Biosecurity (First Point of Entry—Christmas Island International Airport) Determination 2021

The determination rests on a small number of concepts and cross‑references to the Biosecurity Act 2015 as identified in the instrument.

Definitions and references

• The instrument adopts the Act’s definitions for some terms. It states that “Act” means the Biosecurity Act 2015 and notes that a number of expressions used are defined in section 9 of the Act (s 4, note). It expressly treats “aircraft” as defined by section 9 of the Act and treats “goods” as defined by section 19 of the Act (s 4).
• The instrument adds the qualification that “goods” for the purposes of this determination are goods either subject to biosecurity control, or in relation to which an exposed goods order is in force (s 4).

First point of entry and biosecurity entry point

• A first point of entry is a statutorily recognised place to which the Act’s first point of entry rules apply. This instrument declares Christmas Island International Airport a first point of entry for aircraft generally (s 5) and for goods other than live horses (s 6).
• A biosecurity entry point is a designated area within a first point of entry at which biosecurity processing for particular classes of goods or craft must take place. The instrument designates the airport’s International Terminal as a biosecurity entry point specifically for baggage (s 8, table).

Relationship between first point of entry and biosecurity entry point

• The instrument reiterates the Act’s procedural linkage: where an aircraft or goods fall within the scope of a biosecurity entry point at a first point of entry, the Act requires (subject to its provisions) that the aircraft or goods be brought to that biosecurity entry point (notes at s 7 and s 8 referring to s 238 and s 147 of the Act). The instrument makes explicit that there is no designated biosecurity entry point for aircraft at Christmas Island International Airport (s 7, note). It also notes that no other biosecurity entry points are designated for goods beyond baggage, and so section 147 of the Act will not require unloading of those other goods to go to a biosecurity entry point at this airport (s 8, note 2).

Conditions and notification

• The instrument conditions the airport’s designation on a set of notification obligations (Part 4, s 9). Owners and lessees who become aware that there has been, or will be, a change to the business entity operating the airport or a biosecurity entry point must give written notice to the Agriculture Department “as soon as practicable” after becoming aware (s 9(2)-(3)).
• The person or body responsible for carrying out operations must give the Agriculture Department “reasonable notice” in writing of any proposed change that fits any enumerated class in s 9(5). Those enumerated classes are changes to procedures for biosecurity measures, changes to facilities or amenities for biosecurity officials or human biosecurity officers, or changes to procedures that may affect identification or communication of biosecurity risks, or management of factors contributing to biosecurity risk (s 9(5), items (a)-(e)).

Administrative detail

• The instrument’s commencement information notes that the whole instrument commenced on 16 June 2021 and that the commencement table only relates to the instrument as originally made (s 2, commencement table and note).
• The instrument was made by a delegate of the Director of Biosecurity, named in the instrument (Barbara Cooper), and dated 8 June 2021 (title block).

These concepts frame the legal mechanics: designation of the airport as a point of entry, specification of one biosecurity entry point for baggage, and ongoing notification duties for owners, lessees and operational parties about changes that might affect biosecurity management at the airport.

The instrument identifies a narrow set of directly affected persons and entities, and implies others will be affected by operational consequences.

Directly affected parties

• Owner(s) of Christmas Island International Airport. The owner must give written notice to the Agriculture Department if they become aware of changes to the business entity operating the airport or to a biosecurity entry point at the airport (s 9(2)). If there is more than one owner, the duty attaches to “an owner”, not to each owner separately (s 9(2) wording).
• Lessee(s) of the airport. If there is a lessee, a lessee has the same written notice duty as an owner where the lessee becomes aware of changes of the types in s 9(3). If there are multiple lessees, the duty attaches to “a lessee” (s 9(3) wording).
• The person or body responsible for carrying out operations at the airport. That person or body must give the Agriculture Department reasonable written notice of proposed changes that fall within the enumerated classes in s 9(5) (s 9(4)-(5)).

Operators, carriers and goods handlers

• Aircraft operators and masters. The airport is a first point of entry for aircraft generally (s 5). The instrument does not designate a biosecurity entry point for aircraft at this airport (s 7). The instrument’s notes reference an Act provision that requires an aircraft to be brought to a biosecurity entry point at a first point of entry if there is one, but this determination states none exists for aircraft at this airport (s 7 note referencing s 238 of the Act). Practically, aircraft arriving at the airport should be aware of the airport’s first point of entry status and the absence of a designated aircraft biosecurity entry point.
• Persons unloading goods from aircraft. The airport is a first point of entry for goods other than live horses (s 6). The instrument designates baggage as a class of goods that must be brought to a designated biosecurity entry point, specifically the International Terminal (s 8 and its table). The instrument notes that where an aircraft arrives carrying goods mentioned in the table that are to be unloaded, those goods must be brought to the designated biosecurity entry point as soon as practicable (s 8 note 1, referencing s 147 of the Act). For other goods the airport may be a first point of entry for, no biosecurity entry point is designated here, and the s 147 requirement therefore does not apply to their unloading at this airport (s 8 note 2).
• Baggage handlers, freight forwarders and ground handling agents. They will need to comply with the practical requirement that baggage unloaded at Christmas Island International Airport be brought to the designated biosecurity entry point, the International Terminal, as soon as practicable (s 8 table and note 1). They are indirect subjects of the instrument’s operative designation.

Commonwealth agencies and officials

• The Agriculture Department (Department of Agriculture, Water and the Environment). The instrument requires written notices be given to the Agriculture Department in the circumstances specified (s 9(2)-(4)). The Department will receive notifications and, under the Act, will interact with the airport operator or owners regarding any operational or facility changes affecting biosecurity risk.
• Biosecurity officials and human biosecurity officers. The instrument contemplates their role at the airport, by requiring notice where proposed changes would affect facilities and amenities available to them or the procedures by which they are informed of identified biosecurity risks (s 9(5)(b)-(d)). The instrument does not itself authorise or direct specific biosecurity official actions but creates a reporting channel for changes that affect their ability to perform functions under the Act.

Other affected or implicated parties

• Passengers whose baggage is loaded or unloaded at Christmas Island International Airport. Their baggage falls within the designated class “Baggage” for which the International Terminal is the biosecurity entry point (s 8).
• Parties that might propose or carry out procedural changes. They must give reasonable notice for changes that implicate biosecurity measures, risk identification, information flow to officials or facilities for officials (s 9(4)-(5)).

Noteworthy allocation of responsibility

• Where multiple owners or lessees exist, the instrument requires notice from “an owner” or “a lessee” rather than from each co‑owner or co‑lessee (s 9(2)-(3)). This allocates a minimal individual triggering duty rather than a joint or collective duty.
• The instrument does not spell out who qualifies as “the person or body that is responsible for carrying out operations”. That phrase is used in s 9(4) and imposes an obligation on whoever fits that description in practice.

The instrument therefore concentrates direct compliance obligations on airport owners, lessees and operational parties, and places procedural obligations on handlers of baggage unloaded from arriving aircraft.

The determination establishes specific duties, and it is silent on explicit rights. Duties are mainly notification obligations and spatial obligations for baggage. The instrument relies on the Act for broader duties and enforcement.

Duties created by the determination

• First point of entry status.

  • The airport is a first point of entry for aircraft generally (s 5). The designation itself imposes the regulatory status conferred by the Act on aircraft and goods arriving there. The instrument does not set procedures for aircraft under this status but cross‑references the Act for consequences (s 5; s 7 note).
  • The airport is a first point of entry for goods other than live horses (s 6). That establishes the airport as the entry location for goods subject to biosecurity control or an exposed goods order, as per the instrument’s definition of goods (s 4).

• Biosecurity entry point designation for baggage.

  • The instrument designates the Christmas Island Airport International Terminal as a biosecurity entry point for baggage (s 8, table). Where baggage is unloaded from an arriving aircraft and the baggage is a class mentioned in the table, those goods must be brought to the biosecurity entry point as soon as practicable, reflecting the Act’s s 147 requirement referenced in the instrument’s note (s 8 and note 1).

• Notification duties on owners and lessees.

  • If an owner (or, if multiple owners, an owner) becomes aware that there has been, or will be, a change to the business entity operating the airport, or a change to a biosecurity entry point at the airport, that owner must give written notice to the Agriculture Department as soon as practicable after becoming aware (s 9(2)).
  • An identical duty applies to a lessee (or, if multiple lessees, a lessee) who becomes aware of such a change (s 9(3)).

• Notification duties on persons or bodies responsible for carrying out operations.

  • A person or body responsible for carrying out operations at the airport must give reasonable written notice to the Agriculture Department of proposed changes of certain kinds (s 9(4)). Section 9(5) lists the kinds of changes requiring reasonable notice: changes to procedures providing for biosecurity measures; changes to facilities or amenities available for biosecurity officials and human biosecurity officers; changes to procedures affecting the ability to identify biosecurity risks; changes to procedures affecting how officials are informed of identified risks; and changes to procedures for managing factors that affect biosecurity risk (s 9(5)(a)-(e)).

Form and timing of notices

• Notices must be given in writing to the Agriculture Department (s 9(2)-(4)).
• Timing is expressed in two standards:
  • “As soon as practicable after becoming aware that the change has occurred or will occur” for owners and lessees (s 9(2)-(3)).
  • “Reasonable notice” for proposed changes by the person or body responsible for operations (s 9(4)). The instrument does not define “reasonable” nor specify a minimum period.

Rights and absence of rights in the instrument

• The instrument does not create explicit rights for the airport owner, operator, lessee, passengers or third parties. It does not provide an approval mechanism, or a right to refuse a Department request, nor does it specify compensatory mechanisms for compliance.
• The instrument does not grant any express operational discretions to the owner, lessee or operator; rather, it imposes notice obligations and designates spatial biosecurity points.

Duties implicit through cross‑reference to the Act

• The instrument’s notes reference Act provisions that impose procedural duties where biosecurity entry points exist. For example, the instrument notes that under section 238 of the Act an aircraft must be brought to a biosecurity entry point at a first point of entry if there is one (s 7 note). It also references section 147 as requiring goods unloaded that are mentioned in the table to be brought to the biosecurity entry point as soon as practicable (s 8 note 1). These references indicate that the instrument’s designations engage the Act’s operative requirements, but the instrument itself does not restate those statutory duties in full. To understand the broader operational duties and powers that will apply to aircraft, goods and persons at the airport, the Act’s relevant sections must be consulted.

Practical consequences of duties

• Baggage handlers and freight operators must ensure unloaded baggage is taken to the International Terminal biosecurity area promptly (s 8).
• Owners and lessees must have procedures to detect changes to the business entity operating the airport or its biosecurity entry points, and to issue written notice to the Agriculture Department when they become aware the change has occurred or will occur (s 9(2)-(3)).
• Operators proposing procedural or facility changes that affect biosecurity risk must plan to provide reasonable written notice to the Agriculture Department in advance (s 9(4)-(5)). The absence of a numerical time frame means operational planning must account for an assessment of what will be “reasonable” in context.

The instrument is procedural in nature and places a compliance burden predominantly on airport owners, lessees and operational parties, and on those handling baggage arriving at the International Terminal.

The determination itself does not set out penalty provisions, enforcement mechanisms or specific sanctions for non‑compliance. Its operative clauses are designations and notification obligations. Enforcement, including penalties and powers to secure compliance, is vested in the Biosecurity Act 2015, which is cited repeatedly in the instrument and serves as the Act under which the determination was made (s 3; s 4 notes). The instrument therefore operates within the Act’s enforcement framework rather than creating a separate regime.

What the instrument states and what it leaves to the Act

• The instrument identifies duty holders and imposes written notice requirements on owners, lessees and operators in defined circumstances (s 9(2)-(4)). It does not specify what happens if those written notices are not provided, or any penalty for failing to provide them.
• The instrument’s notes reference Act provisions that impose obligations when biosecurity entry points exist (for example s 147 and s 238 are cited in the notes to ss 7-8). Those Act provisions are the likely source of any statutory consequences for failing to fulfill obligations tied to biosecurity entry points. The instrument does not reproduce or summarise the Act’s enforcement or penalty sections.

Enforcement actors and processes implied by the instrument

• The Agriculture Department is the recipient of notices and therefore the administrative counterparty for compliance. The Department will receive and process notices given under s 9. The instrument does not prescribe how the Department will respond, whether it will approve or disallow proposed changes, or what further actions it might take in response to notices.
• Biosecurity officials and human biosecurity officers are referenced in the instrument in relation to facilities, amenities and procedural changes that may affect their ability to perform functions under the Act (s 9(5)(b)-(d)). The instrument presumes these officials operate under the Act’s powers and enforcement provisions.

Compliance risk and uncertainty

• The instrument creates uncertainty about enforcement because it uses qualitative standards for timing, namely “as soon as practicable” and “reasonable notice” (s 9(2)-(4)). Those formulations are context dependent and will require interpretive decisions by the Department if non‑compliance is alleged. The instrument does not state whether the Department will issue guidance or specify timeframes subsequently.
• Because the instrument is silent on penalties for failing to give written notice, enforcement response would be governed by the Act. The instrument does not, for example, specify administrative sanctions, suspension of the first point of entry designation, or other intermediate enforcement options.

Operational enforcement of biosecurity entry point obligations

• The instrument designates an area as the biosecurity entry point for baggage, and it notes the Act requires baggage unloaded from an arriving aircraft to be brought to the relevant biosecurity entry point as soon as practicable (s 8 and note 1, referencing s 147 of the Act). Enforcement of that operational requirement will likewise be pursuant to the Act’s provisions for compliance and enforcement; the instrument provides the spatial designation but does not describe enforcement steps.

In sum, the determination assigns duties and designations but delegates enforcement mechanisms and penalties to the broader statutory Biosecurity Act 2015 framework. The instrument itself is silent on specific enforcement procedures and sanctions; parties should consult the Act to identify penalties and enforcement powers that may apply to failures to comply with obligations engaged by this determination.

This determination is a statutory instrument made under the Biosecurity Act 2015, and it expressly cross‑references several sections of the Act. The interaction is one of delegation and operational detail within the Act’s framework.

Legal basis

• Authority: the instrument was made under subsection 223(1) of the Biosecurity Act 2015 (s 3). That provision is the statutory source that permits a delegate of the Director of Biosecurity to make determinations such as this one. The instrument therefore sits as an exercise of delegated power derived from the Act.

Cross‑references within the instrument

• Definitions. The instrument refers to section 9 of the Act for definitions of “aircraft” and other expressions (s 4 and accompanying notes). It also refers to section 19 for the definition of “goods” (s 4). The instrument then narrows “goods” for its own purposes to goods subject to biosecurity control or those subject to an exposed goods order (s 4).
• Operational effect of the Act’s provisions. The instrument includes explanatory notes that reference specific Act sections:
  • Section 238: referenced in the note to s 7, stating that an aircraft must be brought to a biosecurity entry point at a first point of entry if there is a biosecurity entry point for the aircraft at that first point of entry.
  • Section 147: referenced in the note to s 8, indicating that where an aircraft has arrived carrying goods mentioned in the table and those goods are to be unloaded, they must be brought to the biosecurity entry point as soon as practicable.
  • Sections 173 and 174: referenced in the note to s 6 as dealing with prohibited goods and conditionally non‑prohibited goods, pointing readers to the Act for matters about whether particular goods may be brought into a particular first point of entry.

Nature of interaction

• The instrument supplies place‑specific and class‑specific designations that operate within the Act’s substantive and procedural rules. The Act sets out broader powers, offences and processes; the instrument fixes which areas and which classes of goods at this airport are to be treated as biosecurity entry points and first points of entry for the purposes of applying those Act provisions.
• The instrument does not amend or alter the Act. It is an enabling subordinate instrument that designates places and states notification conditions under the Act’s grant of power. Any change to enforcement, penalty amounts, or the substantive definitions would require amendment of the Act or its other subordinate instruments.

Interaction with administrative practice

• Notices required by s 9 must be given to the Agriculture Department. That creates an administrative interface between the airport’s commercial actors and the Commonwealth agency. The instrument does not specify the Department’s subsequent obligations, approval powers or timelines, so that administrative relationship will be governed by the Act, Departmental practice and any separate administrative guidance or agreements between the Department and the airport operator.

Overlap and gaps

• The instrument designates the International Terminal as the biosecurity entry point for baggage, thereby invoking the Act’s procedural requirements for baggage unloading and processing. For any goods classes not listed in the instrument’s table, the instrument states that the s 147 requirement to bring goods to a biosecurity entry point does not apply at this airport (s 8 note 2), leaving the operational regime for those goods potentially different than at other first points of entry that have more extensive biosecurity entry point designations.
• The instrument uses qualitative timing standards for notices. Those standards require interpretation against any binding time limits, standards or enforcement procedures in the Act. If the Act sets specific timeframes for Department action or for other notifications, those would interact with the instrument’s qualitative standards. The instrument itself, however, does not set those timeframes.

Practical implication of cross‑references

• To determine the full set of duties, powers and possible sanctions that flow from the designations in this instrument, practitioners must read the instrument alongside the indicated sections of the Biosecurity Act 2015 (notably s 9, s 19, s 147, s 173, s 174, s 223(1) and s 238 as referenced in the instrument). The instrument fixes the place and classes; the Act supplies the operative legal machinery.

In short, the determination is a place‑ and class‑specific instrument that operates within the Biosecurity Act 2015. It relies on and invokes Act provisions for definitions, duties, and the operational consequences of biosecurity entry point designations, while itself providing the airport‑level designations and procedural notice obligations.

The instrument contains a commencement table that records the original commencement of the whole instrument. The instrument states that the whole instrument commenced on 16 June 2021 (s 2). The instrument also contains a note that the commencement table relates only to the provisions of the instrument as originally made and will not be amended to deal with any later amendments of the instrument (s 2 note). No subsequent amendments are recorded within the text supplied.

Specific items recorded in the instrument

• Date made and signatory: The instrument was made by a delegate of the Director of Biosecurity and is dated 8 June 2021; the delegate named is Barbara Cooper, Assistant Secretary, Biosecurity Operations Division, Department of Agriculture, Water and the Environment (title block).
• Commencement: The instrument specifies the commencement date as 16 June 2021, which is the date shown in the commencement table and reiterated in the instrument (s 2, table entries).
• Note on commencement table editing: The instrument includes a standard note that any information inserted in column 3 of the commencement table is not part of the instrument and may be edited or inserted in any published version; that language is present but does not effect substantive change to the instrument (s 2(2)).

Absence of amendment records in the supplied text

• The supplied text does not show any amending instruments, revocations or later determinations affecting the instrument. The instrument’s own note says the commencement table will not be amended to deal with later amendments, which means one cannot infer amendment history from the commencement table itself.
• Because the supplied document is self‑contained and shows no schedule of amendments, there is no internal record here of any amendment after the original making and commencement. Practitioners seeking a current status should check the consolidated and current legislative database or registers that track amendments and revocations.

Practical consequence for review and compliance

• At the moment captured by this instrument, the designations and conditions in the text are the operative rules. If an airport operator, owner or lessee relies on this instrument, they should confirm whether later determinations, replacements or revocations have been made under the Act after the commencement date recorded here. The instrument itself contains no later amendment history and no transitional provisions beyond its own commencement table.

In summary, the instrument’s amendment history as presented is limited to its original making and commencement in June 2021; no later amendments are recorded in the supplied text.

The supplied instrument contains no reference to litigation, court decisions, disputes, or judicial interpretation concerning its validity, application or enforcement. It names no cases and does not quote or rely on judicial authority. The instrument is a standalone delegated determination, and the text provided does not include any litigation history.

Implications and practical note

• Because the instrument is a subordinate instrument under the Biosecurity Act 2015, any litigation that would engage its provisions would arise from matters of interpretation of the instrument itself or of the Act in relation to the instrument’s operation. Those matters are not reflected in the instrument text.
• Practitioners should be aware that absence of litigation history in the instrument does not mean there is no case law relevant to how the Act’s sections cited (for example the sections noted in the instrument such as s 147 or s 238) have been interpreted by courts. Any such case law would not appear in this instrument unless cited; it is outside the supplied text.

If litigation issues are material to a client matter, the next step is to review the Biosecurity Act 2015 and any Commonwealth litigation that interprets the Act or comparable determinations, because enforcement and sanctions are governed by the Act. The supplied instrument itself provides no direct litigation pointers.

The instrument is compact, but it contains several practical and legal features that may cause confusion or lead to compliance risk if not addressed deliberately.

1. “An owner” and “a lessee” triggers

• The notification duties in s 9(2)-(3) attach to “the owner (or, if there is more than one owner, an owner)” and likewise to “the lessee (if any) (or, if there is more than one lessee, a lessee)”. That formulation means the duty is triggered by a single owner or a single lessee becoming aware of a relevant change. It does not require every co‑owner or co‑lessee to notify. This is a compliance nuance: it reduces duplication but creates potential coordination gaps if co‑owners or co‑lessees do not have internal procedures allocating responsibility to ensure one of them gives the required notice promptly (s 9(2)-(3)).

2. Knowledge standard: “becomes aware”

• The owner or lessee duty is triggered when that person “becomes aware” that the change has occurred or will occur, and the required timing is “as soon as practicable after becoming aware” (s 9(2)-(3)). The subjective or objective scope of “becomes aware” is not defined, potentially giving rise to disputes about when the notification obligation was triggered.

3. Qualitative timing: “as soon as practicable” and “reasonable notice”

• The instrument uses qualitative timing standards rather than fixed deadlines. Owners and lessees must give notice “as soon as practicable” after becoming aware (s 9(2)-(3)). Persons or bodies proposing changes must give “reasonable notice” of proposed changes (s 9(4)). The instrument does not provide a numerical or presumptive time period. Compliance planning must therefore adopt a conservative approach, triggering notification early and documenting the basis for any assessment that notice was timely.

4. Unclear identification of “person or body responsible for carrying out operations”

• Section 9(4) imposes duties on “a person or body that is responsible for carrying out operations at Christmas Island International Airport”. The instrument does not define that phrase, which may be interpreted differently by stakeholders. Parties should confirm whether they are the responsible person or body for the purposes of this provision and establish internal lines of responsibility accordingly.

5. Narrow designation of biosecurity entry points for goods

• The instrument designates the International Terminal as a biosecurity entry point for baggage only (s 8 and the table). The instrument explicitly states it does not designate biosecurity entry points for other goods for which the airport is a first point of entry, so the Act’s section 147 requirement to bring unloaded goods to a biosecurity entry point does not apply to those other goods at this airport (s 8 note 2). Operators and freight handlers might assume all goods at a first point of entry must go to a specified biosecurity area. That is not the case here. Where other goods require biosecurity control under the Act, practical arrangements at this airport will differ from locations with broader designations.

6. Aircraft biosecurity entry point absence

• The instrument does not designate any area as a biosecurity entry point for aircraft at Christmas Island International Airport (s 7 note). The Act provision noted in the instrument would require an aircraft to be brought to a biosecurity entry point if there were one (s 7 note, referencing s 238). Because none is designated here, aircraft are not subject to that particular placement requirement at this airport under the instrument. Operators should not assume aircraft must go to a specific biosecurity area at this airport unless other administrative arrangements are put in place.

7. Exclusion of live horses from goods designation

• The airport is a first point of entry for goods other than live horses (s 6). That explicit exclusion matters for parties involved in importing live horses: they cannot treat Christmas Island International Airport as a first point of entry for live horses under this determination. The instrument’s note directs readers to the Act for other questions about prohibited or conditionally non‑prohibited goods (s 6 note referencing ss 173 and 174).

8. Notice recipients and Department response not specified

• Notices must be given in writing to the Agriculture Department, but the instrument does not state how the Department will acknowledge, review or act on notices, or whether the Department will have approval or veto powers on proposed changes. The absence of procedural detail can create uncertainty about the practical impacts of giving notice. Parties should document notices and seek confirmation from the Department as necessary (s 9(2)-(4)).

9. Narrow scope of the instrument

• The determination is place‑specific and class‑specific. It does not alter or expand the Act’s general biosecurity powers, nor does it create an enforcement regime separate from the Act. Parties should avoid treating the instrument as comprehensive; it must be read alongside the Biosecurity Act 2015 for full legal effect (s 3, s 4 notes).

10. Administrative record and amendment tracking

• The instrument’s commencement table contains a note that its column 3 entries are not part of the instrument and may be edited in published versions (s 2(2)). Practitioners should verify the current status of the instrument and any later determinations in official consolidated sources rather than relying solely on the printed commencement table or the version supplied here.

These “gotchas” arise from the instrument’s narrow drafting choices: qualitative timing standards, single‑person notification triggers in multi‑owner contexts, limited designation of biosecurity entry points and undefined responsibility phrases. Each can be managed by clear internal procedures, early and well‑documented notice, and direct liaison with the Agriculture Department.

This section provides step‑by‑step, instrument‑grounded actions for owners, lessees, airport operators, ground handlers and other implicated parties. All references are to provisions in the instrument.

1. Confirm status and applicable classes

• Record that Christmas Island International Airport is a first point of entry for aircraft generally (s 5) and for goods other than live horses (s 6). Note that baggage is the only class of goods for which a biosecurity entry point is designated at this airport, and that the designated area is the Christmas Island Airport International Terminal (s 8 and the table).

2. Create an internal notification protocol for owners and lessees

• Because the obligation in s 9(2)-(3) attaches to “an owner” or “a lessee” where there are multiple owners or lessees, appoint a single responsible officer within the ownership/leasehold group to monitor for changes to the business entity operating the airport or to a biosecurity entry point.
• Implement systems to detect changes that trigger the duty, including:
  • Changes in the business entity operating the airport (for example, transfers of operating contracts, insolvency events, changes of controlling shareholders where such changes affect the entity that operates the airport).
  • Changes to a biosecurity entry point at the airport, including establishment, relocation or decommissioning of a designated biosecurity processing area.
• When the responsible officer “becomes aware” of a change or prospective change, give written notice to the Agriculture Department “as soon as practicable” after becoming aware (s 9(2)-(3)). Because “as soon as practicable” is qualitative, treat the duty as requiring prompt notification and document the date and circumstances of awareness.

3. Establish a process to notify the Agriculture Department of proposed operational changes

• Identify who is “the person or body that is responsible for carrying out operations at Christmas Island International Airport” in practice. Ensure that party is aware of the need to give “reasonable notice” in writing under s 9(4) of proposed changes in the enumerated categories in s 9(5).
• The enumerated categories are:
  • Changes to procedures providing for biosecurity measures to manage risk (s 9(5)(a)).
  • Changes to facilities or amenities available for biosecurity officials and human biosecurity officers to perform functions or exercise powers under the Act (s 9(5)(b)).
  • Changes to procedures that may affect the ability to identify biosecurity risks (s 9(5)(c)).
  • Changes to procedures that may affect how biosecurity officials or human biosecurity officials are informed of identified biosecurity risks (s 9(5)(d)).
  • Changes to procedures for managing factors that contribute to or affect the level of biosecurity risk associated with operations (s 9(5)(e)).
• Adopt a conservative standard for “reasonable notice”. Unless confirmed otherwise by the Department, assume reasonable notice means sufficient lead time to allow the Department to assess the change and to advise on biosecurity implications. Early engagement fosters certainty.

4. Document all notices and communications

• All notices must be in writing and delivered to the Agriculture Department (s 9(2)-(4)). Keep a formal record of:
  • The notice content and date of notification.
  • The person who became aware and the factual circumstances leading to awareness.
  • Any Departmental responses, requests for further information, or acknowledgements.
• For proposed changes, document the decision process that produced the proposed change, risk assessments performed, and any steps taken to mitigate biosecurity risk. Attach these to the notice to the Department where appropriate.

5. Operational handling of baggage

• Recognise that baggage is a class of goods with a designated biosecurity entry point at the International Terminal (s 8 table).
• Ensure baggage unloaded from arriving aircraft is taken to the International Terminal biosecurity entry point as soon as practicable, consistent with the instrument’s note referencing s 147 of the Act (s 8 and note 1).
• Train ground handling, security and baggage staff on the requirement and ensure signage and physical pathways direct unloaded baggage to the International Terminal processing area.

6. Clarify arrangements for other goods and live animals

• The instrument excludes live horses from the goods designation at this airport (s 6). Do not plan to import or unload live horses at Christmas Island International Airport on the assumption it is a first point of entry for them under this determination.
• For other goods that may arrive at a first point of entry but for which the instrument has not designated a biosecurity entry point, the s 147 requirement to bring unloaded goods to a biosecurity entry point does not apply at this airport (s 8 note 2). Nevertheless, ensure freight handling procedures comply with the Act and any Departmental directions addressing biosecurity control for non‑baggage goods.

7. Engage early with the Department on facility and procedural changes

• If planning changes to facilities or amenities that could affect biosecurity officials’ ability to perform functions, give reasonable notice and include technical details of the proposed changes, timelines and contingency plans (s 9(5)(b)).
• Where procedural changes may affect the identification or information flow about biosecurity risks, include a clear description of how identification and reporting will continue to function, or will be improved, and any compensating measures during transition (s 9(5)(c)-(d)).

8. Establish an internal awareness and escalation pathway

• Because the duty to notify is triggered by becoming aware, set up monitoring for events that might create change: contractual variations, operator changes, staffing transitions, facility upgrades, maintenance plans, lease assignments, corporate reorganisations.
• Escalate matters to the appointed “owner” or “lessee” responsible for notification so that the statutory notice can be given promptly.

9. Seek clarification and written confirmation from the Department when appropriate

• Where there is uncertainty about whether a planned change falls within s 9(5), or about what constitutes reasonable notice in the circumstances, request written confirmation from the Agriculture Department. Maintain records of these exchanges for audit and compliance demonstration.

10. Periodic review

• Periodically review the airport’s operational practices against the instrument’s designations and the Act, and verify that internal processes still ensure timely compliance with notification requirements. Update responsibilities when ownership or lessee structures change.

These steps are designed to satisfy the instrument’s express duties: written notices to the Agriculture Department by owners and lessees when they become aware of changes to business entities or biosecurity entry points (s 9(2)-(3)); written reasonable notice by persons or bodies responsible for operations for proposed procedural or facility changes that implicate biosecurity risk (s 9(4)-(5)); and operational handling of baggage to the International Terminal as the biosecurity entry point for baggage (s 8).

If legal certainty is required about enforcement, penalty exposure or the Act’s substantive obligations referenced in the instrument, obtain legal advice and consult the Biosecurity Act 2015 sections cited in the instrument.
