What it does
This instrument is a legislative determination that modifies the application of specified provisions of the Banking Act 1959 to a defined class of religious and charitable funds and their controlling entities. It does three mechanical things that can be read directly from the text.
-
It defines the exempted class. The Schedule names specific funds. The determination provides that section 7 of the Banking Act 1959 does not apply to a person who is a controlling entity of a fund in the Schedule, in relation to the activities of that fund; and that section 8 of the Banking Act 1959 does not apply to a fund that is a body corporate, or a body corporate that is a controlling entity of a fund, in the Schedule, in relation to the activities of that fund (Schedule - the class of persons to whom this determination applies). The instrument therefore removes the application of those two Banking Act provisions to the listed entities and funds, but only in relation to the activities of the fund as specified.
-
It imposes conditions on that exemption. The Schedule of conditions sets out substantive compliance conditions the fund must meet to maintain the treatment. These include legal recognition as formed for religious and charitable purposes, limitation of activities to those stated purposes, operation on a not-for-profit basis, retail products having the sole or dominant intention of furthering the fund’s religious and charitable purposes, availability of the fund constitution for APRA inspection, and minimum term / restriction on early redemption of retail products for 31 days (Schedule of conditions, conditions 1-4). The instrument therefore substitutes regulatory conditions for the application of the Banking Act provisions.
-
It defines terms used in the conditions and Schedule. The instrument defines APRA, clarifies that person includes a body corporate pursuant to section 2C of the Acts Interpretation Act 1901, defines controlling entity for the Schedule, and supplies definitions for affiliate, retail investor (tied to Corporations Act s 761G but excluding affiliates), and retail product (Definitions in Schedule). It also records statutory notes about its character as a legislative instrument and the criminal penalties that apply if a person contravenes a condition to which the determination is subject (Notes under Interpretation).
