Barrow Island Royalty Trust Account Act 1985

The Act turns on a small set of statutory constructs and cross-references. Precise comprehension of those concepts is necessary to operate the mechanics set out in later provisions.

• Barrow Island lease. The Act treats the Barrow Island petroleum lease as the source instrument creating royalty obligations. "Barrow Island lease" is defined to mean the petroleum lease dated 27 February 1967 (registered as Number 1H and named "Barrow Island") granted under the Petroleum Act 1936, as varied and affected by the variation agreement, and includes renewals, substitutions or variations (s 3). The Act therefore depends on the lease terms for what constitutes a royalty payment and what triggers refundable amounts.

• Royalty payment. This term is defined to capture amounts payable by the lessee under clause 2 or 2A of the Barrow Island lease as royalty, provisional royalty or additional royalty (s 3). The Act does not elaborate on calculation methods, valuation bases, or audit rights; those remain in the lease.

• Refundable amount. This is defined to mean an amount of royalty that is refundable to the lessee under clause 2A(5) of the Barrow Island lease (s 3). The Act provides mechanisms for paying out refundable amounts to lessees and for handling the interface between Commonwealth and State shares in such refund events (s 6(2), s 7).

• Commonwealth share and State share. For any royalty payment or refundable amount, the Commonwealth share is "so much of that payment, not exceeding 75%, as is payable by the State to the Commonwealth under the revenue sharing agreement" and the State share is whatever remains (s 3). The 75 per cent upper bound is statutorily fixed in the definitions. The revenue sharing agreement is itself defined by reference to the variation agreement attached to the Barrow Island Royalty Variation Agreement Act 1985 (s 3).

• The Account. The Barrow Island Royalty Trust Account is an "agency special purpose account" established under s 16 of the Financial Management Act 2006 (s 4). The designation as a special purpose account imports an administrative formality and a limited-purpose custody role, although the Act does not set out the FMA operational rules other than by reference.

• Notwithstanding provision. Section 5 uses a notwithstanding clause, stating that "Notwithstanding section 64 of the Constitution Act 1889, section 8 of the Financial Management Act 2006 or any other enactment" every royalty payment must be credited to the Account and that certain Commonwealth or Consolidated Account movements "may be credited to the Account" (s 5). That creates a statutory priority for the Account rule over the specific cited provisions and, as written, over any other enactment, for the narrow purpose of directing receipts.

• Timing and distribution. Section 6 imposes a concrete 21-day timeline for distributing the Commonwealth and State shares once a royalty payment is credited to the Account (s 6(1)(a)-(b)). For amounts credited per s 5(b), payment to the lessee is to occur "as soon as is practicable" (s 6(2)), which is a less rigid timing standard.

• Adjustment and reimbursement. Section 7 provides multiple mechanisms to accommodate cross-jurisdictional payment complexities arising from refundable amounts or from the State having advanced Commonwealth shares from outside the Account; these include paying a lessee the Commonwealth share from funds otherwise payable to the Commonwealth (s 7(1)), paying a lessee the State share from funds otherwise payable to Consolidated Account (s 7(2)), recovering reimbursement by deduction from amounts payable to the Commonwealth and crediting such sums to Consolidated Account (s 7(3)(a)), and mandatory repayment to the Commonwealth if a Commonwealth share is later credited to the Account (s 7(4)).

These concepts interlock: the defined labels fix allocation percentages and trigger procedural steps; the Account holds receipts for a short time; and the adjustment provisions provide the State with tools to reconcile timing differences between receipts, refunds and cross-jurisdictional obligations.

The Act targets a narrow set of parties and public accounts. The primary actors are identified in the statutory definitions and distribution provisions.

• The lessee under the Barrow Island lease. The lessee is the payor of royalty payments under clause 2 or clause 2A of the Barrow Island lease (the statutory definition "lessee" is taken from the lease, s 3). The lessee is the entity that may receive refundable amounts under clause 2A(5) of the lease, and section 6(2) contemplates payment to the lessee where amounts described in s 5(b) are credited to the Account.

• The State of Western Australia. The State receives royalty payments from the lessee. Section 5 obliges that every royalty payment received by the State be credited to the Barrow Island Royalty Trust Account. The State also has obligations to pay the Commonwealth share to the Commonwealth or to pay refundable amounts to the lessee, and the Act gives the State the ability to obtain reimbursement if it discharges the Commonwealth share from outside the Account (s 7(3)).

• The Commonwealth of Australia. The Commonwealth is a beneficiary of the royalty splitting arrangement. The Act requires that the Commonwealth share of a royalty payment credited to the Account be paid to the Commonwealth within 21 days (s 6(1)(a)). The Commonwealth may also make payments to the State to meet the Commonwealth share of a refundable amount, and such payments may be credited to the Account under s 5(b)(i).

• The Consolidated Account. The Act directs that the State share of royalty payments credited to the Account be credited to the Consolidated Account within 21 days (s 6(1)(b)). The Consolidated Account is the receiving account on the State side for the net State share.

• Account administrators and the agency responsible for the Account. The Act establishes the Account as an "agency special purpose account" under the Financial Management Act (s 4). Although the Act does not name the specific Department, the Account will be administered under the Financial Management Act apparatus and agency account management procedures, including the responsibilities for receipt, prompt distribution and reconciliation implied by s 5-7.

• Potentially other payees in the chain for refundable amounts. The Act contemplates payments being paid to the lessee as soon as practicable once credited under s 5(b). Where refundable amounts are involved, the Act provides for transfers between the Account and the Commonwealth or Consolidated Account, so the Commonwealth’s cash management and the State’s Consolidated Account are also implicated (s 6(2), s 7).

Who pays. The immediate payor of royalties is the lessee of the Barrow Island lease. The State administers receipt and short-term custody and is statutorily responsible for distributing the Commonwealth share to the Commonwealth and crediting the State share to Consolidated Account. Where refundable amounts arise, the lessee may be paid out of the Account or by other mechanisms authorised in s 7, and the Commonwealth or State will provide or be credited with matching shares in various scenarios.

Who decides. The Act does not create new decision-makers for substantive royalty determination; those rights and disputes remain anchored in the Barrow Island lease and any revenue sharing agreement. The Act determines the procedural routing and timing of monies once royalty payments are received by the State.

The Act imposes a short set of statutory duties and confers specific rights in relation to the custody and distribution of royalties and refundable amounts.

Statutory duties

• Immediate crediting duty. The State must credit every royalty payment it receives to the Barrow Island Royalty Trust Account (s 5(a)). That duty is framed as mandatory by the word "every" and by the notwithstanding clause in s 5.

• Permissive crediting for refundable-related flows. The Act permits, but does not require, that (i) amounts paid to the State by the Commonwealth to meet the Commonwealth share of a refundable amount, or (ii) amounts charged to the Consolidated Account to meet the State share of a refundable amount, be credited to the Account (s 5(b)). The permissive framing means the State can choose to use the Account for these inter-jurisdictional movements but is not compelled to do so.

• Timely distribution duty. Once a royalty payment is credited to the Account under s 5(a), the Act requires payment of the Commonwealth share to the Commonwealth within 21 days and crediting of the State share to the Consolidated Account within 21 days (s 6(1)(a)-(b)). These are expressed as time-limited obligations.

• Lessee payment duty. Where an amount is credited to the Account under s 5(b) (for example a Commonwealth payment to meet the Commonwealth share of a refundable amount), the Act requires that such an amount be paid to the lessee "as soon as is practicable" after it is credited (s 6(2)). The practical urgency standard applies to these particular credited items.

• Adjustment and reimbursement duties. Section 7 sets duties or permissible actions that the State must follow when certain payment or reimbursement circumstances arise. For example, the Act allows the Commonwealth share of a refundable amount to be paid to the lessee from funds otherwise payable to the Commonwealth (s 7(1)), and requires repayment to the Commonwealth if the Commonwealth share is later credited to the Account under s 5(b) (s 7(4)). Section 7(3) permits the State to obtain reimbursement by deducting amounts payable to the Commonwealth from the Account and crediting them to the Consolidated Account, or by crediting to the Consolidated Account amounts that were credited to the Account under s 5(b).

Statutory rights and entitlements

• Lessee rights. The lessee has the right to receive a refundable amount where trigger conditions in clause 2A(5) of the Barrow Island lease are met, and the Act ensures a mechanism for paying such amounts from the Account where the Account holds the relevant credited funds (s 3 definition; s 6(2)).

• Commonwealth entitlement. The Commonwealth is statutorily entitled to the Commonwealth share of royalty payments once they are credited to the Account, and the State is required to pay that share to the Commonwealth within 21 days (s 6(1)(a)). Where the Commonwealth has paid the State to meet the Commonwealth share of a refundable amount, that payment may be credited to the Account (s 5(b)(i)), and if the State later credits to the Account an amount in respect of that Commonwealth share, the State must repay the Commonwealth (s 7(4)).

• State entitlement. The State is entitled to the State share of a royalty payment and must credit that to the Consolidated Account within 21 days of the royalty payment being credited to the Account (s 6(1)(b)). The State also has a statutory reimbursement mechanism where it has advanced the Commonwealth share from outside the Account (s 7(3)).

Limits, caps and reference rights

• Cap on Commonwealth share. The Commonwealth share of any royalty payment or refundable amount is defined as not exceeding 75% (s 3(a)). That cap is a definitional constraint on allocation.

• External reference rights. Many substantive questions about the existence, amount and timing of royalties and refundable amounts remain in the terms of the Barrow Island lease and the revenue sharing agreement, both of which are incorporated by reference (s 3). The Act therefore creates procedural duties hinged on rights that exist elsewhere.

What the Act does not do

• It does not set out penalties for failure to pay within 21 days. The Act establishes timing obligations but contains no express sanctions in its text for late payment or non-payment.

• It does not displace substantive royalty calculation, dispute resolution or audit rights in the Barrow Island lease or the revenue sharing agreement. The Act addresses custody, allocation and timing only.

The Act contains no express criminal offences, administrative penalties, or enforcement mechanisms within its text. The statute prescribes duties and timeframes for crediting and distributing funds, but it does not create specific penalties, fines, or procedural enforcement remedies against a person or agency that fails to comply.

What the text does show

• No enumerated penalties. A search of the Act's provisions supplied in the source reveals no section creating an offence, a civil penalty provision, or a power to impose fines or other monetary penalties for non-compliance with the Account procedures and timing obligations set out in sections 5 to 7. The Act instead sets mandatory wording and timeframes for payments without corresponding penalty clauses.

• Reliance on financial-management machinery. The Account is established under section 16 of the Financial Management Act 2006 (s 4). While the Barrow Island Act itself contains no enforcement provisions, administration of the Account will be carried out as a Financial Management Act agency special purpose account. The FMA contains detailed governance, reporting and compliance regimes that typically regulate agency accounts, but the Barrow Island Act does not itself reproduce those enforcement provisions. Section 5 expressly operates "notwithstanding" s 8 of the FMA, indicating the drafters intended the crediting rule to have priority in this narrow context (s 5).

• Inter-jurisdictional recovery tools. The Act supplies non-punitive statutory mechanisms to adjust payments and to reimburse the State where the State has paid the Commonwealth share from outside the Account (s 7(3)). Those provisions are constructive recovery tools rather than penalties. For example, s 7(3)(a) permits deduction of an amount equal to the Commonwealth share from any amount standing to the credit of the Account that is payable to the Commonwealth, with the amount so deducted credited to the Consolidated Account. Section 7(4) requires repayment to the Commonwealth where a Commonwealth share has been paid to the lessee under s 7(1) and later credited to the Account under s 5(b).

Enforcement channels not specified

• The Act does not specify administrative directions, delegated sanctioning powers, or prosecutorial avenues tied to the Account rules. Any enforcement against non-compliance with the Act’s duties would therefore rely on general public law remedies, the administrative oversight contained in the Financial Management Act or, where relevant, contractual or statutory enforcement in the Barrow Island lease or the revenue sharing agreement. Those external remedies are not provided in this text.

Practical implications

• Compliance risk is therefore one of administrative and reputational cost rather than of an express statutory fine within this Act. Agencies administering the Account face operational risk if they do not meet the 21-day distribution timelines or do not apply the adjustment rules in s 7 correctly. The Act provides tools to remedy certain timing mismatches, but not an explicit sanctioning framework for mismanagement.

• Where disputes arise about whether a sum is a royalty payment or refundable amount, those substantive disputes will be resolved under the Barrow Island lease or other applicable law; the Act does not create a dispute resolution ladder for such questions.

The Act explicitly cross-references and modifies aspects of other statutes by operation of its text. The most significant interactions are with the Barrow Island lease, the revenue sharing agreement, the Financial Management Act 2006 and the Constitution Act 1889.

Cross-reference to the Barrow Island lease and variation agreement

• Source of substantive rights. The Act derives the definition of royalty payments and refundable amounts from the Barrow Island petroleum lease (s 3). It defines "Barrow Island lease" to include the lease as varied by the variation agreement and any renewals or variations (s 3). Clauses in the lease (not reproduced in this Act) determine when a royalty or a refundable amount arises. The Act therefore operates as a procedural overlay to the substantive rights and obligations set out in the lease.

• Revenue sharing agreement. The Act refers to a "revenue sharing agreement" described in clause 4(c)(i) of the variation agreement (s 3). The division between Commonwealth and State shares depends on that revenue sharing agreement. The Act’s allocation rules (including the 75% cap on the Commonwealth share) depend on the revenue sharing agreement as incorporated by the variation agreement language.

Interaction with the Financial Management Act 2006

• Establishment under the FMA. Section 4 establishes the Account as an "agency special purpose account" under section 16 of the Financial Management Act 2006. That ties the Account into the FMA framework for agency accounts. The Act also explicitly refers to s 8 of the Financial Management Act in its notwithstanding clause (s 5). The effect is to prioritise the crediting rules of the Barrow Island Act over the general FMA provisions for receipt and application of public moneys, at least in the narrow context spelled out in s 5.

• Notwithstanding provision. Section 5 explicitly states it operates "notwithstanding section 64 of the Constitution Act 1889, section 8 of the Financial Management Act 2006 or any other enactment" (s 5). That language indicates the drafters intended the receipt-crediting rule to prevail over the specified constitutional and FMA rules and any conflicting enactment. Practically, that means a royalty payment received by the State must be credited to the Barrow Island Royalty Trust Account as the primary course, even where other enactments might otherwise direct a different receipt route.

Interaction with the Constitution Act 1889

• Section 64 reference. The Act invokes s 64 of the Constitution Act 1889 in s 5’s notwithstanding clause. Section 64 concerns receipt and appropriation of public moneys in Western Australia. By stating the crediting requirement is "notwithstanding" s 64, the Barrow Island Act creates a specific statutory exception to the general constitutional arrangement for these royalties.

Interplay with the Consolidated Account

• The Act requires that the State share of a royalty payment credited to the Account be credited to the Consolidated Account within 21 days (s 6(1)(b)). It also contemplates that amounts charged to the Consolidated Account to meet State share of a refundable amount may be credited to the Account (s 5(b)(ii)), and that certain reimbursements or deductions may be credited to the Consolidated Account (s 7(3)). Therefore the Act imposes specific flows to and from the Consolidated Account that interact with general public finance flows.

Limits of interaction depicted in the text

• The Act does not reproduce or alter the substantive terms of the Barrow Island lease, nor does it set the terms of the revenue sharing agreement. It simply frames how receipts and specified transfers are to be handled once the State receives funds or once the Commonwealth makes payments to the State.

• The Act does not itself set out the FMA governance rules, penalties or reporting obligations applicable to agency special purpose accounts; it invokes the FMA for the Account’s legal form but leaves the operational governance to the FMA and related regulations.

In sum, the Act is a narrowly focused statute that overrides certain default constitutional and financial management rules for the specific subject matter of royalties under the Barrow Island lease, while depending for substantive allocation rules on external agreements and instruments encapsulated in the variation agreement.

The Act as compiled in the source has been amended several times and reprinted. The compilation table in the text records the legislative instruments and dates that altered the Act or reprinted it. The key amendment milestones are:

• Original enactment and assent. The Barrow Island Royalty Trust Account Act 1985 (No. 114 of 1985) received assent on 13 December 1985 and commenced on that date (s 2; compilation table).

• Financial Administration Legislation Amendment Act 1993 (No. 6 of 1993, s 11). That amending Act made changes to the Barrow Island Act that are recorded in the compilation table and in the marginal notes to sections 5, 6 and 7. The compilation table notes s 11 of the 1993 Act (assent 27 August 1993) with an operative commencement on 1 July 1993 (see s 2(1) of the 1993 Act as reported in the compilation table).

• Financial Legislation Amendment Act 1996 (No. 49 of 1996, s 64). This amending Act made further changes to the Barrow Island Act. The compilation table shows assent on 25 October 1996 and commencement on that date for its changes to this Act. Marginal notes to sections in the text indicate amendments effected by the 1996 Act.

• Reprint. The Barrow Island Royalty Trust Account Act 1985 was reprinted as Reprint 1 "as at 7 Nov 2003", which incorporated the amendments up to that date. The compilation table records that reprint entry.

• Financial Legislation Amendment and Repeal Act 2006 (No. 77 of 2006, ss 4 and 17). This Act inserted section 4 into the Barrow Island Act and made consequential amendments to sections 5, 6 and 7, as indicated in the marginal notes. The compilation table records that the 2006 Act received assent on 21 December 2006 and that its amendments commenced on 1 February 2007 (per the Act’s s 2 and Gazette notice). The inserted s 4 establishes the Barrow Island Royalty Trust Account as an agency special purpose account under s 16 of the Financial Management Act 2006.

Scope of amendments recorded in the text

• The marginal notes next to s 4 state "Section 4 inserted: No. 77 of 2006 s. 17." Similarly, s 5, s 6 and s 7 carry "Section ... amended" marginal notes that list the amending Acts and sections (No. 6 of 1993 s. 11; No. 49 of 1996 s. 64; No. 77 of 2006 s. 4 and 17). Those marginal notes summarise the amending provisions and confirm that the Act has been updated on multiple occasions to accommodate evolving financial administration law, in particular the Financial Management Act 2006 framework.

• The compilation table itself is included in the source and lists these amending Acts in chronological order with commencement dates and assent dates. The table also records the Reprint 1 as at 7 Nov 2003 that included the earlier listed amendments.

Practical import of the amendment history

• The 2006 amendments are the most structurally significant recorded in the text, because they establish the Account expressly as an agency special purpose account under the Financial Management Act 2006, thereby linking administration of the Account with current FMA account types (s 4).

• Previous amendments in 1993 and 1996 updated the text and its application in light of contemporaneous changes in financial administration, as reflected in the marginal notes to s 5, s 6 and s 7.

• The compilation table therefore offers the authoritative record of amendments up to the reprint and subsequent 2006 changes; it does not purport to include later changes absent from the supplied material.

The text supplied contains no reference to litigation, judicial decisions, appeals or case law interpreting the Barrow Island Royalty Trust Account Act 1985. The Act itself is a short statutory framework dealing with the routing of royalty monies and does not cite any judicial authority.

What the source discloses

• No cases named. The statute and its compilation table do not name any court proceedings, nor do they include annotations or notes referring to judicial interpretation of any of the Act's provisions.

• No embedded dispute-resolution mechanism. The Act allocates receipts and sets timeframes, but it does not include a tribunal or judicial reference provision. Disputes about the amount, calculation or entitlement to royalties or refundable amounts would arise under the Barrow Island lease or the revenue sharing agreement; those instruments are not reproduced in this text, and the Act does not set out a litigation ladder.

Implications for practitioners

• Because the Act is narrowly procedural, litigation touching on it would most likely be incidental to larger disputes about the Barrow Island lease, the revenue sharing agreement, or intergovernmental disputes about the Commonwealth share. Those substantive matters are outside the Act’s text and are not described here.

• The absence of a litigation history in the compiled material does not mean there is no case law at all relevant to royalties or to interactions between State and Commonwealth receipts in other contexts. Practitioners seeking precedential guidance on disputes and enforcement should search case law databases for decisions involving the Barrow Island lease, the revenue sharing agreement, or financial management disputes between State and Commonwealth. The Act itself supplies the statutory mechanics but does not itself manifest any recorded judicial adjudication in the provided source.

This Act’s brevity masks several operational and legal traps that practitioners and administrators should note. The following items are concrete quirks and friction points drawn directly from the Act’s text and structure.

1. Notwithstanding language creates a narrow override. Section 5 states the crediting rule applies "notwithstanding section 64 of the Constitution Act 1889, section 8 of the Financial Management Act 2006 or any other enactment" (s 5). That wording makes the Account-crediting requirement a statutory priority for royalty receipts. Administrators who assume generic receipt rules or default appropriation flows apply may mis-handle receipts if they do not apply s 5 immediately.

2. Mandatory crediting combined with permissive crediting. Section 5(a) requires every royalty payment received by the State be credited to the Account. By contrast, s 5(b) allows certain Commonwealth payments or Consolidated Account charges "to be credited to the Account." The permissive language in s 5(b) means those movements are optional. A practical "gotcha" is treating s 5(b) items as mandatory; doing so may change timing and reconciliation logic. For example, the Commonwealth may have paid the State to meet the Commonwealth share of a refundable amount , the State may but is not required to credit that Commonwealth payment to the Account.

3. 21-day deadline without express sanction. Section 6(1) requires distribution to the Commonwealth and crediting to the Consolidated Account "within 21 days" after the payment is credited to the Account. The Act contains no express sanction for missing the 21-day timeframe. Administrators should nonetheless treat the 21-day requirement as a binding statutory timing obligation; the absence of an internal penalty does not remove the obligation and may increase public or intergovernmental friction if missed.

4. Refundable amounts cross-cut Commonwealth and State rights. Refundable amounts are defined by reference to clause 2A(5) of the Barrow Island lease (s 3). The Act permits complex interplays: for example, s 7(1) allows the Commonwealth share of a refundable amount to be paid to the lessee from funds that otherwise would be payable to the Commonwealth. If such a payment is made, s 7(4) requires repayment to the Commonwealth where an amount is later credited under s 5(b). The practical issue is a potential sequence of payments and repayments between lessee, State and Commonwealth that requires careful reconciliation and documentation to avoid double payments or misapplied credits.

5. Reimbursement mechanics channel money to Consolidated Account. Where the State has paid the Commonwealth share from outside the Account, s 7(3) allows reimbursement by deduction of amounts otherwise payable to the Commonwealth from the Account and crediting those amounts to the Consolidated Account (s 7(3)(a)). Administrators must be able to identify and isolate amounts "standing to the credit of the Account under section 5(a) that is payable to the Commonwealth under section 6(1)(a)" to perform lawful deductions. In practice this requires clear ledger lines for funds that are intended for Commonwealth distribution.

6. Commonwealth share cap at 75 per cent. The definition in s 3 caps the Commonwealth share at 75% of a royalty payment or refundable amount. Do not assume the Commonwealth share is a fixed percentage; the ceiling is 75% and the actual allocation depends on the revenue sharing agreement. Misapplying the cap or assuming a different split creates allocation errors.

7. Reliance on external instruments for substance. The Act depends on the terms of the Barrow Island lease and the variation and revenue sharing agreements for substantive triggers, amounts and entitlements (s 3). Practitioners who interpret the Act without reading those instruments risk mischaracterising whether an amount is a royalty payment, an additional royalty, a provisional royalty, or a refundable amount.

8. Account administration under FMA not fully detailed in this Act. Section 4 establishes the Account under the Financial Management Act 2006 (s 4). The Barrow Island Act does not reproduce the FMA’s administrative requirements, reporting lines, or audit framework. Practitioners must coordinate with FMA rules and agency procedures to ensure compliance with both statutes.

9. Timing asymmetry for s 5(b) monies. Amounts credited under s 5(b) must be paid to the lessee "as soon as is practicable" (s 6(2)), which is a less precise standard than the 21-day rule for s 5(a) royalties. That opens a potential timing ambiguity and operational discretion that needs clear internal policy to meet both legal and fairness expectations.

10. No internal guidance on interest, set-off or exchange adjustments. The Act is silent on interest for late payments, set-off rights between Commonwealth and State, or currency and exchange issues. Where these practicalities arise, administrators will need to rely on related agreements or general financial management practice.

This section translates the Act’s mechanics into a practical compliance checklist for an agency charged with administering the Account and for advisers supporting lessees, the State or the Commonwealth. All references are to the Act’s provisions.

1. Establish account governance and ledger segregation (s 4). Because s 4 establishes the Barrow Island Royalty Trust Account as an "agency special purpose account" under s 16 of the Financial Management Act 2006, confirm the Account’s administrative ownership and the FMA processes that apply. Set up a distinct ledger and bank-account coding so that every royalty payment can be identified and tracked separately from other receipts.

2. Treat every royalty payment as automatically creditable to the Account (s 5(a)). When the State receives a royalty payment from the lessee under clause 2 or 2A of the Barrow Island lease, the payment must be credited to the Barrow Island Royalty Trust Account. Do not apply alternative receipt routing for royalty payments.

3. Record Commonwealth and State shares on receipt (s 3; s 6(1)). On crediting a royalty payment to the Account, calculate the Commonwealth share (not exceeding 75% as defined in s 3) and the State share. Ensure that the calculation uses the revenue sharing agreement incorporated by the variation agreement (s 3).

4. Pay out within 21 days (s 6(1)). Once credited under s 5(a), the Commonwealth share must be paid to the Commonwealth within 21 days and the State share must be credited to the Consolidated Account within 21 days. Implement an operational calendar and workflow that ensures these actions occur within the statutory window.

5. Handle s 5(b) credits as optional but urgent (s 5(b); s 6(2)). If the Commonwealth pays the State to meet the Commonwealth share of a refundable amount, or if the Consolidated Account is charged to meet the State share of a refundable amount, those amounts may be credited to the Account. Where such amounts are credited under s 5(b), pay the lessee "as soon as is practicable" after crediting (s 6(2)). Adopt a policy defining "as soon as is practicable" (for example a defined number of business days) to ensure consistency and defensible administrative action.

6. Use the adjustment and reimbursement tools where timing mismatch occurs (s 7). If a refundable amount arises and the Commonwealth share is to be paid to the lessee, s 7(1) allows payment of the Commonwealth share to the lessee from amounts in the Account otherwise payable to the Commonwealth under s 6(1)(a). If the State has advanced the Commonwealth share from outside the Account, s 7(3) allows reimbursement by deduction from amounts otherwise payable to the Commonwealth, with the deducted amount credited to the Consolidated Account. Put in place reconciliation protocols to identify which amounts are "standing to the credit of the Account under section 5(a) that is payable to the Commonwealth under section 6(1)(a)" to lawfully perform deductions.

7. Track and, if necessary, return Commonwealth receipts (s 7(4)). If the Commonwealth share of a refundable amount has been paid to the lessee under s 7(1) or the State has obtained reimbursement under s 7(3)(a), and an amount is later credited to the Account under s 5(b) in respect of that Commonwealth share, the Act requires that the amount be repaid to the Commonwealth (s 7(4)). Maintain audit trails and prompt repayment procedures to satisfy this obligation.

8. Maintain documentary links to the Barrow Island lease and the revenue sharing agreement (s 3). Because the Act defers to those instruments for substantive triggers and allocation rules, ensure that any royalty calculation, classification as a refundable amount, and reference to the revenue sharing agreement are documented and stored alongside Account transaction records.

9. Create an internal control matrix for timing differences. Given the Act’s tight 21-day rule and the possible cascades of payments and repayments described in s 7, adopt internal controls that segregate duties: receipt processing, calculation of shares, payment execution to Commonwealth, and reconciling and crediting the Consolidated Account. Ensure that any decision to credit s 5(b) amounts is documented and authorised at the appropriate level.

10. Reconcile monthly and produce an audit-ready trail. Prepare monthly reconciliations showing: (a) each royalty payment credited to the Account; (b) the Commonwealth and State shares calculated and paid/credited; (c) any s 5(b) credits and lessee payments made under s 6(2); and (d) any deductions or reimbursements carried out under s 7. Keep copies of the underlying lease clauses and any Commonwealth payment instructions to support the accounting entries.

11. Document policy on "as soon as is practicable." For amounts under s 6(2), set an internal policy to specify the time within which payments to the lessee will be made after receipt, consistent with practical constraints. This reduces discretionary risk and helps manage expectations.

12. Engage with Treasury or equivalent for Consolidated Account credits. The Act requires crediting the State share to the Consolidated Account within 21 days (s 6(1)(b)). Coordinate with the Treasury or central finance authority to ensure correct coding and timely transfer to the Consolidated Account.

13. Prepare for intergovernmental notification and repayment. Where Commonwealth funds are involved (e.g. where the Commonwealth has paid the State to meet the Commonwealth share of a refundable amount), establish procedures to notify the Commonwealth and to effect repayments required by s 7(4).

14. Maintain a register of refundable events. Keep a register of events that potentially create refundable amounts under clause 2A(5) of the Barrow Island lease so that when refunds are triggered, administrators can promptly apply s 6(2) and s 7 mechanics.

15. Seek legal certainty where the classification of a payment is unclear. Because the Act hinges on whether an amount is a royalty payment or a refundable amount per the Barrow Island lease, obtain a legal view if classification is contested before moving funds.

Following these steps will align an agency’s operational practices with the statutory requirements set out in the Barrow Island Royalty Trust Account Act 1985 and provide an auditable trail for dealings with Commonwealth and lessee funds.
