Biosecurity (First Point of Entry—Alice Springs Airport) Determination 2021

The instrument operates through a small set of statutory concepts that are either defined in the instrument or are incorporated by reference to the Biosecurity Act 2015.

• First point of entry. The instrument designates Alice Springs Airport as a first point of entry for the classes listed in ss 5 and 6. The concept of a first point of entry is a statutory status created by determinations under the Act; the instrument does not define the wider legal consequences of that status, but it explicitly links the designation to obligations in the Act by reference to other provisions (see s 3 and the notes to ss 5-6).
• Classes of conveyances and goods. The instrument differentiates between aircraft and goods. It adopts the Act’s definitions: aircraft as defined by s 9 of the Act and goods as defined by s 19 of the Act (s 4). It then narrows the scope of the designation: aircraft generally are covered (s 5), but in relation to goods only crew baggage is covered (s 6).
• Biosecurity entry point. The instrument designates the physical site within the airport where biosecurity control must be conducted. The tables in ss 7 and 8 designate Asia Pacific Aircraft Storage as the sole biosecurity entry point for the listed classes of aircraft and goods. The instrument’s notes recall the statutory obligation that an arriving aircraft or goods must be brought to a biosecurity entry point as soon as practicable (references to ss 238 and 147 of the Act appear in the notes to ss 7 and 8).
• Notification and procedural conditions. Section 9 creates ongoing procedural duties attaching to the determination. Those duties require written notice to the Agriculture Department when ownership or the business entity operating the airport or a biosecurity entry point changes, and they require reasonable notice to the Department of proposed operational changes that could affect biosecurity risk management (s 9(2)-(5)).
• Temporal operation. The instrument’s commencement is specified in s 2: the whole instrument commenced on 16 June 2021. A schedule‑style commencement table is included, with a note that the table reflects the instrument as originally made.

Taken together, the instrument is narrow in scope. It does three discrete things: (1) fix Alice Springs Airport as a first point of entry for certain classes, (2) fix Asia Pacific Aircraft Storage as the designated biosecurity entry point for those classes, and (3) impose notification and procedural conditions around changes to operators, facilities and procedures. The instrument relies on the Biosecurity Act 2015 for the underlying legal machinery and for the practical meaning of terms such as "subject to biosecurity control" and the consequences of failing to present aircraft or goods to a biosecurity entry point.

The determination creates specified legal consequences for a limited set of actors. The instrument itself names the categories; it does not list particular organisations. The affected parties, and the principal effects on each, are as follows.

• Airport owner or owners. The owner, or where there are multiple owners any one owner, must give the Agriculture Department written notice as soon as practicable if they become aware of an existing or imminent change to the business entity operating Alice Springs Airport, or to the business entity operating a biosecurity entry point at the airport (s 9(2)). That creates an administrative duty on ownership changes, and therefore affects transactions such as disposals, transfers, or restructures that change the business entity operating the airport or a biosecurity entry point.
• Airport lessee or lessees. Where there is a lessee, or multiple lessees, any one lessee must give the same written notice to the Agriculture Department in the same circumstances as the owner provision (s 9(3)). Leaseholders therefore share notification obligations with owners where the operational control or the business entity operating the airport or entry point changes.
• Persons or bodies responsible for carrying out operations at Alice Springs Airport. Any person or body responsible for operating at the airport must give the Agriculture Department reasonable written notice of proposed changes to procedures, facilities, amenities, or other operational practices that may affect the airport’s ability to identify or manage biosecurity risk (s 9(4)-(5)). That will in practice include airport operators, ground handling companies, airlines or other service contractors who manage aircraft parking, passenger movements, baggage handling, and related activities.
• Aircraft operators and masters. The instrument designates a biosecurity entry point for all aircraft covered by the instrument (s 7). The notes recall that an arriving aircraft must be brought to its biosecurity entry point as soon as practicable (note to s 7, citing s 238 of the Act). Aircraft operators therefore must plan for arrival, taxiing and parking so that the aircraft can be taken to Asia Pacific Aircraft Storage when required.
• Persons handling crew baggage. The instrument designates Asia Pacific Aircraft Storage as the biosecurity entry point for crew baggage (s 8). The notes recall the statutory requirement that goods to be unloaded be brought to a biosecurity entry point as soon as practicable (note to s 8, citing s 147 of the Act). Those who unload, transport, store, or otherwise handle crew baggage will need to route such baggage to the designated area.
• The Department of Agriculture, Water and the Environment (referred to as the Agriculture Department in s 9). The Department is the statutory recipient of the notices required by s 9, and it will receive information on changes to operators, facilities and procedures.

The instrument does not purport to alter ownership rights directly. It imposes notification obligations on owners and lessees rather than substantive prohibitions. It also does not purport to designate Alice Springs Airport as a first point of entry for all types of goods; it specifically limits goods to crew baggage only (s 6 and Note 1 to s 6). The instrument therefore limits the set of freight and cargo businesses affected by the first point of entry designation to those handling crew baggage at Alice Springs Airport.

Who pays. The instrument places the administrative cost of notification and the operational cost of routing aircraft and crew baggage to the designated entry point on the private parties named in the conditions: owners, lessees, operators, aircraft operators, and baggage handlers. The Department receives information but the instrument does not allocate costs for Departmental attendance or infrastructure upgrade within the text itself.

Who decides. The instrument centralises the decision about the location for biosecurity control at Alice Springs Airport in the Asia Pacific Aircraft Storage area. It also vests in the Agriculture Department the role of recipient and recipient‑assessor of the notices required by s 9; the instrument does not itself describe any decisionmaking tests the Department must apply on receipt of notices.

The instrument creates a short list of duties and identifies the location where rights to bring aircraft and crew baggage for biosecurity control are to be exercised. It does not create express rights of access or regulatory powers beyond the designation and the notification duties. The principal duties and their statutory textual sources are the following.

• Duty to bring an arriving aircraft to the designated biosecurity entry point. While the instrument itself designates the entry point, the accompanying notes refer to the Act’s obligation that an aircraft that has arrived must be brought to a biosecurity entry point as soon as practicable; see the note to s 7 which cites s 238 of the Act. The instrument therefore operates against the background duty in the Act that arriving aircraft must be presented to a biosecurity entry point promptly.
• Duty to bring goods unloaded from an arriving aircraft to a biosecurity entry point. The note to s 8 cites s 147 of the Act and states the requirement that goods to be unloaded must be brought to a biosecurity entry point as soon as practicable. The instrument limits the goods covered at Alice Springs to crew baggage (s 6; s 8 table). Persons unloading crew baggage must therefore ensure it is brought to Asia Pacific Aircraft Storage as soon as practicable.
• Notification duties on owners. If the owner, or any one of multiple owners, of Alice Springs Airport becomes aware that there has been, or will be, a change to the business entity operating the airport or a biosecurity entry point, the owner must give the Agriculture Department written notice as soon as practicable after becoming aware of the change (s 9(2)). The duty is to notify, in writing, promptly upon awareness.
• Notification duties on lessees. The same written‑notice obligation applies to lessees, where applicable, with the same trigger and timeline: where a lessee becomes aware that there has been, or will be, a change to the business entity operating the airport or a biosecurity entry point they must give the Agriculture Department written notice as soon as practicable (s 9(3)).
• Reasonable‑notice duty for proposed operational changes. A person or body responsible for carrying out operations at Alice Springs Airport must give the Agriculture Department reasonable written notice of a proposed change to specified matters if that change may affect biosecurity risk management (s 9(4)-(5)). The enumerated categories in s 9(5) are procedural changes affecting biosecurity measures; changes to facilities or amenities for biosecurity officials and human biosecurity officers; changes to procedures affecting the ability to identify biosecurity risks; changes to procedures affecting the ability to inform biosecurity officials of identified risks; and changes to other procedures for managing factors that may contribute to or affect biosecurity risk (s 9(5)(a)-(e)).
• Definitions‑based limitations. The instrument’s duties apply only in relation to aircraft and goods that are "subject to biosecurity control" or, for goods, are subject to an exposed goods order (s 4). The definitions are supplied by reference to the Act; duties are therefore scoped to matters that fall within the Act’s biosecurity control provisions.

Rights. The instrument does not enumerate express new rights for private parties. What it does is specify where biosecurity control can be lawfully exercised in respect of the designated aircraft and goods. To the extent that operators have an expectation of where aircraft and crew baggage must be presented for biosecurity processing, the instrument grants legal certainty by naming Asia Pacific Aircraft Storage as the designated entry point (ss 7-8).

Form and manner of notices. The instrument requires written notice to the Agriculture Department (s 9(2)-(4)). It specifies timing terms such as "as soon as practicable" for notices triggered by awareness of a change, and "reasonable notice" for proposed operational changes (s 9(2)-(4)). The instrument does not define those temporal standards, or specify delivery addresses, formats, or required content for the notices; those operational matters will be determined by the Department’s administrative practice or further guidance.

Scope and limits. The instrument limits its operation in two important ways. First, goods are limited to crew baggage at Alice Springs Airport (s 6). Second, the biosecurity entry point at Alice Springs Airport is a single specified area, Asia Pacific Aircraft Storage, for both aircraft and crew baggage (ss 7-8). The instrument therefore focuses duties and operational obligations on a narrowly defined subset of airport activity.

The text of the determination does not create new offences or specify penalties. It is an administrative instrument made under the Biosecurity Act 2015 (s 3), and enforcement in terms of sanctions, civil remedies or criminal penalties is governed by the Act itself. The determination does, however, interact with statutory obligations in the Act by designating a first point of entry and a specific biosecurity entry point for certain classes; notes in the instrument cross‑refer to Act provisions that impose obligations to present aircraft and goods to a biosecurity entry point (notes to ss 7 and 8 refer to ss 238 and 147 of the Act).

What the instrument states, and what it does not state.

• Does state. The instrument states the designated first point of entry and biosecurity entry point, and it prescribes written notice and reasonable notice duties for particular actors (ss 5-9).
• Does not state. The instrument does not state any civil or criminal penalty for non‑compliance with its notification duties. It does not provide an enforcement regime specific to the determination. It does not specify how the Agriculture Department must respond to notices, nor how compliance will be monitored, investigated, or prosecuted.

Practical enforcement implications.

• Enforcement will rely on the Act’s existing powers and enforcement framework. The instrument’s legal force derives from being a determination under the Act (s 3). Non‑compliance with duties imposed by the Act, or with obligations associated with first point of entry and biosecurity entry point requirements in the Act, would be addressed under the Act’s enforcement provisions, rather than by any provision in this instrument itself. The instrument therefore channels enforcement to the Act, but it does not restate the Act’s sanctions or mitigation procedures.
• Discretion and uncertainty. The timing standards used in the instrument,"as soon as practicable" and "reasonable notice" (s 9(2), (3) and (4)),are flexible standards. Flexible standards enable the Department to interpret timeliness against operational circumstances, but they also introduce uncertainty for regulated parties about how promptly they must act to avoid enforcement risk.
• Administrative follow‑up. The Department is the recipient of notices. The instrument does not oblige the Department to acknowledge, approve, or contest the notified changes. The instrument therefore creates an informational channel without detailing the Department’s obligations on receipt; the Department’s response will depend on administrative policy and any applicable provisions in the Act.

In summary, the instrument itself imposes procedural duties, it establishes the place where biosecurity control must occur for the designated classes, and enforcement of those duties and obligations relies on the Act rather than on sanctions contained in the instrument. Regulated parties should therefore treat the instrument as a jurisdictional and procedural requirement whose non‑observance may engage the Act’s enforcement machinery.

The instrument is an exercise of power under the Biosecurity Act 2015; its content and effect must be read in conjunction with that Act. The instrument repeatedly references the Act for definitions, duties and cross‑cutting obligations. The principal interactions the instrument states or implies are set out below.

• Delegation under the Act. The instrument is made under subsection 223(1) of the Biosecurity Act 2015 (s 3). That situates the instrument as a statutory instrument operating within the Act’s suite of determinations. Any legal effect of the instrument is therefore derivative of the powers and limits in the Act.
• Definition incorporation. The instrument imports definitions from the Act. It defines "Act" as the Biosecurity Act 2015 and adopts the Act’s definitions for key terms: "aircraft" by reference to s 9 of the Act and "goods" by reference to s 19 of the Act (s 4). Those incorporated definitions will determine the scope of the instrument; for example, whether a particular aircraft or category of goods is "subject to biosecurity control" is a question answered by reference to the Act.
• Operational duties under the Act. The instrument designates the biosecurity entry point while the Act sets out duties to present arriving aircraft and unloaded goods to a biosecurity entry point "as soon as practicable" (notes to ss 7 and 8 refer to ss 238 and 147 of the Act). The instrument therefore operates as a localisation mechanism, specifying where the Act’s obligations will be met at Alice Springs Airport.
• Interface with statutory determinations for prohibited or conditionally non‑prohibited goods. The note to s 6 expressly references ss 173 and 174 of the Act, which deal with prohibited goods and conditionally non‑prohibited goods. The instrument therefore sits alongside other Act determinations or regulations that define what goods may lawfully be brought into a first point of entry. Whether specific goods may be brought into Alice Springs as a first point of entry depends not only on this determination but also on any relevant prohibitions or conditions established under ss 173 and 174 of the Act.
• Administrative law and notice duties. The instrument creates notification duties to the Agriculture Department. Those duties will intersect with administrative law principles and the Department’s policies on information handling, confidentiality, and timing. The instrument does not spell out data handling, confidentiality, or public disclosure obligations, so those matters are governed by other statutory and administrative norms.
• Contractual and commercial law effects. The requirement to provide notice of changes to the business entity operating the airport or entry point will interact with commercial transactions. Vendors, purchasers, lessees and contractors ought to consider the instrument’s notification duties when structuring transaction documents, particularly completion mechanics, assignment clauses, and ongoing obligations. The instrument does not modify property law or titles; it creates an independent statutory duty in addition to any contractual notice requirements.
• Absence of express interactions with airport security, planning, or aviation law. The instrument designates a physical area within the airport but does not expressly address aviation safety, security, or planning laws. Interactions with airport lease conditions, aerodrome operating certificates, or aviation regulatory requirements are not described in the instrument; those matters will need to be resolved through operational coordination and existing regulatory frameworks outside the text of this determination.

In short, the instrument localises the application of provisions of the Biosecurity Act 2015 at Alice Springs Airport by designating a first point of entry and a specific biosecurity entry point, and by creating notification duties linked to operational changes. It relies on and must be read alongside the Biosecurity Act for the substantive content of definitions, the practical obligations to report and present aircraft and goods, and any enforcement consequences.

The instrument’s text contains a commencement table and a note on the table’s scope, but it records no subsequent amendments within the material supplied. The explicit material on commencement is as follows.

• The whole of the instrument commenced on 16 June 2021 (s 2 and the commencement table). The table includes a notation that it relates only to provisions "as originally made" and will not be amended to reflect later amendments (s 2, commencement note).
• The instrument contains a statement that any information present in column 3 of the commencement table is not part of the instrument and may be edited in published versions (s 2(2)). That is a drafting and publication note about non‑operative explanatory material included in the instrument text.

No further amendment clauses appear in the text provided. The instrument does not specify a sunset date or automatic expiry. It does not contain any express amendment history entries or schedules of modification. The instrument’s limited formal content suggests that any amendment would be made by the appropriate delegate under the Biosecurity Act 2015, using the same statutory power cited in s 3, rather than by operation of a provision within the instrument itself.

Practical implications of the amendment silence in the instrument.

• The absence of an expiry or review clause means the instrument remains in force until formally revoked or varied under the Act’s processes. Any change to the designation, to the designated biosecurity entry point area, or to the conditions would require a new or amending determination made under the Act.
• The instrument’s note that the commencement table is not amended in later published versions is an editorial point. It means published forms of the instrument may carry non‑operative explanatory text that can be updated without changing the legally operative instrument.
• Because the instrument does not itself set out transitional arrangements for activities in progress at commencement, parties should assume the designation and notification obligations took effect on the commencement date stated, and they should review records for any compliance steps taken from that date.

The instrument’s own text does not purport to list any prior versions or to summarise amendment history. The reader should therefore treat the instrument as a single, original determination with the content and commencement date expressly stated.

The text of the determination contains no references to litigation. There is no litigation history recorded in the instrument, no mention of judicial decisions, and no annexed or incorporated case law. The instrument does reference provisions of the Biosecurity Act 2015 that themselves may have generated litigation in other contexts, but the instrument does not name any cases and does not provide a history of judicial interpretation.

Consequently, within the four corners of the instrument:

• There are no recorded proceedings challenging the designation, the biosecurity entry point, or the notification conditions.
• There are no recorded administrative reviews or tribunal matters cited.
• The instrument does not provide examples of past enforcement actions, disputes or adjudications.

If a practitioner requires judicial interpretation of any of the Act’s provisions that the instrument cross‑refers to (for example, the meaning of "subject to biosecurity control" in s 9 of the Act, "exposed goods order" under s 19, or the scope of the Act’s enforcement powers under ss 147 or 238), that material is not contained in the determination. The instrument itself provides no litigation guidance or precedent.

Absent recorded litigation in the instrument, parties should consider the following practical steps when assessing legal risk.

• Treat the instrument as a statutory administrative determination whose validity and application could, in principle, be subject to judicial review or legal challenge, but which currently has no reported litigation recorded in the instrument itself.
• Where ambiguity exists (for example about what circumstances qualify as a change to the business entity operating the airport, or what constitutes "reasonable notice"), expect that such questions would be resolved by administrative decision and, if necessary, judicial review of any enforcement action under the Act.
• Recognise that any legal precedents relevant to the definitions and obligations the instrument imports will need to be sourced directly from the Biosecurity Act 2015 jurisprudence, not from this instrument.

The instrument is brief and narrowly targeted, but several practical pitfalls emerge from the text that could produce compliance failure or operational friction if missed.

• Narrow goods scope. The instrument designates Alice Springs Airport as a first point of entry for crew baggage only (s 6). Note 1 to s 6 emphasises that the airport is not a first point of entry for any other goods. Parties that handle cargo, freight, import consignments, or passenger baggage other than crew baggage must not assume that this determination permits them to use Alice Springs Airport as a first point of entry for those goods. Misreading this point could result in attempted importation at a location not designated by the Act and the instrument, potentially triggering enforcement action under provisions of the Act not restated here.
• Single designated area. The instrument designates Asia Pacific Aircraft Storage as the sole biosecurity entry point for all aircraft and for crew baggage at Alice Springs Airport (ss 7-8). Arriving aircraft or crew baggage presented elsewhere at the airport may not meet the statutory requirement to be brought to a biosecurity entry point "as soon as practicable" (note to ss 7 and 8, citing ss 238 and 147 of the Act). Operational plans that rely on using alternative parking bays or storage areas need to be amended or risk non‑compliance.
• Scope determined by Act definitions. The instrument’s reach depends on whether an aircraft or goods are "subject to biosecurity control" or under an "exposed goods order" as those terms are defined by the Act (s 4). Parties must check the Act’s definitions and any relevant orders before assuming they are subject to the instrument. Failing to check the Act’s definitions may lead to misclassification of obligations.
• Ambiguity in notification triggers. The owner and lessee duties in s 9(2)-(3) require notice where they "become aware that there has been, or will be, a change to the business entity operating" the airport or a biosecurity entry point. That raises questions about what constitutes a change to the "business entity operating" the airport. Is the sale of shares in a holding company a change? What about a management services contract that transfers operational control? The instrument does not provide examples. Parties engaged in corporate transactions or reorganisation must therefore assume a low threshold for noticeable change and implement internal triggers to capture any transaction that might be characterised as a change in the business entity operating the airport or a biosecurity entry point.
• Multiple owners or lessees. The duties in s 9(2)-(3) are drafted so that if there is more than one owner or lessee any one owner or lessee must give notice. That single actor’s failure to notify could leave other owners or lessees exposed. Stakeholders should establish contractual arrangements or operational protocols to allocate responsibility for compliance and ensure the giving of notice is not missed.
• Undefined timing standards. The instrument uses "as soon as practicable" for notice after awareness (s 9(2)-(3)) and "reasonable notice" for proposed changes (s 9(4)). These are flexible standards that will be judged against operational context. Practitioners should not rely on the phrase "as soon as practicable" to permit lengthy delays; instead, they should document timely action and the dates of awareness; similarly "reasonable notice" should be interpreted conservatively in contexts that materially affect biosecurity risk.
• Breadth of proposed‑change catchment. Section 9(5) lists a broad set of possible changes that oblige a person or body responsible for operations to give reasonable notice: changes to biosecurity procedures, changes to facilities or amenities used by biosecurity officials, changes affecting the ability to identify or report biosecurity risks, and changes to other procedures affecting biosecurity risk. That list is wide and could capture routine operational adjustments, construction works, reallocation of staff, contract changes affecting reporting lines, or procurement of new equipment. Parties should therefore assume notification is required for material operational changes that touch on biosecurity functions.
• No Departmental response specified. The instrument does not require the Agriculture Department to approve, acknowledge, or provide guidance in response to notices. Regulated parties should not assume that giving notice substitutes for formal approval; they should follow up with the Department where necessary to confirm compliance expectations.
• Interplay with commercial contracts. Commercial parties may not have allowed for the requirement to give notice to the Department when drafting assignment, sale, or service agreements. Transactions should be reviewed to ensure these statutory notice duties can be and are observed in practice.
• No express infrastructure obligations. The instrument identifies Asia Pacific Aircraft Storage as the biosecurity entry point but does not obligate the airport owner, lessee or operator to provide any particular infrastructure or staffing levels. If the area lacks facilities necessary for biosecurity officials to perform functions, this could create operational difficulty. Note that s 9(5)(b) requires notice where there is a change to facilities or amenities available for officials, but the instrument does not set minimum standards.

These "gotchas" are not legal determinations; they are practical risk points grounded in the instrument’s text. Parties should document awareness triggers, set internal notice procedures, align ground handling and parking plans with the single designated entry point, and ensure commercial agreements and transaction documents require compliance with the statutory notification duties.

The instrument imposes a concise set of duties and designations. Compliance requires practical steps to meet those duties and to align operations with the location and procedural constraints the instrument sets. Below are concrete compliance steps tied to the specific provisions.

1. Confirm applicability and scope

• Determine whether your aircraft or goods fall within the instrument’s scope. The determination applies to aircraft "subject to biosecurity control" and goods defined in s 4 as goods that are subject to biosecurity control or in relation to which an exposed goods order is in force. Consult the Biosecurity Act 2015 definitions (s 9 for aircraft and s 19 for goods) to confirm whether obligations attach.
• For goods, note that the instrument only designates crew baggage at Alice Springs Airport (s 6). Freight or other categories of goods are not covered by this determination at Alice Springs.

2. Operationalise the physical designation

• Allocate Asia Pacific Aircraft Storage as the sole biosecurity entry point for arriving aircraft and crew baggage at Alice Springs Airport (ss 7-8). Update ground operations plans, aircraft parking schedules, and baggage routing to ensure arriving aircraft and crew baggage are routed to that site.
• Ensure on‑field signage, marshalling, and air traffic ground instructions are consistent with the obligation to bring aircraft to the biosecurity entry point as soon as practicable; coordinate with aerodrome operations and ground handling teams.

3. Notify the Agriculture Department on ownership or lessee changes

• Implement internal procedures to capture transactions or reorganisations that result in a change to the business entity operating Alice Springs Airport or a biosecurity entry point. Treat a broad range of corporate changes as potentially reportable.
• If the owner or any one of multiple owners becomes aware of an actual or imminent change, give written notice to the Agriculture Department as soon as practicable (s 9(2)). Likewise, if a lessee becomes aware of such a change, give the same written notice (s 9(3)). Keep records of when awareness arose and the date the notice was sent.

4. Give reasonable notice for proposed operational changes

• If you are a person or body responsible for carrying out operations at the airport, establish processes to identify proposed changes that could affect biosecurity measures, facilities used by biosecurity officials, ability to identify biosecurity risks, or information flows to officials (s 9(5)(a)-(e)).
• For any such proposed change, provide the Agriculture Department with reasonable written notice before implementing the change (s 9(4)). Document the content of the notice and the dates of delivery, and retain proof of delivery.

5. Coordinate with ground handlers, airlines and baggage services

• Amend service level agreements and ground handling contracts to require that arriving aircraft that are subject to biosecurity control be brought to the designated biosecurity entry point, and that crew baggage be routed to Asia Pacific Aircraft Storage for unloading and inspection (ss 5-8).
• Train ground handling and baggage staff on the requirement to present crew baggage to the designated area and on the need to escalate any operational factors that may introduce biosecurity risk.

6. Maintain records and evidence

• Keep written records of all notices sent to the Agriculture Department, including the date of awareness, the text of the notice, method of delivery, and any responses.
• Maintain logs documenting the arrival of aircraft and movement to Asia Pacific Aircraft Storage, and records of crew baggage handling to demonstrate that goods were brought to the designated site as soon as practicable where relevant.

7. Transaction and contract drafting

• For sale, purchase, lease or management agreements affecting the airport or biosecurity entry point, include contractual covenants that require parties to comply with the instrument’s notification duties, and to cooperate in providing the Agriculture Department the information it needs.
• Consider closing mechanics that allocate responsibility for giving the statutory notice on a change in the business entity operating the airport, to avoid gaps where multiple owners or lessees exist.

8. Liaise with the Agriculture Department

• The instrument requires notices to be provided to the Agriculture Department but does not specify form, address or content. Contact the Department to obtain any published guidance on the Department’s expectations for notices, the preferred form of delivery, and the Department’s processes on receipt.
• If there is any doubt whether a proposed change is reportable, provide notice and request confirmation. A conservative approach to notice will reduce the risk of non‑compliance with the instrument’s timing standards.

9. Plan for contingency and infrastructure

• If Asia Pacific Aircraft Storage lacks facilities required by biosecurity officials for inspections or processing, prepare contingency plans and coordinate with the Department about what facility changes may be necessary. Notify the Department of any proposed facility changes affecting officials’ ability to perform functions (s 9(5)(b)).
• Where operational changes remove or reassign amenities relied on by biosecurity officers, provide reasonable notice and discuss mitigations with the Department.

10. Review and update governance

• Assign internal compliance ownership for the instrument’s obligations, including a named contact for notices to the Agriculture Department and a process owner for routine operational compliance.
• Embed the instrument’s requirements within the airport’s biosecurity management systems and operational risk registers.

These compliance steps follow directly from the instrument’s provisions. The key practical controls are timely written notice to the Agriculture Department, routing of aircraft and crew baggage to Asia Pacific Aircraft Storage, documented internal procedures to capture reportable corporate or operational changes, and contractual arrangements that ensure third parties cooperate in meeting those obligations.
