### Mortgage may be redeemed by trustee. Vic., s. 157. Q., ss. 137–139. S.A., s. 140. 106.—(1.) If a bankrupt has conveyed, transferred or assigned any property or deposited any deeds, the conveyance, transfer, assignment, assurance or deposit being upon condition or power of redemption at a future day by payment of money or otherwise, the trustee may, before the time of the performance of the condition, make tender or payment of money or other performance according to the condition, and, after the tender, payment or performance, the property may be sold and disposed of for the benefit of the creditors. (2.) Any mortgagee, with the leave of the Court, may bid at any such sale of the mortgaged property.
