Bidyadanga Community By-laws 2004

The text organises regulatory power around a small set of concepts: community lands, membership, Council authority, permission and conditions, out‑of‑bounds designations, traffic control, substance prohibitions, firearms reporting, police enforcement and penalties.

• Community lands and application: The by-laws apply to the Bidyadanga Aboriginal community lands as declared under the Aboriginal Communities Act 1979. The by-laws apply to anyone on those lands, whether or not they are association members (by-law 1(4)-(6)). The association’s constitution defines who is a community member (by-law 1(7)).
• Council authority and decision‑making: The Council is the primary decision maker under the by-laws. When making decisions it must consider the welfare of the community as the most important factor, and it is not required to give reasons for its decisions (by-law 2(1)-(2)). The Council can delegate decision‑making about permissions in writing to a Council member or another person, and such delegations must be in writing (by-law 3(1)). Where the Council has power to grant permission, it may do so subject to conditions, and it may change or revoke those conditions or the permission itself (by-law 3(3)-(4)).
• Permission and conditions: Permission is the central access mechanism for non‑members and for certain activities. The process and content of permissions are governed by by-law 3 and by-law 4, which require non‑members seeking permission to approach the Council, permit limited prior entry to go directly to the Council office to seek permission, and impose an obligation to report arrival and comply with any conditions attached to permission (by-law 4(2)-(5)). Failure to comply with conditions authorises the Council to require immediate departure (by-law 4(6)).
• Notice and signage: The by-laws recognise multiple notice channels. The Council need not give written reasons, but may notify decisions orally, in writing or by public notice on the lands (by-law 2(3)). The Council may also erect signs to indicate out‑of‑bounds locations and traffic rules (by-laws 5(4), 6(4)).
• Security and public order: Nuisance, indecent or disorderly behaviour, interference with Council or customary meetings, obstruction of duties, and damage to property are all prohibited (by-laws 7, 10, 12). Police powers under the by-laws include the ability to require name and address, arrest and remove persons from the lands, and remove property, including vehicles and animals (by-law 13).
• Substances and medicines: The by-laws define “harmful substance” and “illegal drug” by reference to their likely effects and Western Australian law, and broadly prohibit bringing, giving, having, keeping or using alcohol and illegal drugs on community lands. They preserve lawful use of prescribed medication and medical drugs as an exception (by-law 9(1)-(4)).
• Firearms regime: Firearms are defined by reference to the Firearms Act 1973. Individuals must notify the Council of guns they own and of guns they bring onto the lands even if they are not the owner. The Council must maintain a list of community members who have a gun and persons must store guns safely and out of children’s reach (by-law 11(1)-(5)).
• Enforcement and sanctions: Contraventions are criminal offences under by-law 14, with police empowered to charge and courts authorised to impose a fine not exceeding $5,000 and to order compensation up to $250 for property damage (by-law 14(1)-(4)). These concepts interlock to create a Council‑centred regulatory system backed by police enforcement and criminal penalties.

The by-laws therefore combine delegated self‑government style controls operated by the Council with statutory policing and court‑based sanctions, using written delegations and signage as key implementation instruments (by-laws 3(1), 2(3), 5(4), 6(4)).

The by-laws explicitly identify groups and activities to which their controls apply and create obligations that fall on different actors.

• Community members: Persons who are members of the incorporated association under its constitution are entitled to be on the community lands at any time, except where a member of the Police Force removes them under by-law 13(3) (by-law 4(1)). Members are nonetheless subject to the substance, property, nuisance, firearms and other prohibitions in the by-laws, and may be subject to council conditions, charges and fines if they contravene the rules (by-laws 7-11, 14). The Council must keep a list of community members who have a gun (by-law 11(4)).
• Non‑members and visitors: Non‑members may only be on the lands if they have obtained permission from the Council (by-law 4(2)). They are permitted to enter the lands to go straight to the Council office to seek that permission (by-law 4(3)). If permission is granted beforehand, the visitor must notify a Council member of arrival (by-law 4(4)). Any person on the lands who was granted permission must comply with conditions attached to that permission and must leave immediately if ordered to do so by the Council for non‑compliance (by-law 4(5)-(6), by-law 3(3)). This makes the Council the gatekeeper for non‑member access and activity.
• The Council and authorised delegates: The Council has primary regulatory control and decision‑making authority under these by-laws. It must consider community welfare as the predominant factor when making decisions (by-law 2(1)), and it may delegate permission decision powers in writing to members or other persons (by-law 3(1)). The Council is responsible for keeping a firearms list and for placing signage to communicate rules (by-laws 11(4), 5(4), 2(3), 6(4)).
• Police: Members of the Police Force have statutory powers under these by-laws to request name and address from persons suspected of breaching a by-law, to arrest and remove persons from the community lands where they believe a by-law has been or is being breached, and to remove items from the lands including vehicles and animals (by-law 13(1)-(4)). Police therefore carry operational enforcement responsibility.
• Drivers and vehicle operators: Drivers on the community lands must not be under the influence of alcohol or drugs, must drive carefully, must hold a valid Australian driver’s licence, and must obey Council‑posted driving signs (by-law 6(1)-(5)). These rules apply to all drivers regardless of membership.
• Gun owners and anyone bringing guns onto the lands: The by-laws require disclosure to the Council of every gun owned and every gun brought onto the lands even if not owned by the person bringing it (by-law 11(2)-(3)). They require safe storage and create an administrative obligation on the Council to maintain a register of community members who have guns (by-law 11(4)-(5)).
• Persons involved in meetings and customary gatherings: The by-laws prohibit interruption of Council, community or customary meetings by noisy or disorderly behaviour (by-law 10(3)). This affects anyone attending or nearby during such gatherings.

Other practical effects: people on the lands will encounter obligations to obey signage and to comply with Council conditions where permissions have been granted (by-laws 2(3), 3(3), 5(4), 6(4)). The by-laws also affect persons who might otherwise lawfully possess alcohol or illegal drugs under Western Australian law by creating a jurisdictional prohibition within community lands, subject to prescribed medication exceptions (by-law 9(2)-(4)). Overall, the regime imposes obligations on all visitors and residents on the lands, centralises entry and activity permissions through the Council for non‑members, and places operational enforcement duties on the Police Force.

The by-laws set out discrete duties for persons on the community lands, obligate the Council to certain administrative tasks, and confer procedural privileges to various actors. Below is a structured breakdown of the principal duties and rights grounded in specific by‑laws.

Duties imposed on persons on the lands

• Obey the by-laws and any conditions attached to permission given by the Council; contravention is an offence (by-law 14(1)).
• Non‑members must obtain Council permission before being on the lands except to go straight to the Council office to request permission, must report arrival if permission was obtained beforehand, and must comply with any conditions attached to the permission (by-law 4(2)-(6)).
• Do not enter places declared out of bounds to you, and obey signage establishing such restrictions (by-law 5(1)-(4)).
• When driving, do not drive under the influence of alcohol or drugs, drive carefully to avoid danger, hold a valid Australian driver’s licence and obey traffic signage posted by the Council (by-law 6(1)-(5)).
• Do not intentionally damage property, including graffiti, and do not damage plants or trees planted by others or the Council (by-law 7(1)-(3)).
• Do not enter another person’s house without permission and leave if asked (by-law 8(1)-(2)).
• Do not bring, give, possess, keep or consume alcohol on community lands; do not bring, give, possess or use illegal drugs or harmful substances; exceptions are made for properly used prescription medicines (by-law 9(2)-(4)).
• Disclose to the Council every gun you own and every gun you bring onto the lands, keep guns in a safe place where children cannot touch them (by-law 11(2)-(5)).
• Do not obstruct a person carrying out duties under the by-laws or lawful activities (by-law 12).
• If a police officer asks for your name and address under the by-laws, you must provide it (by-law 13(1)-(2)).

Obligations and duties on the Council

• Consider community welfare as the most important consideration when making decisions under the by-laws (by-law 2(1)).
• The Council must make written delegations where it delegates permission decision powers (by-law 3(1)).
• The Council must keep a list of community members who have a gun (by-law 11(4)).
• The Council may place signs and notices to communicate rules and out‑of‑bounds designations (by-laws 2(3), 5(4), 6(4)).
• The Council may impose conditions when granting permission and may change or revoke conditions and permissions (by-law 3(3)-(4)).

Rights and powers created or preserved

• Community members have the right to be on the community lands at any time, subject to police removal (by-law 4(1), 13(3)).
• The Council has the power to grant, refuse, vary or withdraw permission for activities and access on the lands, and to delegate that authority in writing (by-law 3(1)-(4)).
• Police have powers to request name and address, to arrest and remove persons from the lands for by‑law breaches, and to remove items from the lands (by-law 13(1)-(4)).
• Courts have the power to impose fines up to $5,000 and to order compensation up to $250 for property damage arising from a by‑law offence (by-law 14(3)-(4)).
• Persons retain rights under Western Australian law because the by-laws operate in addition to state laws (by-law 1(8)). The by-laws also treat prescribed medicine and doctor/nurse prescriptions as lawful exceptions to the substance prohibitions (by-law 9(4)).

Procedural features that affect rights and duties

• The Council is not required to give reasons for decisions (by-law 2(2)), which affects transparency of administrative decision‑making.
• Notice of Council decisions can be given orally, in writing or by public notice on the lands (by-law 2(3)); signage is an effective mechanism for communicating out‑of‑bounds and driving rules (by‑laws 5(4), 6(4)).
• Delegations of authority must be in writing to be valid, creating a documentation obligation for the Council to ensure delegated decisions are authorised (by-law 3(1)).
• Immediate departure orders from the Council apply where persons have failed to comply with permission conditions (by-law 4(6)), creating a non‑compliance risk for visitors.

Together, these duties and rights allocate daily compliance obligations to individual persons and clear administrative and record‑keeping obligations to the Council, supported by police enforcement and court sanctions.

The by-laws establish a criminal enforcement route, administrative measures available to the Council, and statutory police powers. Enforcement operates through three overlapping mechanisms: Council administrative action, police operational powers, and court sanctions.

Council administrative measures

• The Council may revoke permissions, impose conditions on permissions, change conditions, and order persons to leave the community lands for failure to comply with conditions (by-law 3(3)-(4), 4(6)). The practical effect is that the Council can remove rights to be on the lands without court process where permission conditions are breached.
• The Council may designate places and vehicles out of bounds and erect signs to implement those designations (by-laws 5(1)-(4), 2(3)), and can set driving rules via signage (by-law 6(4)). These measures rely on the Council exercising its authority and on physical notice.

Police operational powers

• If a member of the Police Force believes a person is or has been breaking a by‑law, the officer can request the person’s name and address; the person must comply with that request (by-law 13(1)-(2)).
• Where a police officer believes a person is breaking or has broken a by‑law, the officer can arrest the person and remove them from the community lands (by-law 13(3)). This gives police on‑site authority to effect immediate removal by arrest where deemed necessary.
• Police can remove anything from the community lands, including but not limited to vehicles and animals (by-law 13(4)). This authorises physical seizure and removal by police action.

Court sanctions

• A person commits an offence under the by‑laws if they contravene a by‑law or fail to comply with a condition imposed by the Council when granting permission (by-law 14(1)).
• A member of the Police Force can charge a person with an offence against the by‑laws (by-law 14(2)). Prosecutions thus proceed via ordinary criminal charging practice.
• A court may impose a fine not exceeding $5,000 for an offence against these by‑laws (by-law 14(3)). The maximum fine creates a monetary deterrent enforced by a court.
• If the court finds that property was damaged in the commission of the offence, it can order compensation up to $250 to the injured person or to the association (by-law 14(4)). The compensation cap is relatively modest and targeted specifically at property damage.

Practical enforcement dynamics and compliance pressure

• The by-laws combine Council administrative measures that can effect immediate exclusion and condition revocation with police powers of arrest and seizure, and court fines for formal criminal enforcement. This creates a layered enforcement architecture where the Council controls access and conditions, the police exercise arrest and seizure powers, and courts impose financial penalties.
• The requirement that delegations be in writing (by-law 3(1)) and the Council’s entitlement to provide notice orally or by signs (by-law 2(3)) create mixed evidentiary environments for enforcement actions; written delegations and written permissions will be important records where prosecutions or disputes arise.
• The disparity between the maximum court fine ($5,000) and the maximum compensation order for property damage ($250) affects the remedial mix available to a court. The by-laws allow police to remove items including vehicles and animals without a separate by‑law specifying a forfeiture process, which may have operational implications for property handling.
• The Council’s power not to provide reasons for decisions (by-law 2(2)) limits procedural transparency for those affected by exclusion or permission refusals, though by-law 2(3) permits the Council to use public notices or oral/written communication to advise of decisions.

In short, enforcement is a combination of administrative access control by the Council, statutory police powers on site, and court‑based penalties, with duties on persons to comply with police requests and Council orders. The by-laws place practical burdens on record keeping and signage to support enforcement and create an immediate compliance environment that can be backed by criminal sanction.

The by-laws are explicitly framed to operate alongside the laws of Western Australia rather than to displace them. The text contains express cross‑references and preserves certain state law definitions and exceptions.

Foundational interaction

• The by-laws are made under and operate with reference to the Aboriginal Communities Act 1979. The document states the association is an Aboriginal community to which that Act applies and notes that the Governor has declared the community lands, which identifies the geographic jurisdiction (by-law 1(4), (6)).
• The by-laws operate in addition to the laws of Western Australia, which means they are supplementary rather than substitutive of state law wherever both apply (by-law 1(8)).

Specific statutory cross‑references

• Firearms: The definition of “gun” in by-law 11(1) is expressly tied to the Firearms Act 1973, so the by-law’s firearm obligations sit alongside the state statutory regime governing licences, registration, storage and offences under the Firearms Act. Persons must tell the Council about guns they own or bring onto the lands and must store them safely, but the by-laws do not purport to alter licensing or licensing offences under the Firearms Act (by-law 11(1)-(5)).
• Illegal drugs: The by-laws define “illegal drug” by reference to drugs that it is illegal to possess under the laws of Western Australia, anchoring the substance prohibitions to the existing state controlled substances regime (by-law 9(1), (3)). The by‑laws add a territorial prohibition on possession, supply and use within the community lands subject to the prescribed medicine exception, but they sit alongside state criminal law concerning illegal drugs.
• Medical exceptions: The by-laws preserve lawful use of prescribed medication administered by a doctor or nurse or used as intended, which aligns with therapeutic exceptions within state law and public health regulation (by-law 9(4)).
• Police powers: The by-laws confer on members of the Police Force the authority to require name and address, arrest and remove persons, and remove items from the lands where an officer believes a by‑law is or has been breached (by-law 13). These powers operate in the field and would be exercised consistent with police powers and processes under state criminal procedure and arrest laws.

Operational interdependence

• Where a by-law breach also constitutes an offence under Western Australian law, a person may be subject to parallel or subsequent state criminal processes. The by‑laws create distinct offences triable in court pursuant to the by-laws themselves (by-law 14(3)-(4)), but do not negate state prosecutorial options where applicable.
• Council actions that affect property or persons, such as ordering someone to leave, revoking permission, or requesting disclosure of guns, will intersect with state law protections and police powers when enforcement escalates. For example, an arrest or seizure under by-law 13 will be performed by police under state statutes while the stated trigger is the officer’s belief about a by‑law breach.
• Record‑keeping duties in the by‑laws, notably the Council’s obligation to keep a list of community members with guns (by-law 11(4)), are internal administrative requirements that may also interface with state firearms registries and compliance obligations under the Firearms Act.

Limitations and preserved rights

• The by‑laws contain limited procedural protections; for instance, Council decisions need not be accompanied by reasons (by-law 2(2)). This interacts with state administrative law principles, but the by‑laws themselves do not create an internal appeal mechanism. Any contest of Council action on legal grounds would proceed through the ordinary channels of state law.
• The by‑laws include explicit exceptions for prescribed medicines, which indicates an intent not to criminalise controlled therapeutic use that is lawful under state medical regulation (by-law 9(4)).

In sum, the by‑laws are an additional local regulatory overlay that references and relies on Western Australian statutes for definitions and enforcement mechanisms while leaving state criminal and civil law intact and available alongside the local regulatory sanctions and procedures set out in the by‑laws.

The by‑laws record a limited textual history within the document itself.

• Replacement of prior by‑laws: The Bidyadanga Community By‑laws 2004 explicitly replace the Bidyadanga Aboriginal Community La Grange Incorporated By‑laws made in 1979 and approved in 1980, and those earlier by‑laws are repealed by operation of by-law 1(2). This is the primary amendment event recorded within the text.
• Approval and commencement details: The by‑laws were made by the Council of the association and were approved by the Governor (by-law 1(3)). The compilation table included in the document records the gazettal and commencement date as 12 November 2004 (Compilation table). The by‑laws therefore commenced operation on 12 November 2004.
• No subsequent amendments recorded in the supplied text: The provided compilation table records the citation, gazettal and commencement for the 2004 instrument only. The by‑laws themselves do not contain further amendment provisions, savings, transitional arrangements or later amendment entries in the compilation table supplied. There is no text in the supplied material indicating later variations, revocations or other legislative changes to the 2004 by‑laws.
• Instrument provenance: The by‑laws assert their constitutional relationship to the Aboriginal Communities Act 1979 by identifying the association as an Aboriginal community to which that Act applies, and by noting that the Governor has declared the community lands for the association (by-law 1(4), (6)). The 2004 instrument replaces the 1979 by‑laws with an express repeal of that earlier instrument, and the new instrument’s approval by the Governor is recorded in the by‑laws themselves (by-law 1(2)-(3)).

For practitioners tracking legislative or regulatory changes, the document provides a single clear amendment event, the 2004 replacement of the 1979 instrument, and a single commencement date recorded in the compilation table. There are no internal notes of subsequent amendments in the supplied material.

The by‑laws as supplied do not include or reference any litigation history, reported cases or judicial determinations concerning their validity, interpretation or enforcement.

• No cases or proceedings recorded: The text contains no reference to court decisions, appeals, judicial review proceedings or litigation outcomes. There are no named cases in the by‑laws or in the compilation notes provided. The instrument itself sets out jurisdictional mechanisms for prosecution (by-law 14), but the document does not report any instances in which those mechanisms have been invoked.
• Provisions that create litigation pathways: Although the by‑laws do not record litigation, they create clear legal pathways that could generate litigation. Under by-law 14 a person may be charged by police with an offence against the by‑laws, and a court may impose a fine up to $5,000 and order compensation up to $250 for property damage (by-law 14(2)-(4)). Police powers to arrest and remove persons, and to remove items including vehicles and animals (by-law 13(3)-(4)), could give rise to disputes over the lawfulness of arrest, seizure and removal actions under state law. The by‑laws also create administrative decisions by the Council that are not required to be accompanied by reasons (by-law 2(2)), which could be challenged indirectly in a state court setting on conventional legal grounds, although the by‑laws themselves do not establish an internal appeal mechanism.
• Procedural features relevant to potential litigation: Key textual features that would be relevant in any litigation include the requirement for written delegations of permission decision‑making (by-law 3(1)), the Council’s power to notify decisions orally, in writing or by public notice (by-law 2(3)), and the explicit linkages to state law definitions for firearms and illegal drugs (by‑laws 11(1) and 9(1)). Where disputes arise about delegated authority, the existence or content of permissions, or the application of by‑laws in specific incidents, those textual features will determine the primary documentary and evidentiary record.
• Absence of recorded precedent: Because the supplied material contains no case law citations or litigation history, there is no recorded textual precedent in the instrument itself to guide interpretation beyond the plain language of the by‑laws and the cross‑references to state statutes. Any legal analysis of disputes would therefore proceed from the by‑laws’ text in conjunction with applicable state law and practice.

Practitioners seeking litigation history or precedent beyond this instrument should consult court records and legal databases for proceedings arising from enforcement actions under the Bidyadanga Community By‑laws 2004, as that information is not contained in the supplied text.

Several provisions create practical pitfalls for individuals, the Council and enforcers. These provisions affect evidentiary burdens, immediate compliance risks and administrative obligations.

Delegation and documentary form

• Delegations must be in writing for a person to be authorised to make permission decisions on behalf of the Council (by-law 3(1)). A purported delegation that is not in writing will not satisfy the by‑law’s requirement. Practically, anyone relying on the authority of a delegate should obtain, keep and present written evidence of the delegation. The Council must ensure delegation records are accurate and accessible.
• By contrast, the Council does not have to give reasons for decisions (by-law 2(2)), but it can notify by oral, written or posted notice (by-law 2(3)). The combination of written delegations and variable notice formats can produce evidentiary gaps where the Council acts orally and a person later contests the decision.

Access and permission traps for non‑members

• Non‑members are allowed to enter only to go straight to the Council office to seek permission (by-law 4(3)). Taking other actions before receiving permission, or failing to proceed directly to the office, may strip non‑members of the limited entry privilege and expose them to removal. The by‑law expressly obliges non‑members who obtained prior permission to notify a Council member on arrival (by‑law 4(4)), which is a discrete compliance step. Failure to comply with notification or with conditions can result in immediate removal (by-law 4(5)-(6)). Non‑members should get written permission and keep evidence of it.

Signage and notice

• The Council may communicate decisions and restrictions via signs or public notices (by‑laws 2(3), 5(4), 6(4)). This makes posted signs legally operative methods of notice. Individuals who ignore signage do so at their peril. In enforcement or court proceedings, demonstrating that signage was reasonable and visible will be important.

Substance prohibitions and medical exceptions

• The by‑laws prohibit bringing, giving, possessing, keeping or consuming alcohol and illegal drugs on community lands (by-law 9(2)-(3)). However, the by‑laws preserve the lawful taking of prescribed medication and drugs prescribed by a doctor or nurse (by-law 9(4)). Individuals using lawful prescription medicines should be prepared to explain and, where available, evidence the prescription if questioned, as the general prohibition is broad.

Firearm reporting and storage

• The by‑laws require a person to tell the Council about every gun they own and about every gun they bring onto the lands, even if it is not their gun (by-law 11(2)-(3)). The Council must keep a list of all community members who have a gun (by-law 11(4)). This creates administrative and privacy implications. Visitors bringing firearms that belong to others must still report them. Persons must keep guns in a safe place where children cannot touch them (by-law 11(5)). This interacts with state licensing obligations under the Firearms Act 1973 and will require coordination with state compliance regimes.

Police removal and seizure

• Police have the power to arrest and remove persons they believe to be breaching the by‑laws and to remove property including vehicles and animals (by-law 13(3)-(4)). Such powers are exercised on the basis of an officer’s belief and can be operationally immediate. Individuals and property owners may face swift on‑site intervention. Practically, parties should preserve documentary proof of permissions and the lawful status of any property or activity to contest seizure or removal where necessary.

Sanctions asymmetry

• The court‑imposed fine for an offence under the by‑laws may be up to $5,000 (by-law 14(3)), but compensation for property damage is capped at $250 (by-law 14(4)). This asymmetry affects expected remedies. Those pursuing property recovery may find the compensation cap small relative to actual damage amounts.

Lack of internal appeal procedure and non‑reasoned decisions

• The by‑laws do not provide an internal appeal or review mechanism for Council decisions, and the Council need not provide reasons for decisions (by-law 2(2)). This has practical consequences: affected persons rely on state legal processes if they wish to challenge a decision, and immediate Council exclusions may be hard to pre‑emptively contest.

Driver’s licence requirement

• Drivers must hold a valid Australian driver’s licence to drive on the community lands (by-law 6(3)). Overseas licences, learner permits or informal permissions may be insufficient. Visitors and contractors should ensure compliance to avoid enforcement.

Immediate compliance obligations

• Where the Council orders someone to leave for non‑compliance with a condition, the person must leave immediately (by-law 4(6)). This immediate obligation leaves little room for negotiation at the point of enforcement.

Collectively, these provisions create a compliance environment that is administratively intensive for the Council and legally consequential for individuals. Accurate written permissions, evidence of delegation, clear signage and careful handling of firearms and medicines are practical measures to avoid entrapment by these “gotchas”.

This section sets out practical, source‑grounded steps for different actors to reduce enforcement risk and to operate within the by‑laws’ requirements. Citations refer to the by‑laws.

For non‑members and visitors

• Obtain permission from the Council before being on the community lands, except for the limited purpose of entering to go straight to the Council office to request permission (by-law 4(2)-(3)). If entering to seek permission, proceed directly to the Council office and avoid other activities until permission is granted.
• Where permission has been granted prior to arrival, notify a Council member of your arrival as soon as you arrive on the lands (by-law 4(4)). Keep a copy (written or electronic) of any permission and of any conditions attached to it, so you can produce evidence if asked.
• Review and comply with any conditions attached to permission. Non‑compliance authorises immediate removal from the lands (by-law 4(5)-(6)). If conditions are unclear, seek written clarification from the Council before undertaking the activity.
• Obey all posted signs, including out‑of‑bounds indicators and traffic signs (by-laws 5(4), 6(4)). Do not enter areas declared out of bounds or drive in prohibited zones or speeds.
• If driving on the lands, ensure you are not under the influence of alcohol, illegal drugs or harmful substances, and hold a valid Australian driver’s licence (by-law 6(1)-(3)). Carry your licence when driving.
• Do not bring alcohol or illegal drugs onto the lands, do not give alcohol or illegal drugs to others, and do not consume them on the lands. If you require prescription medication, carry proof of prescription or a clear label and take it only as directed (by-law 9(2)-(4)).
• Do not damage property or plants, do not enter someone else’s house without permission, and obey requests to leave someone’s house (by-laws 7, 8).
• If you bring a firearm or have one in your possession, notify the Council about every gun you own and every gun you bring onto the lands (by-law 11(2)-(3)). Ensure safe storage where children cannot touch it (by-law 11(5)).
• If a police officer asks for your name and address under the by‑laws, provide it (by-law 13(1)-(2)). If asked to leave, do so promptly.

For the Council and delegates

• Make written delegations for any persons authorised to make permission decisions, and keep copies of those delegations readily available (by-law 3(1)). The delegation must be in writing to satisfy the by‑laws.
• When granting permission, record any conditions in writing and provide copies of the permission and conditions to the person receiving them. Keep a log of permissions granted, conditions imposed, and any changes or revocations (by-law 3(3)-(4)). Written records will support enforcement and reduce disputes.
• Ensure signage is clear and posted in appropriate locations to communicate out‑of‑bounds areas, vehicle restrictions, and traffic rules (by-laws 5(4), 6(4), 2(3)). Ensure signage is maintained and legible.
• Maintain the list of community members who have guns as required by the by‑laws, and keep records of notifications from persons who bring guns onto the lands (by-law 11(4)). Coordinate with state firearms compliance processes where relevant.
• When taking actions that affect access or permissions, note that the Council need not give reasons (by-law 2(2)), but consider issuing written notices for clarity and to reduce dispute risk. Use the by‑laws’ permitted notice channels , oral, written or posted notice (by-law 2(3)).
• If ordering a person to leave for non‑compliance, document the ground for the order and the relevant condition breached, and where practicable notify the person in writing or via contemporaneous notation. Immediate removal is permitted, but contemporaneous record keeping assists later action.
• Provide training for Council members and authorised delegates on the correct application of conditions, the process for revocation, and the necessity of written delegations.

For police and enforcement officers

• When acting under by‑law authority, document the basis for the belief that a by‑law has been or is being breached before requesting name and address, effecting arrest or removing items (by‑laws 13(1)-(4)). Ensure procedures comply with state arrest and seizure laws when exercising powers on the lands.
• Record any removals of property including vehicles and animals, and follow state property handling and evidence procedures to preserve chain of custody for any seized items.

For advisers and contractors

• If engaged to work on the lands, obtain written permission from the Council setting out scope and conditions before commencing work. Ensure driver’s licences, vehicle registrations and insurance are current and comply with by‑law traffic requirements (by-law 6).
• Where activity involves firearms or hazardous substances, provide proof of compliance and ensure safe storage and handling practices are in place, and notify the Council about any firearms being brought onto the lands (by-law 11).

Legal and evidentiary precautions

• Keep written evidence of permissions, delegations, conditions, notifications of arrival, and any signage encountered. These documents will be important if a by‑law breach is alleged and a police charge or court proceeding follows (by-law 3(1)-(4), 2(3), 4(4)-(6), 14(2)-(3)).
• For persons relying on medically prescribed drugs, carry prescription verification or medical notes as appropriate to demonstrate the lawful exception under by‑law 9(4).

Summary checklist

• Non‑members: seek written permission, go directly to the Council office if permission not obtained, notify arrival, obey conditions and signage.
• Council: make written delegations, keep firearm and permissions registers, issue written permissions and track revocations, maintain signage.
• Police: document bases for actions, follow state procedures when arresting or seizing.
• Everyone: avoid alcohol and illegal drugs on the lands, comply with driver’s licence and safety obligations, and keep evidence of lawful medical prescriptions and permissions.

Following these steps aligns with the specific by‑laws and will materially reduce the risk of removal, police action or prosecution under the Bidyadanga Community By‑laws 2004.
