39 Compliance with approved measures under TSC Act biodiversity certification
> > (1) An order that was made under section 126ZD (1) or (2) of the [Threatened Species Conservation Act 1995](/view/html/repealed/current/act-1995-101) before the repeal of that Act and that has not been complied with on that repeal is taken to be an order under section 8.13 (1) or (2), respectively, of the new Act.

> > (2) An order may be made under section 8.13 of the new Act in relation to a failure to comply with the approved measures under a biodiversity certification under Part 7AA of the [Threatened Species Conservation Act 1995](/view/html/repealed/current/act-1995-101) that occurred before the repeal of that Act in addition to any such failure that occurs after that repeal.
