37  Officer to contact parent, guardian or next of kin of unaccompanied child or incapable person  (1) A child or incapable person who is not accompanied by an accompanying person must not be subject to a requirement under this Chapter unless a biosecurity officer, human biosecurity officer or chief human biosecurity officer has taken reasonable steps to contact a parent, guardian or next of kin of the child or incapable person. Note: This subsection is subject to subsection (2) and section 41 (exception for requirement to remain at a place).  (2) If the child or incapable person has urgent or life‑threatening medical needs, the officer must meet those needs first. However, the officer must take reasonable steps to contact the parent, guardian or next of kin of the child or incapable person as soon as possible after those needs have been met. Requirements when contacting parent, guardian or next of kin  (3) On contacting the parent, guardian or next of kin, the officer must:  (a) explain the effects of sections 36 and 39; and  (b) allow an accompanying person to accompany the child or incapable person.  (4) If a parent, guardian or next of kin indicates that he or she wishes the child or incapable person to be accompanied, the child or incapable person must not be subject to a requirement under this Chapter until an accompanying person for the child or incapable person accompanies the child or incapable person.
