Western Australia regulation
**What this instrument does (mechanics)
Sets mandatory registration and identification systems for people who own, buy, keep or operate properties with stock (animals) and for beekeepers (regs 7, 10, 13, 16). Owners, non‑farming property operators and beekeepers must be registered and issued property identification codes (PICs), buyer identification codes (BICs) and/or registered identifiers (regs 7–16, 20).
Establishes three main identifier systems:
Requires owners, carriers, purchasers and operators at points in the supply chain (holding yards, saleyards, abattoirs, pounds, export depots, saleyards) to meet species‑specific identification and data‑update obligations (Parts 5–7, Part 6A for sheep/goats, and Parts for pigs, cattle, etc.). Many database updates must be made within 48 hours of a movement or event (for example regs 84, 91, 94, 100–102, 112, 115, 130, 156, 163, 164).
Creates movement documentation rules (waybills, transport documents), movement permits and identification exemption certificates (Part 8, regs 189–201, 196, 70). Waybills must record identifiers/PICs and other transport details (reg 190, 194).

Regulates manufacture and supply of identifiers and identification equipment, including approvals for devices, equipment and manufacturers; record‑keeping requirements for manufacturers and sellers; and controls on supply of NLIS devices/tags (Part 3 Div 4, regs 59–67).
Gives the Director General and inspectors administrative powers to allot/cancel identifiers and PICs, approve devices and manufacturers, grant and cancel permits, give directions, inspect and require records. It also provides penalties for non‑compliance (fines at various levels, e.g. from $2,000 up to $20,000 depending on the contravention) (see regs 8, 11, 35, 38, 59–61, 196, 212 and offences throughout).
**Who this affects (actors and immediate effects)
**Why it matters (purpose claims and how the law achieves them)
The regulations aim to enable traceability and control of animal movements and apiaries, primarily to manage disease risk, support biosecurity responses and record ownership/identity (express purpose reflected throughout Parts 3, 4, Part 8 and the NLIS provisions, and explicit disease‑control powers at regs 69–70).
How: by creating unique identifiers tied to PICs and a central NLIS database (reg 58) and by requiring documentary transport records (waybills) so animals can be linked to properties and movements (regs 189–201). Inspectors have powers to require compliance, to impose conditions and to cancel permits where disease risk exists (regs 38, 69, 70, 196).
**Costs, incentives and trade‑offs (practical testing of the purpose claims)
Direct compliance costs: registration fees, buying/using approved NLIS devices or tags, applying brands/earmarks, maintaining records (many obligations require records to be kept for 7 years — regs 38(8), 62(5), 65(2), 210(2), 190(5)). Manufacturers must keep sale/confirmation records for 7 years (regs 62(5), 65(2), 67(5)).
Ongoing administrative burden: frequent NLIS database updates (often within 48 hours) by owners, saleyard/abattoir/export depot operators and carriers (numerous regs across Parts 5–7, 6A). Non‑compliance attracts fines (sizes vary by offence).
Transaction friction at points in the supply chain: saleyards, holding yards and abattoirs must hold consignments if identification thresholds are breached (e.g. >10% non‑identified) and inform inspectors (see regs 97(3), 104(3), 109(5), 115(3), 142(4), 148(4), 153(5), 160(4)). That creates a practical enforcement mechanism (reduces mixing of identified and non‑identified stock) but imposes delay and potential cost to sellers and buyers.
Market effects and private choice: vendors, purchasers and carriers must provide PICs/BICs and waybills before or at movement (regs 89–92, 190–192). This limits anonymous transfers and makes provenance part of routine contracting for livestock; it raises the cost of informal or ad‑hoc transfers.
Concentrated benefits and costs: Approved manufacturers and ISC Ltd accreditation processes (definitions and accreditation references in regs 3, 64–67) concentrate advantages on approved/accredited device makers; regulators and database administrators obtain monitoring benefits; costs are borne diffusely across many owners/operators as device, recordkeeping and compliance costs.
Discretion and regulatory risk: the Director General and inspectors have broad powers to approve, cancel and condition identifiers, PIC allotments, device approvals, movement permits and exemptions (eg regs 8, 11, 35, 38, 43, 59–61, 69–70, 196). This allows disease‑focused flexibility but creates implementation uncertainty for businesses about when and how discretionary powers will be exercised.
Implementation dependencies: the system depends on a functioning NLIS database maintained by an approved person, reliable device accreditation and manufacturing controls, timely data entry and accurate PIC mapping (reg 58, regs 59–67). Data errors, database downtime or supply bottlenecks for approved devices could reduce the system’s effectiveness.
Property and financing rules: mortgagees can be recorded against identifiers and, while the notice of mortgage is in effect, the mortgagee has rights to use and transfer identifiers (reg 28). That ties identifiers to property security arrangements and affects sale/transfer mechanics.
**Key operational points to watch (implementation and compliance risk)
Where to look in the regulations for the specific rules cited above
The regulations therefore create a comprehensive, species‑tailored traceability regime based on registered identifiers, approved identifiers and an electronic NLIS database, enforced by documentary requirements and inspector powers. The regime shifts costs to animal owners, property operators, device manufacturers and database operators while granting the department discretion to manage disease‑related risks through identification, movement controls and data monitoring (see regs cited above).
