#### 32 Data collected for BAM assessments before the commencement of the new Act 32 Data collected for BAM assessments before the commencement of the new Act > > (1) For the purposes of Part 7 of the new Act, the use of data collected before the commencement of the new Act is taken to be collected in accordance with the Biodiversity Assessment Method if— > > > > > (a) the data was collected in a manner that is substantially consistent with the Biodiversity Assessment Method, and > > > > > (b) the data was collected by an accredited person. > > > (2) An accredited person is— > > > > > (a) a person who was accredited under section 142B of the [Threatened Species Conservation Act 1995](/view/html/repealed/current/act-1995-101) when the data concerned was collected, or > > > > > (b) a person who is accredited under section 6.10 of the new Act.
