8 note referencing s 147 of the Act).

Administrative law and delegation

• The instrument was made by a delegate of the Director of Biosecurity under the Act (cover sheet and s 3). That situates the instrument within the Act’s administrative delegation framework. Any judicial or administrative challenge to decisions under or arising from the instrument would therefore be framed by the Act’s delegation and decision‑making rules, though this instrument does not spell those out.

Procedural and regulatory gaps

• The instrument leaves unspecified procedures, such as how and where to give the required written notices to the Agriculture Department, or the Department’s procedural response. Those procedural details will be supplied by the Department’s administrative practice and by the Act’s general procedural rules. The instrument itself does not contain procedural rules for processing or responding to the notices.

Interplay with local/contractual obligations

• The instrument imposes statutory notification obligations on owners, lessees and responsible operators (s 9). It does not displace private contractual arrangements between owners, lessees and operators; rather, it creates obligations that may need to be reflected in those contracts and local airport procedures to ensure compliance. The instrument does not address how contractual allocation of liability or notice duties interacts with the statutory requirement that any one owner/lessee must give the Department notice.

In sum, the instrument is a piece of the Biosecurity Act’s territorial and operational architecture: it designates place‑based statuses which in turn activate or do not activate specified Act provisions. It relies on the Act for enforcement and procedural detail while prescribing limited, targeted notification duties which interact with, but do not replace, existing Act mechanisms.

Original making and commencement

• The instrument identifies its name as the Biosecurity (First Point of Entry,Cocos (Keeling) Islands Airport) Determination 2021 (s 1). The instrument was signed on 8 June 2021 by a delegate of the Director of Biosecurity (cover sheet) and the commencement table records that the whole instrument commenced on 16 June 2021 (s 2 and the commencement table).

Commencement table note and amendment practice

• The instrument contains an explicit note under the commencement table that the table relates only to the provisions of this instrument "as originally made" and that it will not be amended to deal with any later amendments of the instrument (s 2, note). It also states that any information in column 3 of the table is not part of the instrument, and that such information may be edited in any published version (s 2(2)). That means the instrument’s internal commencement record is preserved as the original commencement statement and that subsequent alterations, if any, will be recorded via formal amendment instruments rather than by editing that table in place.

No recorded amendments within the instrument

• The text supplied contains no amendment provisions, no later determination dates, and no schedules indicating subsequent variation. The instrument therefore appears in this text to be the original instrument as made and commenced in 2021.

Implications for legal research

• Any later amendments, repeals, or replacements would be recorded and published separately; the instrument itself cautions that the commencement table is not updated to reflect later amendments (s 2, note). Practitioners should therefore consult the consolidated and current legislative database maintained by the responsible Commonwealth publication or the Federal Register of Legislation for any subsequent changes beyond the original instrument text.

Administrative changeability

• The instrument was made under the Biosecurity Act 2015 (s 3). Under that Act, determinations can be made, varied or revoked by the relevant decision‑maker pursuant to statutory powers; however, this instrument does not itself set out any amendment or revocation process. Any variation to the status of the first point of entry, designations of biosecurity entry points, or the conditions in s 9 would therefore be effected by subsequent determinations under the Act, not by amendment entries within this text.

Summary

• The instrument was made and commenced in June 2021. No amendments are recorded in this instrument. The instrument’s commencement table explicitly states it will not be updated to record later amendments, so users must check external consolidated sources for any changes since original making.

No cases or litigation recorded in the instrument

• The instrument contains no reference to any litigation, judicial review, or tribunal decisions. It does not cite any cases. The cover sheet, body text and notes contain only statutory references to the Biosecurity Act 2015 and administrative details.

Implications for practitioners

• Because the instrument itself does not include or identify any litigation history, any legal disputes or judicial challenges relating to this determination would need to be identified through independent legal research in court or tribunal databases, or by asking the Agriculture Department for records of administrative action. The instrument provides no internal record of disputes, reviews or challenges.

What the absence of litigation means for legal risk assessment

• The lack of litigation referenced in the instrument does not imply that challenges are impossible or that none have occurred since the instrument’s making; it simply indicates that the instrument text contains no litigation history. Practitioners assessing legal risk should therefore search external case law databases and administrative decisions for any challenges under the Biosecurity Act that might involve this determination or similar site designations.

Potential administrative review pathways (not specified in instrument)

• The instrument does not specify appeal or review pathways for decisions made under it. Any rights to seek judicial review, merits review, or administrative remedies in relation to decisions about first point of entry status, biosecurity entry points, or enforcement would arise from the Biosecurity Act 2015 and from general administrative law principles. Those frameworks are not reproduced in this instrument text.

Summary

• No litigation history is recorded in the instrument itself. For litigation or administrative challenge information, practitioners will need to consult court records, tribunal databases, or Departmental records external to this determination.

Timing and differing notice standards

• The instrument uses two distinct temporal standards for reporting changes: 'as soon as practicable' for owners and lessees (s 9(2)-(3)); and 'reasonable notice' for persons or bodies proposing changes (s 9(4)). These standards are not defined in the instrument. Practitioners should note that the ambiguity creates compliance risk if an owner, lessee or operator misjudges what constitutes 'reasonable' or 'as soon as practicable' in the eyes of the Agriculture Department.

Who must notify when there are multiple parties

• Where there is more than one owner or lessee, the instrument states that 'an owner' or 'a lessee' must give notice (s 9(2)-(3)). That means a single owner or single lessee can satisfy the statutory notice obligation on behalf of others. If multiple owners/lessees do not coordinate, duplicate or delayed notices may occur. Contracts between co‑owners or co‑lessees should therefore reflect who will provide statutory notices.

Scope of 'person or body that is responsible for carrying out operations'

• The instrument requires those persons or bodies to give reasonable notice of proposed changes (s 9(4)), but it does not define the phrase 'person or body that is responsible for carrying out operations'. That invites factual inquiry in each case about whether a contractor, sub‑contractor, or other operator falls within the obligation. Without a statutory definition in the instrument, entities should treat the obligation broadly where they exercise operational control.

Uncertainty about notice content and delivery

• The instrument requires notices to be 'in writing' and addressed to the Agriculture Department (s 9(2)-(4)), but it does not prescribe the required content, formats, addresses, or the Departmental contact point. That creates practical uncertainty: where should a notice be sent, who within the Department should receive it, and what information is sufficient. Absent Departmental guidance, recipients risk ineffective compliance if the notice fails to reach the right office or lacks essential detail.

Baggage designation is narrow and other goods are unaddressed

• The instrument designates only 'Baggage' to the International Terminal as a biosecurity entry point (s 8, table). It explicitly states it does not designate biosecurity entry points for other goods for which the airport is a first point of entry, and that therefore the s 147 requirement to bring goods to a biosecurity entry point on unloading does not apply to those other goods (s 8 note). Practitioners should be careful: importers or freight handlers unloading goods other than baggage cannot assume there is a designated biosecurity entry point at the airport for those goods under this instrument.

No biosecurity entry point for aircraft despite first point of entry status

• The airport is a first point of entry for aircraft generally (s 5) but the instrument 'does not designate any area of Cocos (Keeling) Islands Airport as a biosecurity entry point for aircraft' (s 7). The s 7 note quotes s 238 of the Act which would require an aircraft to be brought to a biosecurity entry point if one were designated. The absence of a designated aircraft biosecurity entry point could create operational confusion for airlines and ground handlers about where aircraft biosecurity inspections or processes should occur.

Live horses excluded from goods designation

• Live horses are explicitly excluded from the goods first point of entry designation (s 6). Parties planning to import or transfer live horses must not assume this airport is a first point of entry for such imports; they must check other determinations or Act provisions (s 6 note referencing ss 173 and 174 of the Act).

Notification obligations may require internal contract and procedure changes

• Because the instrument places notice duties on owners, lessees and operationally responsible bodies (s 9), those parties should ensure their contractual arrangements allocate responsibility to supply statutory notices. Failure to allocate may lead to disputes among contractors, owners and lessees about who should have provided notice and when.

Potential for Departmental discretion and follow‑up not specified

• The instrument leaves unspecified how the Agriculture Department will respond to notices, whether it will require remediation, impose further conditions, or alter the determination. That means an entity giving notice cannot predict the Department’s administrative action from the instrument alone and should anticipate potential follow‑up.

Recordkeeping and proof of notice

• Because timing standards are legally significant ('as soon as practicable' and 'reasonable notice') and delivery channels are unspecified, parties should treat notices conservatively: provide early written notices, retain proof of sending, and seek confirmation of receipt from the Agriculture Department. The instrument does not itself state any evidential or procedural requirements for proof of compliance.

Summary

• The key operational pitfalls derive from narrow designations (baggage only), differing and undefined notice standards, lack of defined delivery channels for notices, and the absence of a designated biosecurity entry point for aircraft despite first point of entry status. These create practical compliance and coordination risks which must be managed by owners, lessees, operators and Departmental liaison.

Establish responsible persons and contact protocols

• Identify who within the ownership structure will be the statutory notifier where there are multiple owners (s 9(2)) and who will act where there are multiple lessees (s 9(3)). The instrument permits any one owner or any one lessee to give the required notices; therefore owners/lessees should allocate that responsibility contractually or by corporate resolution to ensure a single accountable notifier.
• Establish an internal operations contact (or contacts) for persons or bodies responsible for carrying out operations at the airport, so that proposed changes to procedures, facilities or amenities that might trigger s 9(4) are flagged internally in sufficient time to allow 'reasonable notice' to the Agriculture Department.

Draft notice templates and recordkeeping protocols

• Prepare written notice templates that capture the kinds of changes listed in s 9(5). Templates should include: description of the change, effective date (or proposed date), identity of the affected business entity, operational implications for biosecurity risk identification and communication, and contact details for follow‑up.
• Keep a centralised register of notices sent to the Agriculture Department including dates sent, delivery method, recipient (if known), and confirmation of receipt. The instrument requires notices 'in writing' (s 9(2)-(4)); proof of delivery will assist in demonstrating compliance with 'as soon as practicable' or 'reasonable notice' standards if challenged.

Timelines: err on the early side

• For owners and lessees: provide written notice to the Agriculture Department 'as soon as practicable' after becoming aware of the change (s 9(2)-(3)). Where there is doubt, send the notice promptly and do not delay waiting for finalisation of commercial arrangements.
• For proposed changes by operators: provide 'reasonable notice' in writing (s 9(4)). Because 'reasonable' is undefined, provide as much lead time as practicable, and seek confirmation from the Department where possible about whether the proposed timeframe is acceptable.

Engage the Agriculture Department for procedural clarifications

• Because the instrument does not specify the Departmental address, the form of the notice, or required content, contact the Agriculture Department to confirm the appropriate recipient, preferred delivery method (email, official portal, postal address), and any Departmental templates or guidance. Request and retain written confirmation of any such procedural guidance.
• Where proposed changes affect facilities or amenities for biosecurity officials (s 9(5)(b)) or the ability to identify or inform of biosecurity risks (s 9(5)(c)-(d)), consider scheduling a meeting with the Department to discuss timing, resourcing and any likely remedial measures the Department may require.

Operational controls at the airport

• For baggage: ensure baggage from arriving aircraft that is to be unloaded is directed to the International Terminal baggage area designated as the biosecurity entry point (s 8 and table). Implement signage, handling protocols and staff briefings to ensure baggage destined for unloading reaches the International Terminal baggage area 'as soon as practicable' (note to s 8 referencing s 147 of the Act).
• For other goods: recognise that this instrument does not designate biosecurity entry points for other goods (s 8 note). Where other goods are to be unloaded at the airport, seek Departmental guidance on whether additional arrangements or temporary biosecurity entry points are needed, and whether the Act’s s 147 obligations apply in the particular circumstances.

Contracts and procurement

• Update contracts with ground handlers, airport operators and service providers to allocate responsibility for complying with the notification duties in s 9, and to ensure procedural changes by contractors are subject to the operator’s internal change control that includes Departmental notification as required.
• Include express obligations on contractors to notify the airport operator or owner promptly of any proposed procedural or facility changes that may trigger s 9(5). That will enable the accountable owner/lessee to comply with the statutory notice duties.

Training and internal policies

• Train frontline staff, operations managers and contractor managers to recognise changes that fall within s 9(5): procedural changes affecting biosecurity measures, changes to facilities used by biosecurity officials, changes affecting the detection of biosecurity risks, or changes affecting communication with biosecurity officials.
• Document internal escalation procedures so that identified changes are escalated to the nominated statutory notifier without delay.

Recordbox for notices

• Keep contemporaneous records of: the operational change, the decision to notify (or not), the notice provided to the Agriculture Department, and any response received. Retain copies of all written notices and any confirmation of receipt or Departmental responses.

Practical steps where ambiguity exists

• When in doubt whether a proposed change falls within s 9(5), notify the Department early and provide the Department the opportunity to advise whether the change requires further action. The cost of early precautionary notice is likely lower than the administrative or regulatory friction of a dispute about a late notice.
• Seek written confirmation from the Department where a proposed change is deemed not to require notice. That confirmation should be retained in the register.

Liaison and escalation

• Designate a Departmental liaison within the airport operator’s governance structure. Where changes are likely to affect biosecurity risk identification or the ability of biosecurity officials to operate, arrange a pre‑change briefing with the Department to manage any resourcing or logistical impacts.

Legal and compliance checklist

• Confirm the airport’s status as a first point of entry for aircraft and for goods other than live horses (s 5-6).
• Confirm the baggage biosecurity entry point at the International Terminal and adjust baggage handling procedures accordingly (s 8).
• Assign statutory notification responsibilities among owners/lessees/operators (s 9(2)-(4)).
• Implement notice templates, recordkeeping and Departmental liaison arrangements.
• Update contracts and procurement documents to allocate notification and operational duties.
• Maintain training and escalation processes for changes that may affect biosecurity risk identification, facilities, or communication with biosecurity officials (s 9(5)).

By following these steps, airport owners, lessees and operators can align their internal controls with the written notice obligations and the location designations in this instrument, while preserving evidence of compliance in the absence of procedural detail in the instrument itself.
