36 Offences—engage in prohibited dealing (1) A person must not engage in a prohibited dealing. negligently engages in a prohibited dealing. if the defendant proves that they had a reasonable excuse for engaging in the prohibited dealing. Note 1 The defendant has a legal burden in relation to the matters mentioned in s (4) (see Criminal Code, s 59). Note 2 A biosecurity permit may authorise the permit-holder to engage in a prohibited dealing (see s 62).
